which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Defense to appropriately consider Taiwan for enhanced defense industrial base cooperation activities, and for other purposes.</official-title></form><legis-body><section id="id42afc30798e7479fa8b49b4fd9a55fe0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transpacific Allies Investing in Weapons to Advance National Security Act</short-title></quote> or the <quote><short-title>TAIWAN Security Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida18b895a9c0244a2af2667563d81df8c"><enum>2.</enum><header display-inline="yes-display-inline">Consideration of Taiwan for enhanced defense industrial base cooperation</header><subsection id="id5f210e40ae484c359a7b17e6c97b6d64"><enum>(a)</enum><header>Enhanced defense industrial base cooperation</header><paragraph commented="no" display-inline="no-display-inline" id="id223a8384caed433ba325484434722d9d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consistent with the Taiwan Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/22/3301">22 U.S.C. 3301 et seq.</external-xref>), the Secretary of Defense, in coordination with the Secretary of State and the head of any other relevant Federal department or agency, shall take measures to ensure that Taiwan is appropriately considered for enhanced defense industrial base cooperation activities aligned with the United States National Defense Industrial Strategy to expand global defense production, increase supply chain security and resilience, and meet the defense needs of Taiwan. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ce2a45bd9e8446a9f0bf2259dd066c6"><enum>(2)</enum><header>Elements</header><text>Consideration for enhanced defense industrial base cooperation activities under paragraph (1) shall include the consideration of Taiwan for the following:</text><subparagraph id="iddb390fbe241b48548d02f22d3397d431"><enum>(A)</enum><text>Eligibility for funding to initiate or facilitate cooperative research, development, testing, or evaluation projects with the Department of Defense.</text></subparagraph><subparagraph id="id07e8b186ba4242ab87cc67cdf034314d"><enum>(B)</enum><text>Eligibility to enter into a memorandum of understanding or other formal agreement with the Department of Defense for the purpose of conducting cooperative research and development projects on defense equipment and munitions, with a focus on enhancing the defense industry and supply chain resilience of Taiwan.</text></subparagraph></paragraph></subsection><subsection id="id8c1b8432de834c79a41bfb5977fc9fa7"><enum>(b)</enum><header>Feasibility study</header><paragraph id="id14492661a5584dd1b0c655786dc7367a"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, in coordination with the Secretary of State, the Government of Taiwan, and representatives of the United States defense industry, shall conduct a study on the feasibility and advisability of entering into one or more defense industrial agreements with Taiwan. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c6d4ffaaa3448fc9547924fa701d325"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The study required by paragraph (1) shall—</text><subparagraph id="id034807d21b4b44c9bb432bb97436b015"><enum>(A)</enum><text>evaluate the strategic benefits and implications of entering into a defense industrial agreement with Taiwan, including with respect to—</text><clause id="id29a84cfd502144d8b7d8d7835191ecb2"><enum>(i)</enum><text>long-term supply chain security and resilience;</text></clause><clause id="idb610722758c64328a737fb273f2c98df"><enum>(ii)</enum><text>mutual supply of defense goods and services; </text></clause><clause commented="no" display-inline="no-display-inline" id="id6ca75488967e4f7180b0a3bfdb4c521b"><enum>(iii)</enum><text display-inline="yes-display-inline">supply of regional maintenance, repair, and overhaul capabilities and any other support capability the Secretary of Defense considers appropriate; and</text></clause><clause id="id3518648973d049c9bb69ce2a858e21c4"><enum>(iv)</enum><text>the promotion of interoperability; </text></clause></subparagraph><subparagraph id="idbe8e6cf4f7ec4a229dbb9a948ab0c33c"><enum>(B)</enum><text>account for the legal, economic, and defense policy aspects of a closer defense procurement partnership between the United States and Taiwan; and</text></subparagraph><subparagraph id="id02cda476e1b24966aa50d045a26ea210"><enum>(C)</enum><text>include a list of not fewer than five defense capabilities—</text><clause id="id0407d2958bdb4f37bdff0186a666390a"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4b892c8fa5804d1591184fcec0428056"><enum>(I)</enum><text>developed by, and produced in, Taiwan; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id37daac49338f4cbc95c0c1385273ee05" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">that require expedited licenses for components produced in the United States; or</text></subclause></clause><clause id="id665f79b662154e7d991c0395a501ae2c"><enum>(ii)</enum><text>developed by the United States but for which the United States defense industry cannot meet the demand of Taiwan on a timely basis so as to necessitate production in Taiwan. </text></clause></subparagraph></paragraph><paragraph id="id6b823e47744340e9acd70f52df0bc2ae"><enum>(3)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report on the results of the study conducted under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
