require any labor organization that is or would be the collective bargaining representative for any employees to provide information regarding the amount of funds in any defined benefit plan of the labor organization before any labor organization election, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making All Fund Information Available Act</short-title></quote>.</text></section><section id="idfdcff046992a4dc291a094216c45498b"><enum>2.</enum><header>Requirement for labor organizations to provide information regarding defined benefit plans before any labor organization election</header><subsection commented="no" display-inline="no-display-inline" id="id08eb6cfe17cd4d9095ef4e8568829ad6"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ide056bf4402864491b805f5d6472ae90a"><enum>(1)</enum><header>Beneficiary</header><text>The term <term>beneficiary</term> has the meaning given the term in section 3 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id802d56dff6eb461a999b861a7463a318"><enum>(2)</enum><header display-inline="yes-display-inline">Defined benefit plan</header><text>The term <term>defined benefit plan</term> has the meaning given the term in such section of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id459b1f10a3da46dbb703418b406214be"><enum>(3)</enum><header display-inline="yes-display-inline">Employee, employer</header><text>The terms <term>employee</term> and <term>employer</term> have the meanings given such terms in section 2 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbffa8a126412440dac13fbbd142d8131"><enum>(4)</enum><header display-inline="yes-display-inline">Labor organization</header><text>The term <term>labor organization</term> has the meaning given the term in such section of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3a65f779a0d4eb086b765b3194f4d04"><enum>(5)</enum><header>Labor organization election</header><text>The term <term>labor organization election</term> means any election described in section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>), including an election for decertification described in subsection (e) of such section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f1fb7a7782749b1b096d4f841162202"><enum>(6)</enum><header>Participant</header><text>The term <term>participant</term> has the meaning given the term in section 3 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8d56a0f950e44bb09055b18fb471a11c"><enum>(b)</enum><header>Requirement To provide certain information regarding a defined benefit plan</header><paragraph commented="no" display-inline="no-display-inline" id="idd642d26f7d9f421c9e12a4eef457189e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>A labor organization that is the representative of employees of an employer for purposes of collective bargaining in accordance with section 9(a) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159(a)</external-xref>) during a labor organization election, or that would become such a representative of such employees after a labor organization election, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id79237b2f34464a218e2a2d8d14f70392"><enum>(A)</enum><text display-inline="yes-display-inline">not fewer than 3 days before the date of such labor organization election, provide to such employees the notice described in paragraph (2) regarding any defined benefit plan that is or would be available for enrollment by the employees because of representation by the labor organization for purposes of collective bargaining; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idce540df36eab4cfb913dee5ebd73771b"><enum>(B)</enum><text>in the case of such a defined benefit plan that has a percentage of plan liabilities described in paragraph (2)(A)(i) that is less than 100 percent, provide to such employees access to a financial expert (described in paragraph (3)) who is, for the 3 days immediately preceding the date of such labor organization election, able to answer questions regarding such defined benefit plan. </text></subparagraph></paragraph><paragraph id="id10b84725968f48688bafbbf07a7cf6e9"><enum>(2)</enum><header>Notice</header><subparagraph commented="no" display-inline="no-display-inline" id="idef290a3b22214c73a7ae864991160615"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The notice described in this paragraph is a statement that, with respect to a defined benefit plan described in paragraph (1)(A), provides—</text><clause commented="no" display-inline="no-display-inline" id="id569838912da14a16a90c1df8bb22e336"><enum>(i)</enum><text display-inline="yes-display-inline">the percentage of plan liabilities funded, calculated as the ratio between the value of the plan’s assets and liabilities, as of the end of the most recently completed plan year;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida9901ef2846243d58b4e4c4f4b08a105"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an employee who is not a participant in a defined benefit plan described in paragraph (1)(A), the percentage of each dollar of contribution by the employee, if the employee enrolls in such a plan, that—</text><subclause commented="no" display-inline="no-display-inline" id="id27158dc8640d421882f4db809356eb5b"><enum>(I)</enum><text display-inline="yes-display-inline">would be used to provide benefits to the employee (or a beneficiary of the employee); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id35349a47e520400087210876a03dca2e"><enum>(II)</enum><text>would be used to provide benefits to participants of the defined benefit plan (or their beneficiaries) who are enrolled as of the date on which the labor organization election described in paragraph (1) occurs; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5f9683709e174dc4a5978acc578dfc80"><enum>(iii)</enum><text>in the case of a percentage of plan liabilities described in clause (i) that is less than 100 percent—</text><subclause commented="no" display-inline="no-display-inline" id="idf61f1c7f959242528f969a321c90d611"><enum>(I)</enum><text display-inline="yes-display-inline">the ratio between the estimated monthly benefit that a participant or beneficiary would receive at normal retirement age under the defined benefit plan and the estimated monthly benefit that a participant or beneficiary would receive at normal retirement age under the defined benefit plan if such percentage of plan liabilities was 100 percent; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id963548094a464cd3bea969d3cb90f83d"><enum>(II)</enum><text>the estimated amount of the monthly benefit amount that would be paid by the Pension Benefit Guaranty Corporation if the plan is terminated with insufficient assets to pay benefits.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4a5b2596a3a45dbbe907c0b311f06a4"><enum>(B)</enum><header>Information provided in an annual report</header><text>The notice described in subparagraph (A) may quote, in plain language, from the most recently filed annual report provided to the Secretary of Labor or the Pension Benefit Guaranty Corporation under section 104 or 4065 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1024">29 U.S.C. 1024</external-xref>, 1365) with respect to the defined benefit plan described in paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="id1fe8dc8b2f4942319d8703c744fd52fb"><enum>(3)</enum><header>Financial expert</header><text>A financial expert provided by a labor organization in accordance with paragraph (1)(B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4359f43cd29f4a86a07c622cb3f10d61"><enum>(A)</enum><text display-inline="yes-display-inline">shall be—</text><clause commented="no" display-inline="no-display-inline" id="idc6402cabbb334c5fa41258ff54378c28"><enum>(i)</enum><text display-inline="yes-display-inline">independent from the defined benefit plan described in paragraph (1)(A) and the labor organization; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id26a9daa312bf44fc8f3be2af6f69c691"><enum>(ii)</enum><text>provided at no cost to the employees;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8aebf98ece5c412983788851bce04d4a"><enum>(B)</enum><text>may not be compensated using any assets of the defined benefit plan. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33af4a86059f4f3bab61642151d18929"><enum>(4)</enum><header>Availability of materials after election</header><subparagraph commented="no" display-inline="no-display-inline" id="idd3c09d2743c444b6b2e0a20f13342cc6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after a labor organization election described in paragraph (1), a labor organization shall provide to the Office of Labor-Management Standards all written materials (including the notice provided under paragraph (1)(A)), instructions, or handouts provided to employees with respect to the requirements of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2a0b323f18c4244bb2a8c812284af53"><enum>(B)</enum><header>Public availability</header><text>Not later than 30 days after receiving any written materials, instructions, or handouts under subparagraph (A), the Office of Labor-Management Standards shall make such materials, instructions, or handouts publicly available on the website of the Office of Labor-Management Standards. </text></subparagraph></paragraph></subsection><subsection id="id368176E0498D49F984D1C5FE2F905F51"><enum>(c)</enum><header>Enforcement</header><paragraph commented="no" display-inline="no-display-inline" id="idf8fb2348f6cf40ecb11fac04a46dfd59"><enum>(1)</enum><header>Criminal penalties for misleading or false statements</header><subparagraph id="id12c7a3bb6b0c43a9ad18b90f5f9d4eda"><enum>(A)</enum><header>Offense</header><text>It shall be unlawful for any person to lie to or mislead an employee in any notice provided under subsection (b)(1)(A) or with respect to any answers provided under subsection (b)(1)(B).</text></subparagraph><subparagraph id="iddf24a1f265bb4837ae563cb735dcf7cf"><enum>(B)</enum><header>Penalty</header><text>Any person who violates subparagraph (A) shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id777f1318dbb349d0a2443f7a483b9d56"><enum>(2)</enum><header>Private right of action</header><text>Any employee who is adversely affected by an alleged violation of subsection (b) may commence a civil action against any person that violates such section in any court of competent jurisdiction for actual damages. The court may award costs and expenses, including attorney's fees, to an employee in a prevailing action under this paragraph.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idddf2d500c6cc40b2a691fafaea81245b"><enum>(3)</enum><header>Referral</header><text>If the Assistant Secretary of Labor for Employee Benefits Security obtains evidence that any person has engaged in conduct that may constitute a violation of paragraph (1)(A), the Assistant Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8dea4e6633f2466789a3d4e24eac6100"><enum>(A)</enum><text display-inline="yes-display-inline">refer the matter to the Attorney General for prosecution under such paragraph; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2a1cc0c7a4a4b09a3cc712487f0d836"><enum>(B)</enum><text>provide such evidence to the National Labor Relations Board.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80dd1b5846714478ba20f2ba301d358f"><enum>(4)</enum><header>Enforcement by the NLRB</header><text>Section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id987172EDF5364BA5857190A3E92EC980"><subsection commented="no" display-inline="no-display-inline" id="id900d6de26e4e4d3aad9dc90eb8613bc7"><enum>(f)</enum><text>In any case in which the Board determines that the results of an election under this section were influenced by conduct that may constitute a violation of section 2(c)(1)(A) of the <short-title>Making All Fund Information Available Act</short-title> or that a labor organization that is, or would become, the representative of employees after such an election violated section 2(b)(1) of such Act—</text><paragraph commented="no" display-inline="no-display-inline" id="idb7e26da9f8794296aae979f0699e8ac9"><enum>(1)</enum><text display-inline="yes-display-inline">the election shall be invalid; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56d6b2cf5bda4b5f9bbc0504036ed657"><enum>(2)</enum><text display-inline="yes-display-inline">the Board shall set aside the results of such election; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7d07ef0060341f6897edde2c594e972"><enum>(3)</enum><text display-inline="yes-display-inline">a new election may not be held unless the Assistant Secretary of Labor for Employee Benefits Security determines that the labor organization has fulfilled the requirements of section 2(b)(1) of such Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
