which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for water conservation, drought operations, and drought resilience at water resources development projects, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id94de819ff3474c35a59133c728ac4c65"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drought Resilient Infrastructure Act of 2024</short-title></quote>.</text></section><section id="id3eb185730b6945d0a2fada61a38d10d8"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Army. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id16f897162333487bb0f95a8b4ed150a7"><enum>3.</enum><header display-inline="yes-display-inline">Water conservation measures</header><subsection commented="no" display-inline="no-display-inline" id="idf2bbb3383ebb4a5393633d47477f317f"><enum>(a)</enum><header>In general</header><text>The Secretary is authorized to carry out water conservation measures as part of water resources development projects for which water supply is an authorized project purpose.</text></subsection><subsection id="idd9c7a939bae9400c826f10b923310311"><enum>(b)</enum><header>Inclusions</header><text>Water conservation measures authorized under subsection (a) may include—</text><paragraph commented="no" display-inline="no-display-inline" id="id5af08b103d1743ff820213da50d45b72"><enum>(1)</enum><text>operational measures to enhance stormwater retention or aquifer recharge, including the use of nonstructural, natural features or nature-based features;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2eaafe10da1a4d10aa8575a788bd18f4"><enum>(2)</enum><text>releases to augment water supply at another facility; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef58f9cd805548d49c094236291894e6"><enum>(3)</enum><text display-inline="yes-display-inline">modifications to existing Corps of Engineers facilities (including the addition of new project features and the use of nonstructural, natural features or nature-based features) to enhance stormwater retention, water storage, or aquifer recharge; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6cf79b34d754de1bc746ec37778956e"><enum>(4)</enum><text>other actions designed to conserve limited water resources.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idaf6eef6f08304918bb44e088853e8a8c"><enum>(c)</enum><header>Requirement</header><text>The Secretary shall ensure that water conservation measures authorized under subsection (a) are carried out consistent with other authorized project purposes.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7b136048144045abbf6b632cdb671616"><enum>(d)</enum><header>Contributed funds</header><text>Notwithstanding any other provision of law, the Secretary may receive and expend funds contributed by a non-Federal interest or a Federal agency to carry out measures authorized under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9d8a0ea365af42179d31abd85fcb40fe"><enum>(e)</enum><header>Effect</header><paragraph commented="no" display-inline="no-display-inline" id="id8462456f2b49418eaaf9b11013889c6a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8447813b148e4d2eb829fd731d9b630e"><enum>(A)</enum><text display-inline="yes-display-inline">affects any other authority of the Secretary to use amounts derived from revenues from a Bureau of Reclamation project; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc619d99feb0d4e4fa05c355e2ca66c31"><enum>(B)</enum><text>creates, impairs, alters, or supersedes a State water right.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32f744db30dd43eb80f7b61ff6131b61"><enum>(2)</enum><header>Applicable law</header><text>In carrying out this section, the Secretary shall comply with all applicable—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6a476df4cddf41deabe28ebcda543d64"><enum>(A)</enum><text display-inline="yes-display-inline">State water laws;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc898d7f8301b4dfa81d4c158c9b881d2"><enum>(B)</enum><text display-inline="yes-display-inline">Federal laws and policies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id822bce92845c4480beb8b03dc46760de"><enum>(C)</enum><text>interstate water compacts.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idd297abd61db147f7b6dc4ba5ec78847a"><enum>4.</enum><header>Emergency drought operations</header><subsection commented="no" display-inline="no-display-inline" id="id3cec0d99d9b9442f90647ba76566f086"><enum>(a)</enum><header>Definition of covered project</header><text>In this section, the term <term>covered project</term> means any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id4f16cd3bdadc47218f3bd3d210375cf8"><enum>(1)</enum><text>A project of the Corps of Engineers. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ede2576142b44ecb96c3d61d3ac13ea"><enum>(2)</enum><text>A project for which the Secretary develops a water control manual under section 7 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 890, chapter 665; <external-xref legal-doc="usc" parsable-cite="usc/33/709">33 U.S.C. 709</external-xref>). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id715ae92cc0d1473f98b78ec767a223c6"><enum>(b)</enum><header>Emergency operation during drought</header><paragraph commented="no" display-inline="no-display-inline" id="idd8d22886c3c74aa0851f279df167755e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Consistent with other authorized project purposes, with respect to the operation of a covered project during a drought or long-term drought conditions in the project area, the covered project shall be operated with water supply and water conservation as the primary project purposes.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbdca23b81de147af9558390ae7412570"><enum>(2)</enum><header>Coordination</header><text>The operation of a covered project in accordance with paragraph (1) shall be carried out in coordination with the applicable non-Federal interest or Federal agency, to the extent practicable.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbe34ff0750be40f49f2c9e80ef37bab9"><enum>(c)</enum><header>Updates</header><text>In carrying out this section, the Secretary, in consultation with the applicable non-Federal interest or Federal agency, to the extent practicable, shall update the water control manual for a covered project to include drought operations and contingency plans.</text></subsection><subsection id="ide3f8de3ce8194272b4e7a667764994bf"><enum>(d)</enum><header>Requirements</header><text>In carrying out subsection (b), the Secretary shall ensure that—</text><paragraph commented="no" display-inline="no-display-inline" id="id1de41965aaf94c99a74ddb45cf8a44df"><enum>(1)</enum><text>operations described in that subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id95fde2fccf32419ca51ef6e813280e1b"><enum>(A)</enum><text display-inline="yes-display-inline">are consistent with water management deviations and drought contingency plans in the water control manual for the covered project;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31ba674763e14852ae4e06e50ef3f374"><enum>(B)</enum><text>impact only the flood pool managed by the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77a6a11b279749fc96a929ba160ae424"><enum>(C)</enum><text>are not being carried out in the event of a forecast or anticipated flood or weather event that would require the flood risk management mission to take precedence;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a1636920b0c4765b0dd305b66dfd16e"><enum>(2)</enum><text>to the extent practicable, the Secretary uses forecast-informed reservoir operations; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b8a1db55a5b4c07878c19a56f4a34a7"><enum>(3)</enum><text>the covered project returns to operation with original authorized project purposes, at a time determined by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0d8ce7c38f8b491d93b1d2db6d045dbb"><enum>(e)</enum><header>Contributed funds</header><text>Notwithstanding any other provision of law, the Secretary may receive and expend funds contributed by a non-Federal interest or a Federal agency to carry out activities under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id99c2b42b28f44ff18fd1f29c544ff0af"><enum>(f)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary, to the maximum extent practicable, shall coordinate with State and local authorities and relevant Federal agencies in carrying out this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf91f73124ecb498faf2ac84982c3ee8d"><enum>(g)</enum><header display-inline="yes-display-inline">Savings provisions</header><text>Nothing in this section preempts or affects—</text><paragraph commented="no" display-inline="no-display-inline" id="id47fcd165bcbf4e6d8d6073b697416259"><enum>(1)</enum><text>water rights and water supply agreements;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca9a0e8a9eb741edb0f3b59fe9bf7293"><enum>(2)</enum><text display-inline="yes-display-inline">any State water law;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6690ee383cd4024ab4092bf3917a2a5"><enum>(3)</enum><text>any interstate compact governing water; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29bf2f36d47c4a3cb345bbad8cc688eb"><enum>(4)</enum><text>any obligation to comply with the provisions of any Federal or State environmental law, including—</text><subparagraph commented="no" id="idceb115c7dc17466d857b62177c384731"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" id="id163ee81aae7c466f948ef28517de47fb"><enum>(B)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" id="ide1ddee4413f04306832027bc22a334ba"><enum>(C)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>). </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida0f66a1f41964fc58196933d86c1c793"><enum>(h)</enum><header>Authorization of appropriations</header><text>Section 5(a) of the Act of August 18, 1941 (commonly known as the <quote>Flood Control Act of 1941</quote>) (55 Stat. 650, chapter 377; <external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n(a)</external-xref>), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEC286E50C11447F3BDD6B3DCC2AF9033"><paragraph commented="no" display-inline="no-display-inline" id="id6c82cd57a19045018f731c0aedb44dbe"><enum>(6)</enum><header>Authorization of appropriations for emergency drought operations</header><text>Of the amounts made available for each fiscal year to carry out this subsection, not less than $5,000,000 for each of fiscal years 2024 through 2034 shall be used to carry out section 4 of the <short-title>Drought Resilient Infrastructure Act of 2024</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3dbcfec93b2a4f2f8fe8f7fa240b5b24"><enum>5.</enum><header>Drought resilience</header><subsection id="id3de7c80e7f9949eabd25b5b7290837ec"><enum>(a)</enum><header>In general</header><text>The Secretary may carry out a drought resilience project if the Secretary determines that the project—</text><paragraph id="id894c5c205a9a492b82630f521b0f698a"><enum>(1)</enum><text>will provide for drought resilience, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8ee7135401874d8cb3c4acd498d78108"><enum>(A)</enum><text display-inline="yes-display-inline">water conservation measures to mitigate and address drought conditions; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf757fadef5a14261bb2b932133f6ca5c"><enum>(B)</enum><text display-inline="yes-display-inline">the management of sediment for increased water in the system; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f4ef518db62408c988bacc0c28db800"><enum>(C)</enum><text display-inline="yes-display-inline">the mitigation and monitoring associated with aquatic or riparian non-native species that exacerbate drought conditions, such as salt cedar; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf77afba066eb4c7f8d179c3737c9dd26"><enum>(D)</enum><text display-inline="yes-display-inline">the planting of native plant species that will reduce the risk of recurrence and threat associated with non-native plant species; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e29445e2fc344eaac784d3b83430ec3"><enum>(E)</enum><text>other actions that increase drought resilience, including the use of nonstructural, natural features or nature-based features;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id426e95b0960344db889b7b3c018d706d"><enum>(2)</enum><text display-inline="yes-display-inline">is in the public interest; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec3a70f6e5a346dbb26f4415f2751cc9"><enum>(3)</enum><text display-inline="yes-display-inline">is cost effective.</text></paragraph></subsection><subsection id="idd94d0d61d17d48d781a79d5e1a05d073"><enum>(b)</enum><header>Cost sharing</header><paragraph commented="no" display-inline="no-display-inline" id="id832ffd38d0174500a31d80c4f8ed125d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The non-Federal interest shall provide 35 percent of the cost of construction of a project under this section. </text></paragraph><paragraph id="id92AF01119D314191A91781182DDE271E"><enum>(2)</enum><header>Items provided by non-Federal interests</header><subparagraph commented="no" display-inline="no-display-inline" id="idE3EF02C92B0E4D6F95BF3B5319AE900E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The non-Federal interest for a project under this section shall provide all land, easements, rights-of-way, and relocations necessary for the project.</text></subparagraph><subparagraph id="id9AE2056CD0664A72A62F04E779FAF7E8"><enum>(B)</enum><header>Credit</header><text>The value of the land, easements, rights of-way, and relocations referred to in subparagraph (A) shall be credited toward the non-Federal share of the cost of the project under paragraph (1). </text></subparagraph></paragraph></subsection><subsection id="id72087e46e0034e439e5b0b304b609cfa"><enum>(c)</enum><header>Agreements</header><text>Construction of a project under this section shall be initiated only after the Secretary and the non-Federal interest enter into an agreement under which the non-Federal interest agrees to pay—</text><paragraph commented="no" display-inline="no-display-inline" id="id7a03345c97584db698bd5a1ffabc0181"><enum>(1)</enum><text display-inline="yes-display-inline">the non-Federal share of the cost of construction required under this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6333829171e5416692b240d2a56220b9"><enum>(2)</enum><text display-inline="yes-display-inline">100 percent of any operation, maintenance, and replacement and rehabilitation costs with respect to the project, in accordance with regulations prescribed by the Secretary.</text></paragraph></subsection><subsection id="idc7aed7e1b6c7460fa93d67bdc3fcea69"><enum>(d)</enum><header>Cost limitation</header><text>Not more than $10,000,000 in Federal funds may be allotted under this section for a project at any single locality.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc9e4b4bd5be243358cb092223d55a668"><enum>(e)</enum><header>Technical assistance</header><text>As part of carrying out a project under this section, the Secretary may provide technical assistance to non-Federal interests necessary to support comprehensive, system-wide approaches and operations, maintenance, and replacement and rehabilitation that take into account changing conditions from extreme and prolonged weather events.</text></subsection><subsection id="idc38ac04810fc48ffbb99e3fb4c46b8ec"><enum>(f)</enum><header>Funding</header><text>There is authorized to be appropriated to carry out this section $35,000,000 for each fiscal year.</text></subsection><subsection id="ide991f758ece94a97b0fb54b16cef7243"><enum>(g)</enum><header>Savings provisions</header><text>Nothing in this section preempts or affects—</text><paragraph id="idad8b1c70db1a49238faa75c7e83ccdfd"><enum>(1)</enum><text>water rights and water supply agreements;</text></paragraph><paragraph id="id2449cc9a8be94f9ca15913521546d7b1"><enum>(2)</enum><text>any State water law; or</text></paragraph><paragraph id="idcecbf472c65043c789fd93dad5734433"><enum>(3)</enum><text>any interstate compact governing water.</text></paragraph></subsection><subsection commented="no" id="id2edcb27a8b5a4eba9e53bdb0febec9a9"><enum>(h)</enum><header>Conforming amendments</header><paragraph commented="no" id="id90cbc55d502241eebcbd14c9d401b631"><enum>(1)</enum><text>Section 1030(a)(1) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/400">33 U.S.C. 400(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id27b51730c62f45158f8d1546364ea518"><subparagraph commented="no" id="idcca8b96a3c674cdaa029cce07c8d2806"><enum>(L)</enum><text>Section 5 of the <short-title>Drought Resilient Infrastructure Act of 2024</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id449ded0ff9924d4485e97cdef986fd53"><enum>(2)</enum><text>Section 7001(c)(1)(D)(iii) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282d">33 U.S.C. 2282d(c)(1)(D)(iii)</external-xref>) is amended—</text><subparagraph commented="no" id="id571258a5d5024c5eb83c66d2538abb04"><enum>(A)</enum><text>in subclause (VIII), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" id="id1716f0e75d6546c5b696bffbe2a2b7ec"><enum>(B)</enum><text>in subclause (IX), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="id70f070ea4f62455f91ebe00371aabbae"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id869d4896d3b24dc986d553e40694da53"><subclause commented="no" id="idb37239869a7d458ebbf685b6300f8db9"><enum>(X)</enum><text>section 5 of the <short-title>Drought Resilient Infrastructure Act of 2024</short-title>.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id86f51a1404ca47ce86f883c480293274"><enum>6.</enum><header>Leveraging Federal infrastructure for increased water supply</header><text display-inline="no-display-inline">Section 1118(i)(2) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/43/390b-2">43 U.S.C. 390b–2(i)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3e49d3481e5d4225ad6df7dfb4e457d5"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>or a Federal agency</quote> after <quote>non-Federal interest</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f52bb7793d54784bf53180cd5bb3deb"><enum>(2)</enum><text>by inserting <quote>and to carry out any infrastructure modifications required to implement the revised operational documents</quote> after <quote>documents</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id203fd3695fe5421d93b95eac9abb1937"><enum>7.</enum><header>Water supply purpose, Colorado River Basin States</header><subsection commented="no" display-inline="no-display-inline" id="id43ddce6ca70b4f958d70807992c20bf5"><enum>(a)</enum><header>Definition of Colorado River Basin State</header><text>In this section, the term <term>Colorado River Basin State</term> means any of the following States:</text><paragraph commented="no" display-inline="no-display-inline" id="idd2833e04e525463686f022899b3c3273"><enum>(1)</enum><text>Arizona.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11eeb03cda0f46009a38b7474f6f25f9"><enum>(2)</enum><text>California.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id174364319ea046ffbdc400609bc0f3b8"><enum>(3)</enum><text>Colorado.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6261354f4b334e04a068c3fe835f5b2d"><enum>(4)</enum><text>Nevada.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08e82bd33edf4906be5cd8cde8aa75d2"><enum>(5)</enum><text>New Mexico.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide1bf3a22a12c4e0c8f3952601c31208f"><enum>(6)</enum><text>Utah.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95961767f66a46688b101d57f672c3f2"><enum>(7)</enum><text>Wyoming. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9196363745e34c8d8ff9f88460150532"><enum>(b)</enum><header display-inline="yes-display-inline">Modifications</header><text>Each project of the Corps of Engineers in a Colorado River Basin State shall be modified to include water supply as a project purpose if a request for such a modification is made to the Secretary by—</text><paragraph commented="no" display-inline="no-display-inline" id="ida8cca7254082414db494436d30cf701a"><enum>(1)</enum><text display-inline="yes-display-inline">the non-Federal sponsor of the project; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8a5d6d22f234da686a7fb49d132030d"><enum>(2)</enum><text>in the case of a project for which there is no non-Federal sponsor, the Governor of the applicable Colorado River Basin State.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf79fb08c442f457e8631460ffb591935"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary, to the maximum extent practicable, shall coordinate with State and local authorities in carrying out this section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id28e646ee690d430bb9e527368c541ebc"><enum>8.</enum><header>Forecast-informed reservoir operations pilot program</header><text display-inline="no-display-inline">Section 1222 of the America’s Water Infrastructure Act of 2018 (132 Stat. 3811; 134 Stat. 2661) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id144EBC56AD38474299ACE3880923807B"><subsection commented="no" display-inline="no-display-inline" id="id6696b46ca14a43078f19302b345343c7"><enum>(d)</enum><header>Forecast-Informed reservoir operations pilot program</header><text>The Secretary shall carry out a pilot program for the use of forecast-informed reservoir operations in the South Pacific Division of the Corps of Engineers—</text><paragraph commented="no" display-inline="no-display-inline" id="id773c192e09094b82a45295a7ba6dc383"><enum>(1)</enum><text display-inline="yes-display-inline">with the goal of providing for drought resilience; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59842345a35442e698702c58f1b2364b"><enum>(2)</enum><text display-inline="yes-display-inline">for further development and application of the forecast-informed reservoir operations screening process developed by the Corps of Engineers to assess the suitability of performing a full forecast-informed reservoir operations (commonly known as <quote>FIRO</quote>) viability assessment and prioritizing water conservation as a project purpose at projects located in a Colorado River Basin State (as defined in section 7(a) of the <short-title>Drought Resilient Infrastructure Act of 2024</short-title>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id5cf117a4f8014af196168d5be9394f0b"><enum>9.</enum><header>Invasive species that exacerbate drought</header><subsection commented="no" display-inline="no-display-inline" id="idc8644179d2d14fc7ad9a61b97446c3c0"><enum>(a)</enum><header>Aquatic ecosystem restoration</header><text>Section 206(a) of the Water Resources Development Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/33/2330">33 U.S.C. 2330(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id769686a8fa624f8a8496deff92789cf0"><enum>(1)</enum><text>in paragraph (1)(A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id32869748fa3040f29a217ca2458e677e"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id207f4f5bd57e4aca8ba2cf9b2519ba96"><enum>(B)</enum><text>in clause (ii), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf4708ef3f9d4978b8f028863384c46f"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7F12284F46E04122B0A0115363F015FF"><clause commented="no" display-inline="no-display-inline" id="iddaf214ffae17479e9b5e56c85847173d" indent="up1"><enum>(iii)</enum><text>will provide for drought resilience; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddae4644ce94c4de9be282d27357fd929"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBA2C658EA9024037B1AF13B84088AAB7"><paragraph commented="no" display-inline="no-display-inline" id="id500330ada5f34bcab7647cf254799e2d"><enum>(4)</enum><header>Removal and mitigation of invasive species</header><text>A project under this section may include measures to remove and mitigate invasive aquatic or riparian species that exacerbate drought conditions and risk of fire, including the replacement of invasive species with non-invasive native species that reduce the risk of regrowth of invasive species.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id33becdf284344759bdb1b7194b49ab40"><enum>(b)</enum><header>Project modifications for improvement of environment</header><text>Section 1135 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2309a">33 U.S.C. 2309a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2aa50f8229d743d0b5d48865b4b40f9c"><enum>(1)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id23D24E78160C4540ABE519676C966622"><paragraph commented="no" display-inline="no-display-inline" id="idef5f5f462415415bb5e2d4695d503212"><enum>(3)</enum><header>Control of aquatic or riparian invasive species that exacerbate drought conditions and the risk of fire</header><text>The Secretary may use the authority under this section for the mitigation of salt cedar and replacement with native species plantings.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1c1c3cde1f364a178f943785789380ac"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9fc70d8dd36a453daf2ae28e0613ba16"><enum>(A)</enum><text>by striking <quote>(e) The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5FA905EAF2FE41A49A0F6AC3BB0A58C9"><subsection commented="no" display-inline="no-display-inline" id="ide165604f4a194ef18207eb842cca1969"><enum>(e)</enum><header>Coordination and assistance</header><paragraph commented="no" display-inline="no-display-inline" id="id1cdad7d756384eb28cd07145927212f9"><enum>(1)</enum><header>Coordination</header><text>The Secretary</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided28bbee80734d88b51f21050636f2b5"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF0EC7E404CA04F7B8853DEDB9E0019B5"><paragraph commented="no" display-inline="no-display-inline" id="id57a409aca2a845f3af483101057222cc"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to a non-Federal interest managing land adjacent to the water resources project being modified under this section if the Secretary determines the assistance to be necessary in order to extend the benefit or enable success of the modification.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id27D1618FF014402D8B0B4F49A05929DF"><enum>10.</enum><header>Silver Jackets program</header><text display-inline="no-display-inline">Section 206 of the Flood Control Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/33/709a">33 U.S.C. 709a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id367C47C1E5774725A0A4F7AAD0ED0D61"><subsection commented="no" display-inline="no-display-inline" id="id29cb292e9b3b4f94b5e77a50995afeed"><enum>(f)</enum><header>Silver Jackets program</header><text>There is authorized to be appropriated $25,000,000 for each fiscal year to carry out the Silver Jackets program of the Secretary established pursuant to this section and section 204 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5134">42 U.S.C. 5134</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id051a87f3d1ce47ddbf1374b912d962f4"><enum>11.</enum><header>Tribal partnership program</header><subsection commented="no" display-inline="no-display-inline" id="idd71192b67a564da9a72c2439e62dd69a"><enum>(a)</enum><header>Removal of restriction</header><text>Section 203 of the Water Resources Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/33/2269">33 U.S.C. 2269</external-xref>) is amended by striking subsection (e).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5239152bf7154060bf28195cf5e81de4"><enum>(b)</enum><header>Cost-Share</header><text display-inline="yes-display-inline">Section 203(d) of the Water Resources Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/33/2269">33 U.S.C. 2269(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id46ff0a8f482f4d7699d8a7ba8faf45dd"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd67657c0b2864ee7ac47417a738d7526"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>50 percent</quote> and inserting <quote>10 percent</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13701ad52e3642198aca30846561af81"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id72fe450f3e584d3ab4115ff2cb29083f"><subparagraph id="idb71aa85485fd4d2b8769b4f70c45c6c8"><enum>(B)</enum><header>Other costs</header><text>The costs of design and construction of a project described in subparagraph (A) shall be assigned to the appropriate project purposes and shared as described in sections 101 and 103 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2211">33 U.S.C. 2211</external-xref>, 2213) except that—</text><clause id="id23371e848c734ad59f16fbff8741c95e"><enum>(i)</enum><text>the non-Federal share shall be 10 percent;</text></clause><clause id="id9757da44af494882b07dcefd20afe306"><enum>(ii)</enum><text>in the case of a navigation project—</text><subclause commented="no" display-inline="no-display-inline" id="idee7341122e4d453083caffe06c73afcb"><enum>(I)</enum><text display-inline="yes-display-inline">section 101(a)(2) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2211">33 U.S.C. 2211(a)(2)</external-xref>) shall not apply; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7f7f7a4a3374414caed73cee4997b173"><enum>(II)</enum><text display-inline="yes-display-inline">the value of land, easements, rights-of-way, and relocations under subsection (a)(3) of section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2211">33 U.S.C. 2211</external-xref>) and the costs of relocations under subsection (a)(4) of that section shall be included in the total project costs and credited toward the non-Federal share under clause (i); and</text></subclause></clause><clause id="id3a0f41653eba4019afbc3d9c9b25bb87"><enum>(iii)</enum><text>in the case of a flood risk management project, section 103(a)(1)(A) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213(a)(1)(A)</external-xref>) shall not apply.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb212c6c622f048a38731edfd810e7acf"><enum>(2)</enum><text>in paragraph (5)(A), by striking <quote>25 percent</quote> and inserting <quote>10 percent</quote>.</text></paragraph></subsection></section></legis-body></bill>
