which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide greater regional access to the Katahdin Woods and Waters National Monument in the State of Maine, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Katahdin Woods and Waters National Monument Access Act</short-title></quote>.</text></section><section id="ide28239e1e1904a09a60af2552f8b4c99"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4accf7b933e44cf0b3c21b597464a515"><enum>(1)</enum><header>Authorized acquisition area</header><text>The term <term>authorized acquisition area</term> means the designated area outside the boundary of the National Monument depicted as <quote>Authorized Acquisition Area</quote> on the map entitled <quote>Katahdin Woods and Waters National Monument Proposed Boundary Adjustment</quote>, numbered 686/193,181 and dated March 2024.</text></paragraph><paragraph id="id943ba4c204624c5e9936f088592bb59b"><enum>(2)</enum><header>National Monument</header><text>The term <term>National Monument</term> means the Katahdin Woods and Waters National Monument in the State of Maine established by the Proclamation.</text></paragraph><paragraph id="idf0cbbe12d4fc40b19b4024b5674f5ae5"><enum>(3)</enum><header>Proclamation</header><text>The term <term>Proclamation</term> means Presidential Proclamation Number 9476, dated August 24, 2016 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text></paragraph><paragraph id="id4704b27912694e52a934dbd0118b62b9"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="idfffbada209574058a0c9c1d8037129a1"><enum>3.</enum><header>Acquisition of additional land for National Monument</header><subsection id="idff2cd63dc7fe4eb79025d4c1d4dbee9d"><enum>(a)</enum><header>Boundary</header><text>The boundaries of the National Monument shall be the boundaries established by the Proclamation.</text></subsection><subsection id="id6a47da141ca748db840c2c50a87393af"><enum>(b)</enum><header>Acquisition</header><paragraph commented="no" display-inline="no-display-inline" id="id35694412c31d4076a6f04318618c448a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), the Secretary may acquire, by purchase from a willing seller, donation, or exchange, land or interests in land within the authorized acquisition area.</text></paragraph><paragraph id="idb7cacc2632b640f2852509c48f59cfc6"><enum>(2)</enum><header>Prohibition on use of eminent domain</header><text>Nothing in this Act authorizes the use of eminent domain to acquire land or an interest in land.</text></paragraph></subsection><subsection id="iddd888039225c437095d181d27db3b544"><enum>(c)</enum><header>Treatment of acquired land; boundary adjustment</header><text>On acquisition by the Secretary of any land pursuant to subsection (b)—</text><paragraph commented="no" display-inline="no-display-inline" id="id44801fc28ed845f69ebbdf214d88783b"><enum>(1)</enum><text display-inline="yes-display-inline">the land shall be included in the National Monument; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e90a6f170014e7bbbd807a72a61df11"><enum>(2)</enum><text display-inline="yes-display-inline">the boundaries of the National Monument shall be adjusted accordingly.</text></paragraph></subsection></section><section id="id7e3d5044e32841ffa1ccb9482aa9a34a"><enum>4.</enum><header>Administration of National Monument</header><subsection id="ida3f85b305f7a432589322dbc88b79960"><enum>(a)</enum><header>Administration</header><text>The Secretary shall administer the National Monument (including the land added to the National Monument under this Act) in accordance with—</text><paragraph id="idbdb9ec4221b04f2c9ce47db342a0ddba"><enum>(1)</enum><text>this Act;</text></paragraph><paragraph id="idd2f15a464117461a89347a156f5b507c"><enum>(2)</enum><text>the Proclamation; and</text></paragraph><paragraph id="id5eec822f28964aeab0cfbf05c79eb13b"><enum>(3)</enum><text>the laws generally applicable to units of the National Park System.</text></paragraph></subsection><subsection id="id4a3fbdd851f74b12b7a24fe024cc1854"><enum>(b)</enum><header>Hunting, fishing, and outdoor recreation on acquired land</header><text>The Secretary shall allow hunting, fishing, or any other outdoor recreation activity on land acquired pursuant to section 3(b)—</text><paragraph commented="no" display-inline="no-display-inline" id="idb1f5055705f847e0a6b8ebc4a8937f48"><enum>(1)</enum><text display-inline="yes-display-inline">if that activity was in existence on the day before the date of acquisition of the land; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91191050b6db40cb943cb6dbe1c9f4f7"><enum>(2)</enum><text display-inline="yes-display-inline">consistent with the management of that activity under the Proclamation.</text></paragraph></subsection><subsection id="id6803d5839779419baec6ccfe4370d6bc"><enum>(c)</enum><header>Collection of fiddlehead ferns</header><paragraph id="ida32e01439b6240d0aecbac4f3cef5cc5"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall allow the gathering by hand of fiddlehead ferns (Matteuccia struthiopteris) in the National Monument for noncommercial personal use and consumption by the general public.</text></paragraph><paragraph id="id783469c489e245b1a6df8bf9d37aa9db"><enum>(2)</enum><header>Limitation</header><text>If the Secretary determines that the gathering of fiddlehead ferns (Matteuccia struthiopteris) under paragraph (1) may adversely affect resources of the National Monument, the Secretary may limit the gathering of fiddlehead ferns (Matteuccia struthiopteris) under that paragraph in accordance with applicable regulations.</text></paragraph></subsection><subsection id="id96d363b87551488fa9070105b211588c"><enum>(d)</enum><header>Public education</header><text>In accordance with the mission of the National Park Service, the Secretary shall collaborate with local communities and Tribal governments to educate the public regarding the natural environment and history of land management in the National Monument, including the shaping of that landscape by Native communities and practices, successive generations of timber management, and other activities.</text></subsection><subsection id="idaaa12b764b914034a1d20a73f0ef0838"><enum>(e)</enum><header>Forestry</header><text>In accordance with the management plan for the National Monument, the Secretary may conduct such noncommercial timber harvests as the Secretary determines to be necessary.</text></subsection><subsection id="id787490005dd04d5598a2501e5581b74c"><enum>(f)</enum><header>Protection of existing access</header><text>Nothing in this Act affects valid existing rights, including existing rights of access through the National Monument for the removal of timber outside the boundaries of the National Monument.</text></subsection><subsection id="iddbaf86a3f6c44554974bc72ba5a22beb"><enum>(g)</enum><header>Public safety</header><paragraph id="idfeea7e90ef4940eda1f7662f8bb2534d"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide to the public appropriate safety education and notification materials to ensure safe interactions between visitors and logging trucks, equipment, and operations on roads in or adjacent to the National Monument.</text></paragraph><paragraph id="id03857ed124fe452d9bd08d26cc78a1ae"><enum>(2)</enum><header>Procedures</header><text>The Secretary shall collaborate with affected stakeholders to establish procedures to meet the needs of visitors to the National Monument, logging and trucking operations, and other users of roads in or adjacent to the National Monument to ensure safe interactions between active logging operations and visitors.</text></paragraph></subsection></section><section id="id881217642acb4ff4964edbce42a5e2c0"><enum>5.</enum><header>Administrative sites and visitor facilities</header><subsection id="idf6ffb78727734dce9d02b8a037625061"><enum>(a)</enum><header>In general</header><text>To facilitate the administration of the National Monument, the Secretary may acquire, by purchase from a willing seller, donation, or exchange, not more than 10 acres of land or interests in land, including improvements, for the administration of the National Monument and visitor services outside the boundaries, but within the vicinity, of the National Monument.</text></subsection><subsection id="id741342971e514b9e9c9b4e8bb9445508"><enum>(b)</enum><header>Agreements</header><text>The Secretary may enter into agreements with State of Maine, units of Tribal or local government, or private entities—</text><paragraph id="idd0e2d51dbd2947c2abd4e7b29f5c8dc4"><enum>(1)</enum><text>to carry out this section; and</text></paragraph><paragraph id="id8b5e0600d03f472b8e46db2dbdc49072"><enum>(2)</enum><text>to develop a cooperative information center for the National Monument.</text></paragraph></subsection></section></legis-body></bill>
