<section id="HEE7A7F33C3234EC9B0FEC11934B55E2D" section-type="section-one"><enum>1.</enum><header>Congressional Fitness Challenge</header><text display-inline="no-display-inline">There is established a national recognition program, to be known as the Congressional Fitness Challenge (in this concurrent resolution referred to as the <quote>Challenge</quote>), to promote physical fitness and personal achievement among eligible participants through voluntary, performance-based fitness tests.</text></section> <section id="H674D64C3282B4D2BBCEA35C4E7D27F64"><enum>2.</enum><header>Tests</header><text display-inline="no-display-inline">The Challenge shall be comprised of the following tests to be administered to eligible participants:</text> 
<paragraph id="HA7849133430E4DCFA4180CFB318FE790" display-inline="no-display-inline"><enum>(1)</enum><text>1-mile run or walk, which shall be assessed based on the time taken to run or walk 1 mile.</text></paragraph> <paragraph id="H4C59EBA8C2B9436BA3147BE6297980B1"><enum>(2)</enum><text display-inline="yes-display-inline">Pull-ups or flexed arm hang, which shall be assessed based on the maximum number of continuous pull-ups or flexed arm hangs completed with proper form.</text></paragraph> 
<paragraph id="H8184438299CB4F138C8B0CE21AA8365A"><enum>(3)</enum><text display-inline="yes-display-inline">Curl-ups or sit-ups, which shall be assessed based on the number of curl-ups or sit-ups completed in 60 seconds.</text> </paragraph> <paragraph id="HF69C6815133C4F09833C28FBDE08D6DA"><enum>(4)</enum><text display-inline="yes-display-inline">Shuttle run, which shall be assessed based on the time taken to run 30 feet back and forth between 2 parallel lines, picking up a block of wood or similar object twice at 1 such line, for a total of 120 feet.</text></paragraph> 
<paragraph id="H11460CDBAD184EBD991DA080AC5637B1"><enum>(5)</enum><text display-inline="yes-display-inline">Sit-and-reach, which shall be assessed based on the maximum distance reached.</text> </paragraph></section> <section id="HD07393B707DD4900BAC3B478A3C634C1"><enum>3.</enum><header>Administration of Challenge</header> <subsection id="HFE38876705FC4091B71FFADD2EDF7935"><enum>(a)</enum><header>Challenge sponsors</header><text display-inline="yes-display-inline">The following entities may sponsor the Challenge:</text> 
<paragraph id="HF55FCB5D83204ECF9B6A7E0B7F13BC16"><enum>(1)</enum><text display-inline="yes-display-inline">A public or private school that provides education in any grade from kindergarten through grade 12.</text></paragraph> <paragraph id="H7536C829603F4A6EBCDEB9B36C0B57D9"><enum>(2)</enum><text display-inline="yes-display-inline">A Member of the House of Representatives or Senator who organizes a community-based event.</text></paragraph> 
<paragraph id="HD16CD411957744E9AB0A331B86F1F427"><enum>(3)</enum><text display-inline="yes-display-inline">An independent entity that provides testing for an eligible participant that attends a home school.</text> </paragraph></subsection> <subsection id="H36ECD1CAAF304BAD9E9B6D11E66A5BB0"><enum>(b)</enum><header>Test administrators</header><text>The tests under section 2 shall be administered by a certified fitness professional.</text></subsection></section> 
<section id="HA0D9D49370BB4B18A9B3A4B3C78EEE66"><enum>4.</enum><header>Benchmarks</header> 
<subsection id="H343170532D9E4ACDB834D1BCC0D1FA08"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The covered committees shall consult with fitness organizations or certified fitness professionals to finalize and publish benchmarks that set a performance standard for each test under section 2 based on age and gender. In finalizing such benchmarks, such committees shall take into account the historical standards used in the Presidential Physical Fitness Test.</text> </subsection> <subsection id="HE555F93767D8486D862F749487D0EB67"><enum>(b)</enum><header>Adaptive standards</header><text>Such benchmarks shall include adaptive standards for eligible participants with disabilities.</text></subsection></section> 
<section id="HF2B85FA5A74F462BBAEAABAF3D330046"><enum>5.</enum><header>Data collection</header> 
<subsection id="H2050BB4AC01E4923828C74F7D6D53C53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An entity sponsoring the Challenge under section 3(a) shall submit to the covered committees the data of all eligible participants who participate in the Challenge sponsored by such entity.</text></subsection> <subsection id="H526E64DED1B54F718614660C2A3D0856"><enum>(b)</enum><header>Data aggregation</header><text>The covered committees shall aggregate such data based on the gender and age group of such participants across the United States for each 1-year period.</text></subsection> </section> 
<section id="HC4F824CA7938461A97362868C285721D"><enum>6.</enum><header>Recognition</header> 
<subsection id="H65186897A8B5471D87ABFF0D36B1779C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible participant who performs at or above the benchmarks under section 4 in the gender and age group of such participant for each test under section 2 may receive a certificate that is signed by—</text> <paragraph id="H6B3894458E3C4DF0B822D254434CD697"><enum>(1)</enum><text>the Speaker of the House of Representatives;</text></paragraph> 
<paragraph id="H54D3BD5FC72C42C793DF5ACCD1B31F86"><enum>(2)</enum><text>the President pro tempore of the Senate;</text></paragraph> <paragraph id="H4DBE1FE42FBF4CE2AF08B0A4F0ECDC45" display-inline="no-display-inline"><enum>(3)</enum><text>the Member of the House of Representatives who represents the congressional district in which such participant resides; and</text></paragraph> 
<paragraph id="H23C59B8A6CE749C0820C5DFFEDAB319C"><enum>(4)</enum><text>the Senator of the State in which such participant resides.</text></paragraph> </subsection> <subsection id="H147D74B5908F4EF6B2EEA58B1036E9A5" display-inline="no-display-inline"><enum>(b)</enum><header>Recognition levels</header><text display-inline="yes-display-inline">For an eligible participant who performs at or above the following percentiles in the gender and age group of such participant for each test under section 2, a certificate under subsection (a) shall indicate the lowest recognition level achieved on any such test as follows:</text> 
<paragraph id="H4FEA5F65057E4881B1B0C6E3B81B67EE"><enum>(1)</enum><text>Gold level: Top 85th percentile of eligible participants who participated in the Challenge.</text></paragraph> <paragraph id="HEDEFFF316AC148A49F84C37DC4C0FE31"><enum>(2)</enum><text display-inline="yes-display-inline">Silver level: Top 75th percentile of eligible participants who participated in the Challenge.</text></paragraph> 
<paragraph id="H02DD5BC736E645B6B993F4BDDD8AD675"><enum>(3)</enum><text display-inline="yes-display-inline">Bronze level: Top 50th percentile of eligible participants who participated in the Challenge.</text> </paragraph></subsection></section> <section id="H09892D35E2D24DF1A199056A91E21936"><enum>7.</enum><header>Administration and oversight</header> <subsection id="HF94139967B494403A832006071D9AA57"><enum>(a)</enum><header>Regulations and guidance</header><text display-inline="yes-display-inline">The covered committees shall jointly—</text> 
<paragraph id="H5637FA4C4DC247A4861B1EFFAAB09BA5"><enum>(1)</enum><text display-inline="yes-display-inline">prescribe regulations to oversee the Challenge, including—</text> <subparagraph id="H7D9EF91BBBC147529FDB3D72FD479156"><enum>(A)</enum><text>testing protocols;</text></subparagraph> 
<subparagraph id="HD87B5284006B423D8A0534CF5A7F210C"><enum>(B)</enum><text>mechanisms to report any information needed for recognition under section 6 to the Member of the House of Representatives who represents the congressional district in which an eligible participant resides and the Senator of the State in which such participant resides;</text></subparagraph> <subparagraph id="H57BE723DE768491D967D3C381496FD04"><enum>(C)</enum><text>regulations to protect the privacy of eligible participants who participate in the Challenge and address the liability risks of sponsors under section 3(a); and</text></subparagraph> 
<subparagraph id="HD5810ACE717C4E4F828CC02AB8C93431"><enum>(D)</enum><text>uniform standards for submitting data to the covered committees under section 5; and</text></subparagraph></paragraph> <paragraph id="H1312BE051C0A4BD28724AB23325CE1C7"><enum>(2)</enum><text display-inline="yes-display-inline">issue guidance on the use of—</text> 
<subparagraph id="HF2CCD745694741ABB146B38D2F7EF686"><enum>(A)</enum><text>a Members’ Representational Allowance by a Member of the House of Representatives under subsection (b); and</text></subparagraph> <subparagraph id="H2A6E295EDE1542889739C708547C7481"><enum>(B)</enum><text display-inline="yes-display-inline">a Senators’ Official Personnel and Office Expense Account by a Senator under subsection (b).</text></subparagraph></paragraph></subsection> 
<subsection id="H0461780C61454C8FA247F06A53BB0D39" display-inline="no-display-inline"><enum>(b)</enum><header>Funding sources</header> 
<paragraph id="H86B66670F0F547469287F670A20D1F0E"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H7A024EE4AB5C40F2BF4DB4451011FCBD"><enum>(A)</enum><header>Members’ Representational Allowance</header><text display-inline="yes-display-inline">A Member of the House of Representatives may use amounts provided under the Members’ Representational Allowance of such Member under section 101 of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5341">2 U.S.C. 5341</external-xref>) to carry out activities related to the Challenge.</text></subparagraph> <subparagraph id="H077E51ADAA7B4B509E803E4723F0373F"><enum>(B)</enum><header>Senators’ Official Personnel and Office Expense Account</header><text display-inline="yes-display-inline">A Senator may use amounts provided under the Senators’ Official Personnel and Office Expense Account of such Senator under the first section of <external-xref legal-doc="public-law" parsable-cite="pl/100/137">Public Law 100–137</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/2/6313">2 U.S.C. 6313</external-xref>) to carry out activities related to the Challenge.</text></subparagraph></paragraph> 
<paragraph id="HE0D7419B3C8946FDB6C440C81CA91D63"><enum>(2)</enum><header>Alternative funding</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Subcommittees on the Legislative Branch of the Committees on Appropriations of the House of Representatives and the Senate shall publish a report on the feasibility and desirability of using other funds of the House of Representatives and Senate in covering expenses incurred in carrying out the Challenge.</text></paragraph></subsection></section> <section id="HD6EB20B14B1E4750B5626497D38F524C"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this concurrent resolution:</text> 
<paragraph id="HB601B8C02EE340F38FEAE9BF8826C2F9"><enum>(1)</enum><header>Certified fitness professional</header><text display-inline="yes-display-inline">The term <term>certified fitness professional</term> means a fitness professional with a relevant certification, as determined by a sponsor under section 3(a), such as—</text> <subparagraph id="HD26390CA118F4F89BD8B7804B8F0F76B"><enum>(A)</enum><text>a physical education teacher at a public or private school that provides education in a grade from kindergarten through grade 12, but only with respect to eligible participants who are in an age group for which such teacher is qualified to administer the tests under section 2; or</text></subparagraph> 
<subparagraph id="H1C4B87F44D8945D79D42EB153913C3DE"><enum>(B)</enum><text>a physical trainer with a certification from the National Academy of Sports Medicine, the American Council on Exercise, or a similar entity.</text></subparagraph></paragraph> <paragraph id="H69FCFC8FE39843BD856E966B71227985"><enum>(2)</enum><header>Covered committees</header><text display-inline="yes-display-inline">The term <term>covered committees</term> means the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate.</text></paragraph> 
<paragraph id="H6AFA04AD4A4D44A786E39734EA043617"><enum>(3)</enum><header>Eligible participant</header><text display-inline="yes-display-inline">The term <term>eligible participant</term> means a student, including a student attending a public, private, or home school, aged 6 through 17.</text> </paragraph> <paragraph id="HC333B55534A24B439325702A5423D242"><enum>(4)</enum><header>Member of the House of Representatives</header><text display-inline="yes-display-inline">The term <term>Member of the House of Representatives</term> means a Representative in, or a Delegate or Resident Commissioner to, the Congress.</text></paragraph></section>
