<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4188</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240418">April 18, 2024</action-date><action-desc><sponsor name-id="S366">Ms. Warren</sponsor> (for herself, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, and <cosponsor name-id="S313">Mr. Sanders</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Commodity Exchange Act to prohibit trading of water and water rights for future delivery, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future of Water Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="idD065DE1EBC0145908764946DA04C640F"><enum>2.</enum><header>Prohibition of trading in water and water rights for future delivery</header><subsection id="id57EB1F2F91814BAC8B5DF39536145DCA"><enum>(a)</enum><header>Commodity Exchange Act</header><text>Section 1a(9) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a(9)</external-xref>) is amended—</text><paragraph id="id04EFC81A2CFD4EECBAD2752334AFC08A"><enum>(1)</enum><text>by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/13-1">7 U.S.C. 13–1</external-xref>)) and</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/13-1">7 U.S.C. 13–1</external-xref>)),</quote>;</text></paragraph><paragraph id="idDC07094B659B4B9DBEBBEDBEECE20D45"><enum>(2)</enum><text>by inserting <quote>water or water rights (or any index, measure, value, or data related to water or water rights), and</quote> after <quote>receipts), and</quote>; and</text></paragraph><paragraph id="id262c5dccb3e942739cf55e40115a4e9e"><enum>(3)</enum><text>by striking <quote>receipts) in which</quote> and inserting <quote>receipts, and water or water rights, or any index, measure, value, or data related to water or water rights) in which</quote>. </text></paragraph></subsection><subsection id="id7CE008321374422A931E4D2ABAED8041"><enum>(b)</enum><header>Public Law 85–839</header><text display-inline="yes-display-inline">The first section of <external-xref legal-doc="public-law" parsable-cite="pl/85/839">Public Law 85–839</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/7/13-1">7 U.S.C. 13–1</external-xref>) is amended in the first sentence of subsection (a)—</text><paragraph id="id696563CF4DB545A1B33804C442AA18FC"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>water or water rights (or any index, measure, value, or data related to water or water rights),</quote> after <quote>sale of</quote>; and</text></paragraph><paragraph id="id44972197C55745278528EEA5266EDB6F"><enum>(2)</enum><text>by striking <quote>receipts)</quote> and inserting <quote>receipts),</quote>.</text></paragraph></subsection></section></legis-body></bill>
