<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4379</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240521">May 21, 2024</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> (for himself, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, and <cosponsor name-id="S370">Mr. Booker</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to change certain grant requirements for certain students with disabilities, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H051530E0FC714111A8704A9A4FEAF102"><section section-type="section-one" id="HB19411FD7BD54D21B418DE137A6F883C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Grant Flexibility Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H057FF5325B7F4BE59ED57477833E0C6E"><enum>2.</enum><header>Federal Pell Grants</header><text display-inline="no-display-inline">Section 401(b)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a(b)(2)</external-xref>), as amended by section 703 of division FF of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), is amended—</text><paragraph id="H2593711DC70946088B74D0D903A9C879"><enum>(1)</enum><text>by striking <quote>In any case</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H59AF82269C01421ABF7E70B137CDFF85"><subparagraph id="H64C259F63D594BB79161BF26814C210A"><enum>(A)</enum><header>Reduction</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), in any case</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8F28E820379B441183D95A6598164F81"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H69ED89A9CBC64EA1B1891FEB1608DAD2"><subparagraph id="H3A28ACB4288347E09EBE5F58F1F93661"><enum>(B)</enum><header>Students with disabilities</header><clause id="H72F75A075DEF4452B81D80652FBEAB75"><enum>(i)</enum><header>In general</header><text>In the case of a student with a disability (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)) for whom a reduced course load has been approved as a reasonable accommodation under section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>) or the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the student's enrollment in the reduced course load or 5 credits (or the equivalent), whichever is greater, shall be deemed to be enrollment on a full-time basis for purposes of calculating the elements of cost of attendance for such student under paragraphs (2) through (14) of section 472(a) for purposes of determining the amount of the Federal Pell Grant to which the student is entitled. Subsection (b) of section 472 shall not apply with respect to such student.</text></clause><clause id="HCB8F90D42D5B4BBDA0A13E66AD12BC02"><enum>(ii)</enum><header>Limited application</header><text>A determination under clause (i) shall not be used in the calculation of Federal Pell Grant semester eligibility under subsection (d)(5).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id70ce16f59cac4b5c937f7d0e998c01b5"><enum>3.</enum><header>Federal Supplemental Educational Opportunity Grants</header><text display-inline="no-display-inline">Section 413B(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070b-2">20 U.S.C. 1070b–2(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id21FAC9905A4F445892CB22AC8D0363B2"><paragraph commented="no" display-inline="no-display-inline" id="idfdaec1749ccb46c8aaf0bf55a117e36d"><enum>(4)</enum><text>Notwithstanding any other provision of this subpart or part F of this title, in the case of a student with a disability (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)) for whom a reduced course load has been approved as a reasonable accommodation under section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>) or the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the student's enrollment in the reduced course load or 5 credits (or the equivalent), whichever is greater, shall be deemed to be enrollment on a full-time basis for purposes of calculating the elements of cost of attendance for such student under paragraphs (2) through (14) of section 472(a) for purposes of determining the amount of the supplemental grant to which the student is entitled in accordance with the provisions of part F of this title. Subsection (b) of section 472 shall not apply with respect to such student.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6efa652db59f42f9b4065342fc16bdba"><enum>4.</enum><header>TEACH Grants</header><text display-inline="no-display-inline">Section 420M(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070g-1">20 U.S.C. 1070g–1(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id4640510647b64ffcb4c878b8b727cf1e"><enum>(1)</enum><text>in paragraph (1), by striking <quote>In any case</quote> and inserting <quote>Subject to paragraph (3), in any case</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b3cb212a3bd4b19b417327870343874"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E8E733BCA9C4B149CB9A6D0478163BB"><paragraph commented="no" display-inline="no-display-inline" id="id4e13d8745c514440975f5b6c54783fb4"><enum>(3)</enum><header display-inline="yes-display-inline">Teacher candidates with a disability</header><text display-inline="yes-display-inline">In the case of a teacher candidate with a disability (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)) for whom a reduced course load has been approved as a reasonable accommodation under section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>) or the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the teacher candidate's enrollment in the reduced course load or 5 credits (or the equivalent), whichever is greater, shall be deemed to be enrollment on a full-time basis for purposes of calculating the elements of cost of attendance for such student under paragraphs (2) through (14) of section 472(a) for purposes of determining the amount of the grant under this subpart to which the teacher candidate is entitled. Subsection (b) of section 472 shall not apply with respect to such teacher candidate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6A51392060E94928B5D8EE9FC7C0C8A7"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this section shall take effect as if included in section 703 of division FF of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) and subject to the effective date of section 701(b) of such FAFSA Simplification Act, as amended by section 102(a) of the FAFSA Simplification Act Technical Corrections Act (division R of <external-xref legal-doc="public-law" parsable-cite="pl/117/103">Public Law 117–103</external-xref>) (including the authorization provided under section 102(c)(1)(A) of such Act).</text></section></legis-body></bill>
