<section id="HC04BC537A00449F5BC9D88B980F62E7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Local Elections Act</short-title></quote> or the <quote><short-title>POLE Act</short-title></quote>.</text></section> <section id="HB8713671D91B48038C9743792D1BC7EC"><enum>2.</enum><header>Findings; sense of Congress</header> <subsection id="HB6EEB2DE3AD64291A6A8B9C43F15FB80"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H7DCA5F53180D4F8298757008770F6494"><enum>(1)</enum><text display-inline="yes-display-inline">Holding local elections for public office in odd-numbered years provides greater focus on local candidates and issues.</text></paragraph> <paragraph id="H6E07BCCF63B2433FBD403C4DAB7CBDB8"><enum>(2)</enum><text>Local elections held in odd-numbered years allow voters to make more informed decisions about their local representation.</text></paragraph> 
<paragraph id="HBBCF39B1F2BA4652A432AAE1A354C712"><enum>(3)</enum><text>Holding all elections in even-numbered years diminishes the attention given to community matters.</text></paragraph> <paragraph id="HD2F8E3EC0B45463682EB43BB3E5504B4"><enum>(4)</enum><text>Holding all elections in even-numbered years overcrowds the ballot, hindering the decision-making process for voters.</text></paragraph> 
<paragraph id="H9AB3BAEB758446F094BC32A9952E67A5"><enum>(5)</enum><text>Local elected officials directly serve their immediate communities and needs.</text></paragraph> <paragraph id="HB7CF9F1A735D43C594F4E5CC6C914204"><enum>(6)</enum><text>Local leaders played a vital role in the founding of the United States.</text></paragraph> 
<paragraph id="HAD3AEC4F2A1A4AD593C8F14D4BB0F640"><enum>(7)</enum><text>Local governments are at the core of our Nation’s republic.</text></paragraph></subsection> <subsection id="HD7D2C3126C5C4425B74190AE9AACA3C7"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="HED784FAD7CC443A1A5EC4AD083AF32AD"><enum>(1)</enum><text display-inline="yes-display-inline">units of local governments should have the authority to conduct elections for local office in odd-numbered years;</text></paragraph> <paragraph id="H1F2AEED55432473BB1CC132BD25B80DB"><enum>(2)</enum><text>local elections held in odd-numbered years ensure that local candidates and issues receive greater attention and allow voters to make well-informed choices; and</text></paragraph> 
<paragraph id="H4D2B4BEA8D724E72BB21E6CE2A217878"><enum>(3)</enum><text>the most effective form of representation is attained through local governance.</text></paragraph></subsection></section> <section id="H808EFF6552614940909F0C5AE8E2E3D3"><enum>3.</enum><header>Prohibiting provision of Federal funds for election administration for States not permitting local governments to hold elections for local office in odd-numbered years</header> <subsection id="HB319D357A3214DB2B0303C4ED4283EF7"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Title IX of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21141">52 U.S.C. 21141 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H954DE6343FF14B7A954E56FE44FDA0A1"><enum>907.</enum><header>Prohibiting provision of Federal funds for election administration for States not permitting local governments to hold elections for local office in odd-numbered years</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, no Federal funds may be provided under this Act or any other Act to administer an election for Federal, State, or local office held in a State which does not have in effect a law which permits units of local government in the State to hold elections for local office in odd-numbered years.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H47D7436094244356BACE385244BE0F35"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by adding at the end of the items relating to title IX the following:</text>

<subsection id="H8573F97F97F5457BB408722BFA80C771"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to fiscal year 2027 and each succeeding fiscal year.</text></subsection></section> </legis-body></bill>
