which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To collect information regarding water access needs across the United States, to understand the impacts of the water access gap in each State and territory, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water, Sanitation, and Hygiene Access Data Collection Act of 2024</short-title></quote> or the <quote><short-title>WASH Access Data Collection Act of 2024</short-title></quote>. </text></section><section id="id22a1a8b9d9f649d6920d886d4c504c65"><enum>2.</enum><header>Water and sanitation needs working group</header><subsection id="id0a453325946b4743b438336549a0330c"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idae4ef8423609452c98462855d7773fde"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id3fd3e580755147fdbdf902771eab01c9"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id8b87392045ba407da3be57217cf6fdce"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="idff421cebf4be47be9984e8fdc1b86642"><enum>(A)</enum><text>each of the 50 States;</text></subparagraph><subparagraph id="id18798c5167164385983fb71e3595036b"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="id4c88bdc8a1664e22be110954af941b58"><enum>(C)</enum><text>any territory of the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5404903e8ad4fd3a864b36a5db57d37"><enum>(4)</enum><header>Working Group</header><text>The term <term>Working Group</term> means the Water and Sanitation Needs Working Group established under subsection (b).</text></paragraph></subsection><subsection id="id1ba312c25bd24ed7ae302b699b04f61a"><enum>(b)</enum><header>Establishment</header><text>For the purposes of improving water access for the people of the United States facing water insecurity, preventing significant annual economic losses, and helping the Federal Government prioritize and plan water infrastructure plans more effectively, not later than 180 days after the date of enactment of this Act, the Administrator shall establish a working group, to be known as the <quote>Water and Sanitation Needs Working Group</quote>—</text><paragraph id="idce48c476e7c544bb9673a293ea7a53fb"><enum>(1)</enum><text>to work with a Federal agency or independently to carry out a survey that will estimate the number and approximate geographic distribution of households in the United States that do not have access to drinking water infrastructure or a means for adequate wastewater treatment; and</text></paragraph><paragraph id="id481f92fdbd224c799b290313d3918363"><enum>(2)</enum><text>on the basis of the results of the survey carried out under paragraph (1), to prepare a report for Congress that estimates the cost of capital improvements that would be needed to ensure that all households in the United States have access to reliable drinking water and adequate sanitation, subject to the condition that the Working Group will not be required to collect or report personally identifiable information, but can maintain information with respect to drinking water and sanitation needs based on ZIP Code or another appropriate geographic breakdown.</text></paragraph></subsection><subsection id="id344ac3d6782240218fccffba470d3d00"><enum>(c)</enum><header>Chairperson; membership</header><paragraph id="ida8ade1eee1334e0bb96c3f282bdc041b"><enum>(1)</enum><header>Chairperson</header><text>The Administrator shall serve as the chairperson of the Working Group.</text></paragraph><paragraph id="id5603334c951e47aba21dff233628353a"><enum>(2)</enum><header>Membership</header><text>The Working Group shall comprise senior representatives from such Federal agencies as the Administrator determines to be appropriate, including—</text><subparagraph id="id87d4a4716c8942f3ad51a3afd156731e"><enum>(A)</enum><text>the Department of the Interior, including the Bureau of Indian Affairs and the Bureau of Reclamation;</text></subparagraph><subparagraph id="id0d8ac7451c6748759254bb40c238f2e5"><enum>(B)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id038584264e0b4d4e9f9177f6da511147"><enum>(C)</enum><text>the Census Bureau;</text></subparagraph><subparagraph id="id6babed23575b483b92e5364edcbadd56"><enum>(D)</enum><text>the Department of Health and Human Services, including the Indian Health Service; and</text></subparagraph><subparagraph id="idc915bf08f52f484db1a1c70b95601136"><enum>(E)</enum><text>the Department of Housing and Urban Development.</text></subparagraph></paragraph></subsection><subsection id="id13e5102727314742812007f1b6d5aac5"><enum>(d)</enum><header>Duties</header><text>The Working Group shall—</text><paragraph id="id81d67a5920f04c29ba70efa29563f533"><enum>(1)</enum><text>leverage the expertise of industry, the research community, nongovernmental organizations, and utilities, including through the incorporation of information that could be collected by utilities, circuit riders, and technical assistance providers;</text></paragraph><paragraph id="id29aa37446de14d2c96837368e4d82d8a"><enum>(2)</enum><text>consult, on a regular basis, with States, units of local government, Indian Tribes, and relevant Federal agencies not included in the membership of the Working Group;</text></paragraph><paragraph id="id4fdb486bb0324015ad1327d844ba7b5d"><enum>(3)</enum><text>in carrying out subsection (b)—</text><subparagraph id="id3ef54ec00d2e478f8f2bf40f2b181ae6"><enum>(A)</enum><text>seek to determine whether the decennial census or another existing survey or data collection effort carried out by the Federal Government presents an efficient opportunity for collecting the information described in paragraph (1) of that subsection;</text></subparagraph><subparagraph id="idbfdf58e5d93b4ec1a61686f1cbd152d3"><enum>(B)</enum><text>seek to coordinate Federal programs and policies to support the collection and use of the information described in that subsection;</text></subparagraph><subparagraph id="idba31058c8e544426a0c5c814badab345"><enum>(C)</enum><text>develop a methodology for creating the cost estimate required under paragraph (2) of that subsection; and</text></subparagraph><subparagraph id="id525616275fce4a9eb082f9ac44f80c5b"><enum>(D)</enum><text>oversee the collection of—</text><clause id="id6799a0a8e516492494ac600ce2cb9850"><enum>(i)</enum><text>the information described in paragraph (1) of that subsection; and</text></clause><clause id="id2d1ddf3c6c3a43e583c7a7d83c48f8c2"><enum>(ii)</enum><text>the information necessary to create the cost estimate required under paragraph (2) of that subsection; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0369d7c64c2e479eb8c66fc7d901d282"><enum>(4)</enum><text>establish a national, public index for publishing and linking water access data from Federal sources and State, Tribal, and other non-Federal sources that will be accessible online.</text></paragraph></subsection><subsection id="idd1ce09abd6f64df58185cfba845f9130"><enum>(e)</enum><header>Report on water and sanitation needs</header><text>Not less frequently than once every 5 years, the Administrator shall submit to Congress a report that describes the activities and findings of the Working Group, including—</text><paragraph id="id92444045d1cf4a0f93f1dc0366acdcc5"><enum>(1)</enum><text>an explanation of the methodology used by the Working Group to determine drinking water and sanitation needs;</text></paragraph><paragraph id="idac4bd0e28f2b459e871b82ada470930a"><enum>(2)</enum><text>an estimate of the amount of funds necessary to provide all households with access to reliable drinking water and adequate sanitation; and</text></paragraph><paragraph id="idd4eb18c08031482ba8c88e0efa9b4da1"><enum>(3)</enum><text>a breakdown by State and, if feasible, congressional district of—</text><subparagraph id="idd383fbf492e146ddaba8dd89f1230926"><enum>(A)</enum><text>drinking water and sanitation needs; and</text></subparagraph><subparagraph id="id097cb51b2d304e7fbb31ed017a2e24ce"><enum>(B)</enum><text>the amount of funding required to address those needs.</text></subparagraph></paragraph></subsection><subsection id="iddc169b954bb74dfbaff4c1cd980d6315"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator and other necessary Federal agencies to collect the information and prepare the reports required under this section—</text><paragraph id="id5330f8339472427e865fb32f46320b63"><enum>(1)</enum><text>for each of fiscal years 2025 through 2029, $10,000,000; and</text></paragraph><paragraph id="id5fad7b3911194c2a996258fb369b49ec"><enum>(2)</enum><text>for fiscal year 2030 and each fiscal year thereafter, such sums as may be necessary. </text></paragraph></subsection></section></legis-body></bill>
