which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><action display="yes"><action-date date="20250327">March 27, 2025</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on February 10, 2025</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide for the application of the mailbox rule to documents and payments electronically submitted to the Internal Revenue Service.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HWM00" reported-display-style="italic" id="H0276F05E901446449D404BE6657986E3"><section id="HC6E440564EE743EFAC743DAAD55CC42A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electronic Filing and Payment Fairness Act</short-title></quote>.</text></section><section id="HF54FB494E73F4BFC845614EE64614457"><enum>2.</enum><header>Application of mailbox rule to documents and payments electronically submitted to the Internal Revenue Service</header><subsection commented="no" display-inline="no-display-inline" id="H670C27E622934F6B8FE68809A7F13E36"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/7502">Section 7502(c)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H79C947D1CBD6409FA5718349489626E4"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text style="tax" level="subsection">and payment</header-in-text></quote> after <quote><header-in-text style="tax" level="subsection">filing</header-in-text></quote>,</text></paragraph><paragraph id="H34F8E2F199854BA6913DAB3D0FFB6D51"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HAF3258591F204E83B592F13CEB7F7B94"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text style="tax" level="paragraph">; electronic filing</header-in-text></quote>, and</text></subparagraph><subparagraph id="H53D8AB38830F4148864FC0C363BFAB42"><enum>(B)</enum><text>by striking <quote>and electronic filing</quote>, and</text></subparagraph></paragraph><paragraph id="H25F64762CF844F9DA792FEDCF2B12776"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA3B1D18EE6664338994D6E1670435AE4" changed="added" reported-display-style="italic" committee-id="HWM00"><paragraph id="H83E9C6FEAD3E421B90F362A457D4AD33"><enum>(3)</enum><header>Electronic filing and payment</header><subparagraph commented="no" display-inline="no-display-inline" id="H3EC3A069D28F464BBCBC7CCB62288191"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If any return, claim, statement, or other document required to be filed, or any payment required to be made, within a prescribed period or on or before a prescribed date under authority of any provision of the internal revenue laws is sent electronically by any person to the agency, officer, or office with which such return, claim, statement, or other document is required to be filed, or to which such payment is required to be made, the date on which such return, claim, statement, or other document, or payment, is sent electronically by such person shall be deemed to be the date of delivery or the date of payment, as the case may be, regardless of the date on which the applicable agency, officer, or office receives or reviews such return, claim, statement, document, or payment.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A94ACB02337454E972113DF5EEDF007"><enum>(B)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than December 31, 2025, the Secretary shall issue such regulations or other guidance as the Secretary determines necessary to carry out the purposes of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1925FF227F2547368056CBEF37BCC500"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text>The amendments made by this section shall apply to any document or payment sent after December 31, 2025.</text></subsection></section></legis-body><endorsement display="yes"><action-date date="20250327">March 27, 2025</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
