which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to require, as a condition of receiving Federal Medicaid funding, that States do not prohibit in vitro fertilization (IVF) services, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>IVF Protection Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idcf0406f685324e6b9d24091817c514a9"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id678A10D8C11C474590BE3747E0CD562A"><enum>(1)</enum><text>Since its development in the 1970s, in vitro fertilization (referred to in this section as <term>IVF</term>) has proven itself to be a safe, effective, and reliable means to achieving pregnancy.</text></paragraph><paragraph id="id583BC08B6D174FB1B06AE25411AA362C"><enum>(2)</enum><text>IVF has allowed millions of aspiring parents to experience the miracle of childbirth.</text></paragraph><paragraph id="id8020C3167ABF4111B5FD78DB4E5774F7"><enum>(3)</enum><text>IVF is a pro-woman and pro-family solution for those struggling to have children.</text></paragraph><paragraph id="idB41D2BC9D3C4409091F50CFB802421FE"><enum>(4)</enum><text>IVF has become a symbol of hope for those aspiring to conceive.</text></paragraph><paragraph id="id82DEF011711548DF80DCDF6DF2EA9909"><enum>(5)</enum><text>It is now estimated that nearly 2 percent of all live births in the United States are the result of IVF, resulting in tens of thousands of happy, healthy babies being born annually.</text></paragraph><paragraph id="idCC95FB0ABF584AD6A7DCAFA9DD323B63"><enum>(6)</enum><text>The use of IVF has strengthened our communities and our nation by promoting generations of children and families that otherwise may not have come to be.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id92bdf900ecc34220b369322df3339db7"><enum>3.</enum><header>Medicaid requirement that States do not prohibit IVF services</header><text display-inline="no-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="idF98B82D434714D52834E79867D77D043" style="OLC" act-name=""><subsection id="idA80512D437D1444F958A6C8F9D8F7555"><enum>(uu)</enum><header>Requirement that States do not prohibit IVF services</header><text display-inline="yes-display-inline">As a condition of receiving payments under section 1903(a), a State— </text><paragraph commented="no" display-inline="no-display-inline" id="ida8529a0d5eca45709653f5521878c55f"><enum>(1)</enum><text display-inline="yes-display-inline">shall not prohibit in vitro fertilization (as defined in section 4(b) of the <short-title>IVF Protection Act</short-title>) services; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92cf52e4467d4437861147c2f7672128"><enum>(2)</enum><text>shall ensure that no unit of local government in the State prohibits such services.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id46dadd4725554b97b7d57c39117ee126"><enum>4.</enum><header>No requirement to furnish IVF services</header><subsection commented="no" display-inline="no-display-inline" id="id68a11d33b0ea4520ac7b0ac30c2e005e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Nothing in the <short-title>IVF Protection Act</short-title> shall be construed to compel any individual or organization to provide in vitro fertilization services.</text></subsection><subsection id="idB372E7CDB47846249E403181F79384F0" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">In vitro fertilization defined</header><text display-inline="yes-display-inline">In this section, the term <term>in vitro fertilization</term> means the practice whereby eggs are collected from ovaries and manually fertilized by sperm, for later placement inside of a uterus.</text></subsection></section><section id="id5cd2bc80c4724874af08792c13b16938"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the <short-title>IVF Protection Act</short-title> shall be construed to impede States from implementing health and safety standards regarding the practice of in vitro fertilization (as defined in section 4(b)). </text></section></legis-body></bill>
