<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4336</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240514">May 14, 2024</action-date><action-desc><sponsor name-id="S399">Mr. Hawley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Secretary of Homeland Security from using Federal funds to establish the ICE Secure Docket Card program and to prohibit the use of documentation issued in connection with immigration proceedings to establish eligibility for Federal public benefits.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Taxpayer Funds for Illegal Immigrant Identity Cards Act</short-title></quote>.</text></section><section id="idc7f3af70fe4b40268ca7fd7d08bbf334"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ee0271079484751bfc0f4623910d851"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit the Secretary of Homeland Security from using Federal funds to establish the ICE Secure Docket Card program or any other Federal program that issues free identity cards to aliens who are unlawfully present in the United States.</text></paragraph></section><section id="id7d968b5a4dc44c4f9a77ee78fe1a4cfa"><enum>3.</enum><header>Prohibitions</header><subsection commented="no" display-inline="no-display-inline" id="id5cfce2ae073f45dba6895e346cab0518"><enum>(a)</enum><header display-inline="yes-display-inline">ICE Secure Docket Card</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal funds may be used to establish, implement, or otherwise support the activities of the U.S. Immigration and Customs Enforcement Secure Docket Card program or of any other similar program of the Department of Homeland Security. </text></subsection><subsection id="id2269f4be139942a096769d66067cdc31"><enum>(b)</enum><header>Proof of identification</header><text>No documentation, in any form, which was issued for the primary purpose of providing access to information regarding the status of an individual’s immigration proceedings, may be used as proof of identification for the purpose of establishing eligibility for any Federal public benefit (as defined in section 401(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611(c)</external-xref>)). </text></subsection></section><section id="id4cba2376f9e5401cb0585b50a30a54bc"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline"> Not later than 6 months after the date of enactment of this Act, the Inspector General of the Department of Homeland Security shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that describes the establishment, operation, and any costs associated with the ICE Secure Docket Card program or any other Federal program that issues free identity cards to aliens who are unlawfully present in the United States. </text></section></legis-body></bill>
