<section id="H3CF58C69A5D443DB8B96216E686A820A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future in Logging Careers Act</short-title></quote>.</text></section> <section id="HF33B25A4D27644C6933CCFC151E7E835"><enum>2.</enum><header>Child labor law exemptions for timber harvesting entities and mechanized timber harvesting entities</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text>
<paragraph id="HDE25C2100B3D474987B26936957C4633"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HC4D24ABA4955408EB0E68DA2F3F0C309" style="OLC"> <subsection id="H7DEE39B37AD948CCACE46A0DEF380DEC"><enum>(z)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HD90863BD1D34409284125D80DE1E7C37"><enum>(1)</enum><text><term>Timber harvesting employer</term> means an employer engaged in—</text>
<subparagraph id="H9315CFACB0784ADA8B1C242ED9AA9220" indent="up1"><enum>(A)</enum><text>the felling, skidding, yarding, loading and processing of timber by equipment other than manually operated chainsaws and cable skidders;</text></subparagraph> <subparagraph id="H7C80BC62B98647F490403D10CF0EE6F4" indent="up1"><enum>(B)</enum><text>the felling of timber in mechanized operations;</text></subparagraph>
<subparagraph id="HE748EA1014BD4E4AB8BEB1668A333175" indent="up1"><enum>(C)</enum><text>the bucking or converting of timber into logs, poles, ties, bolts, pulpwood, chemical wood, excelsior wood, cordwood, fence posts, or similar products;</text></subparagraph> <subparagraph id="H4E4C2E1F2E69422788EF4C7A21056C50" indent="up1"><enum>(D)</enum><text>the collecting, skidding, yarding, loading, transporting and unloading of such products in connection with logging;</text></subparagraph>
<subparagraph id="H443AFC6C81494951B56F921CC2F6B83D" indent="up1"><enum>(E)</enum><text>the constructing, repairing and maintaining of roads or camps used in connection with logging; the constructing, repairing, and maintenance of machinery or equipment used in logging; and</text></subparagraph> <subparagraph id="HE9BB17D902124E60BAE302595FFB8B5C" indent="up1"><enum>(F)</enum><text>other work performed in connection with logging.</text></subparagraph></paragraph>
<paragraph id="H230A7CF5D9C84F1080104EDC6F8A0428" indent="up1"><enum>(2)</enum><text><term>Mechanized timber harvesting employer</term>—</text> <subparagraph id="H948826F5ACC64E8080B4654CA3A0A334"><enum>(A)</enum><text>means an employer engaged in the felling, skidding, yarding, loading and processing of timber by equipment other than manually operated chain­saws and cable skidders; and</text></subparagraph>
<subparagraph id="H953E8E493F8D4301831F05DF753BAD4D"><enum>(B)</enum><text display-inline="yes-display-inline">includes an employer engaged in the use of whole tree processors, cut-to-length processors, stroke boom delimbers, wheeled and track feller-bunchers, pull thru delimbers, wheeled and track forwarders, chippers, grinders, mechanical de­bark­ers, wheeled and track grapple skidders, yarders, bulldozers, excavators, and log loaders.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H5331BD125B1942498681984F46A4D9B2"><enum>(2)</enum><text display-inline="yes-display-inline"> in section 13(c) (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)</external-xref>), by adding at the end the following:</text>

<paragraph id="HB4CE778C0FF4485EAA412F6F18708B0A" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">The provisions of section 12 relating to child labor shall apply to an employee who is 16 or 17 years old employed by a timber harvesting employer or mechanized timber harvesting employer in an occupation that the Secretary of Labor finds and declares to be particularly hazardous for the employment of children ages 16 or 17, except where such employee is employed by a timber harvesting employer or mechanized timber harvesting employer owned or operated by a parent or a person standing in the place of a parent of such employee.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
