which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to issue a rule relating to the collection of crashworthiness information under the New Car Assessment Program of the National Highway Traffic Safety Administration, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>She Develops Regulations In Vehicle Equality and Safety Act</short-title></quote> or the <quote><short-title>She DRIVES Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb58b382e28824f269e26e58ed4912184"><enum>2.</enum><header>Crashworthiness standards under NCAP</header><subsection commented="no" display-inline="no-display-inline" id="id696398567b234d02a506f59afa5805f5"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idaf6b90d515534384b0f7071e5789c2be"><enum>(1)</enum><header>Anthropomorphic test device</header><text>The term <term>anthropomorphic test device</term> means a testing device used for compliance testing of motor vehicles and motor vehicle equipment with respect to Federal motor vehicle safety standards that is—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc48dea015f184af8b3afec3915aa69f7"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idd3b262efe6d042bc9cb49b0bf004a337"><enum>(i)</enum><text display-inline="yes-display-inline">described in section 572.5 of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id98f53ece1a804cffb53251037f152323" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">used to determine occupant crash protection, in the determination of the Secretary, in each seating position; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6860301ae0d47898a1b18f5c9ab0d5c"><enum>(B)</enum><text>instrumented with sensors and injury measurement capability at the parts of the body most at risk for injury, including injury measurement for, at a minimum, the acetabulum load, upper and lower thorax displacement, abdominal displacement, ankle angle, and Achilles load.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8eca0f4f0794542b95443fd30aaf919"><enum>(2)</enum><header>Crashworthiness</header><text display-inline="yes-display-inline">The term <term>crashworthiness</term> has the meaning given the term in section 32301 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide21e313c89d8487aac630b353a3d13c6"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="id3346303147a246d0ad626abc6e8558fb"><enum>(b)</enum><header>NCAP testing rule</header><paragraph commented="no" display-inline="no-display-inline" id="idb38306571549430fbce7fdb5df5b0114"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall issue a final rule updating the testing procedures used to test the crashworthiness of passenger motor vehicles under the New Car Assessment Program of the National Highway Traffic Safety Administration, in accordance with paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67a225de2cf64e0fb5c2a30de6d9411b"><enum>(2)</enum><header>Requirements</header><text>The final rule issued under paragraph (1) shall include the following:</text><subparagraph id="id78bbb8d080154d32871f1ef0ff9b9756"><enum>(A)</enum><text>The inclusion of the new generation—</text><clause commented="no" display-inline="no-display-inline" id="id596d042545f2458894c7ab9e8fb78e3f"><enum>(i)</enum><text display-inline="yes-display-inline">50th percentile adult male testing device, as referenced by Regulation Identifier Number 2127–AM20; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id8840207ddba942fd9f1b942067d70110"><enum>(ii)</enum><text display-inline="yes-display-inline">5th percentile adult female testing device, as referenced by Regulation Identifier Number 2127–AM56.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id691bbd8a99184397ba1998702a24e469"><enum>(B)</enum><text>The updating of test procedures and devices, including anthropomorphic test devices, to procedures that mandate the use of the most technologically advanced devices available in the global and domestic markets used in crashworthiness testing and validation.</text></subparagraph><subparagraph id="id73b2f380add847e1a9b435234382508d"><enum>(C)</enum><text>The establishment of new, or refinement of existing, injury criteria, including head, neck, chest, abdomen, pelvis, upper leg, and lower leg injury criteria, with anthropomorphic test devices based on—</text><clause commented="no" display-inline="no-display-inline" id="id92f1641945d4412f802f5fef61ec3805"><enum>(i)</enum><text display-inline="yes-display-inline">real-world injuries; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1a46fe1cb89f4b6d9e5d72f9aeaed9f0"><enum>(ii)</enum><text display-inline="yes-display-inline">the greatest potential to increase safety.</text></clause></subparagraph><subparagraph id="idcca048a12cd641019c49692f505b6344"><enum>(D)</enum><text>The establishment of front seat crashworthiness frontal and side impact tests with anthropomorphic test devices for adult female occupants in all designated front seating positions, including the driving position.</text></subparagraph><subparagraph id="id5113ac366086428ca7e9af9f241270d4"><enum>(E)</enum><text>The establishment of rear seat crashworthiness frontal and side impact tests with anthropomorphic test devices for adult female occupants in all designated rear seating positions.</text></subparagraph><subparagraph id="id1dce8b0f870a422aad007a4801deb8ae"><enum>(F)</enum><text>The establishment of a requirement that the use of digital simulation tests shall be validated by matching physical tests with anthropomorphic test devices.</text></subparagraph></paragraph></subsection><subsection id="id700f8533a25a4b9dbbde0dae79dc0f96"><enum>(c)</enum><header>Continuous updates</header><text>Not later than 2 years after the date on which the Secretary carries out the requirements of this section, and not less frequently than once every year thereafter, the Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id86d60870402b4652b28dcdb11571b761"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate new anthropomorphic test devices; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff10025035624334b72dc52b6c76677b"><enum>(2)</enum><text display-inline="yes-display-inline">if applicable, issue a new rule that requires the use of new anthropomorphic test devices evaluated under paragraph (1) in the tests described in subsection (b)(2).</text></paragraph></subsection><subsection id="id0e1b20ad48584864a08b38d6f0e1a1d0"><enum>(d)</enum><header>Missed deadline; report required</header><text>If the Secretary does not issue the final rule required under subsection (b)(1) by the deadline described in that subsection, the Secretary shall, not later than 30 days after the date on which the deadline elapses, and every 30 days thereafter until the date on which the Secretary issue that rule, submit to Congress a report detailing—</text><paragraph commented="no" display-inline="no-display-inline" id="ided5847f4312e435782ca8b698bb4320e"><enum>(1)</enum><text display-inline="yes-display-inline">the reasons for why the deadline was missed; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id580df9492f8a4e3cb1bb612fd81acb72"><enum>(2)</enum><text display-inline="yes-display-inline">the approximate date on which the Secretary will issue that rule.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id60f2df701c284947af9b799a0e164898"><enum>3.</enum><header>Federal motor vehicle safety standards update</header><subsection commented="no" display-inline="no-display-inline" id="id3b16accffe1b489880a66d2b451bff78"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 30111 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id70686f66a6c446c688ac3bc824f012c8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the first sentence, by inserting <quote>(referred to in this section as the <term>Secretary</term>)</quote> after <quote>of Transportation</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc68476243ce644d899ddbf6d908fa0bf"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE4E16441D61F402E9BB6CE7BAB79581F"><subsection commented="no" display-inline="no-display-inline" id="id815c6e44c2a148ed8f10fee04df45e5a"><enum>(g)</enum><header>Crashworthiness requirements</header><text>In prescribing motor vehicle safety standards under this section that relate to crashworthiness (as defined in section 32301), the Secretary shall use the tests contained in the rule issued by the Secretary pursuant to section 2(b)(1) of the <short-title>She DRIVES Act</short-title>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2913133dfc854c2b8abba6ddd0b015ff"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a)(2) shall take effect on the date on which the Secretary of Transportation issues the rule required under section 2(b)(1).</text></subsection></section></legis-body></bill>
