<section id="HDBEF702ACF5E46E1A8A5F7B47D74613F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drain the Swamp Act of 2025</short-title></quote>.</text></section> <section id="HDDE767294D9D4F46B244FF9C3B2A761D"><enum>2.</enum><header>Relocation of agency headquarters</header> <subsection id="HEDC8C9628313488F9554BFC209E7A2F1"><enum>(a)</enum><header>Repeal of headquarters location requirement</header><text display-inline="yes-display-inline">Section 72 of title 4, United States Code, is repealed.</text></subsection>
<subsection id="HE5114F9A596E428B9CA889A756DDEFE5"><enum>(b)</enum><header>Headquarters relocation plan</header>
<paragraph id="H3ECC6266E78A40E49A3390C2C1020CD2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than September 30, 2026, the head of each executive agency shall develop and submit to Congress a plan for the relocation of the headquarters of that agency outside of the Washington metropolitan area.</text></paragraph> <paragraph id="HDFC7D29387A740A1B52F332C8582F320"><enum>(2)</enum><header>Requirements</header><text>The plan described in paragraph (1) shall—</text>
<subparagraph id="HE3281E0330AA46F997A20F073A2F1537"><enum>(A)</enum><text>identify a location for a new headquarters outside of the Washington metropolitan area;</text></subparagraph> <subparagraph id="H1F2705C83BE64DABBF1ADB51D8984FAB"><enum>(B)</enum><text>maximize any potential cost savings associated with the relocation; </text></subparagraph>
<subparagraph id="H6980BE35AE7B4CACBEA3ED5792DB9189"><enum>(C)</enum><text>provide that, upon implementation of the plan, no more than 10 percent of the employees of the agency are based in the Washington metropolitan area; and</text></subparagraph> <subparagraph id="H5CD1700B3ED8414C85EFDA3622A67B2B"><enum>(D)</enum><text>consider any potential national security implications of the relocation. </text></subparagraph></paragraph>
<paragraph id="H2E81360A98514C79B65514A74B34A93F"><enum>(3)</enum><header>Certification</header><text display-inline="yes-display-inline">Prior to the submission of a plan under paragraph (1), the Director of the Office of Management and Budget and the Administrator of General Services shall certify the compliance of the plan with the provisions of this section if the plan meets the requirements described in paragraph (2).</text></paragraph> <paragraph id="H5BE1BF3DD2F4417BBA24C479084D4FE1"><enum>(4)</enum><header>Implementation</header><text>Not later than September 30, 2030, the head of each executive agency shall implement the plan for such agency submitted under paragraph (1).</text></paragraph></subsection>
<subsection id="H098452C33A3544E7B5BC266F9BD2DAE9"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text> <paragraph id="HA8D9053D68E049FE81C04997BDDAF388"><enum>(1)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code, except that the term does not include the Executive Office of the President.</text></paragraph>
<paragraph id="H9FA2E74A5E3942B5B78FC535EA702775"><enum>(2)</enum><header>Washington metropolitan area</header><text display-inline="yes-display-inline">The term <term>Washington metropolitan area</term> means the geographic area located within the boundaries of—</text> <subparagraph id="H83A525A19A4741969D21D13D586C9BFE"><enum>(A)</enum><text>the District of Columbia;</text></subparagraph>
<subparagraph id="H5ED03272638742F699F19ACE282B9D10"><enum>(B)</enum><text>Montgomery and Prince George’s Counties in the State of Maryland; and</text></subparagraph> <subparagraph id="HAE965801C987462EB5AFA150FC61670B"><enum>(C)</enum><text>Arlington, Fairfax, Loudon, and Prince William Counties and the City of Alexandria in the Commonwealth of Virginia.</text></subparagraph></paragraph></subsection></section>
