which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 relating to work requirements; to amend title XIX of the Social Security Act to establish work requirements under the Medicaid program.</official-title></form><legis-body id="H752CE384480D4353B50AD1DCB236515A" style="OLC"><section id="HEE01A0F64BC04C7EA60B15721F37CD2F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending the Cycle of Dependency Act of 2025</short-title></quote>.</text></section><section id="H52484A28BB724935B2AC1A2F86ABC749" section-type="subsequent-section"><enum>2.</enum><header>Amendments to the Food and Nutrition Act of 2008 relating to work requirements</header><subsection id="HA9D74C89C61243FFBF394D90DF454BD6"><enum>(a)</enum><header>Work requirements</header><text display-inline="yes-display-inline">Section 6(o) of the Food and Nutrition Act of 2008 (7 U.S.C. 2015(6)(o)) is amended—</text><paragraph id="H935F830F799E4EB29ADC27FBB81B3B82"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><subparagraph id="H65718213316B45F7BF982220870B7EAC"><enum>(A) </enum><text>in subparagraph (A) by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" id="H651653C624F54DA79A77BB06DE8B68C8" display-inline="no-display-inline"><clause id="HE7B009FB625A4D7A92AB9069A3862E12" indent="up1"><enum>(ii) </enum><text display-inline="yes-display-inline">over 60 years of age;</text></clause><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5C91666568B348F09D4F4A60386FFFD6"><enum>(B)</enum><text>in subparagraph (C) by inserting <quote>under 6 years of age;</quote> a after <quote>child</quote>, </text></subparagraph><subparagraph id="H32C2C4BA8A63487997D0BA409F93DDBC"><enum>(C) </enum><text>in subparagraph (E) by striking the semicolon at the end and inserting <quote>; or</quote>,</text></subparagraph><subparagraph id="H948EFC3214ED4EEC838C6E38DD74316A"><enum>(D)</enum><text>by striking subparagraphs (F) and (H).; and</text></subparagraph><subparagraph id="HF22FBDDD7F1246108F31628FEAE4CBD5"><enum>(E)</enum><text> by redesignating subparagraph (G) as subparagraph (F), and</text></subparagraph></paragraph><paragraph id="H99BBEB0947B740769038E7E640856A5E"><enum>(2)</enum><text>by striking subparagraph (4).</text></paragraph></subsection><subsection id="H84DD4CDB592349ACBB27B0300987B60D"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 311 of title II of division C of the Fiscal Responsibility Act of 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/118/5">Public Law 118–5</external-xref>; 137 STAT. 36) is amended by striking subsection (b).</text></subsection></section><section id="H574267E43722405395ECB2AAC5B5B26C"><enum>3.</enum><header>Establishing work requirements under the Medicaid program</header><subsection id="H995BD1105F1141789535DFFA90D24966"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text><paragraph id="HBA8660BE2B454E77BAD234D92D8BEDE4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (26), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="H328D6AE9459840209F054386A1437177"><enum>(2)</enum><text>in paragraph (27), by striking the period at the end and inserting <quote>; or</quote>;</text></paragraph><paragraph id="H87E7CA82CBAC472C9A3A68B3228D4139"><enum>(3)</enum><text>by inserting after paragraph (27) the following new paragraph:</text><quoted-block style="OLC" id="H8BBC30AFD1C54D1E980BA13D1F8184BE" display-inline="no-display-inline"><paragraph id="HF32E8AD65FB246D2BC3415C78C483108"><enum>(28)</enum><text display-inline="yes-display-inline">with respect to any amount expended for medical assistance for an applicable individual for a month in a calendar year if such individual did not meet the work requirement under section 1905(kk) for 3 or more preceding months during such calendar year while such individual was an applicable individual and was enrolled in a State plan (or waiver of such plan) under this title.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HAB3BD1E9347547CA871BA7F55C945B45"><enum>(4)</enum><text>in the flush left matter at the end, by striking <quote>and (18)</quote> and inserting <quote>(18), and (28)</quote>.</text></paragraph></subsection><subsection id="HC173572D42A54F66AA4B659FD10CB37E"><enum>(b)</enum><header>Work requirement</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HAE8000725F3A40B5B735ECC9347D75F9" display-inline="no-display-inline"><subsection id="H9C68C5DF56A04231B9D57AFBED0489FB"><enum>(kk)</enum><header>Work requirement for applicable individuals</header><paragraph id="HBE70D73BFABC44F3AC2CB688DAB671DC"><enum>(1)</enum><header>Work requirement described</header><text>For purposes of section 1903(i)(28), the work requirement described in this subsection with respect to an applicable individual and a month is that such individual satisfies at least one of the following with respect to such month:</text><subparagraph id="H93D5519E0DC2480299D608DE07E3C05B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The individual works 80 hours or more per month, or has a monthly income that is at least equal to the Federal minimum wage under section 6 of the Fair Labor Standards Act of 1938, multiplied by 80 hours.</text></subparagraph><subparagraph id="HDFCE4683643D432CB90CDA06823C455A" commented="no"><enum>(B)</enum><text>The individual completes 80 hours or more of community service per month.</text></subparagraph><subparagraph id="H4F8E33A9B1614243904B428AF03129AD"><enum>(C)</enum><text>The individual participates in a work program for at least 80 hours per month.</text></subparagraph><subparagraph id="HFCD21A278844460E921093A1C0BCB3C6"><enum>(D)</enum><text>The individual participates in a combination of work, including community service, and a work program for a total of at least 80 hours per month.</text></subparagraph></paragraph><paragraph id="H5969B741200A40C681994853EB2B7FF1"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H6E2998D9559F493B929A83C1D80AD944"><enum>(A)</enum><header>Applicable individual</header><text display-inline="yes-display-inline">The term <quote>applicable individual</quote> means any individual who is not—</text><clause id="H620E683266D24762BD3CC8D02DE99C5E"><enum>(i)</enum><text display-inline="yes-display-inline">under 19 years of age or age 60 or older;</text></clause><clause id="H54268E1F29574F1282E35B0AEC3044E6" commented="no"><enum>(ii)</enum><text>physically or mentally unfit for employment, as determined and verified by a physician or other medical professional;</text></clause><clause id="H77ED42870F25439695BE2886BF2E5480" commented="no"><enum>(iii)</enum><text>pregnant;</text></clause><clause id="HE500BF8021514A29AC47479C13E42F8C" commented="no"><enum>(iv)</enum><text>the parent or caretaker of a dependent child under the age of 6;</text></clause><clause id="HEF6868D033564A2C987CE0B59006182E" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">the parent or caretaker of an incapacitated person;</text></clause><clause id="H62DCCD6B8F0B44CF8E4AF5FC18A79D86" commented="no"><enum>(vi)</enum><text>complying with work requirements under a different program under Federal law;</text></clause><clause id="H3F047FFEB7E54C3F8D3F2C925CDF106A" commented="no"><enum>(vii)</enum><text>participating in a drug or alcohol treatment and rehabilitation program (as defined in section 3(h) of the Food and Nutrition Act of 2008); or</text></clause><clause id="H05AF379184B04CF8BD7B7775353488A7" commented="no"><enum>(viii)</enum><text>enrolled in an educational program at least half time.</text></clause></subparagraph><subparagraph id="H2537B4E93C6343618DFD6D17820271A8"><enum>(B)</enum><header>Educational program</header><text>The term <quote>educational program</quote> means—</text><clause id="H83D1473F5ED94D3BBBF478DEE3796822"><enum>(i)</enum><text>an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965);</text></clause><clause id="H2527FBFCAAEA482887A9505930B2CC8B"><enum>(ii)</enum><text display-inline="yes-display-inline">a program of career and technical education (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006); or</text></clause><clause id="H3165A70D71164EF1A344DED21DA0D697"><enum>(iii)</enum><text>any other educational program approved by the Secretary.</text></clause></subparagraph><subparagraph id="HC7AC88C622BF44C9B883ACCB651CFB39"><enum>(C)</enum><header>State Medicaid agency</header><text display-inline="yes-display-inline">The term <quote>State Medicaid agency</quote> means the State agency responsible for administering the State Medicaid plan.</text></subparagraph><subparagraph id="H4DB2B954B6334153AEF56783BE622C82"><enum>(D)</enum><header>Work program</header><text display-inline="yes-display-inline">The term <quote>work program</quote> has the meaning given such term in section 6(o)(1) of the Food and Nutrition Act of 2008.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDAAC96EEE341490A9B407DC0E75679C1"><enum>(c)</enum><header>State option To disenroll certain individuals</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended by adding at the end of the flush left text following paragraph (87) the following: <quote>Notwithstanding any of the preceding provisions of this subsection, at the option of a State, such State may elect to disenroll an applicable individual for a month if, with respect to medical assistance furnished to such individual for such month, no Federal financial participation would be available, pursuant to section 1903(i)(28).</quote>.</text></subsection></section></legis-body></bill>
