R. 1283</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250213">February 13, 2025</action-date><action-desc><sponsor name-id="B001257">Mr. Bilirakis</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit child pornography produced using artificial intelligence.</official-title></form><legis-body id="HA5F409F3FC1143FC9D9422378B7B2D4A" style="OLC"><section id="H64793A07F4D8407EB276F5845C35232B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Children in an AI World Act of 2025</short-title></quote>.</text></section><section id="HD97627D5425B4B7994322E74A78B87F5"><enum>2.</enum><header>Child pornography produced using artificial intelligence</header><subsection id="H5B34C648B46B431AA073A7324F734105"><enum>(a)</enum><header>Elimination of affirmative defense</header><text display-inline="yes-display-inline">Section 2252A(c) of title 18, United States Code, is amended—</text><paragraph id="HD1D1AC8B51704891A02BD1C3BB7D024B"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="H490E6A129C094A98BC6EBD12D7FC425C"><enum>(A)</enum><text>paragraph (1), by striking <quote>; or</quote> at the end; and</text></subparagraph><subparagraph id="H03F66566CED24B04881B4AFCF899DA26"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph></paragraph><paragraph id="H642AA5B925F645A497D76ED3183169C7"><enum>(2)</enum><text>in the matter following subsection (c), by striking <quote>No affirmative defense under subsection (c)(2) shall be available in any prosecution that involves child pornography as described in section 2256(8)(C).</quote>.</text></paragraph></subsection><subsection id="H4178FFF48CEA4E3BB46589809288FEB8"><enum>(b)</enum><header>Definition of sexually explicit conduct</header><text>Section 2256(2)(B) of title 18, United States Code, is amended—</text><paragraph id="HD3921E3ECF2D4B2F8E6DF7ACFE0E12C8"><enum>(1)</enum><text>in clause (ii)(III), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H83E4A7ECA4C24B81A42DB5180A300E45"><enum>(2)</enum><text>in clause (iii), by adding <quote>or</quote> at the end; and</text></paragraph><paragraph id="HF14090EB5EE744F0A3C21F705564B2CA"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H410A10EADAE9491DAE3BC439831D6A2B" display-inline="no-display-inline"><clause id="HD1E40E10D6F34B07BFF5E1658E3BDFB2"><enum>(iv)</enum><text display-inline="yes-display-inline">actual or simulated obscene exhibition of the clothed or unclothed genitals, pubic area, buttocks, or female nipple; </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9A59906B450C427F93A8047A98E80D5D"><enum>(c)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this Act, or any amendment made by this Act, or the application of such provision to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, or any amendment made thereby, or the application of such provision to all other persons, entities, governments, or circumstances, shall not be affected thereby. </text></subsection></section></legis-body></bill>
