Definitions. </toc-entry><toc-entry level="section" idref="id4de03a839245462fa7a0e076be51a54b">652. Requirement for rules to appear in agency-specific monthly publication. </toc-entry></toc><section id="HC80E09AC7A2C4039AEC7B9A81B7F2D85"><enum>651.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph commented="no" display-inline="no-display-inline" id="ide39745b2cc98452a8a2c296698c997f0"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idedd2bf8e59274c98abddc570199b12b1"><enum>(2)</enum><header>Agency; agency action; rule; rule making</header><text display-inline="yes-display-inline">The terms <term>agency</term>, <term>agency action</term>, <term>rule</term>, and <term>rule making</term> have the meanings given those terms in section 551 of this title. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4de03a839245462fa7a0e076be51a54b"><enum>652.</enum><header>Agency monthly submission to Office of Information and Regulatory Affairs</header><text display-inline="no-display-inline">On a monthly basis, the head of each agency shall submit to the Administrator, in such a manner as the Administrator may reasonably require, the following information: </text><paragraph id="HA8D27363C7D24908B3F6BF15C65CD841"><enum>(1)</enum><text>For each rule that the agency expects to propose or finalize during the following year—</text><subparagraph id="H50DF63BAE4E44B02984745E0C42048A2"><enum>(A)</enum><text>a summary of the nature of the rule, including the regulation identifier number and the docket number for the rule;</text></subparagraph><subparagraph id="HE902258EC44B4302B6698A394D26CF8E"><enum>(B)</enum><text>the objectives of and legal basis for the issuance of the rule, including—</text><clause id="H500A927351B44FC2B51235F80EB2BF18"><enum>(i)</enum><text>any statutory or judicial deadline; and</text></clause><clause id="HFEE6E65CD5AD4008B255CF1047A989CA"><enum>(ii)</enum><text>whether the legal basis restricts or precludes the agency from conducting an analysis of the costs or benefits of the rule during the rule making, and if not, whether the agency plans to conduct an analysis of the costs or benefits of the rule during the rule making;</text></clause></subparagraph><subparagraph id="H86CB67E55ECA4F418E4FBE8E4FE50A12"><enum>(C)</enum><text>whether the agency plans to claim an exemption from the requirements of section 553 of this title pursuant to section 553(b)(B);</text></subparagraph><subparagraph id="H0C821195C1F4472C93F525C769635737"><enum>(D)</enum><text>the stage of the rule making as of the date of submission; and</text></subparagraph><subparagraph id="H1D5F5F3B4D14490BBEA8F23F4B8D19FC"><enum>(E)</enum><text>whether the rule is subject to review under section 610 of this title.</text></subparagraph></paragraph><paragraph id="HE7304352BC7640CD91B8505FDF137AC4"><enum>(2)</enum><text>For each rule that the agency expects to finalize during the following year and for which the agency has issued a general notice of proposed rule making—</text><subparagraph id="H6131047109DF43C49D04FD92AF37A088"><enum>(A)</enum><text>an approximate schedule for completing action on the rule;</text></subparagraph><subparagraph id="H4346A42261DC4FC1B3B8D785CAE1C21E"><enum>(B)</enum><text>an estimate of whether the rule will cost—</text><clause id="H3D018A1790CE4BC580F80AD7103EEDAF"><enum>(i)</enum><text>less than $50,000,000;</text></clause><clause id="HD0D9D2A2A7F94E959C53D5E1C587A8D4"><enum>(ii)</enum><text>$50,000,000 or more but less than $100,000,000;</text></clause><clause id="H4E76AD01D7174D8B92EC8E1A9F641F07"><enum>(iii)</enum><text>$100,000,000 or more but less than $500,000,000;</text></clause><clause id="H79ED8B5DD4734BC8AD7747BC0979C658"><enum>(iv)</enum><text>$500,000,000 or more but less than $1,000,000,000;</text></clause><clause id="H3110C079161A4D43BA12129848756A6C"><enum>(v)</enum><text>$1,000,000,000 or more but less than $5,000,000,000;</text></clause><clause id="H0FE54E61CF4B444FA57AA44FCCE9B30A"><enum>(vi)</enum><text>$5,000,000,000 or more but less than $10,000,000,000; or</text></clause><clause id="H2FF4AC5D315241F9BC6C86BE1A8DDCF1"><enum>(vii)</enum><text>$10,000,000,000 or more; and</text></clause></subparagraph><subparagraph id="H9052D17F7E7D43A5AEE31ECDA43FB1C2"><enum>(C)</enum><text>any estimate of the economic effects of the rule, including—</text><clause commented="no" display-inline="no-display-inline" id="id8e58f6f36d834177b1b150187f74f6c4"><enum>(i)</enum><text display-inline="yes-display-inline">any estimate of the net effect that the rule will have on the number of jobs in the United States that was considered in drafting the rule; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id4b5bdc8f08594c1482418becb71c7fe9"><enum>(ii)</enum><text display-inline="yes-display-inline">if an estimate is not available, a statement affirming that no information on the economic effects of the rule, including the effect the rule will have on the number of jobs in the United States, has been considered.</text></clause></subparagraph></paragraph></section><section id="HBA7F04FFE48D4C4F8821301FEE3345FD"><enum>653.</enum><header>Office of Information and Regulatory Affairs publications</header><subsection id="H9B262808BCB0438692CB90C756065BEA"><enum>(a)</enum><header>Agency-Specific information published monthly</header><text>Not later than 30 days after the submission of information pursuant to section 652, the Administrator shall make the information publicly available on the internet.</text></subsection><subsection id="H4C21B0E95B4C426EA65C2677C5217389"><enum>(b)</enum><header>Cumulative assessment of agency rule making published annually</header><paragraph id="H7273F4C7ADAD47DBABA241FC7204DE5E"><enum>(1)</enum><header>Publication in the Federal register</header><text>Not later than October 1 of each year, the Administrator shall publish in the Federal Register, for the 1-year period immediately preceding the date of publication of this information, the following:</text><subparagraph id="H10E52ADA9DA9477593C2D920D4CF9242"><enum>(A)</enum><text>The information that the Administrator received from the head of each agency under section 652.</text></subparagraph><subparagraph id="HCFCD2FAA4F0C44BF9628BDD430CD3DA8"><enum>(B)</enum><text>The number of rules and a list of each rule—</text><clause id="H712DA82415B54600AE0F8DED3E3841D9"><enum>(i)</enum><text>that was proposed by each agency, including, for each rule, an indication of whether the issuing agency conducted an analysis of the costs or benefits of the rule; and</text></clause><clause id="HE86ABB441FA04F0DA2A47CE215EA0785"><enum>(ii)</enum><text>that was finalized by each agency, including for each rule an indication of whether—</text><subclause id="H366065D7F02C4A0BACB91D0C77988D44"><enum>(I)</enum><text>the agency conducted an analysis of the costs or benefits of the rule;</text></subclause><subclause id="H6895E3F549DC43289F100DE721CE7CB5"><enum>(II)</enum><text>the agency claimed an exemption from the procedures under section 553 of this title pursuant to section 553(b)(B); and</text></subclause><subclause id="H471720EDF7874D03B6A5D0B22902FCC8"><enum>(III)</enum><text>the rule was issued pursuant to a statutory mandate or the rule making is committed to agency discretion by law.</text></subclause></clause></subparagraph><subparagraph id="HD018017616A341098AED0697037FC36D"><enum>(C)</enum><text>The number of agency actions and a list of each action taken by each agency that—</text><clause id="HF683379DDB3E4DFEB474B875C4D6D3A3"><enum>(i)</enum><text>repealed a rule;</text></clause><clause id="HC8E84CBE1CF64C969757BE11E36CEE62"><enum>(ii)</enum><text>reduced the scope of a rule;</text></clause><clause id="HF47F352D66AB44A3B164EB86BD3C72C8"><enum>(iii)</enum><text>reduced the cost of a rule; or</text></clause><clause id="H4C3B13CE2E0F4360ADD35531F24E065A"><enum>(iv)</enum><text>accelerated the expiration date of a rule.</text></clause></subparagraph><subparagraph id="H3104AC58C5E946629D23BC759B72DA49"><enum>(D)</enum><text>The total cost (without reducing the cost by any offsetting benefits) of all rules proposed or finalized, and the number of rules for which an estimate of the cost of the rule was not available.</text></subparagraph></paragraph><paragraph id="H4CCCFF12F4E6476BAADC860507A9046E"><enum>(2)</enum><header>Publication on the internet</header><text>Not later than October 1 of each year, the Administrator shall make publicly available on the internet, for the 1-year period immediately preceding the date of publication of this information, the following:</text><subparagraph id="H64700B26107F4B8580CE13D07B48980A"><enum>(A)</enum><text>The analysis of the costs or benefits, if conducted, for each proposed rule or final rule issued by an agency.</text></subparagraph><subparagraph id="H6C408EF185984E0DAE1124D3D259FAF7"><enum>(B)</enum><text>The docket number and regulation identifier number for each proposed or final rule issued by an agency.</text></subparagraph><subparagraph id="H417CD18C30784C3281F7504A2C3E85E2"><enum>(C)</enum><text>The number of rules and a list of each rule reviewed by the Director of the Office of Management and Budget, and the authority under which each review was conducted.</text></subparagraph><subparagraph id="H6A0F9F606B624915AD5A497398F83155"><enum>(D)</enum><text>The number of rules and a list of each rule for which the head of an agency completed a review under section 610 of this title.</text></subparagraph><subparagraph id="HD4E82E8CD5414E9186A80FDDC17EF4E3"><enum>(E)</enum><text>The number of rules and a list of each rule submitted to the Comptroller General of the United States under section 801 of this title.</text></subparagraph><subparagraph id="H3A00076204924E66B6041B534637D52D"><enum>(F)</enum><text>The number of rules and a list of each rule for which a resolution of disapproval was introduced in either the House of Representatives or the Senate under section 802 of this title.</text></subparagraph></paragraph></subsection></section><section id="H8E83B245CCF748E9926C982B03C2CE99"><enum>654.</enum><header>Requirement for rules to appear in agency-specific monthly publication</header><subsection id="H908C6231EC764965AE87E6E9425D8777"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), a rule may not take effect until the information described in section 652 regarding the rule has been made publicly available on the internet pursuant to section 653(a) for not less than 6 months.</text></subsection><subsection id="H1EFC55218AC2436E97012665047163EA"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) shall not apply in the case of a rule—</text><paragraph id="HE0B2616A9DAD49ABBDEB8F83A7C4F9AF"><enum>(1)</enum><text>for which the agency issuing the rule claims an exception under section 553(b)(B) of this title; or</text></paragraph><paragraph id="H5C4AFF9F251647898435C30D1ECABB87"><enum>(2)</enum><text>which the President determines by Executive order should take effect because the rule is—</text><subparagraph id="HDBF9ABE0A8CD435DA5F126E744F2849E"><enum>(A)</enum><text>necessary because of an imminent threat to health or safety or other emergency;</text></subparagraph><subparagraph id="H21B1D70471C84B0CB56BA459247516C8"><enum>(B)</enum><text>necessary for the enforcement of criminal laws;</text></subparagraph><subparagraph id="H5993F86A781A49088ED4FA91A29CA461"><enum>(C)</enum><text>necessary for national security; or</text></subparagraph><subparagraph id="H3042F48883684B41804158E520D30456"><enum>(D)</enum><text>issued pursuant to any statute implementing an international trade agreement.</text></subparagraph></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H2BC249C4F5574964BD78A7E66B525B77"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of chapters for part I of title 5, United States Code, is amended by striking the item relating to chapter 5 and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HCAACD81D2C03414F9633E47B4D391202"><toc regeneration="no-regeneration"><multi-column-toc-entry level="chapter" bold="off"><toc-enum>5. </toc-enum><level-header level="chapter">Administrative Procedure</level-header><target>500</target></multi-column-toc-entry><multi-column-toc-entry level="chapter" bold="off"><toc-enum>6. </toc-enum><level-header level="chapter">The Analysis of Regulatory Functions</level-header><target>601</target></multi-column-toc-entry><multi-column-toc-entry level="chapter"><toc-enum>6A. </toc-enum><level-header level="chapter">Office of Information and Regulatory Affairs Publication of Information Relating to Rules</level-header><target>651</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H21A577E731164168927EFE0FA58425BD"><enum>(c)</enum><header>Effective dates</header><paragraph id="H19E76B36B51D4450B4B4453815C26265"><enum>(1)</enum><header>Agency monthly submission to the Office of Information and Regulatory Affairs</header><text>Not later than 30 days after the date of enactment of this Act, the head of each agency shall submit to the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget the information required under section 652 of title 5, United States Code, as added by subsection (a) of this Act.</text></paragraph><paragraph id="H5E9512FBACDD4C1BBECCB5D68BD2BFE0"><enum>(2)</enum><header>Cumulative assessment of agency rule making</header><subparagraph id="H0105A74CA508403AAC0F715F33E6CCEC"><enum>(A)</enum><header>In general</header><text>Subsection (b) of section 653 of title 5, United States Code, as added by subsection (a) of this Act, shall take effect on the date that is 60 days after the date of enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a48493854274e00b04017544f1b98ea"><enum>(B)</enum><header>Deadline</header><text>The first requirement to publish or make available, as the case may be, under subsection (b) of section 653 of title 5, United States Code, as added by subsection (a) of this Act, shall be the first October 1 after the effective date of subsection (b).</text></subparagraph><subparagraph id="H14034C09B0E84472BDB0FFF0626072C4"><enum>(C)</enum><header>First publication</header><text>The first publication made available under section 653(b)(2) of title 5, United States Code, as added by subsection (a) of this Act, shall include any analysis of the costs or benefits conducted for a proposed or final rule during the 10 years preceding the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="H543C790B57D5437398D251A8A747C6A0"><enum>(3)</enum><header>Requirement for rules to appear in agency-specific monthly publication</header><text>Section 654 of title 5, United States Code, as added by subsection (a) of this Act, shall take effect on the date that is 8 months after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
