R. 120</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250103">January 3, 2025</action-date><action-desc><sponsor name-id="B001302">Mr. Biggs of Arizona</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HHA00">House Administration</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit COVID–19 vaccination mandates, and for other purposes.</official-title></form><legis-body id="H8251C78FCCE24994A1CE6AC465AB2A96" style="OLC"><section id="H0FC7E0D3A4FC4171B7BADBD672E0D35A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Mandates Act</short-title></quote>.</text></section><section id="HE36831192AFB42629FBC9895CB7BFF1E"><enum>2.</enum><header>Prohibition on agencies issuing vaccine mandates</header><subsection id="H0F2E7517C0574394BA40ED4037FE5C59"><enum>(a)</enum><header>In general</header><text>No agency may issue any rule, regulations, or guidance requiring any individual to receive a vaccination for COVID–19.</text></subsection><subsection id="H3D7086D4AB674D59BA8210B498E38049"><enum>(b)</enum><header>Agency defined</header><text>In this section, the term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code.</text></subsection></section><section id="H40F980C7208347418520DE963CEAC571"><enum>3.</enum><header>Prohibition on requiring proof of COVID–19 vaccination for Federal access</header><text display-inline="no-display-inline">A vaccination for COVID–19 shall not be required for access to Federal property or Federal services, or for access to congressional grounds or services.</text></section><section id="H6938B1F3329046C6BCC862D28CD8B705"><enum>4.</enum><header>Federal funding restrictions</header><subsection id="HF7D07F9573C147A9809C1106DCCA78E6"><enum>(a)</enum><header>Funding restriction</header><text>No entity that received Federal funds under a COVID–19 relief package or that receives any other Federal funds after the date of the enactment of this Act may require any individual to have received a vaccination for COVID–19 as a condition of such entity providing any service to such individual.</text></subsection><subsection id="HA95B1D5C2AA44D45AF0E26CD10BA5DA3"><enum>(b)</enum><header>Return of funds</header><text>Any entity that does not comply with subsection (a) shall be required to pay to the Government an amount equal to the sum of all funds such entity received.</text></subsection><subsection id="H180B09A6B69C42C49A07766A3AD9A3DD"><enum>(c)</enum><header>COVID–19 relief package defined</header><text>In this section, the term <term>COVID–19 relief package</term> means any of the following:</text><paragraph id="H355CED082FBD41B492163CC01CC4C4E5"><enum>(1)</enum><text>CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9001">15 U.S.C. 9001 et seq.</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281).</text></paragraph><paragraph id="HF6F93887E55848E6B8E0C50C56E1D6AE"><enum>(2)</enum><text>Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>; 134 Stat. 146).</text></paragraph><paragraph id="H238C8C5DECDC4DD4A1851D0A4C189DA3"><enum>(3)</enum><text>Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>; 134 Stat. 178).</text></paragraph><paragraph id="H8BBC675AE87B4210A98DE20FB6CAF133"><enum>(4)</enum><text>Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>; 134 Stat. 620).</text></paragraph><paragraph id="H9E249010EFC347D9B25D7CD20EEA9299"><enum>(5)</enum><text>Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1182).</text></paragraph><paragraph id="HC466A47CE8F5498C9735A1CFF1F16F6D"><enum>(6)</enum><text>American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 41).</text></paragraph></subsection></section></legis-body></bill>
