Restoring the Federal Trade Commission's ability to promulgate rules on children's advertising.</toc-entry></toc></subsection></section><title style="OLC" commented="no" level-type="subsequent" id="idf66b79a89aed42b38d80a9a1748b4dea"><enum>I</enum><header>Department of Health and Human Services</header><section id="id09363bcf03c0467fb5a1f1a5f408f8f4"><enum>101.</enum><header>Health warning labeling of foods; restriction on certain advertisements directed at children</header><subsection commented="no" display-inline="no-display-inline" id="id3a4fa8e2ecb748a6834428875ca5e44f"><enum>(a)</enum><header display-inline="yes-display-inline">Health warning labeling</header><text display-inline="yes-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2c2783a333694ed48c0d4ab01cdad445"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F6DC8E8E6354F0282B859902956AA57"><subsection id="id0dad313c8c0e4ab2800f21c4fdc0909d"><enum>(z)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ided0c7ded79e34cb9bd147ae9b657fff5"><enum>(1)</enum><text>If it is a sugar-sweetened beverage intended for human consumption and is offered for sale, unless its label includes the following statement: <quote>Food and Drug Administration Warning: Drinking beverages with added sugar can contribute to obesity, type-2 diabetes, and tooth decay. Not recommended for children.</quote>, and such statement is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9bfd1365f4914e2d9c07358668e1efd7" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">enclosed by a rectangular border in bold type and readily legible under ordinary conditions alongside an icon comprised of an exclamation point contained within a triangle; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id9e14958f5d3d4b4994f8cfc47762130f"><enum>(B)</enum><text display-inline="yes-display-inline">prominently displayed on the front, or the principal display, of the container, using not less than 5 percent of the area of the front, or the principal display, of the container, and, as applicable, on 2 sides of any multi-pack packaging or on the exterior of any vending machine or self-service machine from which the beverage is available.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="ide45d1678bf354ba7b8273b73ec7f90ba"><enum>(2)</enum><text>If it is a food, including a beverage, containing any non-sugar sweetener intended for human consumption and is offered for sale, unless its label includes the following statement: <quote>Food and Drug Administration Warning: Contains non-sugar sweeteners. Not recommended for children.</quote>, and such statement is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5EA9EF80F7C047A4BD2733243CB8679A"><enum>(A)</enum><text display-inline="yes-display-inline">enclosed by a rectangular border in bold type and readily legible under ordinary conditions alongside an icon comprised of an exclamation point contained within a triangle; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5556463b88c4138a6bf1a19f248b756"><enum>(B)</enum><text display-inline="yes-display-inline">prominently displayed on the front, or the principal display, of the container, using not less than 5 percent of the area of the front, or the principal display, of the container, and, as applicable, on 2 sides of any multi-pack packaging or on the exterior of any vending machine or self-service machine from which the food is available.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id4ab735c64fc7437e9ef1410ceaf5422a"><enum>(3)</enum><text display-inline="yes-display-inline">If it is an ultra-processed food, including a beverage, intended for human consumption and is offered for sale, unless its label includes the following statement: <quote>Food and Drug Administration Warning: Consuming ultra-processed foods and drinks can cause weight gain, which increases the risk of obesity and type-2 diabetes.</quote>, and such statement is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1bc9803c86644e2c8253cbc819c4bc17"><enum>(A)</enum><text display-inline="yes-display-inline">enclosed by a rectangular border in bold type and readily legible under ordinary conditions alongside an icon comprised of an exclamation point contained within a triangle; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E84E765ED384709A3E5311B43CA0406"><enum>(B)</enum><text display-inline="yes-display-inline">prominently displayed on the front, or the principal display, of the container, using not less than 5 percent of the area of the front, or the principal display, of the container, and, as applicable, on 2 sides of any multi-pack packaging or on the exterior of any vending machine or self-service machine from which the food is available.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id2d8a05ae845647f3859a053612f747a8"><enum>(4)</enum><text display-inline="yes-display-inline">If it is a food, including a beverage, intended for human consumption and is offered for sale, and such food contains a nutrient of concern, such as added sugar, saturated fat, or sodium, or any other nutrient of concern, as the Secretary determines appropriate, at a level that increases, for individuals in the general population, the risk of disease or a health-related condition, as defined by the Secretary, unless its label includes the following statement for each nutrient of concern: <quote>High in</quote>, followed by the specific nutrient of concern, and such statement is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id264a39eb3fd641beadb38874f02ec8c5"><enum>(A)</enum><text display-inline="yes-display-inline">enclosed by an octagon border in bold type and readily legible under ordinary conditions; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6505f10d81b4079a3ee51fb64af2445"><enum>(B)</enum><text display-inline="yes-display-inline">prominently displayed on the front, or the principal display, of the container, using not less than 5 percent of the area of the front, or the principal display, of the container, and, as applicable, on 2 sides of any multi-pack packaging or on the exterior of any vending machine or self-service machine from which the food is available.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="idc091d7fc26e6489680fb13921df7b22c"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall promulgate regulations to apply the labeling requirements under subparagraphs (1), (2), (3), and (4) with respect to food offered for sale by online retailers.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id8cf7ef8ee9b1495ea3781f4c0e62ab8c"><enum>(6)</enum><text display-inline="yes-display-inline">For purposes of this paragraph—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida51c2d611bee4e3484ad6d08ef5c170e"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>non-sugar sweetener</term>—</text><clause commented="no" display-inline="no-display-inline" id="id445583bfa52c4ec582763a9d31a2662a"><enum>(i)</enum><text display-inline="yes-display-inline">means any synthetic, naturally-occurring, or modified non-nutritive sweetener that is not classified as sugar and is used as an ingredient in manufactured food, or sold on its own to be added to food; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id542930f91b36421b80eb1b0c5c005300"><enum>(ii)</enum><text display-inline="yes-display-inline">includes acesulfame K, aspartame, advantame, cyclamates, monk fruit, neotame, saccharin, sucralose, stevia, and stevia derivatives;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide80f0983a4a9421d8627d390ddeed7e3"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>sugar-sweetened beverage</term>—</text><clause commented="no" display-inline="no-display-inline" id="ida7f5563e2cc24742a300ae78421a7002"><enum>(i)</enum><text display-inline="yes-display-inline">means any beverage intended for human consumption to which one or more caloric sweeteners has been added and that contains 25 or more calories per 12 fluid ounces of beverage; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8adb04e29deb46f2a4ec045a7607e884"><enum>(ii)</enum><text display-inline="yes-display-inline">includes drinks and beverages commonly referred to as <quote>soda</quote>, <quote>pop</quote>, <quote>cola</quote>, <quote>soft drinks</quote>, <quote>sports drinks</quote>, <quote>energy drinks</quote>, <quote>slushies</quote>, <quote>sweetened ice tea</quote>, <quote>fruit juice</quote>, or any other drinks and beverage; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd4ab52af53f249d298ee5a46c214fa96"><enum>(iii)</enum><text display-inline="yes-display-inline">does not include—</text><subclause commented="no" display-inline="no-display-inline" id="ide2a9bb8bb71343548bdbbfc4295d1be4"><enum>(I)</enum><text display-inline="yes-display-inline">infant formula or oral rehydration fluids for children; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id15c61bfe7a3541dd8dbae19d81f96222"><enum>(II)</enum><text display-inline="yes-display-inline">any beverage for medical use; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6f4163f97a7d4d73994934691ce55ac3"><enum>(III)</enum><text display-inline="yes-display-inline">any beverage designed as supplemental, meal replacement, or sole-source nutrition that includes proteins, carbohydrates, and multiple vitamins and minerals; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddaf1c89d34654f15bfb29250ce9a55d6"><enum>(IV)</enum><text display-inline="yes-display-inline">any milk product; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc05fe3c5bcc344c9ab68e8031cedb191"><enum>(V)</enum><text display-inline="yes-display-inline">100 percent natural fruit or vegetable juice with no added caloric or non-sugar sweetener; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id37521dc78b894c2a9a92fc6303dd9305"><enum>(VI)</enum><text display-inline="yes-display-inline">any alcoholic beverage; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7678bb6eeca14291bdf7b345a66cbdff"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>ultra-processed food</term>—</text><clause commented="no" display-inline="no-display-inline" id="id96166efdeef34d498a0f25d14dddbf91"><enum>(i)</enum><text display-inline="yes-display-inline">for the period before the effective date of the regulations under subclause (ii), means a food, including a beverage, containing one or more industrial ingredients, including surface-active agents, stabilizers and thickeners, propellants, aerating agents and gases, color and coloring adjuncts, emulsifiers and emulsifier salts, flavoring agents and adjuvants, flavor enhancers, surface-finishing, non-sugar sweeteners, and other ingredients, as the Secretary determines appropriate; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id73469b3c4ddd48e69c642616aeee9106"><enum>(ii)</enum><text display-inline="yes-display-inline">has the meaning given such term in regulations promulgated by the Secretary, not later than 1 year after the National Academies of Science, Engineering, and Medicine issues a report pursuant to section 201(c) of the <short-title>Childhood Diabetes Reduction Act of 2024</short-title>, taking into consideration the recommendations included in such report, for the period beginning on the effective date of such regulations.</text></clause></subparagraph></paragraph></subsection><after-quoted-block> and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id375bd906bada4e9d8133ca89b032b3a6"><enum>(2)</enum><text>in paragraph (r)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide8eda1535a3048dca67a36f3788e1b88"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (2)(A)(vi), by inserting <quote>, including if the Secretary determines that the food is high in added sugar, saturated fat, sodium, or any other nutrient of concern (as determined by the Secretary pursuant to paragraph (z)(4)), or if the food contains non-sugar sweetener or is an ultra-processed food (as defined in paragraph (z)(6)(C))</quote> before the period at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a4c663c637d4a1dab682777809c9426"><enum>(B)</enum><text>in subparagraph (3)(A)—</text><clause commented="no" display-inline="no-display-inline" id="id3a9969e22a2f4f13b5ecde046a69ef16"><enum>(i)</enum><text display-inline="yes-display-inline">in subclause (i), by striking <quote>, and</quote> and inserting a semicolon;</text></clause><clause commented="no" display-inline="no-display-inline" id="id346d2f84a1f247558a34585b0a9c6a8a"><enum>(ii)</enum><text>in subclause (ii), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7a6b4a9bbc83494c90d632b83fb2f612"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA6598A092D4C46F19407397F95175CF3"><clause id="id1a6ab5be16c1406d9315412480403c52" indent="up2"><enum>(iii)</enum><text>if the food is not required to include a nutrition warning label under subparagraph (1), (2), (3), or (4) of paragraph (z).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida0ae26a252e148719a77cfd519217695"><enum>(b)</enum><header>Advertising</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idDB68325A29AA4A53A3824B0775278F56"><subsection id="id764525fb1dd1445d9f6e25b9ad3333fc" commented="no"><enum>(jjj)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idb6f727e08df04241895227953eddc443"><enum>(1)</enum><text>Marketing or advertising a food for which labeling is required under section 403(z), in a manner that reasonably appears to be directed at children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id016ac4deef2c44599f4144eac0e4e1c2" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In determining whether any marketing or advertising reasonably appears to be directed to children for purposes of subparagraph (1), the Secretary shall consider the totality of the circumstances, including whether such marketing or advertising uses themes or promotional strategies for food described in section 403(z) that appeal to children, such as the use of fun or fantasy themes, athletes and celebrities, cross-promotions using fictional characters, cartoon characters, social media influencers, animation, children’s music, actors, or situations representing children’s daily life, or free gifts or toys, contests, interactive games, or mobile or computer applications.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id7198ed8dd37a46d093788459ea66486d"><enum>(c)</enum><header display-inline="yes-display-inline">NASEM review</header><text>The Secretary of Health and Human Services (referred to in this subsection as the <quote>Secretary</quote>) shall seek to enter into a contract with the National Academies of Science, Engineering, and Medicine (referred to in this subsection as the <quote>National Academies</quote>) under which the National Academies—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ade61571999467f9c098096e038aa74"><enum>(1)</enum><text display-inline="yes-display-inline">convenes a committee of experts in the field of nutrition science to review the science of ultra-processed food (as defined in paragraph (z)(6)(C) of section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>)), as added by subsection (a);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b1b12f1d9c843718c03027d63cc9265"><enum>(2)</enum><text display-inline="yes-display-inline">develops recommendations for defining the term <term>ultra-processed food</term> for purposes of paragraph (z)(6)(C)(ii) of section 403 of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf81916d6167b473fae0895b8003b7116"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, submits to the Secretary a report that includes the recommendations developed under paragraph (2). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idba1bca77629a4e358bcf426eb4f81d49"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Health and Human Services $5,000,000 for each of fiscal years 2025 through 2029 for purposes of promulgating regulations and carrying out enforcement activities with respect to the labeling requirements under the amendments made by subsections (a) and (b).</text></subsection></section><section id="id33d200b275d3441e97ac96809e9bbb18"><enum>102.</enum><header>National Institutes of Health research on nutrition science</header><text display-inline="no-display-inline">Part A of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFF6AF71E8ED64856B42DF07D932069B3"><section id="idb19f0b7425264a6c939b18696fbefa32"><enum>404P.</enum><header>Research and collaboration on nutrition science</header><subsection commented="no" display-inline="no-display-inline" id="idf4a84704af554a7d9b1b9dd2507af8d4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Director of NIH shall expand, intensify, and coordinate programs for the conduct and support of research with respect to nutrition science, including research on—</text><paragraph commented="no" display-inline="no-display-inline" id="ide520646bfcbb4da68b62b820a8bd6989"><enum>(1)</enum><text display-inline="yes-display-inline">the health effects of ultra-processed foods on consumers;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2daad272066a4446ad8e23b66236a262"><enum>(2)</enum><text display-inline="yes-display-inline">the specific food and beverage ingredients, additives, sweeteners, and chemicals within ultra-processed foods that may be harmful to health; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id15bac7ac8a6e4e6da601723320d0b97a"><enum>(3)</enum><text>the safety profile of food and beverage ingredients, additives, sweeteners, and chemicals that have been self-affirmed by food and beverage manufacturers as generally recognized as safe without review of such status by the Food and Drug Administration; and</text></paragraph><paragraph id="id2cc15348a25d48fabcd0a5746e8557fa"><enum>(4)</enum><text>the formulation of ultra-processed foods to have hyper-palatable qualities and association with addiction.</text></paragraph></subsection><subsection id="id33cfac6f149c4813b22af7b0081d1dd4"><enum>(b)</enum><header>Meetings on nutrition</header><paragraph commented="no" display-inline="no-display-inline" id="id0ac82b431e3b4d7294825eb643589d56"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Childhood Diabetes Reduction Act of 2024</short-title>, and every 5 years thereafter, the Director of NIH, in coordination with the Commissioner of Food and Drugs, shall convene a public meeting for the purpose of discussing research efforts aimed at improving nutrition and reducing the incidence of diet-related chronic disease, with the goal of informing Federal policy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b94412b2f954daca91f70da7fb954e2"><enum>(2)</enum><header>Participants</header><subparagraph commented="no" display-inline="no-display-inline" id="id69ef070916144c75936f19c3fe1c9dab"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each meeting under paragraph (1) shall involve a diverse group of stakeholders, including food scientists and researchers, registered dietitians and nutritionists, clinicians specializing in nutrition-related diseases, Federal stakeholders, and nongovernmental organizations focused on nutrition and health. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b938465b0b747ebb97cc7f54abebb8d"><enum>(B)</enum><header>Consideration</header><text>In selecting stakeholders described in subparagraph (A) for participation for each meeting under paragraph (1), the Director of NIH, in coordination with the Commissioner of Food and Drugs, shall ensure that stakeholders who have no financial affiliation with manufacturers of ultra-processed food make up the majority of participants.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id982a5878cde54978b406410bbbe891bc"><enum>(3)</enum><header>Topics</header><text display-inline="yes-display-inline">Each meeting under paragraph (1) shall include discussion of—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddbc189bdaa584783993d792c1d387a41"><enum>(A)</enum><text display-inline="yes-display-inline">current research findings related to nutrition and chronic disease, including the impact of food labeling requirements under section 403(z) of the Federal Food, Drug, and Cosmetic Act;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5671f56d11184c2cb7e433a4b8f1cc2c"><enum>(B)</enum><text display-inline="yes-display-inline">any gaps in such research and priorities for future research; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id057b8101c67f4156b9f2d8e942af2980"><enum>(C)</enum><text display-inline="yes-display-inline">evidenced-based practices for improving nutrition and innovative approaches to prevent and manage chronic conditions through dietary innovations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1997f442e154b39a0de7f5afd491528"><enum>(D)</enum><text display-inline="yes-display-inline">such other topics as the Director of NIH, in coordination with the Commissioner of Food and Drugs, determines appropriate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8e94b9c3ead4adabdb11349151b0ecc"><enum>(4)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Director NIH, in coordination with the Commissioner of Food and Drugs, shall submit a report on each meeting under paragraph (1) to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, and shall make each such report publicly available on the website of the National Institutes of Health. </text></paragraph></subsection><subsection id="id90eebe6d7a3843eba58d4d42deda70c2"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>ultra-processed food</term> has the meaning given such term in section 403(z)(6) of the Federal Food, Drug, and Cosmetic Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id17e30d48468b4e099ad64af6d2839a9d"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated $60,000,000 for each fiscal years 2025 through 2029.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8ac663f53a514885864e0184fec0bd45"><enum>103.</enum><header>Nutrition and physical activity public education campaign</header><text display-inline="no-display-inline">Title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/241">42 U.S.C. 241 et seq.</external-xref>) is amended by striking section 399Y and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBABAC72EBE8F45D99882E3A7C33DDC8A"><section id="id804c6bd460d44ce095946278ec7067e0"><enum>399Y.</enum><header>Nutrition and physical activity public education campaign</header><subsection id="idec75a035357e4283a10a9e5e0331bcfd"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, and in collaboration with national, State, Tribal, and local partners, physical activity organizations, nutrition experts, physical activity experts, health professional organizations, and other organizations, as appropriate, shall develop a national public campaign to educate children and their caregivers concerning—</text><paragraph id="id31b20b7321dd4084bf139391809a4e08"><enum>(1)</enum><text>how to read and understand the nutrient warning labels required under subparagraphs (1) through (4) of section 403(z) of the Federal Food, Drug, and Cosmetic Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43877728db48411581ae4c0ad3bf1a2d"><enum>(2)</enum><text display-inline="yes-display-inline">the health risks associated with obesity, inactivity, and poor nutrition, including consumption of foods described in subparagraphs (1) through (4) of section 403(z) of the Federal Food, Drug, and Cosmetic Act;</text></paragraph><paragraph id="id0c4029a0fba244cba0757202832b8c92"><enum>(3)</enum><text>ways to incorporate physical activity into daily living;</text></paragraph><paragraph id="idfcd8134566cc40e183ebe6edf60e5ef0"><enum>(4)</enum><text>ways to support a healthy lifestyle and reduce the risk of chronic illness, including obesity; </text></paragraph><paragraph id="idc7975ac9038641cebf426d869972672d"><enum>(5)</enum><text>the benefits of good nutrition; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1e06e74dc304637a6bfbf16149d3cde"><enum>(6)</enum><text display-inline="yes-display-inline">strategies to improve eating and drinking habits, such as identifying and selecting healthier food choices and reducing consumption of added sugars, saturated fat, and sodium.</text></paragraph></subsection><subsection id="id3559fdcecc6e43e4979495c0b930f668"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $10,000,000 for each of the fiscal years 2025 through 2029.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="id22e82923971c4054b1a55d6d4aeddbfd" style="OLC"><enum>II</enum><header>Federal Trade Commission</header><section id="id4ab90e76f02b482ab31fe3d0245f9387"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" display-inline="no-display-inline" id="id1f7e9e4f7bc44dffb9c804dd1ad13c94"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual who is under the age of 13.</text></paragraph><paragraph id="idb3fa51c40311418783ebc35eacac994f" commented="no"><enum>(2)</enum><header>Child-directed advertising</header><text>The term <term>child-directed advertising</term> means any advertisement—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide592ba1a08e344408b3ca589c853b2a5"><enum>(A)</enum><text display-inline="yes-display-inline">that uses themes or promotional strategies that appeal to children, which may include the use of— </text><clause commented="no" display-inline="no-display-inline" id="idcb130880b64e4efea2809e222f4b66ff"><enum>(i)</enum><text display-inline="yes-display-inline">fun<italic></italic> or fantasy themes, cartoon characters, social media influencers, animation, endorsements by celebrities and athletes, cross-promotions using fictional characters, children's music, actors, or situations representing children's daily life; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7cceae099ca94d34bb3812135d2a70bd"><enum>(ii)</enum><text display-inline="yes-display-inline">free gifts or toys, contests, interactive games, or mobile or computer applications; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida85e8096447e4b3eb0616c1e214e9067"><enum>(B)</enum><text>in media for which children comprise at least 30 percent of the audience, as determined by the Commission, that is displayed using—</text><clause commented="no" display-inline="no-display-inline" id="id0a72338266104386827b8f1168eff3e6"><enum>(i)</enum><text display-inline="yes-display-inline">traditional measured media, such as television, radio, and printed media; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7b402ff44ef74de384b05f61d0db9453"><enum>(ii)</enum><text display-inline="yes-display-inline">electronic media, content created by influencers, online videos, company-sponsored websites, social media, movies, and video games.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e8f40749c5047189e4e0bcc5bf4318a"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84ea0312d2504f2cb0a3f8de0ce45090"><enum>(4)</enum><header>Junk food</header><text>The term <term>junk food</term> means products with labeling requirements described in subparagraph (1), (2), (3), or (4) of paragraph (z) of section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>), as added by section 101(a) of this Act.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3f1723d8937b44e1948f260d73bb4899"><enum>202.</enum><header>Restrictions on advertisements for junk food directed at children; required disclosure of any health and nutrient warning label in advertisements</header><subsection commented="no" display-inline="no-display-inline" id="id6496cd7181524052a9c7ada9f8f45f62"><enum>(a)</enum><header>Marketing or advertising junk food to children</header><paragraph commented="no" display-inline="no-display-inline" id="id0d5a0e4e8bb84a22aad854e645655747"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to market or advertise, or produce or distribute any advertisement or marketing material for, junk food by using child-directed advertising.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide627e6ec4a244b399ecb5e97c79acbe9"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining whether any marketing or advertising uses child-directed advertising for purposes of subparagraph (A), the Commission shall consider the totality of the circumstances.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb5fd1d00e72a4114ba2c39617252c0ef"><enum>(b)</enum><header>Required disclosure</header><text display-inline="yes-display-inline">It shall be unlawful for any person to market or advertise, or produce or distribute any advertisement or marketing material for, junk food without including in such advertisement or marketing material the relevant mandatory health or nutrient warning label or notice described in section 403(z) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(z)</external-xref>). </text></subsection><subsection id="idbad049f0c7354b66b7edf92f23df6821"><enum>(c)</enum><header>Effective date</header><text>The prohibitions established in this section shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id91c4250329034c589dcf3ea6dbd82cfa"><enum>(d)</enum><header>Enforcement by the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="id2df98fa0f21f4e6984cde9ea8401a0ea"><enum>(1)</enum><header>Unfair or deceptive act or practice</header><text><italic></italic>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1530eae16f0048b89e0a72be05169059"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="idee9d63fac2ae4334bb50190de69bcbb5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in subparagraph (C), the Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7667a37b89842fe80bad077a4fbcaf8"><enum>(B)</enum><header>Privileges and immunities</header><text>Except as provided in subparagraph (C), any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id172f2cc36912478faec222471680f2c3"><enum>(C)</enum><header>Common Carriers</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act, in the same manner provided in subparagraphs (A) and (B), with respect to common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and Acts amendatory thereof and supplementary thereto. </text></subparagraph><subparagraph id="id09e2e8b0db1b4904aaeb522e9b86acb6"><enum>(D)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph id="id26adc9bfe1184dbdb688badc216da96a" commented="no"><enum>(E)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this section.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idca90986bb0a446d4896cf9eb100dd8cc"><enum>203.</enum><header>Restoring the Federal Trade Commission's ability to promulgate rules on children's advertising</header><subsection commented="no" display-inline="no-display-inline" id="id7dcd85238e22453da923d06663728428"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 18(h) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(h)</external-xref>) is repealed.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7d5a6e064c42489589a113c7228cf7ee"><enum>(b)</enum><header>Conforming amendment</header><text>Section 18(a)(1) of such Act is amended in the matter preceding subparagraph (A), by striking <quote>Except as provided in subsection (h), the Commission</quote> and inserting <quote>The Commission</quote>.</text></subsection></section></title></legis-body></bill>
