which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To cancel existing medical debt, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC8F85B447A6D43719FAF7CCBE0201167"><section section-type="section-one" id="HF89C75E7F2D64B66BA61F9801D46BEA8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Debt Cancellation Act</short-title></quote>.</text></section><section id="HE4F2AF3F0FA641779191F42583627C0C"><enum>2.</enum><header>Grants to cancel medical debt owed by patients</header><text display-inline="no-display-inline">Section 2799B–10 of the Public Health Service Act, as added by section 3, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF6D20B92C3ED47DCBE07F11ABD960548"><subsection id="id789EF49EC6414A8BA84D6D36A85A3258"><enum>(e)</enum><header>Grants To cancel medical debt owed by patients</header><paragraph id="id3F14BF8880A244D79BE174F9347F7219"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a grant program under which the Secretary, beginning not later than 1 year after the date of enactment of the <short-title>Medical Debt Cancellation Act</short-title>, awards grants on a competitive basis to hospitals in the United States in order to eliminate all eligible medical debt owed by residents of the United States to such hospitals.</text></paragraph><paragraph id="id9186B748C5AA4734931E983A07605B7F"><enum>(2)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this subsection, a hospital shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id53e4539c23544c55846d812e30d7103d"><enum>(A)</enum><text display-inline="yes-display-inline">submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbbd9c314361146dd982a24e53bc8068b"><enum>(B)</enum><text>agree to submit to the Secretary such reports regarding the use of grant funds as the Secretary may require.</text></subparagraph></paragraph><paragraph id="id435CD0F4CBB64719B9B00F4D466F7E70"><enum>(3)</enum><header>Prioritization</header><text>In awarding grants under this subsection, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc34956a62d344554aea86bf314309917"><enum>(A)</enum><text display-inline="yes-display-inline">prioritize awards to hospitals that—</text><clause commented="no" display-inline="no-display-inline" id="id4978383C37334E83B9F86995490A31EC"><enum>(i)</enum><text display-inline="yes-display-inline">are safety net hospitals; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8E56E5AEEB754C5A821973B8E06E11BF"><enum>(ii)</enum><text>agree to cancel, at a minimum, all medical debt that is—</text><subclause commented="no" display-inline="no-display-inline" id="id872FDBF49BEA46F4861781FA4B9C331A"><enum>(I)</enum><text display-inline="yes-display-inline">15 months old or less; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEFC634CED01D425C9654D99028CCC26F"><enum>(II)</enum><text display-inline="yes-display-inline">owed by low-income and vulnerable patient populations; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3C0B2C70C79D42B49F9E05F47A225DA5"><enum>(III)</enum><text display-inline="yes-display-inline">attributable to emergency and non-elective care; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45ac7123e7084169aee6a5e7a2370018"><enum>(B)</enum><text>ensure that awards are distributed to hospitals across diverse geographical areas of the United States.</text></subparagraph></paragraph><paragraph id="id3A3B8527F50E45C6AA5A49B56DA0B562"><enum>(4)</enum><header>Supplement, not supplant</header><text>Grants awarded to a hospital under this subsection shall be used to supplement, and not supplant, other sources of funding and investments made by the hospital for the purposes of providing financial assistance to patients.</text></paragraph><paragraph id="id9472E5675E9B4A4CB925BC26F4049DF4"><enum>(5)</enum><header>Expansion of medical debt cancellation</header><text>Not later than 2 years after the date of enactment of the <short-title>Medical Debt Cancellation Act</short-title>, the Secretary shall expand the program under this subsection to allow providers and health care facilities other than hospitals, and individuals, to receive medical debt cancellation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3a1f1ac49bc49be99469fbeb2596aa7"><enum>(6)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of the <short-title>Medical Debt Cancellation Act</short-title>, the Secretary shall instruct Federal health care programs to eliminate medical debt collections.</text></paragraph><paragraph id="idF63130ECFA3048B484E2F3591DC7D2B1"><enum>(7)</enum><header>Consultation</header><text>In carrying out this subsection, the Secretary shall consult with relevant Federal agencies, departments, and health programs, patient advocates, community-based organizations with experience in medical debt cancellation, providers, and other key stakeholders.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE5058E6E269145BDAA4A341E91806E6D"><enum>(8)</enum><header>Reporting</header><text>Beginning 2 years after the date of enactment of the <short-title>Medical Debt Cancellation Act</short-title>, and annually thereafter until the date on which the program under this subsection sunsets pursuant to paragraph (10), the Secretary shall submit to relevant congressional committees a progress report on the implementation, administration, and impact of the program under this subsection.</text></paragraph><paragraph id="idfc8efc93afe64229a9d01b3a319e4948"><enum>(9)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2a0f7dceb450416a85ee00fbac2ae5d1"><enum>(A)</enum><text>the term <term>eligible medical debt</term>—</text><clause commented="no" display-inline="no-display-inline" id="idA19953A8739E40F9BBED1763D01E21D6"><enum>(i)</enum><text display-inline="yes-display-inline">means the out-of-pocket unpaid amount owed by a resident of the United States for items or services furnished to such individual by a hospital, provided that—</text><subclause id="id52C6AAF7E5A145E8A48C2D0C0EF8F56D"><enum>(I)</enum><text>such medical debt is in compliance with applicable Federal laws and regulations, including—</text><item id="id4127E410B9764EAE871A92239D748938"><enum>(aa)</enum><text>the medical billing requirements of subsection (a); </text></item><item id="id2DAD3F8C98D941DAA6AB9C12F8864697"><enum>(bb)</enum><text>the medical debt collection requirements of subsection (b); and</text></item><item commented="no" display-inline="no-display-inline" id="id59D3C86B9F95401A9CE11DE08F6C0B13"><enum>(cc)</enum><text>the contracting limitation under subsection (c); </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idb4f88c3fa119492191239edd86d8bac7"><enum>(II)</enum><text display-inline="yes-display-inline">such medical debt is with respect to items and services furnished to an individual on or before the date of enactment of the <short-title>Medical Debt Cancellation Act</short-title>; and</text></subclause><subclause id="id0B0609AA1DAB4537856788A4EB04C83A"><enum>(III)</enum><text>any dispute resolution process under section 2799B–7 is complete; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id697FD4FE637E446EBC89008315BE9E28"><enum>(ii)</enum><text>excludes—</text><subclause commented="no" display-inline="no-display-inline" id="id453c5a6add7f4ca487ef42aaf65fdac3"><enum>(I)</enum><text display-inline="yes-display-inline">any amount paid or payable by any Federal health care program; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5cbc0efa1d3040ba80b8efa1b975db83"><enum>(II)</enum><text>with respect to items and services furnished to an individual by the hospital, any amount that is in excess of the sum of the amount reimbursable by a Federal health care program or other payer and copayment amounts under such a program or other health insurance plan with respect to such items and services.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21fefd73587546f5b869ac55373c6577"><enum>(B)</enum><text>the term <term>Federal health care program</term> has the meaning given such term in section 1128B(f) of the Social Security Act.</text></subparagraph></paragraph><paragraph id="id66C0F531BE9F495097A93C2C0C967961"><enum>(10)</enum><header>Sunset</header><text>The authorities under this subsection shall sunset on the date the Secretary certifies all eligible medical debt in the United States has been canceled under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd8aa12e9161d4cdcbf2038b3120da51d"><enum>3.</enum><header display-inline="yes-display-inline">Requirements for medical billing practices and medical debt collection; medical payment assistance</header><subsection id="H556459D54EA6429090871FD3358BDD05"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part E of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-131">42 U.S.C. 300gg–131 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF93597D084AA44E392054AF8F6E496E5"><section id="HC72BE0CDB0C54EC2BCAE198EA968FA22"><enum>2799B–10.</enum><header>Requirements for medical billing and medical debt collection; medical payment assistance resource</header><subsection id="H1555154F1A1D425FB74114EE7F1867B4"><enum>(a)</enum><header>Medical billing requirements</header><text>In the case of a health care provider or facility that furnishes items or services to an individual, such provider or facility shall, not later than 45 days before the date on which payment for such items or services is due—</text><paragraph id="H11089B4D00B0451E938BAC9D6A165553"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idaa33af8c99cd499d9c50131d91ca7fd7"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether such individual is eligible for assistance with respect to such payment pursuant to the charity care or financial assistance policy of such provider or facility; and</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idf8eb64080c40474aa3f5703396c5ce1a"><enum>(B)</enum><text>if such individual is eligible for such assistance, provide information to such individual regarding such assistance; and</text></subparagraph></paragraph><paragraph commented="no" id="H3019F1FAB2D14B35B540C5CF991D5EEA"><enum>(2)</enum><text display-inline="yes-display-inline">on or after the date on which the medical payment assistance resource list under subsection (d)(1) is made available, provide such individual with such list.</text></paragraph></subsection><subsection id="H11487AADA42D4FF0A8AD6B0C138D35D2"><enum>(b)</enum><header>Medical debt collection requirements</header><paragraph id="H698EFA353A2347B7AC58578943097034"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a health care provider or facility that furnishes items or services to an individual, if payment for such items or services is past due, such provider or facility shall—</text><subparagraph id="H8DC891AF2161496C96BA1B894C77FAF4"><enum>(A)</enum><text>not later than 30 days after the date on which the payment was due, provide to such individual a statement (in clear and understandable language) that includes—</text><clause id="HE27A125C24F847CF9F87A84383DACC6C"><enum>(i)</enum><text>subject to paragraph (2)(A), the total amount of the payment that remains due;</text></clause><clause id="H5D597D4A41F141638BA170DEBE5D8342"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of the attempts made by such provider or facility to determine whether such individual is eligible for assistance (as described in subsection (a)(1)) with respect to the payment; and</text></clause><clause id="HA7BB8FA272894B868BB5F02F1F04C792"><enum>(iii)</enum><text>in each of the 15 most commonly language (other than English), as determined by the Secretary, information about language-assistance services related to the payment that are available to individuals with limited English proficiency; and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HFF38442A955F46959398709B474A6CB8"><enum>(B)</enum><text>not later than 30 days after a payment related to such items or services is made, provide to such individual a detailed receipt of such payment and a statement of the amount that remains due, if applicable.</text></subparagraph></paragraph><paragraph id="H8EEFB003ADEE4036B71F51F0F7B3F012"><enum>(2)</enum><header>Limitations on medical debt amounts</header><subparagraph commented="no" id="H3DC8C3BB17E443C49CED024D540C46C4"><enum>(A)</enum><header>Uninsured individuals</header><text display-inline="yes-display-inline">In the case of items or services furnished to an uninsured individual by an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(r)(2)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(c)(3) of such Code, such organization may not collect payment from such individual with respect to such items or services in an amount greater than the amounts generally billed (within the meaning of section 501(r) of such Code).</text></subparagraph><subparagraph id="HF97201F5226F4222AB83A84B4B12B3FB"><enum>(B)</enum><header>Interest rate</header><text>A health care provider or facility may not collect interest on past-due payments for items or services furnished to an individual. </text></subparagraph></paragraph></subsection><subsection commented="no" id="HDF572B6BAF4A46C980F6469B98F125CA"><enum>(c)</enum><header>Limitation on contracting for purposes of medical billing and medical debt collection</header><text display-inline="yes-display-inline">A health care provider or facility may not enter into a contract with an entity for purposes of collecting payment with respect to items or services furnished by such provider or facility unless such entity agrees to comply with the requirements described in subsections (a) and (b) for such provider or facility with respect to such payment.</text></subsection><subsection id="HB523F77F62B04074B1143ED7C2537BB5"><enum>(d)</enum><header>Medical payment assistance resource list</header><paragraph id="H5FB72909096E4E578312C0AF9E99EB54"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Medical Debt Cancellation Act</short-title>, the Secretary shall make publicly available on the website of the Department of Health and Human Services a comprehensive list of Federal, State, and local programs that provide financial assistance with respect to payment for items or services furnished by a health care provider or facility.</text></paragraph><paragraph id="HF4AD3C8641934A73AA8FDD360000961B"><enum>(2)</enum><header>Updates</header><text>The Secretary shall update the list described in paragraph (1) not less frequently than annually.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7E794FF2216D4C9C9D96D2949BE79E84"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to items and services furnished on or after the date that is 1 year after the date of the enactment of this Act. </text></subsection><subsection id="idE8C14A8316D142BBA64D1466462EF6DD"><enum>(c)</enum><header>Coordination and consultation</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary of Health and Human Services shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id052A57C30D1341239676DCC388EC51B9"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate with relevant Federal departments and agencies, including the Consumer Financial Protection Bureau and the Department of the Treasury; and</text></paragraph><paragraph id="idF3108399FAE049E6A1F65AA13F13E68C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">consult with relevant stakeholders including patient advocates, community-based organizations with experience in medical debt cancellation, and health care providers. </text></paragraph></subsection></section><section id="id5cdb81eec81d47fe842e62ead0b480f1" commented="no"><enum>4.</enum><header>Medical debt collection</header><subsection id="id5FDADA10D8D24A23B3063736F4033C32" commented="no"><enum>(a)</enum><header>Collection of medical debt</header><paragraph commented="no" display-inline="no-display-inline" id="id13067a6e2e69462f8f907cf20b37d522"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692">15 U.S.C. 1692 et seq.</external-xref>) is amended by inserting after section 818 (<external-xref legal-doc="usc" parsable-cite="usc/15/1692p">15 U.S.C. 1692p</external-xref>) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id4D0EDC754C2D4D758DB8EB226E315220"><section id="id45C8B6B404A34E2980FE89BB5C614995" commented="no"><enum>818A.</enum><header>Collection of medical debt</header><subsection id="idFD7C66FD1A644DC0B7C0A1181D76134F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No debt collector or creditor may collect or attempt to collect debt that arose from the receipt of medical services, products, or devices if such debt was incurred by a consumer before the date of enactment of this section.</text></subsection><subsection id="id90E0DAE295DC4A5891CD6E6E6BD99903" commented="no"><enum>(b)</enum><header>Private right of action</header><text display-inline="yes-display-inline">Any consumer who is harmed by a violation of subsection (a) may bring a civil action in the appropriate United States district court against the debt collector or creditor that violated subsection (a) for—</text><paragraph id="id9B63F75C1EA64557B1EC7E0F693F2913" commented="no"><enum>(1)</enum><text>compensatory damages, including for economic losses and for emotional harm;</text></paragraph><paragraph id="id3EE038891C8A4B109407B65A2FB55B89" commented="no"><enum>(2)</enum><text>punitive damages; and</text></paragraph><paragraph id="id88363A4DE07142B997F9867A1C3CE206" commented="no"><enum>(3)</enum><text>reasonable attorney’s fees and costs of the action to a prevailing plaintiff.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide5b9199911dd406081f394add6edf126"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692">15 U.S.C. 1692 et seq.</external-xref>) is amended by inserting after the item relating to section 818 the following:</text><quoted-block style="USC" id="id7561ba15-3f6b-4764-b58f-bbe8be7929e4"><toc><toc-entry level="section" idref="id45C8B6B404A34E2980FE89BB5C614995">818A. Collection of medical debt.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id4DC2F433C7C648E6A89285FEC55B3A00" commented="no"><enum>5.</enum><header>Medical debt reporting</header><subsection id="id71472F9D967D43E79271D2D3CB1F1B65" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD89E4DF7C6444FDEBD6ECD757272EFC9"><paragraph id="id90368EEF1EED4F1BAA97DC232E0ED524" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">Any information related to debt that arose from the receipt of medical services, products, or devices accrued by a consumer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8CAA921D888B43BCBD87361F3B65A862" commented="no"><enum>(b)</enum><header>Notice requirements</header><text display-inline="yes-display-inline">Each credit reporting agency that removes information from the consumer report of a consumer to comply with section 605(a)(9) of the Fair Credit Reporting Act, as added by subsection (a) of this section, shall notify the consumer of the removal.</text></subsection><subsection id="idD4EC581D029D429AA441A5BA7B990126" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall take effect on the date that is 30 days after the date of enactment of this section. </text></subsection></section></legis-body></bill>
