which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XLI of the FAST Act to improve the Federal permitting process, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Permitting Council Improvement Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id78470d2d590f468096e80b49bb3bf39d"><enum>2.</enum><header>Federal permitting improvement</header><subsection commented="no" display-inline="no-display-inline" id="id87a1906dd6ba49dea365a88dd34edaf7"><enum>(a)</enum><header>Definitions</header><text>Section 41001(6) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc5d69fcb2f9a445f81c56878c8ab3e2a"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id60913ae3869c45e1b79a74e0d87f9aed"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35f6f1dcd9664353adb4222ecf010a88"><enum>(B)</enum><text>in the matter preceding subclause (I) (as so redesignated), by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81D78C17429F4571A212BED20160D5DE"><clause commented="no" display-inline="no-display-inline" id="idfde73fdcee43487aa10eb1ea5d3d3bbe"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the term</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86dc40b265ac4cb285e7b02fbfe34642"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id32300EC13D4147388A84947DD3D28C23"><clause commented="no" display-inline="no-display-inline" id="id002905f460324bb781ee29eeacea570f"><enum>(ii)</enum><header>Clarification for requirements needed to complete environmental reviews and authorizations of covered projects</header><text>Notwithstanding clause (i), the Department of Transportation or Army Corps of Engineers shall be subject to the requirements and other provisions of this title for any environmental review or authorization that the agency is required to complete, subject to the conditions that the project is a covered project and is not subject to section 139 of title 23, United States Code, or section 2045 of the Water Resources Development Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/33/2348">33 U.S.C. 2348</external-xref>), as applicable.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ab63dd1de6c4c87a929439397ca0c50"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD6B375D3D6740FD851850075B854A14"><subparagraph commented="no" display-inline="no-display-inline" id="id12fd99206ba94c72bc95f48dbb2bc41e"><enum>(D)</enum><header>Clarification</header><text>For purposes of subparagraph (A)(iii)(III), an activity shall be considered to be located on land owned or under the jurisdiction of a sponsoring entity if any part of the activity is located on that land.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8f8e55e742d14112894667f7ea0dcc1e"><enum>(b)</enum><header>Federal Permitting Improvement Steering Council</header><paragraph commented="no" display-inline="no-display-inline" id="id28e0f1ff26ce409993cecfb3a7d06bf0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 41002 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-1">42 U.S.C. 4370m–1</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2cdb513bde8d4654b5f9cdd8b06ac7fc"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(A), by inserting <quote>, in consultation with the majority leader of the Senate, the Speaker of the House of Representatives, the minority leader of the Senate, and the minority leader of the House of Representatives</quote> after <quote>President</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc56625339bab422994a9abf4a0a384a6"><enum>(B)</enum><text>in subsection (c)—</text><clause commented="no" display-inline="no-display-inline" id="id0be412f69c5e433fa66ddbfee5ce8413"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause commented="no" display-inline="no-display-inline" id="id5c17ec98514e4d60b46574c7e7b1bcbe"><enum>(I)</enum><text display-inline="yes-display-inline">by striking subparagraph (C);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd174a5e8521944659ab971fd6b8659c8"><enum>(II)</enum><text>by redesignating subparagraph (D) as subparagraph (C);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id46dacd9a7a994cd7b7d568096300c2e5"><enum>(III)</enum><text>in subparagraph (C) (as so redesignated), in the matter preceding clause (i), by striking <quote>may recommend to the Director of the Office of Management and Budget or to the Council on Environmental Quality, as appropriate, that guidance be issued as necessary</quote> and inserting <quote>may issue guidance, as necessary,</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3e81c94114ee49d6822ac383a30b4cbd"><enum>(IV)</enum><text>by inserting after subparagraph (C) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D641F8A9D484D1DB629CA6559EE8168"><subparagraph commented="no" display-inline="no-display-inline" id="idbd918f79803a4f72a5309dc8abfe1d37"><enum>(D)</enum><header>Clarification of responsibilities</header><text>Any guidance issued by the Executive Director under subparagraph (C)(i)—</text><clause commented="no" display-inline="no-display-inline" id="id11a865aa64d44460ac9729586a4eb15c"><enum>(i)</enum><text display-inline="yes-display-inline">shall be consistent with the implementing regulations for NEPA promulgated by the Chair of the Council on Environmental Quality and contained in subchapter A of chapter V of title 40, Code of Federal Regulations (or successor regulations); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idba6e713ab27143a9a4785400a7648578"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not supersede those regulations with respect to the implementation of NEPA.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc03a41d8728b46ada2004a5a068b8b13"><enum>(ii)</enum><text>in paragraph (2)(B), in the matter preceding clause (i), by striking <quote>covered projects</quote> and inserting <quote>covered projects and other projects in sectors described in section 41001(6)(A)</quote>.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21e767ff514841c2904fdc3c5fee11af"><enum>(2)</enum><header>Conforming amendments</header><subparagraph commented="no" display-inline="no-display-inline" id="id3aa7f9f2d1e845bca1f345c806a07c1f"><enum>(A)</enum><text>Section 41002(c)(2)(A)(i) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-1">42 U.S.C. 4370m–1(c)(2)(A)(i)</external-xref>) is amended by striking <quote>and the performance schedules under paragraph (1)(C)</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id229edf9b8d2a42be9e47647889dbeb56"><enum>(B)</enum><text display-inline="yes-display-inline">Section 41003(c)(2)(B) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-2">42 U.S.C. 4370m–2(c)(2)(B)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>follow</quote> and all that follows through <quote>relevant factors,</quote> and inserting <quote>take into account relevant factors,</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15f1a90b47f048498d53e71d0b065ce0"><enum>(c)</enum><header>Permitting process improvement</header><text>Section 41003 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-2">42 U.S.C. 4370m–2</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id462d79bdced8433ebf84431f300b6550"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idEC4B314E6E2C4CE6948F73F2FD74CC3C"><enum>(A)</enum><text>by redesignating clauses (ii) through (v) as clauses (iii) through (vi), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id068D10C283704E63994123001EFAEBF8"><enum>(B)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2FB7F408551C43569D1B3F4EF76EC918"><clause commented="no" display-inline="no-display-inline" id="id19E2C6E18E82487882389421F2A81119"><enum>(ii)</enum><text>a statement of the total investment required to plan, design, and construct the proposed project;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ca0304d6d6543a582494f4a345550ef"><enum>(2)</enum><text>in subsection (c)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id55d11943b0ac40fdb5441d0dc3b11ef5"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text><clause commented="no" display-inline="no-display-inline" id="id1e99ef34520441a09ac2aa84f97d53b8"><enum>(i)</enum><text display-inline="yes-display-inline">by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id569EA6F6698E4510A4475CDDE2D796B3"><clause commented="no" display-inline="no-display-inline" id="idafbb3457d66f4d1abd0be0bd08a4dc29"><enum>(i)</enum><header>In general</header><text>The Executive Director, in consultation with appropriate agency officials and the project sponsor, shall, as necessary, mediate any disputes identified by the project sponsor or appropriate agency official for any affected agency relating to the content or timing of the permitting timetable established under subparagraph (A).</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idd8be7d394d6246bc877bade14e8685a0"><enum>(ii)</enum><text>by redesignating clauses (ii) and (iii) as clauses (iii) and (iv), respectively;</text></clause><clause commented="no" display-inline="no-display-inline" id="id45a1ff8cb5f644be90ddd0c5008a04b9"><enum>(iii)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE0196242B7C94FA9B8C731A99582CF5A"><clause commented="no" display-inline="no-display-inline" id="id4baa948c3c6e4c9e8290e579818cef03"><enum>(ii)</enum><header>Modified permitting timetable</header><subclause commented="no" display-inline="no-display-inline" id="id2d62892d711c4af9acd6a0c439097ac3"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">As part of mediating a dispute relating to the content or timing of the permitting timetable established under subparagraph (A), the Executive Director may—</text><item commented="no" display-inline="no-display-inline" id="iddf38f17845a84224931ed27660b119fe"><enum>(aa)</enum><text display-inline="yes-display-inline">propose a new permitting timetable, or modifications to a previously adopted permitting timetable, to resolve the dispute; and </text></item><item commented="no" display-inline="no-display-inline" id="id275e83e3f2cf4e33a6c99e88c33656b7"><enum>(bb)</enum><text display-inline="yes-display-inline">recommend that the affected agencies adopt that new or modified permitting timetable.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id01e2f036d960422e8742a8bde73d7ab8"><enum>(II)</enum><header>Review and response</header><text>Each affected agency shall have 7 business days to review and respond to the new or modified permitting timetable proposed under subclause (I)(aa) and if the agency determines that the agency is unable to adopt that new or modified timetable, that agency shall submit to the Executive Director, in writing, an explanation describing the reasons why the new or modified timetable is not feasible.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id374c59a5bc164754b0bb3b424d89668c"><enum>(iv)</enum><text>in clause (iv) (as so redesignated), in the mattering preceding subclause (I), by striking <quote>clause (ii)</quote> and inserting <quote>clause (iii)</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e677b6699554320a91ad5435917c0b1"><enum>(B)</enum><text>in subparagraph (D)—</text><clause commented="no" display-inline="no-display-inline" id="id15be6e5573464a1aa87b83cd463f76b4"><enum>(i)</enum><text>in clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="id85cea5feff034489a30b9582a9d35870"><enum>(I)</enum><text>in subclause (II), by inserting <quote>or alternative completion date</quote> after <quote>completion date</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ideacbbf9a70574fa6a4932a1638e1249d"><enum>(II)</enum><text>in subclause (IV)—</text><item commented="no" display-inline="no-display-inline" id="id1298545b07a44ee594b4d29b29ec4617"><enum>(aa)</enum><text>by striking <quote>final</quote> each place it appears;</text></item><item commented="no" display-inline="no-display-inline" id="id7206e3451a1149439c286bd036de93da"><enum>(bb)</enum><text>by inserting <quote>or alternative completion date that is the final action</quote> before <quote>under a permitting timetable</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="id0a97486648284efa90ed004b97f62e42"><enum>(cc)</enum><text>by inserting <quote>or alternative completion date established under clause (v)</quote> before <quote>, the facilitating or lead agency</quote>;<italic></italic></text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idac8d9da15f8c485fadfcf73607a5d440"><enum>(ii)</enum><text>in clause (ii)—</text><subclause commented="no" display-inline="no-display-inline" id="id159abf1aee8748019413213a8f99e0ba"><enum>(I)</enum><text display-inline="yes-display-inline">by inserting <quote>or alternative completion date established under clause (v), as applicable,</quote> after <quote>A completion date</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id330bbd8a2934477f800d9900a5684e8c"><enum>(II)</enum><text>by inserting <quote>or alternative completion date, as applicable</quote> after <quote>the completion date</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc639dcd8eec54561b7c1c13100116cd6"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA0B51E6B6D8C42188D227E5E142B08AC"><clause commented="no" display-inline="no-display-inline" id="id0a73330adbe54f3a8637561617e36c3b"><enum>(v)</enum><header>Alternative completion date</header><subclause commented="no" display-inline="no-display-inline" id="id58b3be7693ea4be3bec484e072c21b0e"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text>If a Federal agency has missed or will miss an intermediate or final completion date originally established under subparagraph (A) for agency action on a covered project and fails to comply with the process for modification of a permitting timetable under clause (i), not later than 15 days after that intermediate or final completion date, the agency, in consultation with the facilitating or lead agency, as applicable, any relevant cooperating and participating agencies, and the project sponsor, shall submit to the Executive Director an alternative completion date for publication on the Dashboard.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb01c75d4b64d47f0bc793ae5bb69de9d"><enum>(II)</enum><header>Treatment</header><text>An alternative completion date submitted under subclause (I) shall be subject to the same requirements for modification as other intermediate and final completion dates in the permitting timetable originally established under subparagraph (A).</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8abf4487946546d6bdfa3a6036ed0fb2"><enum>(C)</enum><text>in subparagraph (F)—</text><clause commented="no" display-inline="no-display-inline" id="id1e54b6e7e8484209a4549468a018e04a"><enum>(i)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Conforming to</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Compliance with</header-in-text></quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idefdc520c6303496a8f05c98acc8df3bc"><enum>(ii)</enum><text>in clause (i), by striking <quote>conform to</quote> and inserting <quote>comply with</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id433911ddee6a44d699f132eb7fce2f9b"><enum>(iii)</enum><text>by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A686079F0A34E40A0154EE90814076A"><clause commented="no" display-inline="no-display-inline" id="idcd09988820bb41e687aa049180a9d659"><enum>(ii)</enum><header>Failure to comply</header><subclause commented="no" display-inline="no-display-inline" id="id2f2ce19b6b5e43dda3e81b984c0d3fb0"><enum>(I)</enum><header>In general</header><text>If a Federal agency fails to comply with an intermediate or final completion date for the agency action on a covered project, not later than 5 business days after the date on which the intermediate or final completion date has been or will be missed, the agency shall submit to the Executive Director for publication on the Dashboard an explanation of—</text><item commented="no" display-inline="no-display-inline" id="id9fbb503af7ec46768b1d2d5d7dd93463"><enum>(aa)</enum><text display-inline="yes-display-inline">the specific reasons for failing to comply with the completion date; and </text></item><item commented="no" display-inline="no-display-inline" id="id6995ee3ca90f4ccc876bd197f632f011"><enum>(bb)</enum><text display-inline="yes-display-inline">actions the agency will carry out to avoid additional delays, including actions to comply with the alternative completion date established under subparagraph (D)(v).<italic></italic></text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id218e1fb45ecd4e1096f0fba650dc10c3"><enum>(II)</enum><header>Status report</header><text>If a Federal agency fails to comply with requirements to establish a permitting timetable or the requirement to establish an alternative completion date under subparagraph (D)(v), each month until the month in which the Federal agency has established the permitting timetable or alternative completion date under that subparagraph, the Federal agency shall submit to the Executive Director for posting on the Dashboard a status report describing agency activity related to the project and actions to support the establishment of a permitting timetable or alternative completion date under that subparagraph.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45dd71a70b8c45d38af3ba79314f8ffe"><enum>(D)</enum><text>by redesignating subparagraph (G) as subparagraph (H); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63d98263843c49dbbf5da0e95c40f908"><enum>(E)</enum><text>by inserting after subparagraph (F) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE5BAF2F2B7D2411AB4AB01412B2CF014"><subparagraph commented="no" display-inline="no-display-inline" id="id8d343baa081d4fdd88a0d42667dbd090"><enum>(G)</enum><header>Posting and reporting agency noncompliance with permitting timetable modification and noncompliance procedures</header><clause id="idfeb1c88d7c2744c0bc3c941bfc264d3c"><enum>(i)</enum><header>In general</header><text>Agency noncompliance with the permitting timetable modification procedures under subparagraph (D) or the compliance requirements under subparagraph (F) constitutes noncompliance with this title.</text></clause><clause id="id9393f2af10054f57a7244163d53ef9be"><enum>(ii)</enum><header>Indication of noncompliance</header><text display-inline="yes-display-inline">The Executive Director shall post on the Dashboard, consistent with the requirements of subsection (b)(4)(B), all instances of agency noncompliance with permitting timetables described under subparagraphs (D) and (F). </text></clause><clause id="id9b11c8dd5db249d6858a36b4d786c2fe"><enum>(iii)</enum><header>Quarterly report</header><subclause commented="no" display-inline="no-display-inline" id="id8ff83d8d7f9a431ca33cd34fb4d7368d"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Executive Director shall include in the quarterly agency performance report submitted to Congress pursuant to section 41008(a)(2) all new and ongoing instances of agency noncompliance with subparagraphs (D) and (F). </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id42dfeae047f1414080f5de2df753ca18"><enum>(II)</enum><header>Inclusion of project sponsor comments</header><text display-inline="yes-display-inline">The Executive Director shall offer the relevant project sponsor of a covered project that is in noncompliance with subparagraph (D) or (F) the opportunity to provide for inclusion in the quarterly agency performance report submitted to Congress pursuant to section 41008(a)(2) the views of the project sponsor with respect to—</text><item commented="no" display-inline="no-display-inline" id="id872274e16c184a8bb09933cd039b9622"><enum>(aa)</enum><text display-inline="yes-display-inline">the cause of delay and agency noncompliance; and</text></clause><clause id="id0ecd8a21ce4942cdac3272e4d22a449a"><enum>(ii)</enum><text>makes recommendations for how to improve the Federal permitting workforce.</text></clause></subparagraph><subparagraph id="id101f500ce1c04615818f1fbbfa2de18e"><enum>(B)</enum><header>Report on Dashboard</header><text>Not later than 18 months after the date of enactment of this Act, the Executive Director of the Federal Permitting Improvement Steering Council, in coordination with the Secretary of Transportation and Administrator of General Services, shall submit to Congress a report that assesses, and makes recommendations on how to improve—</text><clause commented="no" display-inline="no-display-inline" id="ide8b77b91ba6345fabf7cb68f8c685eae"><enum>(i)</enum><text display-inline="yes-display-inline">the usability of the Permitting Dashboard required under section 41003(b) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-2">42 U.S.C. 4370m–2(b)</external-xref>); and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1042a6ac4e224a5780604a052f705f64"><enum>(ii)</enum><text display-inline="yes-display-inline">the quality and usefulness of information on the Dashboard.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6943699febb74ed59f084c58485fa997"><enum>(C)</enum><header>Inclusion in annual reports</header><text>The reports required under subparagraphs (A) and (B) may be included in an annual report required to be submitted to Congress pursuant to subsection (a)(1) of section 41008 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-7">42 U.S.C. 4370m–7</external-xref>) (as amended by paragraph (1)(A)).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17d41fe48a99473ab9906f3d1f89e5bd"><enum>(3)</enum><header>Repeal of GAO report</header><subparagraph commented="no" display-inline="no-display-inline" id="id76a1ad75ad294b52ab1e5ff5f41f4b9c"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 41011 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-10">42 U.S.C. 4370m–10</external-xref>) is repealed.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id766dc2923767497e855f30e8e6e06529"><enum>(B)</enum><header>Clerical amendment</header><text>The table of contents contained in section 1(b) of the FAST Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>; 129 Stat. 1319) is amended by striking the item relating to section 41011.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0125be9061794065bfee181f11e6b049"><enum>(e)</enum><header>Funding for governance, oversight, and processing of environmental reviews and permits</header><text>Section 41009 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-8">42 U.S.C. 4370m–8</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcb0b1172eea4433a8442a527b310d476"><enum>(1)</enum><text>in subsection (a), by striking <quote>projects to reimburse the United States for reasonable costs incurred in conducting environmental reviews and authorizations for covered projects.</quote> and inserting <quote>projects.</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c346699f7f64719b79a8082fb3b2d99"><enum>(2)</enum><text>by striking subsections (b) and (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3D920234A30437FA60A1D51E6B2195D"><subsection commented="no" display-inline="no-display-inline" id="ide678b9250f7f483999fbf22e912f54f0"><enum>(b)</enum><header>Fee structure</header><text>The fee structure established under subsection (a) shall—</text><paragraph id="id02a2d4e83ffb431b891aca3f08df4d69"><enum>(1)</enum><text>enable the Executive Director to assess appropriate fees for each covered project based on relevant factors, including—</text><subparagraph id="idde659c0b3323429db7233c002169cc69"><enum>(A)</enum><text>the total investment required for the covered project stated by the project sponsor in the notice of the initiation of a proposed covered project pursuant to section 41003(a)(1);</text></subparagraph><subparagraph id="id35b28b9e598a4701a91801e45d5fee69"><enum>(B)</enum><text>the anticipated complexity of the environmental review and authorization process for the covered project; and</text></subparagraph><subparagraph id="id254b61dc00884319911eeb980f3fa7bb"><enum>(C)</enum><text>the resources available to each participating agency to conduct environmental reviews and issue authorizations for the covered project;</text></subparagraph></paragraph><paragraph id="idbb4c37dff3f74b759faf662df67ed330"><enum>(2)</enum><text>be developed in consultation with affected project proponents, industries, and other stakeholders;</text></paragraph><paragraph id="id072ebad936cb4b28b06c115a4d4e1c23"><enum>(3)</enum><text>not exceed 1 percent of the total investment required for the covered project stated by the project sponsor in the notice of the initiation of a proposed covered project pursuant to section 41003(a)(1); and</text></paragraph><paragraph id="idbe02408198df4712921dac9133f96585"><enum>(4)</enum><text>exclude parties for which the fee would impose an undue financial burden or is otherwise determined to be inappropriate.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideef78e0a973448b5b96af843b3bae4c4"><enum>(3)</enum><text>by redesignating subsections (d) through (f) as subsections (c) through (e), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida591d48bc92a498d88ea3422e9bf99be"><enum>(4)</enum><text>in subsection (c) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id915e3042b315448783215c704038b862"><enum>(A)</enum><text>in paragraph (2), by inserting <quote>making investments to improve Federal environmental reviews and authorizations and supporting infrastructure permitting processes,</quote> after <quote>agency project managers,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3498efb5c2cc4848a335e42340e8ab6e"><enum>(B)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id593136B9D835461EA0C8CC5E2F5C4D08"><paragraph commented="no" display-inline="no-display-inline" id="id98b5bb2c76674f548599da0d64fc3b5d"><enum>(3)</enum><header>Transfer</header><text>For the purpose of carrying out this title, the Executive Director, in consultation with the Director of the Office of Management and Budget, may transfer amounts in the Fund to other Federal agencies, State and local governments, Indian Tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), Alaska Native Corporations, and Native Hawaiian organizations (as defined in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>)) (including the Department of Hawaiian Home Lands and the Office of Hawaiian Affairs) to facilitate timely and efficient environmental reviews and authorizations, including activities described in paragraph (2), for covered projects and other projects in sectors described in section 41001(6)(A), including direct reimbursement agreements with agency CERPOs, reimbursable agreements, and approval and consultation processes and staff for covered projects and other projects in sectors described in section 41001(6)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b82c0e3d977450ea0c1ca8e94cb916f"><enum>(4)</enum><header>Authorization of appropriations</header><subparagraph commented="no" display-inline="no-display-inline" id="id23037bd8aa4e460fb4473e3b1a92f10b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to amounts deposited in the Fund under paragraph (1), there are authorized to be appropriated for deposit in the Fund—</text><clause id="ida48027d47a504d2f94da21ce1c06634c"><enum>(i)</enum><text>for fiscal year 2025, $12,000,000;</text></clause><clause id="id2f8297a59dda4a78b3fe2e2ae7682ffc"><enum>(ii)</enum><text>for fiscal year 2026, $13,500,000;</text></clause><clause id="id15c65dcabba14d30a7a3f8bd4abca1dd"><enum>(iii)</enum><text>for fiscal year 2027, $15,000,000;</text></clause><clause id="id647f3e924fd24916bd16b592b8ac2a53"><enum>(iv)</enum><text>for fiscal year 2028, $16,500,000;</text></clause><clause id="idada60ad602ec49c7a007960c718be682"><enum>(v)</enum><text>for fiscal year 2029, $18,000,000;</text></clause><clause id="idd1fb65cada674684af73ec7aea806b01"><enum>(vi)</enum><text>for fiscal year 2030, $19,500,000; and</text></clause><clause id="idd9f4e9c2c4094b839cc0e464b9e13a7a"><enum>(vii)</enum><text>for fiscal year 2031, $21,000,000.</text></clause></subparagraph><subparagraph id="id58f5cd5482cf499da332188294f33752"><enum>(B)</enum><header>Availability</header><text>Amounts made available pursuant to subparagraph (A) shall remain available until expended.</text></subparagraph></paragraph><after-quoted-block>;
