<section id="HDECA2D732A9C4AFAA12B4EEC7E5FBB16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Water Instruction for Minors Act of 2025</short-title></quote> or the <quote><short-title>SWIM Act of 2025</short-title></quote>.</text></section> <section id="HB9383B9CEB9A4F28B53659DD63250979"><enum>2.</enum><header>Certain amounts paid for water competency and life saving water safety lessons</header> <subsection id="HA256424FCBFE4CE29DBF0CE600F4FA9E"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/213">Section 213(d)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of subparagraph (C), by striking the period at the end of subparagraph (D) and inserting <quote>, or</quote>, and by inserting after subparagraph (D) the following new subparagraph:</text>

<subparagraph id="H74F14E8EAA9744E69FED8D4B19B3E1F0"><enum>(E)</enum><text>for qualified water competency and water safety lesson expenses.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H24399EE5892346679D187A62E0249676"><enum>(b)</enum><header>Qualified water competency and water safety lesson expenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/213">Section 213(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="HBD015335DFDB4966B8D335E46015C066"><enum>(12)</enum><header>Qualified water competency and water safety lesson expenses</header>
<subparagraph id="H9394942C78AB45F3B3A4F23CAAE56D22"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified water competency and water safety lesson expenses</quote> means amounts paid to participate in basic water safety and basic swimming instruction or for equipment necessary for such participation.</text></subparagraph> <subparagraph id="HB34F4E00FF444406A3BE43A73490FC1C"><enum>(B)</enum><header>Overall dollar limitation</header><text>The aggregate amount treated as water competency and water safety expenses with respect to any taxpayer for any taxable year shall not exceed $500 ($1,000 in the case of a joint return or a head of household (as defined in section 2(b)).</text></subparagraph>
<subparagraph id="HF8DE60C151464285AE08A07A7CA674C9"><enum>(C)</enum><header>Limitations related to water competency and water safety lessons</header><text>Amounts paid for lessons described in subparagraph (A) shall be treated as qualified expenses only—</text> <clause id="H0DC08CA6660441AB8B8A67983C35835E"><enum>(i)</enum><text>if such lessons are focused on water safety and competency lessons and are not intended for competitive swimming or training lessons, and</text></clause>
<clause id="HD5C80AEE7DC44DD7894CA3A4142CB32E"><enum>(ii)</enum><text>in the case of amounts paid for any single item equipment, such amounts do not exceed $100.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4F3EF16B83D64794B48110F08B64EA93"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section>
