<section section-type="section-one" id="H0EF53964F6E54664BB1ADC921BBFA1D5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting America’s Agricultural Land from Foreign Harm Act of 2025</short-title></quote>.</text></section> <section id="H98421E1C6125425F9FD9F34D82D4EA8F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" id="H7F076D3B83EF43699A31DE0261938EDC"><enum>(1)</enum><header>Agricultural land</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7DE2B2CC9D8B4ABF8DFEFB4963B4A5B4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>agricultural land</term> has the meaning given the term in section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFACC097994144F9EA6E54F016C5B5CEE"><enum>(B)</enum><header>Inclusion</header><text>The term <term>agricultural land</term> includes land described in section 9(1) of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508(1)</external-xref>) that is used for ranching purposes.</text></subparagraph></paragraph> 
<paragraph id="H247C8F6DFBB944259E32DAFA4DB9E71B"><enum>(2)</enum><header>Covered person</header> 
<subparagraph id="H41A8DF2C40AE4A8F9E932720486E08CA"><enum>(A)</enum><header>In general</header><text>The term <term>covered person</term> has the meaning given the term <quote>person owned by, controlled by, or subject to the jurisdiction or direction of a foreign adversary</quote> in section 7.2 of title 15, Code of Federal Regulations (as in effect on the date of enactment of this Act), except that each reference to <quote>foreign adversary</quote> in that definition shall be deemed to be a reference to the Government of—</text> <clause id="H85D47B35746B436C9C2CC2F71779AC4A"><enum>(i)</enum><text>Iran; </text></clause> 
<clause id="HC23BE4CF93354E33A1A9B0313403F51B"><enum>(ii)</enum><text>North Korea; </text></clause> <clause id="H0E8A0D5D1506406E86674D1AF2FCA28E"><enum>(iii)</enum><text>the People's Republic of China; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HF4C1AB2ACB3642E790DB60539CC4BBBE"><enum>(iv)</enum><text>the Russian Federation. </text></clause></subparagraph> <subparagraph id="HAA4B93099FA64C81A5F1E4D9CA4345E7"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered person</term> does not include a United States citizen or an alien lawfully admitted for permanent residence to the United States.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9ACE7F7A1AA54922857A1BE4B074FD95"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture. </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H208B3D8492B34906BAEC89CF8DEC2615"><enum>(4)</enum><header>United States</header><text>The term <term>United States</term> includes any State, territory, or possession of the United States. </text></paragraph></section> 
<section section-type="subsequent-section" id="H2249AC23941B4BAABAA6A1D790BD249A"><enum>3.</enum><header>Prohibition on purchase or lease of agricultural land in the United States by persons associated with certain foreign governments</header> 
<subsection id="H5985E3B5A41C4A6B969D556E40664E08"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President shall take such actions as may be necessary to prohibit the purchase or lease by covered persons of—</text> <paragraph id="H106897474F4E4C8EBBDAAA2142B79A71"><enum>(1)</enum><text>public agricultural land that is owned by the United States and administered by the head of any Federal department or agency, including the Secretary, the Secretary of the Interior, and the Secretary of Defense; or</text></paragraph> 
<paragraph id="HFF1D4EF185354F999C5E8566BC6CCAE7"><enum>(2)</enum><text>private agricultural land located in the United States.</text></paragraph></subsection> <subsection id="H43BDC13C9ABC439BA6FB81C8DE179F05"><enum>(b)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out subsection (a).</text></subsection> 
<subsection id="H795DA92B04BD442C982EFA58BE9C0C99"><enum>(c)</enum><header>Penalties</header><text>A person that knowingly violates, attempts to violate, conspires to violate, or causes a violation of subsection (a) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></subsection> <subsection id="HCEAB84DFA0124A83B6E06E784FBA6F3F"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed—</text> 
<paragraph id="HFC17D513BA7D4526AA530D08B5570BD0"><enum>(1)</enum><text>to prohibit or otherwise affect the purchase or lease of public or private agricultural land described in subsection (a) by any person other than a covered person;</text></paragraph> <paragraph id="HF750AEC5820642819B136B1D444D05D7"><enum>(2)</enum><text>to prohibit or otherwise affect the use of public or private agricultural land described in subsection (a) that is transferred to or acquired by a person other than a covered person from a covered person; or </text></paragraph> 
<paragraph id="HA2F91E4AAB9C4AC78E9FDF0F83378C28"><enum>(3)</enum><text>to require a covered person that owns or leases public or private agricultural land described in subsection (a) as of the date of enactment of this Act to sell that land. </text></paragraph></subsection></section> <section id="H58916556C3394CE685158EBA2D545C04"><enum>4.</enum><header>Prohibition on participation in Department of Agriculture programs by persons associated with certain foreign governments</header> <subsection id="H91A06D837B70495288F1B196D16A266F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), notwithstanding any other provision of the law, the President shall take such actions as may be necessary to prohibit participation in Department of Agriculture programs by covered persons that have full or partial ownership of agricultural land in the United States or lease agricultural land in the United States. </text></subsection> 
<subsection id="H2A1A0B4EB69043939C7F9389B2D5DCCC"><enum>(b)</enum><header>Exclusions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to participation in any program—</text> <paragraph id="H131DFBFA3DAA4A84B12AAEF1D808B62E"><enum>(1)</enum><text display-inline="yes-display-inline">relating to—</text> 
<subparagraph id="H62025374B1224EDA92C9058E264A6BC1"><enum>(A)</enum><text display-inline="yes-display-inline">food inspection or any other food safety regulatory requirements; or</text></subparagraph> <subparagraph id="HB5AA396FDAD54EDB95CD266B2E8C3E2F"><enum>(B)</enum><text>health and labor safety of individuals; or</text></subparagraph></paragraph> 
<paragraph id="H79CFEA2F5D304F41B12B5D0CD1F05DEF"><enum>(2)</enum><text>administered by the Farm Service Agency, with respect to the administration of this Act or the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>).</text></paragraph></subsection> <subsection id="HA3F3E19459604D1BBDA192AAD59F9666"><enum>(c)</enum><header>Proof of citizenship</header><text>To participate in a Department of Agriculture program described in subsection (b) (except for a program under this Act or the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>)), a person described in subparagraph (A) of section 2(2) that is a person described in subparagraph (B) of that section shall submit to the Secretary proof that the person is described in subparagraph (B) of that section.</text></subsection></section> 
<section id="H13062EB6A9C248C5BC5A1E6D4FEFA2BB"><enum>5.</enum><header>Agricultural foreign investment disclosure</header> 
<subsection id="HD5012616B3384594AE3BD52A6B496061"><enum>(a)</enum><header>Inclusion of security interests and leases in reporting requirements</header> 
<paragraph id="H8DF9C59503B3441C96FB5AAFA34ABC4B"><enum>(1)</enum><header>In general</header><text>Section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508</external-xref>) is amended—</text> <subparagraph id="HFC1DE91580854FB48BDAD2A72EFCC49F"><enum>(A)</enum><text>by redesignating paragraphs (4) through (6) as paragraphs (5) through (7), respectively; and</text></subparagraph> 
<subparagraph id="H751572E8DFF74EC598FA43FDFF6298BE"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H4B1386CEFB5C4FEDA9CFDF9326E4165D"> <paragraph id="HD7A1BF8A1C674ACCA3089B6E4ECA4098"><enum>(4)</enum><text>the term <term>interest</term> includes—</text> 
<subparagraph id="H93C4FEACD83D40BFB3B5DA7D771AFADA"><enum>(A)</enum><text>a security interest; and</text></subparagraph> <subparagraph id="H74E97700B5BD49A1B15B043DFFCA14DC"><enum>(B)</enum><text>a lease, without regard to the duration of the lease;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H07C47C419C7D433A9C620EF2104C9D86"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 2 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>) is amended by striking <quote>, other than a security interest,</quote> each place it appears.</text></paragraph></subsection> <subsection id="H76DDC161D90B481C9C07CF5700C4F699"><enum>(b)</enum><header>Civil penalty</header><text display-inline="yes-display-inline">Section 3 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3502">7 U.S.C. 3502</external-xref>) is amended—</text> 
<paragraph id="HED25A493F20C4B2B81C09B637FD9112E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>exceed 25 percent</quote> and inserting <quote>be less than 15 percent, or exceed 30 percent,</quote>; and</text></paragraph> <paragraph id="H3D5AF17D26ED409490FF7E99344FCE49"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H7570970D64DD461D9D80C980F8CE80D6"> 
<subsection id="HA15C1EF778A54A839ADB26DF4669CA51"><enum>(c)</enum><header>Liens</header><text>On imposing a penalty under subsection (a), the Secretary shall ensure that a lien is placed on the agricultural land with respect to which the violation occurred, which shall be released only on payment of the penalty.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE745B78689814A778D01AC9A4ED111ED"><enum>(c)</enum><header>Transparency</header><text display-inline="yes-display-inline">Section 7 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3506">7 U.S.C. 3506</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HBDCBA131672D461E8C3622CA4C563DBA"> 
<section id="H99D7016388DD4FC2895CC3AC5B7C6C17"><enum>7.</enum><header>Public data sets</header> 
<subsection id="H43D50F4C8ACB44F1BB4166DBCE4F2177"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall publish in the internet database established under section 742 of division B of the Consolidated Appropriations Act, 2024 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref>) human-readable and machine-readable data sets that—</text> <paragraph id="HD6239603A08447DE9C5ACDA1A7C78724"><enum>(1)</enum><text>contain all data that the Secretary possesses relating to reporting under this Act from each report submitted to the Secretary under section 2; and</text></paragraph> 
<paragraph id="H342A66F257ED4609A84F34561C035FEE"><enum>(2)</enum><text>as soon as practicable, but not later than 30 days, after the date of receipt of any report under section 2, shall be updated with the data from that report.</text></paragraph></subsection> <subsection id="H1FDF16E347C94D338ACD9D3CEE64CE3F"><enum>(b)</enum><header>Included data</header><text>The data sets established under subsection (a) shall include—</text> 
<paragraph id="H1FA1702B1C2642339059C55C1306C9D2"><enum>(1)</enum><text>a description of—</text> <subparagraph id="H9FF378FDAC854E41A23A111E630CA9BE"><enum>(A)</enum><text>the purchase price paid for, or any other consideration given for, each interest in agricultural land for which a report is submitted under section 2; and</text></subparagraph> 
<subparagraph id="H358BD54DCADB43159CC382C8A2797B9A"><enum>(B)</enum><text>updated estimated values of each interest in agricultural land described in subparagraph (A), as that information is made available to the Secretary, based on the most recently assessed value of the agricultural land or another comparable method determined by the Secretary; and</text></subparagraph></paragraph> <paragraph id="H68A35A83152E49FFB44DB7FE44C25B88"><enum>(2)</enum><text>with respect to any agricultural land for which a report is submitted under section 2, updated descriptions of each foreign person who holds an interest in at least 1 percent of the agricultural land, as that information is made available to the Secretary, categorized as a majority owner or a minority owner that holds an interest in the agricultural land.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H431968E58BAE4C2A80CE124F06CD3300"><enum>(d)</enum><header>Definition of foreign person</header><text>Section 9(3) of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508(3)</external-xref>) is amended—</text> <paragraph id="H621848D0EE5E48AF996524019AA2BA6D"><enum>(1)</enum><text>in subparagraph (C)(ii)(IV), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H61E3A659AFA54F0F9B4F007282764D9D"><enum>(2)</enum><text>in subparagraph (D), by inserting <quote>and</quote> after the semicolon; and</text></paragraph> <paragraph id="HBC13BDFFF4884B2491BA2C364E8BFD0E"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HBF317457521142098624930133B15507"> 
<subparagraph id="H4D221372D65E44D3969C827ABC6349A0"><enum>(E)</enum><text>any person, other than an individual or a government, that issues equity securities that are primarily traded on a foreign securities exchange within—</text> <clause id="H348E2A23C57044449B17A06952700642"><enum>(i)</enum><text>Iran; </text></clause> 
<clause id="HB8F13F2C533F4EDFA6EB8E032A187E40"><enum>(ii)</enum><text>North Korea; </text></clause> <clause id="HC64DC6AE383D4BBEA05ED0F984DE5692"><enum>(iii)</enum><text>the People's Republic of China; or</text></clause> 
<clause id="HF3E24580205347CDA74331E4FB7081AF" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text>the Russian Federation;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HA45418CEFA62477E9FD62BC7DE85AEF9"><enum>6.</enum><header>Reports</header> <subsection id="H9EE1CB16D4F54C8DAC329CA62A315174"><enum>(a)</enum><header>Report from the Secretary on foreign ownership of agricultural land in the United States</header> <paragraph id="H6FDF31DAC8514B49B5A5772D9B6A086B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and once every 2 years thereafter, the Secretary shall submit to Congress a report describing—</text> 
<subparagraph id="H527CBAB75C704BFB8EE1BB13B9EBBA40"><enum>(A)</enum><text>the risks and benefits, as determined by the Secretary, that are associated with foreign ownership or lease of agricultural land in rural areas (as defined in section 520 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490">42 U.S.C. 1490</external-xref>)); </text></subparagraph> <subparagraph id="HCD4F2B8BDEC24D91BC0EDBA74CA8A049"><enum>(B)</enum><text>the intended and unintended misrepresentation of foreign land ownership in the annual reports prepared by the Secretary describing foreign holdings of agricultural land due to inaccurate reporting of foreign holdings of agricultural land;</text></subparagraph> 
<subparagraph id="H9FA97A5A24F04A93BF52BD183F7C77CE"><enum>(C)</enum><text>the specific work that the Secretary has undertaken to monitor erroneous reporting required by the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>) that would result in a violation or civil penalty; and</text></subparagraph> <subparagraph id="H24584015971D4BAA916E9EDB1C880FA5"><enum>(D)</enum><text>the role of State and local government authorities in tracking foreign ownership of agricultural land in the United States. </text></subparagraph></paragraph> 
<paragraph id="H0B78F102CAB442CFBD1BA955151DFD5E"><enum>(2)</enum><header>Protection of information</header><text>In carrying out paragraph (1), the Secretary shall establish a plan to ensure the protection of personally identifiable information.</text></paragraph></subsection> <subsection id="H4C9F14B0832C4CCEAE93167EF0D249FD"><enum>(b)</enum><header>Report from the Director of National Intelligence on foreign ownership of agricultural land in the United States</header> <paragraph id="H09DDA355666844F78AC87308CA8DEEE0"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and once every 2 years thereafter, the Director of National Intelligence shall submit to the congressional recipients described in paragraph (2) a report describing—</text> 
<subparagraph id="HDE848AC9DB2641FB9C6A6793D0874ED6"><enum>(A)</enum><text>an analysis of foreign malign influence (as defined in section 119C(e) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3059">50 U.S.C. 3059(e)</external-xref>)) by covered persons that have foreign ownership in the United States agriculture industry; and</text></subparagraph> <subparagraph id="H73ADCAE9974C4454A64577F1703BF751"><enum>(B)</enum><text>the primary motives, as determined by the Director of National Intelligence, of foreign investors to acquire agricultural land.</text></subparagraph></paragraph> 
<paragraph id="H0DC029F174BB4A3DBAA19F3FBF677023"><enum>(2)</enum><header>Congressional recipients described</header><text>The report under paragraph (1) shall be submitted to—</text> <subparagraph id="H63A857169CEF48FFBE5C15724191018B"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs of the Senate;</text></subparagraph> 
<subparagraph id="H7C52C93F980E4A0DAD273C4899408E69"><enum>(B)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph> <subparagraph id="HEE29C5B5B8E9484EAED704E0345CE01C"><enum>(C)</enum><text>the Select Committee on Intelligence of the Senate;</text></subparagraph> 
<subparagraph id="H6E8F47C0874C4F5CA11BF3A4BDBFDDAB"><enum>(D)</enum><text>the Committee on Foreign Relations of the Senate;</text></subparagraph> <subparagraph id="H0F51258F82BB42C186C6AF81344E0CB3"><enum>(E)</enum><text>the Committee on Financial Services of the House of Representatives;</text></subparagraph>

<subsection id="H55CEBF1C6A464A5DB5BB43077FC4A425"><enum>(c)</enum><header>Government Accountability Office report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report describing—</text> <paragraph id="H7B7C1F0F1B744044AD6F21B4310B0EA8"><enum>(1)</enum><text display-inline="yes-display-inline">a review of resources, staffing, and expertise for carrying out the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>), and enforcement issues limiting the effectiveness of that Act; and</text></paragraph> 
<paragraph id="H96570A0CF0AF45249C162361B387711F"><enum>(2)</enum><text>any recommended necessary changes to that Act.</text></paragraph></subsection></section> </legis-body></bill>
