<section id="HBC7E76B1C3DE4BCFAF7811B8D850408D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This concurrent resolution may be cited as the <quote><short-title>Exposing Congressional Drug Abuse Act</short-title></quote>.</text></section> <section id="H6F17BADC360645B8B28B446B1FA1E5EB"><enum>2.</enum><header>Random drug testing of Members of the House of Representatives and the Senate</header> <subsection id="HEAA37B53CFE449F0A92A8DE96573BC1E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each Member of the House of Representatives and the Senate shall participate in accordance with this concurrent resolution in a program for testing for illegal use of controlled substances.</text></subsection> 
<subsection id="HF68554D9F48743FFA19B60D092D8694D"><enum>(b)</enum><header>Features</header><text>The program under this concurrent resolution shall include the following features:</text> <paragraph id="HB0119EF1759746C183F2DBEE73359E8A"><enum>(1)</enum><text>Each Member of the House of Representatives and the Senate shall be subject to a random drug test once per term of such Member.</text></paragraph> 
<paragraph id="HD181D9EFE9EA4736A6D5D65875EC03CC"><enum>(2)</enum><text>Each confirmed positive result under the program shall be provided as follows:</text> <subparagraph id="H500BCB26FB514D068212FE3F80424033"><enum>(A)</enum><text>To the Member involved.</text></subparagraph> 
<subparagraph id="H8079DD9144A946C8AEA664990D45C243"><enum>(B)</enum><text>In the case of a Member of the House of Representatives, to the Committee on Ethics of the House of Representatives for such review as may be necessary under the Rules of the House of Representatives.</text></subparagraph> <subparagraph id="H881CF7B52C3B46E98754B74928B7D16B"><enum>(C)</enum><text>In the case of a Member of the Senate, to the Select Committee on Ethics of the Senate for such review as may be necessary under the Standing Rules of the Senate.</text></subparagraph></paragraph> 
<paragraph id="HD5A2EB1A2BE54D86A912A4D721201E56"><enum>(3)</enum><text>The Committee on Ethics of the House of Representatives, with respect to a Member of the House, and the Select Committee on Ethics of the Senate, with respect to a Member of the Senate, shall publicly disclose the identity of each Member who refuses to participate in the program and take other action against each such Member as appropriate.</text></paragraph> <paragraph id="H81E7BE0303804D0191C0C4F9C903A2F3"><enum>(4)</enum><text>Each Member of the House of Representatives and the Senate shall reimburse the House of Representatives or the Senate for the cost of the random drug test of such Member under the program.</text></paragraph></subsection> 
<subsection id="H58A96E5C932F441F9673B6677C98CB50"><enum>(c)</enum><header>Regulations</header><text>The Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate shall each issue such rules and regulations as may be necessary to carry out this concurrent resolution.</text></subsection> <subsection id="H31FD87D4522043D9B6D1A06E78B50078"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this concurrent resolution:</text> 
<paragraph id="H411AF21377DD4DD6BC6F209DCB07685A"><enum>(1)</enum><header>Confirmed positive result</header><text>The term <term>confirmed positive result</term>—</text> <subparagraph id="HF4E57D2220E54A0AA16DDDD4E36722C9"><enum>(A)</enum><text>means a random drug test—</text> 
<clause id="H55707FBD24FF4B47833B8AD014C39ACA"><enum>(i)</enum><text>which has initially tested as positive for the presence of an illegal controlled substance;</text></clause> <clause id="H68C363196D6A461C915D1DCF48BB0B72"><enum>(ii)</enum><text>for which the initially positive test has been confirmed by a second test using a different chemical process than the process used for the initial test; and</text></clause> 
<clause id="H62DBF5B0E123428BBC9469B3FBB561F3"><enum>(iii)</enum><text>which has been reviewed and certified as positive by a medical review officer with whom the House of Representatives or the Senate has entered into a contract to perform such reviews; and</text></clause></subparagraph> <subparagraph id="H4FD66453AB904A95975D2CE5B987CC32"><enum>(B)</enum><text>does not include a drug test which shows only the presence of legal, over-the-counter drugs and drugs that have been legally prescribed for the individual involved.</text></subparagraph></paragraph> 
<paragraph id="HB0091BD42DAE4ADF938A716E8F45E6CC"><enum>(2)</enum><header>Controlled substance</header><text>The term <term>controlled substance</term> has the meaning given the term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph> <paragraph id="HDB78CC37C4E64CF8915EBC77348F71B7"><enum>(3)</enum><header>Member</header><text>The term <term>Member</term>, with respect to the House of Representatives, includes a Delegate or Resident Commissioner to the Congress.</text></paragraph> 
<paragraph id="HA6FE5A94F5FE49CC88EFC148405BEF28"><enum>(4)</enum><header>Random drug test</header><text>The term <term>random drug test</term> means a test conducted for the purpose of detecting the illegal use of a controlled substance which is conducted—</text> <subparagraph id="HA61658D454024F78B37374363722E8E3"><enum>(A)</enum><text>on a periodic basis;</text></subparagraph> 
<subparagraph id="H368C0CF31CAA473E88F7239744C379FB"><enum>(B)</enum><text>without advance notice; and</text></subparagraph> <subparagraph id="H55A7B34CC8A84D7883DFE266BE893E73"><enum>(C)</enum><text>without individualized suspicion.</text></subparagraph></paragraph></subsection></section>
