which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to include physical therapists and occupational therapists as health professionals for purposes of the annual wellness visit under the Medicare program, and for other purposes.</official-title></form><legis-body id="HEA087EEAACD949FB95802963E87C9C3A" style="OLC"><section id="HB62C9FFEADF24320BEABB32622589A28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Addiction and Falls for the Elderly Act</short-title></quote> or the <quote><short-title>SAFE Act</short-title></quote>.</text></section><section id="HE7BC0E8805E34C79B776265AD9862095"><enum>2.</enum><header>Physical therapy and occupational therapy benefit in the Medicare annual wellness visit and initial preventive physical exam</header><subsection id="H47A097DD2C004E219635D3C6650112F1"><enum>(a)</enum><header>Annual wellness visit</header><paragraph id="HAB31EC895A7A42AC86A8D6692E86D68E"><enum>(1)</enum><header>In general</header><text>Section 1861(hhh) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(hhh)</external-xref>) is amended—</text><subparagraph id="HBC2A3E8E99A5428486D22D3BC2E7EC62"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H87A61CBE2875420A8FE9CD246929100C"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="H18F4EC6C330B40009A0A3EF63DA22410"><enum>(ii)</enum><text>in subparagraph (B)(ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H1F1145187CDE4747B9EAD714D89C33BD"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HBFF50F9B54BF4B8D99CEB06D7F6D8532" display-inline="no-display-inline"><subparagraph id="H379CFED6006B47C186ED85E7D90B3F0A" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">that, in the case of an individual who has been determined by a physician to have fallen in the previous calendar year, includes a falls risk assessment and fall prevention services.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H16A6115EAD63489FAE98368B3E6CCA05"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="H9CE421996CB24B898E014E6A0D0C79DE"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></clause><clause id="H7BC4B9ED9A4942778B7AF8739300637E"><enum>(ii)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="H612E5D98AC4D488EA8DAD2ED02C2B968"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HC77BE209048D42FD8C29EABA4D135F71" display-inline="no-display-inline"><subparagraph id="HB9AB6A136824436F87DF5F135838075A" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of an individual described in paragraph (1)(C), a physical therapist or an occupational therapist furnishing a separate falls risk assessment and fall prevention services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H62E5535081C24BA8B72B7D1B5980C7F8"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to annual wellness visits furnished on or after January 1, 2026.</text></paragraph></subsection><subsection id="H6D93E8A4724B4A3CAFB69B80DDF45F30"><enum>(b)</enum><header>Initial preventive physical examination</header><paragraph id="HBF8BE273926E488C99F15CF502593A55"><enum>(1)</enum><header>In general</header><text>Section 1861(ww)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ww)(2)</external-xref>) is amended—</text><subparagraph id="HEAD7F011C3D246D6AE77CBDCD2C1F32D"><enum>(A)</enum><text>in subparagraph (N), by moving the margins of such subparagraph 2 ems to the left;</text></subparagraph><subparagraph id="H78B9B1D8581743058CDB76526EE5761F"><enum>(B)</enum><text>by redesignating subparagraph (O) as subparagraph (P); and</text></subparagraph><subparagraph id="H96843FAC89D346DB80F49159201FF863"><enum>(C)</enum><text>by inserting after subparagraph (N) the following new subparagraph:</text><quoted-block style="OLC" id="H24ADC90B0CBF4F14B44D99950C05CFDC" display-inline="no-display-inline"><subparagraph id="HC30CD6CCCAF04068A30978F2B7C9F719" indent="up1"><enum>(O)</enum><text display-inline="yes-display-inline">In the case of an individual that has been determined by a physician to have experienced a fall in the previous calendar year, outpatient occupational therapy services (as defined in subsection (g)) and outpatient physical therapy services (as defined in subsection (p)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H67567A0C0D2448338E179ACE550467E5"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to initial preventive physical examinations furnished on or after January 1, 2026.</text></paragraph></subsection></section><section id="H975CBFEBF97846058C8EB77CA2954E00"><enum>3.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Beginning January 1, 2027, and annually thereafter, the Secretary of Health and Human Services shall submit to Congress a report on the number of falls (as reported by the Centers for Disease Control and Prevention) experienced by individuals aged 65 and older that received treatment for pain or injury related to a fall or falls experienced in the previous calendar year. With respect to each subsequent report, such Secretary shall include the data reported in previous years and describe any changes from year to year.</text></section></legis-body></bill>
