(or a successor statute). </text></paragraph><paragraph id="HC160A32C5C0849BA97A025F350BB4136"><enum>(3)</enum><header>Optimal Location Review</header><text>The term <term>optimal location review</term> means a review conducted in accordance with the process described in the guide entitled <quote>Continental Divide National Scenic Trail Optimal Location Review Guide</quote> and dated November 2017. </text></paragraph><paragraph id="idB88C7B35615A4526B68C1919C6DAC199"><enum>(4)</enum><header>Secretaries</header><text>The term <quote>Secretaries</quote> means each of the Secretary and the Secretary of the Interior.</text></paragraph><paragraph id="idF2EE3A2C0D1640919A4E1C2F4A17B60E"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="HB9E0A467F2A14E6DA9DA3BE4B3F6FBCD"><enum>(6)</enum><header>Team</header><text>The term <term>Team</term> means the joint Forest Service and Bureau of Land Management Trail completion team established under section 3(b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF8935021D31F403B93FD79CB2CF56C03"><enum>(7)</enum><header>Trail</header><text>The term <term>Trail</term> means the Continental Divide National Scenic Trail established by section 5(a)(5) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1244">16 U.S.C. 1244(a)(5)</external-xref>). </text></paragraph></section><section id="H63E99EAED6E845268876A0A56E749327" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Continental Divide National Scenic Trail</header><subsection id="HB809E60B91424B7F8103E8C82C4DED39"><enum>(a)</enum><header>Completion of trail</header><paragraph id="idF8948DD2C2C04FE9BF77A03AC4AB986B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than November 10, 2028, the Secretaries shall, to the maximum extent practicable, ensure the completion of the Trail as a contiguous route, consistent with sections 3(a)(2), 5(a)(5), and 7 of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1242">16 U.S.C. 1242(a)(2)</external-xref>, 1244(a)(5), 1246). </text></paragraph><paragraph id="id1DADC633BC9C44A193BF37EC2B660100"><enum>(2)</enum><header>Required activities</header><text display-inline="yes-display-inline">The Secretaries shall, to the maximum extent practicable, carry out necessary activities to achieve the goal described in paragraph (1), including the following activities, in the following order of priority:</text><subparagraph id="ide80f6f92bd114f53a953bee1f5e8bd6f"><enum>(A)</enum><text>Complete the Trail by acquiring land or an interest in land, entering into easement agreements, or encouraging a State or local government to enter into a cooperative agreement to acquire any interest in land, that is necessary—</text><clause id="idBEDA17D8E6684F77885EC66F66FBD314"><enum>(i)</enum><text display-inline="yes-display-inline">to eliminate gaps between sections of the Trail; and </text></clause><clause id="idBC2C25F88FF84B36B28E0E1F4F97C6CA"><enum>(ii)</enum><text display-inline="yes-display-inline">to maintain the nature and purposes of the Trail.</text></clause></subparagraph><subparagraph id="id934613b51ff84ca6979ed23ff9b5ff8e"><enum>(B)</enum><text>If appropriate and supported by local affected stakeholders, optimize the Trail by relocating, consistent with the nature and purposes of the Trail, existing incompatible portions of the Trail onto Federal land as necessary to provide for—</text><clause id="id5b4f8bb884364ce4b54d462c088abaf5"><enum>(i)</enum><text>maximum outdoor recreation potential; </text></clause><clause id="id86b00cee068e4494b1231def7963827d"><enum>(ii)</enum><text>the conservation and enjoyment of the nationally significant scenic, historic, natural, or cultural qualities of the areas through which the Trail passes;</text></clause><clause id="idc57cb52cbea04f95b2814987e2fe4545"><enum>(iii)</enum><text>continuity in land ownership, if desired by the owner of the affected land; and</text></clause><clause id="idcb7c4464aac94673ae4d87a448a53dde"><enum>(iv)</enum><text>segments of the Trail that are comparable in length to the segments of the Trail being relocated.</text></clause></subparagraph><subparagraph id="HEF9A7E54B4E741378D891F2820F825DB"><enum>(C)</enum><text display-inline="yes-display-inline">Publish maps of the completed corridor of the Trail.</text></subparagraph></paragraph></subsection><subsection id="HD136B27ACDB0459ABFC75A705344F229"><enum>(b)</enum><header>Trail completion team</header><paragraph id="HE4AB745C05424AD29F115A37445D4718"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out subsection (a), not later than 1 year after the date of enactment of this Act, the Secretaries shall establish a joint Forest Service and Bureau of Land Management Trail completion team to work in coordination with the administrator of the Trail to facilitate the completion and optimization of the Trail, pursuant to the purposes of section 3(a)(2) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1242">16 U.S.C. 1242(a)(2)</external-xref>), consistent with the nature and purposes of the Trail.</text></paragraph><paragraph id="H528E492E72574ECF9907C964E0E7DF6B"><enum>(2)</enum><header>Duties of the Team</header><text>The Team shall—</text><subparagraph id="HAA9804E9166F403EA68514E4B85E22E1"><enum>(A)</enum><text>carry out land and right-of-way acquisitions, easement acquisitions, relocations, and Trail construction activities, consistent with any optimal location reviews, giving priority to land that—</text><clause id="H0171B54AEC73455F9C27648D547050B5"><enum>(i)</enum><text>eliminates gaps between segments of the Trail;</text></clause><clause id="H15D6233866064C6AAC24DC24CBD6CDFE"><enum>(ii)</enum><text>may be acquired for the Trail by the Secretary or the Secretary of the Interior by—</text><subclause id="id6790167B2C6E49D4BF265996AA3A8B75"><enum>(I)</enum><text>purchase from a willing seller;</text></subclause><subclause id="id826279A05E584901B63007443E3D5EFF"><enum>(II)</enum><text>donation; </text></subclause><subclause id="idCB4A1C424BD54FBA945B86B5CFA9749F"><enum>(III)</enum><text>exchange; </text></subclause><subclause id="id0EB02D11F4384764A479F8549DBB2D44"><enum>(IV)</enum><text>cooperative agreement; or</text></subclause><subclause id="id8A80EC8F02C34125B2E37BAF397E3573"><enum>(V)</enum><text>easement agreement;</text></subclause></clause><clause id="H92834897F7B94C659E614B4CB937112C"><enum>(iii)</enum><text display-inline="yes-display-inline">is best suited for inclusion in the Trail corridor in accordance with the purposes, policy, and provisions of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241 et seq.</external-xref>); </text></clause><clause id="id00b51618eb284170b09c43efb84b8147"><enum>(iv)</enum><text>if appropriate and supported by local affected stakeholders, has been identified as a segment of the Trail on Federal land that should be relocated to provide for maximum outdoor recreation potential and the conservation and enjoyment of the nationally significant scenic, historic, natural, or cultural qualities of the areas through which the Trail passes;</text></clause><clause id="ida4ab28bb700f446fab7cb35d44bb9434"><enum>(v)</enum><text>mitigates land use conflicts;</text></clause><clause id="idc58bc6b747d54126823ae317d861789d"><enum>(vi)</enum><text>would support the development of rural communities through use as a trail; and</text></clause><clause id="id44AFE70FA88D4130AAD1B4277EA3CD97"><enum>(vii)</enum><text>minimizes the distance to connect compatible segments of the Trail;</text></clause></subparagraph><subparagraph id="H2DFC9B00836748769DFCE295CC4FEA6E"><enum>(B)</enum><text display-inline="yes-display-inline">provide the necessary administrative and technical support to complete conveyances of the Trail corridor under subsection (a);</text></subparagraph><subparagraph id="id57333e6981d34c4ea2547d5d71ff8c6d"><enum>(C)</enum><text>as appropriate, consult with other Federal agencies, Governors of the affected States, affected Indian Tribes, local governments, affected land owners, land-grant mercedes, acequias, and applicable owners or users of a land grant-merced or acequia, the Continental Divide Trail Coalition, and other volunteer and nonprofit organizations that assist in the development, maintenance, and management of the Trail; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id299bf0033cab46e4a6788ca7f0490d27"><enum>(D)</enum><text>support the Secretary in the development of the comprehensive development plan for the Trail under subsection (c) and annual reports under subsection (f).</text></subparagraph></paragraph></subsection><subsection id="HC5153CB88C9F40AD9FA433A4B39027B3"><enum>(c)</enum><header>Comprehensive Development Plan</header><paragraph id="id84522069133A44898595E4EC12CBDCED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of establishment of the Team under subsection (b), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a comprehensive development plan for the Trail. </text></paragraph><paragraph id="idE88611D030F34CAF8AD8C401903D8FA1"><enum>(2)</enum><header>Recommended inclusions</header><text display-inline="yes-display-inline">The plan submitted under paragraph (1) should—</text><subparagraph commented="no" id="id4CE218059E244BF4937B7C149CD73848"><enum>(A)</enum><text>identify any gaps in the Trail with respect to which the Secretaries have not been able to acquire land or interests in land by purchase from a willing seller, donation, exchange, cooperative agreement, or easement agreement; </text></subparagraph><subparagraph commented="no" id="id9B70CAD9013045E487D013E74CB7531F"><enum>(B)</enum><text>include a plan for closing the gaps identified under paragraph (1) by acquiring land or interests in land or entering into an easement agreement; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3F76EB08A5B64F2B8AD26497DEF6F3CB"><enum>(C)</enum><text>include general and site-specific development plans, including anticipated costs. </text></subparagraph></paragraph></subsection><subsection id="H0DD1D49E91864C9E808CD0B1A9231E4C"><enum>(d)</enum><header>Method of acquisition</header><text>In carrying out this section, the Secretaries—</text><paragraph id="H8C24980257BF431F9D9BDB44429FE988"><enum>(1)</enum><text display-inline="yes-display-inline">may acquire land or an interest in land only by—</text><subparagraph id="id9ECFBF426E3A4D7C8D6D2A6FB30D7340"><enum>(A)</enum><text display-inline="yes-display-inline">purchase from a willing seller with donated or appropriated funds;</text></subparagraph><subparagraph id="id48C14BB9B2A945C4BA33219D030E6A1C"><enum>(B)</enum><text display-inline="yes-display-inline">donation; </text></subparagraph><subparagraph id="id954D03F00D0349BAB16DEF8A4A4F5A66"><enum>(C)</enum><text display-inline="yes-display-inline">exchange; </text></subparagraph><subparagraph commented="no" id="idC0197BB6F6554293BCE4750F4A1F703F"><enum>(D)</enum><text>cooperative agreement; or</text></subparagraph><subparagraph commented="no" id="idD4C6BE1AEA6B4804929779B79613B1E8"><enum>(E)</enum><text>easement agreement; and</text></subparagraph></paragraph><paragraph id="HF99790748BEC4289AF3BDBC441721D91"><enum>(2)</enum><text>may not acquire land or an interest in land by eminent domain. </text></paragraph></subsection><subsection id="HA12B09A20B5C492986E63E5A4DE22B3C"><enum>(e)</enum><header>Maintaining existing partnerships</header><text>In carrying out this section, the Secretaries shall continue to maintain and develop working relationships with volunteer and nonprofit organizations that assist in the development, maintenance, and management of the Trail.</text></subsection><subsection id="H1696AD17666B4E5CB898DF83C388625A"><enum>(f)</enum><header>Reports</header><text>Not later than September 30, 2024, and not later than the end of each fiscal year thereafter until the date on which the comprehensive development plan for the Trail is determined by the Secretary to be fully implemented, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that includes the following:</text><paragraph id="id4587b99acf0e48d9940eec5f42cf677e"><enum>(1)</enum><text>A description of the progress of the Secretaries in acquiring land or interests in land to complete the Trail consistent with this Act.</text></paragraph><paragraph id="ide9927a59e7c640ffb9654dfaa57ab035"><enum>(2)</enum><text>The quantity of land or interests in land acquired during the fiscal year and the amount expended for the land or interests in land.</text></paragraph><paragraph id="iddfd0eda5a4c8456284827173bdf9fcbf"><enum>(3)</enum><text>The quantity of land or interests in land planned for acquisition in the subsequent fiscal year and the estimated cost of the land or interests in land.</text></paragraph><paragraph id="id303fa87744b642d9b1da9aec7b76ccb0"><enum>(4)</enum><text>The estimated quantity of land or interests in land remaining to be acquired after taking into account the acquisitions under paragraphs (2) and (3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6256634616974aeda19e3b3db4d9d6d9"><enum>(5)</enum><text>The existing number of miles of the Trail on Federal land that need to be relocated to provide for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id35F9E68F84974BAEAA9F38F39F07B0BF"><enum>(A)</enum><text>maximum outdoor recreation potential; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E98C9C39925496195D7DEDAF399D56F"><enum>(B)</enum><text>conservation and enjoyment of the nationally significant scenic, historic, natural, or cultural qualities of the areas through which the Trail passes. </text></subparagraph></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id6e97d00e15874f1081704763985c2bfc" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continental Divide National Scenic Trail Completion Act</short-title></quote>.</text></section><section id="id862ae593dd3d4dd8bf714fa6852dc8e6" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idd083e0b4f004480bb1269c5adbade041"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id26cc0f33938b44b79cf6ad4d6be5938d"><enum>(2)</enum><header>Trail</header><text>The term <term>Trail</term> means the Continental Divide National Scenic Trail.</text></paragraph><paragraph id="id9b6178e0c4eb465385e9c205d2028195"><enum>(3)</enum><header>Trail Completion Team</header><text>The term <quote>Trail Completion Team</quote> means the joint Forest Service-Bureau of Land Management Trail completion team established under section 4(a).</text></paragraph></section><section id="idd2833a2a9bd9430896311ac4febde3ca" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Completion of Continental Divide National Scenic Trail</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary and the Secretary of the Interior shall seek to complete the Trail as a continuous route not later than the 50th anniversary of the date of designation of the Trail as a national scenic trail.</text></section><section id="id28f63ff34c704ad28d031b837008bd45" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>4.</enum><header>Trail Completion Team</header><subsection id="id1ba66cf4693846c984ae7ce465608997"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary and the Secretary of the Interior shall establish a joint Forest Service-Bureau of Land Management Trail completion team to work in coordination with the administrator of the Trail—</text><paragraph id="idcd2441233847466182eb3d0ac9690dbb"><enum>(1)</enum><text>to facilitate the completion and optimization of the Trail, consistent with the purposes of the Trail; and</text></paragraph><paragraph id="id0b9e8cca865648cb9d9562610d3a9083"><enum>(2)</enum><text>to assist in the development of the comprehensive development plan for the Trail under section 5.</text></paragraph></subsection><subsection id="idf3da9bdc8ad748b7b87cdd3b0415eba3"><enum>(b)</enum><header>Consultation</header><text>As appropriate, the Trail Completion Team shall consult with other Federal agencies, affected State, Tribal, and local governments, landowners, affected land-grant mercedes owners and users, acequias, and other interested parties in—</text><paragraph commented="no" display-inline="no-display-inline" id="ida0b702bb874944a9b7b2d126938d3b13"><enum>(1)</enum><text display-inline="yes-display-inline">the completion and optimization of the Trail; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57f61beefaab4ef8867ea06e06352413"><enum>(2)</enum><text display-inline="yes-display-inline">the development and completion of the comprehensive development plan for the Trail under section 5.</text></paragraph></subsection></section><section id="id0cf6b1aafbf3457bb6439b33510d7e09" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>5.</enum><header>Comprehensive development plan for the Continental Divide National Scenic Trail</header><subsection id="id1ccb360700d9401eab7aab13ca426fef"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of establishment of the Trail Completion Team under section 4(a), the Secretary shall complete a comprehensive development plan for the Trail.</text></subsection><subsection id="ida26ea56726984cfea697dfd0b53360b6"><enum>(b)</enum><header>Plan inclusions</header><text>The comprehensive development plan under subsection (a) shall—</text><paragraph id="id54e93d725b4b4c058c7505d44087fdbb"><enum>(1)</enum><text>identify any gaps in the Trail for which the Secretary and the Secretary of the Interior have not been able to acquire land;</text></paragraph><paragraph id="ide599b3f7bd3d415c96482968ed49d552"><enum>(2)</enum><text>identify opportunities for the use of easements acquired from willing sellers to facilitate completion of the Trail; and</text></paragraph><paragraph id="id1df83b3a821e429ea465b8b8d3ce2c50"><enum>(3)</enum><text>include general and site-specific Trail development plans, including anticipated costs of the plans.</text></paragraph></subsection></section><section id="id236dae9cca9e4ae4a5ec44fba365b63e" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>6.</enum><header>Partnerships</header><text display-inline="no-display-inline">The Secretary and the Secretary of the Interior shall seek to enter into agreements with volunteer and nonprofit organizations, as appropriate, to facilitate the completion and administration of the Trail.</text></section><section id="id45c793ed8a494ada82a2b6e5d4d30066" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>7.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id3649962d9b2c4cca85354ddc1f073228"><enum>(1)</enum><text display-inline="yes-display-inline">provides any authority to acquire land or interests in land for inclusion in the Trail beyond the authorities provided for the Trail in the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241 et seq.</external-xref>), including acquisition by eminent domain; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8acba5a3d1e466d96c3d828229bf6e0"><enum>(2)</enum><text>makes the acquisition of land or interests in land for the Trail a priority over other land acquisition authorizations. </text></paragraph></section></legis-body><endorsement><action-date date="20240516">May 16, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
