<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4302</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240509">May 9, 2024</action-date><action-desc><sponsor name-id="S384">Mr. Tillis</sponsor> (for himself, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S423">Mr. Ricketts</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S399">Mr. Hawley</cosponsor>, and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that individuals convicted of certain crimes relating to institutions of higher education are ineligible for Federal student financial assistance under title IV of the Higher Education Act of 1965, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Higher education Assistance for Mobs of Antisemitic and terrorist Sympathizing Students Act</short-title></quote> or the <quote><short-title>No HAMAS Act</short-title></quote>.</text></section><section id="id2051d6e3726549e59b1cc20acd5fa28f"><enum>2.</enum><header>Suspension of eligibility for financial assistance under the Higher Education Act of 1965</header><subsection commented="no" display-inline="no-display-inline" id="id35abf809c4f140fbb8f5f1d872eb8594"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment</header><text>Section 484 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1A7A58E329714C34AA68BC4C518B0279"><subsection commented="no" display-inline="no-display-inline" id="idb3961cc50c854376af1f27e19aa6362b"><enum>(u)</enum><header>Individuals convicted of trespassing or damaging institutional property</header><paragraph commented="no" display-inline="no-display-inline" id="id4cc83f2b517c4bc9ad01687ae19bcd64"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual described in paragraph (2) shall not be eligible to receive any grant, loan, or work assistance under this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id545631df8df942fa8da813c5d517d09d"><enum>(2)</enum><header>Affected individuals</header><text display-inline="yes-display-inline">An individual described in this paragraph is an individual who is convicted of any offense under any Federal or State law—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0992d7009a764341be7b2c3ab0fb49ee"><enum>(A)</enum><text display-inline="yes-display-inline">based on conduct occurring at and during the course of a protest that occurs at an institution of higher education; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1860f348b947414f974c4559c6832d37"><enum>(B)</enum><text display-inline="yes-display-inline">involving—</text><clause commented="no" display-inline="no-display-inline" id="id8f56364ed4f54fbf91a32f8efd0f2955"><enum>(i)</enum><text display-inline="yes-display-inline">unlawful assembly, rioting, or trespassing on the campus (as such term is defined in section 485(f)(6)) of an institution of higher education; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idb40b685f7b2e49ab93f2fc1d23584a5c"><enum>(ii)</enum><text display-inline="yes-display-inline">damaging property of an institution of higher education.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id980c78db2797486d8230f411ac19221c"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall take effect on the date of enactment of this Act and apply with respect to any grant, loan, or work assistance provided under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>) on or after July 1, 2025. </text></subsection></section></legis-body></bill>
