Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to allow for brownfield revitalization funding eligibility for Alaska Native Tribes, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contaminated Lands Reclamation Act of 2024</short-title></quote>.</text></section><section id="ida3779d5f50e94df29503b279d3c8f022"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id640fca461b904f93842f6bc8dc73ff43"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1375552f0fa54b56879718e8ce2ba633"><enum>(2)</enum><header>Alaska Native Corporation</header><text>The term <term>Alaska Native Corporation</term> has the meaning given the term <term>Native Corporation</term> in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d05236fc8e7457ba1ea93604cbc12bd"><enum>(3)</enum><header>ANCSA land</header><text>The term <term>ANCSA land</term> means land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb9f4b2efb2fc45699de6970951f7f201"><enum>(A)</enum><text display-inline="yes-display-inline">is or was contaminated land at the time of conveyance pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id396035a99aae44349f3a865c3631679d"><enum>(B)</enum><text display-inline="yes-display-inline">was conveyed pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) to an Alaska Native Corporation or Indian Tribe, including—</text><clause commented="no" display-inline="no-display-inline" id="idec5211a60b9749d4a84c1d72edd674ff"><enum>(i)</enum><text>land reconveyed by an Alaska Native Corporation—</text><subclause commented="no" display-inline="no-display-inline" id="idaf5de8314fc7431d99741d566a8fb002"><enum>(I)</enum><text display-inline="yes-display-inline">to a settlement trust pursuant to section 39 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1629e">43 U.S.C. 1629e</external-xref>); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idae0023b54eec4cfb99feb63437fbeab1"><enum>(II)</enum><text display-inline="yes-display-inline">pursuant to other applicable law;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7d1b0721f50b4025906dfeec61f69f36"><enum>(ii)</enum><text display-inline="yes-display-inline">land conveyed to an Alaska Native Corporation pursuant to an exchange authorized by—</text><subclause commented="no" display-inline="no-display-inline" id="id77bc4375449d4141a99aa387418b8ec3"><enum>(I)</enum><text display-inline="yes-display-inline">section 22(f) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1621">43 U.S.C. 1621(f)</external-xref>); </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide9abcbc531ab4797b5c4559717b27208"><enum>(II)</enum><text display-inline="yes-display-inline">section 3192(h) of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3192">16 U.S.C. 3192(h)</external-xref>); or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf83e14820eb04cf28a3eab9f2d7998a7"><enum>(III)</enum><text display-inline="yes-display-inline">other applicable law; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8853abbdd5db438f96669cd118b67816"><enum>(iii)</enum><text display-inline="yes-display-inline">land conveyed by an Alaska Native Corporation to a successor in interest to which the lands were conveyed under section 14(c) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1613">43 U.S.C. 1613(c)</external-xref>). </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66f1155343434b738aa752dfbaf89b84"><enum>(4)</enum><header>Compensatory mitigation</header><subparagraph commented="no" display-inline="no-display-inline" id="idaf3c8bd180d34c3fb421a9d3029e96ea"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>compensatory mitigation</term>, for the purposes of remediating eligible land, means—</text><clause commented="no" display-inline="no-display-inline" id="ida463bb95c10b4083b2f349a55f816500"><enum>(i)</enum><text>restoration, including reestablishment or rehabilitation;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida0f4eb8d25f9492198855f147fa6aa2d"><enum>(ii)</enum><text>establishment, including creation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id325a5c3444c945198d13c5930d220d2b"><enum>(iii)</enum><text>enhancement; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idaca25765f20e4c7eb885cd9374157baa"><enum>(iv)</enum><text>in certain circumstances, as determined by the Secretary, the preservation of eligible land.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida65cd96033c14f41842e85a2b7f44ea9"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>compensatory mitigation</term> includes—</text><clause commented="no" display-inline="no-display-inline" id="ideda5dd3ad81944348a747b73c9f184a1"><enum>(i)</enum><text display-inline="yes-display-inline">on-site permittee-responsible mitigation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0cd096b860b54e479210d6e7aca68564"><enum>(ii)</enum><text>off-site permittee-responsible mitigation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id416e6805f3234fc98f19ef7c45fa9657"><enum>(iii)</enum><text>in-leu fee mitigation.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id436f8dee69814dbfa9d88a78fc40b2c5"><enum>(5)</enum><header display-inline="yes-display-inline">Contaminated land</header><text>The term <term>contaminated land</term> means land, including ANCSA land and Indian land, contaminated by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id287a5d99c2e7463792bcf0d06e81e923"><enum>(A)</enum><text display-inline="yes-display-inline">petroleum;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90017414226a4ad1b02bb475e2f4e7f8"><enum>(B)</enum><text>a petroleum-based product;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7837ee361f64abdb9632bcd8fa0abe5"><enum>(C)</enum><text>a hazardous substance (as is defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6918e17b514d40fda08752d1851b5dd0"><enum>(D)</enum><text>any other pollutant or contaminant (as is defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6dab6599800f43d28767399ed087316d"><enum>(6)</enum><header display-inline="yes-display-inline">Credit</header><subparagraph commented="no" display-inline="no-display-inline" id="idf8ff3f87c7e34473982c406dfcb8f3b3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>credit</term> means a unit of measure (such as a functional or areal measure or other suitable metric) that represents the accrual or attainment of the functions associated with the restoration, establishment, enhancement, or preservation of resources at a compensatory mitigation site, with no change in the size of the area of the compensatory mitigation site.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43767bc12f1945a8a1564807ced3e037"><enum>(B)</enum><header>Generating mitigation credit</header><text>Remediation of contaminated sites is an appropriate means of generating mitigation credit when the removal of hazardous substances, pollutants, or contaminants restores or enhances aquatic resource functions on ANCSA land or Indian land.</text></subparagraph></paragraph><paragraph id="id5d65da0401344480a0d009e751e23bb5"><enum>(7)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Self Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10756deaa4774dfea61eadbf7af44e5b"><enum>(8)</enum><header display-inline="yes-display-inline">Indian land</header><text>The term <term>Indian land</term> means land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2445885bd5f548348fd6c3a88da9781d"><enum>(A)</enum><text display-inline="yes-display-inline">is held in trust by the United States for an Indian Tribe; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id375eceeda00f42dd8dfa8b54727f94ef"><enum>(B)</enum><text>is owned by an Indian or Indian Tribe and is subject to restrictions against alienation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf74e65dcb911436b85cd9e5c642be3fb"><enum>(9)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40415d73aa6f43bb96ca04bfc2fab3a0"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Army, acting through the Chief of Engineers.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id9b2d1d3d44814b97b6d2d125df30e6ad"><enum>3.</enum><header display-inline="yes-display-inline">Department of the Interior responsibilities for Alaska Native Claims Settlement Act contaminated lands</header><subsection commented="no" display-inline="no-display-inline" id="id58c797026bea4895a2037880d117d3b4"><enum>(a)</enum><header>Congressional findings</header><text>Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="id81f60bba92894704a9a2742308a4e019"><enum>(1)</enum><text>for more than 50 years after the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) was enacted, Alaska Native Peoples and their communities continue to face obstacles in the pursuit of self-determination, resulting in ongoing economic, social, and cultural instability due to the contamination of lands conveyed to them by the Federal Government pursuant to that Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb40a466031144585895eb6a3e0729563"><enum>(2)</enum><text>in 1971, the Secretary of the Interior failed to identify and remediate 44,000,000 acres of land conveyed to Alaska Natives pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3e9f6b864c44993b48aca88d28f632b"><enum>(3)</enum><text>in 1990, Congress directed the Secretary of the Interior to submit a report identifying lands and properties transferred to Alaska Native Corporations pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) that at the time of transfer were represented or disclosed by the Federal Government as being free from contaminants, and which subsequently were discovered to be contaminated;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id267581fcc3404d0484b90d816d7ead21"><enum>(4)</enum><text display-inline="yes-display-inline">the Secretary of the Interior never submitted the report described under paragraph (3);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe58777ffa7a47528e051eb902116c26"><enum>(5)</enum><text display-inline="yes-display-inline">in 1995, Congress amended the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) by adding section 40 to that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1629f">43 U.S.C. 1629f</external-xref>), which directed the Secretary of the Interior to submit a report addressing issues resulting from the presence of contaminants on lands conveyed or prioritized for conveyance to Alaska Native Corporations under that Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a5957c82d554b88ae6fd9efe9c2f80f"><enum>(6)</enum><text display-inline="yes-display-inline">in 1998, the Secretary of the Interior responded to the directive from Congress described in paragraph (5) by submitting to Congress a report entitled <quote>Hazardous Substance Contamination of Alaska Native Claims Settlement Act Lands in Alaska</quote>, the findings of which Congress recognizes, including that the United States conveyed numerous contaminated lands to Alaska Native Corporations pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) for the settlement of aboriginal land claims;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id737a5ae3fc7f47daad82c9905b09be0b"><enum>(7)</enum><text>in 2014, in the joint explanatory statement for the Department of the Interior, Environment, and Related Agencies accompanying the Consolidated and Further Continuing Appropriations Act, 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/113/235">Public Law 113–235</external-xref>; 128 Stat. 2130), Congress directed the Secretary of the Interior—</text><subparagraph commented="no" display-inline="no-display-inline" id="id32e6b3d30059408980c8bd87dc37a2d3"><enum>(A)</enum><text display-inline="yes-display-inline">to provide an update on the inventory of contaminated sites conveyed pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), including sites identified subsequent to the 1998 report described in paragraph (6);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7f06f227d4b49b2942c47c85689077a"><enum>(B)</enum><text display-inline="yes-display-inline">to provide an updated status on the 6 duties listed in the 1998 report described in paragraph (6); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide71097d7f5594775a4a06e26594e0eb5"><enum>(C)</enum><text>to provide a detailed plan on how the Department of the Interior intended to complete a cleanup of each contaminated site conveyed pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf4a41aa0f5044618926c18336b94d16a"><enum>(8)</enum><text display-inline="yes-display-inline">in 2016, the Secretary of the Interior updated the report described in paragraph (6), the updated findings of which Congress recognizes, including that 920 contaminated land sites were conveyed to Alaska Native Corporations pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1265685db330415bb5d21507253640f4"><enum>(9)</enum><text display-inline="yes-display-inline">the full number of currently contaminated lands that were contaminated at the time of conveyance pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>) is unknown;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idceda961a61f2435792cac516578c13a4"><enum>(10)</enum><text>it is not, and never was, the intent of Congress to convey lands that would still be contaminated in 2024 to Alaska Native Corporations for the settlement of aboriginal land claims in 1971;</text></paragraph><paragraph id="id68e3879fc979408c9fd8b949565d9a9a"><enum>(11)</enum><text>there is an immediate need to address the environmental and health risks to Alaska Native Peoples due to the United States conveying contaminated lands and lands at risk for contamination to Alaska Native Corporations; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39732f27c8d64e19a0181b0e06eaf388"><enum>(12)</enum><text display-inline="yes-display-inline">addressing the environmental and health risks to Alaska Native Peoples due to the conveyance of contaminated lands by the United States to Alaska Native Peoples should be done rapidly, with certainty, without litigation, and in conformity with the real economic, social, and cultural needs of Alaska Native communities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4a530f316ea447d89734cba7731bb2f"><enum>(b)</enum><header>Duties of the Secretary of the Interior</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id55b36694490e47e39c107ff312d27dd5"><enum>(1)</enum><text display-inline="yes-display-inline">perform the duties established in the 2016 update to the Department of the Interior 1998 report entitled <quote>Hazardous Substance Contamination of Alaska Native Claims Settlement Act Lands in Alaska</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c7cdcabedd049d8a64b6671c09d3ea7"><enum>(2)</enum><text>develop a cleanup plan for ANCSA land.</text></paragraph></subsection><subsection id="id452d01698b354d3db70894a1f9802b4e" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of enactment of this Act, and each year thereafter for a period of 10 years, the Secretary of the Interior shall submit to Congress a report that describes the status of the performance of the duties required under subsection (b). </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfb38ff45d4294a33b007026b3351db7d"><enum>4.</enum><header>Brownfield revitalization funding eligibility</header><subsection commented="no" display-inline="no-display-inline" id="id34fc463d25b14a7f80e7c1e2ce89e818"><enum>(a)</enum><header display-inline="yes-display-inline">Alaska Native eligibility</header><text>Section 104(k)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb7e47672f1f64ea880822691d4f64f2a"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>other than in Alaska</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd62bbc7a52ce4587839936006e219149"><enum>(2)</enum><text>in subparagraph (H), by striking <quote>and following) and the Metlakatla Indian community</quote> and inserting <quote>et seq.)</quote>.</text></paragraph></subsection><subsection id="id564a9694c10342bca1994d6b72607194"><enum>(b)</enum><header>Grants and loans for Brownfield remediation</header><text>Section 104(k)(3)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)(A)(ii)</external-xref>) is amended by striking <quote>$500,000 for each site</quote> and all that follows through the period at the end and inserting <quote>$1,000,000 for each site to be remediated.</quote>.</text></subsection></section><section id="idaf3e6473f52442b09c6e389ac405508d"><enum>5.</enum><header>Alaska Native Claims Settlement Act conveyed land grant program</header><subsection id="idd12a9cdc1ad34b13af35bbeee431fb0d"><enum>(a)</enum><header>Definitions</header><text>In this section: </text><paragraph commented="no" display-inline="no-display-inline" id="idc8fab3b2d89846ceb71c86b90ac91a14"><enum>(1)</enum><header>Eligible contaminant</header><text>The term <term>eligible contaminant</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide4ccd20e0a644cdcaf1cf68a1cb7b710"><enum>(A)</enum><text display-inline="yes-display-inline">solid waste (as defined section 1004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>)); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0fd8576c91594cf884aaae0d8a04a202"><enum>(B)</enum><text display-inline="yes-display-inline">a hazardous substance (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13770a57fa4c4528902d1884717f0d80"><enum>(C)</enum><text display-inline="yes-display-inline">a pollutant or contaminant (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44b53c1335754cbd8c853193ce8f994e"><enum>(D)</enum><text display-inline="yes-display-inline">petroleum, including—</text><clause commented="no" display-inline="no-display-inline" id="id87d2cde64b124b7d8ed6aa41eb4ec7f4"><enum>(i)</enum><text display-inline="yes-display-inline">crude oil or any fraction thereof; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7fb0f891c6484bdd9611c73000096b62"><enum>(ii)</enum><text display-inline="yes-display-inline">any other petroleum product excluded from the definition of <quote>hazardous substance</quote> in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1cb6950009745d3afc15be132c8b267"><enum>(2)</enum><header>Eligible recipient</header><text display-inline="yes-display-inline">The term <term>eligible recipient</term> means— </text><subparagraph id="id15cb76ae3cb646929fb1cbc28c5c0f04"><enum>(A)</enum><text>a Regional Corporation (as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>));</text></subparagraph><subparagraph id="id59dd8b565dd4496a9aaa3684ce4b1312"><enum>(B)</enum><text>a Village Corporation (as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>));</text></subparagraph><subparagraph id="id8528869e467a483ab0d80fe1c01e8cc5"><enum>(C)</enum><text>an Indian Tribe in the State of Alaska;</text></subparagraph><subparagraph id="idec165cc6128b46f8b53cf1655da4d0a4"><enum>(D)</enum><text>an Alaska Native nonprofit organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6dbaf63701a4325bd8aac323f060991"><enum>(E)</enum><text display-inline="yes-display-inline">an Alaska Native nonprofit association; and</text></subparagraph><subparagraph id="id2700349dc31d4f5ba0c6d87f14159864" commented="no"><enum>(F)</enum><text>an intertribal consortium (as defined in section 35.502 of title 40, Code of Federal Regulations (or successor regulations)), that meets the requirements described in subsections (a) and (c) of section 35.504 of that title.</text></subparagraph></paragraph></subsection><subsection id="id155cc545d9cc4b1d886785bb8d184661"><enum>(b)</enum><header>Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="id31c0171dbc96485e9ee9e40feb1fd245"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, acting through the Regional Administrator for Region 10 (referred to in this subsection as the <term>Administrator</term>), may provide grants to eligible recipients to address contamination by eligible contaminants on ANCSA land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf90219fab6a1479591c5f6e762188841"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (4), is or was contaminated by an eligible contaminant at the time of conveyance pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b4825b0d6b841a6a249371794eb67e6"><enum>(B)</enum><text display-inline="yes-display-inline">is on an inventory of that land maintained by the Environmental Protection Agency.</text></subparagraph></paragraph><paragraph id="id5ddbfe4d980c41728798ad980d3627c2"><enum>(2)</enum><header>Supplement</header><text>An eligible recipient may use a grant awarded under this subsection to supplement other funds provided by the Environmental Protection Agency or any other Federal agency for identical or similar purposes to the purposes described in paragraph (1), in accordance with such conditions as the Administrator may establish.</text></paragraph><paragraph id="id1f2c8e4e884a4207afffc61617454264"><enum>(3)</enum><header>Use of funds</header><text>Subject to such conditions as the Administrator may establish, an eligible recipient may use a grant awarded under this subsection to address contamination by eligible contaminants on ANCSA land through planning, assessment, remediation, and activities necessary to prepare the land for reuse.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e5ad6b715944bad9c367ee4b27d91ad"><enum>(4)</enum><header>Waiver</header><subparagraph commented="no" display-inline="no-display-inline" id="id77426f3b635b47ef872a3653c1b562df"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may waive the requirement described in paragraph (1)(A) if the owner of the land at the time a grant is awarded under this subsection did not cause or contribute to the contamination on the land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb23b3b337a74a1d901a51e52a9c29eb"><enum>(B)</enum><header>Effect of waiver</header><text>Land with respect to which a waiver is provided under subparagraph (A) shall be eligible for a grant under this subsection if the land was contaminated by an eligible contaminant after the time of conveyance of the land pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id35d6b27b5e624a848abd2eacdbf8be65"><enum>(5)</enum><header>Priorities</header><text>In awarding grants under this subsection, the Administrator shall give priority to ANCSA land with respect to which—</text><subparagraph id="id1984bf3afb0440f0ae769ff0331adf84"><enum>(A)</enum><text>the contamination by eligible contaminants presents an imminent and substantial risk to human health or the environment, regardless of the specific circumstances that created the risk; or</text></subparagraph><subparagraph id="idc2e99ab06cb045f28ff06e2b55c138e0"><enum>(B)</enum><text>the Federal Government caused or contributed to the contamination by eligible contaminants prior to the conveyance of the land pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id0337597351364260a5a3a8c721331a20"><enum>(6)</enum><header>Ineligibility of certain land</header><subparagraph commented="no" display-inline="no-display-inline" id="id0d90f9da807944249c362731a884c63b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Administrator shall not award a grant under this subsection for land with respect to which the Administrator determines a financially viable non-Federal party (or successors to such a party) or an affiliate of such a party is primarily responsible for the contamination by eligible contaminants.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5f98f40562984f2192291d7b09aef120"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to land described in paragraph (5)(A).</text></subparagraph></paragraph><paragraph id="idd2c7ed25da554f68b48885e0ed2b144e"><enum>(7)</enum><header>Funding</header><subparagraph id="idc247d9234888432dae7fd75e1c1ab109"><enum>(A)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $35,000,000 for each of fiscal years 2025 through 2030, to remain available until expended. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id357a431c302541b29d94a337b26214fd"><enum>(B)</enum><header>Reservation</header><text display-inline="yes-display-inline">The Administrator may reserve up to 10 percent of the amount appropriated to carry out this subsection for salaries, expenses, and administration. </text></subparagraph><subparagraph id="id867fd55350784f179d4f20ddae1cf29d" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No funds appropriated to carry out section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) may be used to carry out this subsection.</text></subparagraph></paragraph></subsection><subsection id="id141afcb088c74d168c3cfaf9615ebc84"><enum>(c)</enum><header>Brownfields program funding</header><paragraph commented="no" display-inline="no-display-inline" id="id68fae2378d2f4eb9b3c2494f3f4d0da0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an eligible recipient may use funding provided under paragraphs (2)(A)(i), (3), and (4) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) to address contamination on ANCSA land that— </text><subparagraph commented="no" display-inline="no-display-inline" id="id5AF476654FF74A4EB60E67F76D797A5E"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (2), is or was contaminated by an eligible contaminant at the time of conveyance pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7EFB8A4A4AF46BB868E0DF334556C0C"><enum>(B)</enum><text display-inline="yes-display-inline">is on an inventory of that land maintained by the Environmental Protection Agency. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B8995C9CBA44146BA6280438D24FE65"><enum>(2)</enum><header>Waiver</header><subparagraph commented="no" display-inline="no-display-inline" id="idCAD127DC0A14415C8A5B1A1870F2BA0A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may waive the requirement described in paragraph (1)(A) if the owner of the land at the time funding described in paragraph (1) is provided did not cause or contribute to the contamination on the land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66AB2625004245B9BCC5A3EB9C680AF3"><enum>(B)</enum><header>Effect of waiver</header><text>Land with respect to which a waiver is provided under subparagraph (A) shall be eligible to use funding for the purpose described in paragraph (1) if the land was contaminated by an eligible contaminant after the time of conveyance of the land pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="id89c22668a1884b33900e0f5a41e6f5ca"><enum>(d)</enum><header>Guidance</header><paragraph commented="no" display-inline="no-display-inline" id="idd4dc8246fd5c45a19bdd0e4b339f5df4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall update guidance relating to eligibility for brownfields funding under section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) for land described in paragraph (2) to provide that the Federal Government shall not be considered a viable responsible party.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id510c635385f043208502542d1fd5bb11"><enum>(2)</enum><header>Land described</header><text display-inline="yes-display-inline">The land referred to in paragraph (1) is ANCSA land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida3e50fbfb8e24a37b6607fffe2cf6509"><enum>(A)</enum><text display-inline="yes-display-inline">contains contamination by a contaminant described in subsection (a)(1)(D) that the Federal Government caused or contributed to prior to conveyance pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); and</text></subparagraph><subparagraph id="idEBFED47D0CE446FA8954007DB7591859"><enum>(B)</enum><text>is on an inventory of that land maintained by the Environmental Protection Agency. </text></subparagraph></paragraph><paragraph id="id714d480becfa4094a187edf8ae278fa6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Cessation of effectiveness</header><text>The update to the guidance required under paragraph (1) shall cease to be effective on the date on which funding made available for the program under subsection (b) through fiscal year 2030 is fully obligated.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idEF13B928202948A1AF8CB277414227F4"><enum>6.</enum><header>Authorization or contaminated land remediation in compensatory mitigation programs</header><subsection commented="no" display-inline="no-display-inline" id="ide5b20dd703d947c9baa5164ba0a7903e"><enum>(a)</enum><header>Remediation of contaminated lands</header><text>The Secretary shall allow a person who has been issued a permit for the discharge of dredged or fill material under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) to enter into an agreement with an Indian Tribe to remediate ANCSA land or Indian land for the purpose of compensatory mitigation for a permitted activity.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9b66b611fac247a99a709ddd157dd939"><enum>(b)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary and Administrator shall jointly promulgate regulations and issue guidance, as necessary, to establish performance standards and criteria for determining credits generated through the remediation of contamination under this section on ANCSA land or Indian land that—</text><paragraph commented="no" display-inline="no-display-inline" id="idfde7bbbf44324e8c8f5b6e58c696a79a"><enum>(1)</enum><text>maximize opportunities for mitigation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide756b55d97784ee48fe7c407b175f37b"><enum>(2)</enum><text>provide flexibility for regional variations in conditions, functions, and values;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida45ba73a3e494d9c808bd7eb46c7fb8c"><enum>(3)</enum><text>apply equivalent standards and criteria to each type of compensatory mitigation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id182236594bba4abf9f144576279aec52"><enum>(4)</enum><text display-inline="yes-display-inline">include procedures for consulting with eligible entities; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd186e43806d1486d8ebdb268525179b3"><enum>(5)</enum><text>provide that decontamination undertaken to generate credits must be done in compliance with applicable Federal and State standards and applicable Federal or State cleanup programs authorized under section 104 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604</external-xref>).</text></paragraph></subsection></section><section id="iddd3717528135428894133b0514d537e1"><enum>7.</enum><header>Tribal project implementation pilot program</header><subsection id="id630a18ec1fac410782e40c21994cd208"><enum>(a)</enum><header>Definition of eligible project</header><text>In this section, the term <term>eligible project</term> includes siting, design, engineering, and construction work for—</text><paragraph commented="no" display-inline="no-display-inline" id="id64ab62e1a5ce41009aa703f921038f4e"><enum>(1)</enum><text display-inline="yes-display-inline">a project of the Secretary authorized for construction;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf5e688f8c3246c0914e46f70be114e1"><enum>(2)</enum><text>a project carried out under a continuing authority program (as defined in section 7001(c)(1)(D)(iii) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282d">33 U.S.C. 2282d(c)(1)(D)(iii)</external-xref>));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a65023e5b4d4b38b40fc9374a0075c5"><enum>(3)</enum><text display-inline="yes-display-inline">a project or activity eligible to be carried out under the Tribal partnership program under section 203 of the Water Resources Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/33/2269">33 U.S.C. 2269</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfccc79456de41b0b78063c297c25ea1"><enum>(4)</enum><text>a project carried out under section 219 of the Water Resources Development Act of 1992 (106 Stat. 4835; 110 Stat. 3757; 113 Stat. 334; 136 Stat. 3808). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2e31d7da803e4439a2bd9ba6651f7f0c"><enum>(b)</enum><header>Authorization</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall establish and implement a pilot program under which Indian Tribes may directly carry out eligible projects. </text></subsection><subsection id="ide96d4731ac23424a9f3578070ecc9dd4"><enum>(c)</enum><header>Administration</header><paragraph id="id0d9a2e3ce74141ae87fe343d01451370"><enum>(1)</enum><header>In general</header><text>In carrying out the pilot program under this section, the Secretary shall—</text><subparagraph id="id2f284da3ac024ef7a2e5c00984f38c25"><enum>(A)</enum><text>identify not less than 5 eligible projects, including, in each of fiscal years 2025 and 2026—</text><clause commented="no" display-inline="no-display-inline" id="id1dc098c681f14610a61bf57fd795f082"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 1 eligible project in the South Pacific Division of the Corps of Engineers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5d1ec7626e694922b49946cbf9fc48c5"><enum>(ii)</enum><text>not less than 1 eligible project in the Pacific Ocean Division of the Corps of Engineers;</text></clause></subparagraph><subparagraph id="id94bd796598594f958832d12c8e9596f5"><enum>(B)</enum><text>notify the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the identification of each eligible project under the pilot program under this section;</text></subparagraph><subparagraph id="id42f002fc4560475eb84a36fb1037d2a6"><enum>(C)</enum><text>in collaboration with the Indian Tribe, develop a detailed project management plan for each identified eligible project that outlines the scope, budget, design, and construction resource requirements necessary for the Indian Tribe to execute the project or a separable element of the eligible project;</text></subparagraph><subparagraph id="id7d64915d02fe4cb88eea285ca3b93164"><enum>(D)</enum><text>on the request of the Indian Tribe and in accordance with subsection (e)(3), enter into a project partnership agreement with the Indian Tribe for the Indian Tribe to provide full project management control for construction of the eligible project, or a separable element of the eligible project, in accordance with plans approved by the Secretary;</text></subparagraph><subparagraph id="id6e81b3118b6c49baaf43d441140debdc"><enum>(E)</enum><text>following execution of the project partnership agreement, transfer to the Indian Tribe to carry out construction of the eligible project, or a separable element of the eligible project—</text><clause id="id6d35cb98ef704709a5b0f8d41f250e77"><enum>(i)</enum><text>if applicable, the balance of the unobligated amounts appropriated for the eligible project, except that the Secretary shall retain sufficient amounts for the Corps of Engineers to carry out any responsibilities of the Corps of Engineers relating to the eligible project and the pilot program under this section; and</text></clause><clause id="id9ab0c6fc98024efd878fd13588e2bfbf"><enum>(ii)</enum><text>additional amounts, as determined by the Secretary, from amounts made available to carry out this section, except that the total amount transferred to the Indian Tribe shall not exceed the updated estimate of the Federal share of the cost of construction, including any required design; and</text></clause></subparagraph><subparagraph id="id8ba985a998c44cee8b24454b9737ae7a"><enum>(F)</enum><text>regularly monitor and audit each eligible project being constructed by an Indian Tribe under this section to ensure that the construction activities are carried out in compliance with the plans approved by the Secretary and that the construction costs are reasonable.</text></subparagraph></paragraph><paragraph id="id3b41f647610a41ec8c1bdb1a00afa6e2"><enum>(2)</enum><header>Detailed project schedule</header><text>Not later than 180 days after entering into an agreement under paragraph (1)(D), each Indian Tribe, to the maximum extent practicable, shall submit to the Secretary a detailed project schedule, based on estimated funding levels, that lists all deadlines for each milestone in the construction of the eligible project.</text></paragraph><paragraph id="id54f9be16bbe94a60b4004a01d5cb3a70"><enum>(3)</enum><header>Technical assistance</header><text>On the request of an Indian Tribe, the Secretary may provide technical assistance to the Indian Tribe relating to—</text><subparagraph id="id70d0f9a8242949c3ac7348318dbcf3fc"><enum>(A)</enum><text>any study, engineering activity, design, or construction activity carried out by the Indian Tribe under this section; and</text></subparagraph><subparagraph id="id579609be510a45439c04070989aba89a"><enum>(B)</enum><text>expeditiously obtaining any permits necessary for the eligible project.</text></subparagraph></paragraph></subsection><subsection id="id90a640c79008427d925abff89833f8f7"><enum>(d)</enum><header>Cost share</header><text>Nothing in this section affects the cost-sharing requirement applicable on the day before the date of enactment of this Act to an eligible project carried out under this section.</text></subsection><subsection id="id3b6be3dcd4794f56aab1d51628d97e12"><enum>(e)</enum><header>Implementation guidance</header><paragraph id="id964090889cd449c5b75df82492bc7f14"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall issue guidance for the implementation of the pilot program under this section that, to the extent practicable, identifies—</text><subparagraph id="idf49e310b689c4b3c86e05bdd37678128"><enum>(A)</enum><text>the metrics for measuring the success of the pilot program; and</text></subparagraph><subparagraph id="id6ca1db988728458a8a66ed0908a9aa2d"><enum>(B)</enum><text>the laws and regulations that an Indian Tribe must follow in carrying out an eligible project under the pilot program.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf63f869e28d4aa7be0d439f6e9e35ce"><enum>(2)</enum><header>Monitoring</header><text display-inline="yes-display-inline">The Secretary shall monitor the progress of each Indian Tribe participating in the pilot program under this section to ensure that, in siting, designing, engineering, or constructing an eligible project, the Indian Tribe—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaac4235e4fbb4d5e94e1872a16038d9d"><enum>(A)</enum><text display-inline="yes-display-inline">is complying with all applicable laws and regulations, including any requirements that would apply if the Secretary was carrying out the project; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafd3ab9c4b2b4a7093750077a7be148c"><enum>(B)</enum><text>is meeting the standards of the Corps of Engineers for design and quality.</text></subparagraph></paragraph><paragraph id="id1f82b50a54c2417bae68f53f426635d5"><enum>(3)</enum><header>New project partnership agreements</header><text>The Secretary may not enter into a project partnership agreement under this section until the date on which the Secretary issues guidance under paragraph (1). </text></paragraph></subsection><subsection id="idfde6044fc180494293e817b71a26bd34"><enum>(f)</enum><header>Report</header><paragraph id="id5107e8d6a7bc438ca701a4672f42544f"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives and make publicly available a report detailing the results of the pilot program under this section, including—</text><subparagraph id="idb6629827c1cb4a338b12f3c4648dfd5a"><enum>(A)</enum><text>a description of the progress of Indian Tribes in meeting milestones in detailed project schedules developed pursuant to subsection (c)(2); and</text></subparagraph><subparagraph id="id978ae26f498b4421b690b58bd67457fa"><enum>(B)</enum><text>any recommendations of the Secretary concerning whether the pilot program or any component of the pilot program should be implemented on a national basis.</text></subparagraph></paragraph><paragraph id="ida1ff938e4e8f4aa881a2c5cc09a00c18"><enum>(2)</enum><header>Update</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives an update to the report under paragraph (1).</text></paragraph><paragraph id="id6b5b50c9138d45a7a9c85fae93acddc8"><enum>(3)</enum><header>Failure to meet deadline</header><text>If the Secretary fails to submit a report by the required deadline under this subsection, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a detailed explanation of why the deadline was missed and a projected date for submission of the report.</text></paragraph></subsection><subsection id="id16f452bb3bbb46e5a1b917f5f68e7fe9"><enum>(g)</enum><header>Administration</header><text>All laws and regulations that would apply to the Secretary if the Secretary were carrying out the eligible project shall apply to an Indian Tribe carrying out an eligible project under this section.</text></subsection><subsection id="id2521eb1181db421baff04f31378ea8f5"><enum>(h)</enum><header>Termination of authority</header><text>The authority to commence an eligible project under this section terminates on the date that is 5 years after the date of enactment of this Act.</text></subsection><subsection id="id1a02968a07494d8593912ce57e1aeb6e"><enum>(i)</enum><header>Authorization of appropriations</header><text>In addition to any amounts appropriated for a specific eligible project, there is authorized to be appropriated to the Secretary to carry out this section, including the costs of administration of the Secretary, $15,000,000 for each of fiscal years 2025 through 2029. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="idfff5639d6d64468baa3c43568a414b2b"><enum>8.</enum><header>Report on remediation of contaminated ANCSA land</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Secretary, Secretary of the Interior, and other Federal agencies, as the Secretary determines to be appropriate, shall submit to Congress a report that describes—</text><paragraph commented="no" display-inline="no-display-inline" id="idca3952a57e934fdebaeb67dfb62e850e"><enum>(1)</enum><text display-inline="yes-display-inline">the status of remediating ANCSA land pursuant to this Act; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac6e22b591724d6881ba1e580e16cf82"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations on what additional authorities are needed to identify and remediate ANCSA land.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd167d4cdd2af48f9ae36a82fda76a30f"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act conflicts with the requirements of any existing program established for the purpose of remediating ANCSA land or Indian land.</text></section></legis-body></bill>
