which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Act of 2014 to modify provisions relating to base acres, loan rates, and textile mills, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Southern Commodities, Rates, Opportunities, Production, and Support Act</short-title></quote> or the <quote><short-title>Southern CROPS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id6fd9fb9e1b6d453d95f7066cbbd525ea"><enum>2.</enum><header>Base acres</header><text display-inline="no-display-inline">Section 1112 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9012">7 U.S.C. 9012</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd466df44453f45159e0ae14a3110ed96"><enum>(1)</enum><text>by redesignating subsections (b) through (d) as subsections (c) through (e), respectively;</text></paragraph><paragraph id="id70bc849a4aa14971977cac93a9c15f57"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD920E4ED151646649E38D72A274D110B"><subsection id="ida95c6ea6431f4b63a1a1f09c5fec1275"><enum>(b)</enum><header>Base acre increase for underserved farmers of covered commodities</header><paragraph id="ida2581f9f5a8a41adb3d3602f90903662"><enum>(1)</enum><header>Definition of underserved farmer of covered commodities</header><text>In this subsection, the term <term>underserved farmer of covered commodities</term> means an underserved producer (as defined in section 508(a)(7)(A) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1508">7 U.S.C. 1508(a)(7)(A)</external-xref>)) or a limited resource or economically distressed farmer (as determined by the Secretary) of 1 or more covered commodities.</text></paragraph><paragraph id="idcf0354be7cef4c5fb4cb12b0dd386fbe"><enum>(2)</enum><header>Opportunity to increase base acres</header><text>As soon as practicable after the date of enactment of the <short-title>Southern CROPS Act</short-title>, the Secretary shall provide a 1-time opportunity for an underserved farmer of covered commodities to increase base acres on a farm if—</text><subparagraph id="id34e410eb8d9c42a692f3463a76c710f3"><enum>(A)</enum><text>the underserved farmer of covered commodities—</text><clause commented="no" display-inline="no-display-inline" id="id8f846e9a7607474fbff1c9fd5e02d0d6"><enum>(i)</enum><text display-inline="yes-display-inline">is an operator on the farm and provides a significant contribution of active personal labor on the farm; or</text></clause><clause id="ida5297030fc6141928ff85fb2bfe19de8"><enum>(ii)</enum><text>has, or has an option to obtain, a significant ownership share of the farm or a business producing covered commodities on the farm, as determined by the Secretary; and</text></clause></subparagraph><subparagraph id="id9608aa2dc5ec4b1fa713a53a8d77b147"><enum>(B)</enum><text>the average number of acres on the farm planted or prevented from planting as described in subclauses (I) and (II), respectively, of paragraph (3)(A)(i) to covered commodities during the 2018 through 2022 crop years is greater than the number of base acres on the farm.</text></subparagraph></paragraph><paragraph id="idfb873c6f90424f29b5071ae6bd88b899"><enum>(3)</enum><header>Base acre increase</header><subparagraph id="id85f2cea9156640cbad6ff3e9d383b688"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the number of base acres added to a farm under paragraph (2) shall be equal to the difference between—</text><clause id="id56e9122f631e406d88ee2089c92cdbc3"><enum>(i)</enum><text>the sum obtained by adding—</text><subclause id="id96bc50744816435ea2086b93af62843d"><enum>(I)</enum><text>the 5-year average of the acreage planted on the farm to all covered commodities for harvest, grazing, haying, sileage, or other similar purposes for the 2018 through 2022 crop years, according to records submitted to the Farm Service Agency or the Risk Management Agency; and</text></subclause><subclause id="idee987dd7c7e74887bda78cefdd52275a"><enum>(II)</enum><text>the 5-year average of any acreage on the farm that was prevented from planting to 1 or more covered commodities during the 2018 through 2022 crop years because of drought, flood, or other natural disaster, or other condition beyond the control of the producers, according to records submitted to the Farm Service Agency or the Risk Management Agency; and</text></subclause></clause><clause id="id183b3961e1d24a0b88fa5f65eba2cb83"><enum>(ii)</enum><text>the number of base acres for covered commodities on the farm.</text></clause></subparagraph><subparagraph id="id1b86880194e240ad85a0b935693c0878"><enum>(B)</enum><header>Limitations</header><clause commented="no" display-inline="no-display-inline" id="idbb8a588626ef4d74ac9af8efc18e5d98"><enum>(i)</enum><header>Maximum</header><text display-inline="yes-display-inline">Not more than 160 base acres shall be added to any farm under paragraph (2).</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5bfd8ccb08c4eb48b4807669d5551cc"><enum>(ii)</enum><header>Prohibition on reconstitution of farm</header><text>The Secretary shall ensure that producers on a farm do not reconstitute the farm for the purpose of increasing the number of cumulative acres added to the farm under paragraph (2).</text></clause></subparagraph><subparagraph id="id827639282d4242b4844004d98bd161a2"><enum>(C)</enum><header>Distribution</header><text>Base acres added to a farm under paragraph (2) shall be added to the base acreage of each covered commodity on the farm in the proportion that—</text><clause id="id2e08b63e9d8746c586844efc1b0d1757"><enum>(i)</enum><text>the acreage planted or prevented from planting to the covered commodity on the farm; bears to</text></clause><clause id="ide8e1afdbfec64059a0670eeaa9a27bca"><enum>(ii)</enum><text>the acreage planted or prevented from planting to all covered commodities on the farm.</text></clause></subparagraph></paragraph><paragraph id="idd9e5330d41784fb8b9d2c79d6da6e9e0"><enum>(4)</enum><header>Reduction of base acres</header><text>If an underserved farmer of covered commodities on a farm for which base acres have been increased under paragraph (2) does not own or operate the farm for any of the 2025 through 2029 crop years, the Secretary shall reduce the number of base acres on the farm by the number of base acres added to the farm under paragraph (2) for that crop year, in the same proportion among covered commodities on the farm described in paragraph (3)(C).</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id161eeaa68504415db437a1be7e4ec895"><enum>(3)</enum><text>in subsection (d) (as so redesignated), in paragraph (2)(C), by striking <quote>(b)(1)(C)</quote> and inserting <quote>(c)(1)(C)</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8e399527ad2f4c33b36647c909ab5fa2"><enum>3.</enum><header>Loan rates</header><subsection id="id013e847cfe3e4e0a86042d9db1638bd0"><enum>(a)</enum><header>In general</header><text>Section 1202 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9032">7 U.S.C. 9032</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idab2e05b8b4a44399956836a629a66073"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5a1808a1827a42a5b3ad7012137fa7ae"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">2023</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">2024</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id235e3a3edaa944af88fde21088650b6d"><enum>(B)</enum><text>in the matter preceding paragraph (1), by striking <quote>2023</quote> and inserting <quote>2024</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9eec1467c3634c5f8b271b7498f2822e"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide65080269a7b424190e0c95320563d0a"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4CEF9658F7CD447AAC2B5DD8B4EDA142"><subsection id="id0c1569b72f2540b58c839f8acac80325"><enum>(c)</enum><header>2025 and subsequent crop years</header><text>Beginning with the 2025 crop year, the Secretary shall establish a loan rate for a marketing assistance loan under section 1201 for a loan commodity equal to the lesser of—</text><paragraph id="ida6b7a6d1e8f54ac79b8ccc704f023a37"><enum>(1)</enum><text>an amount equal to 110 percent of the loan rate for the loan commodity described in subsection (b); and</text></paragraph><paragraph id="id7052d0bb8a3941debfa91e4f7e65d100"><enum>(2)</enum><text>an amount equal to the greater of—</text><subparagraph id="id5a2cb545b34640d0b55d0b166c6aa541"><enum>(A)</enum><text>the loan rate for the loan commodity described in subsection (b); and</text></subparagraph><subparagraph id="id159df4f55e784eb2a4b1031724dbe202"><enum>(B)</enum><text>the sum obtained by adding—</text><clause id="id3e2230bbe268420fa9479b9525dcab26"><enum>(i)</enum><text>the loan rate for the loan commodity described in subsection (b); and</text></clause><clause id="id85ee198a9c9d462f991fa5330d36d91e"><enum>(ii)</enum><text>the product obtained by multiplying—</text><subclause id="id1dfea769d3bf4532803b30e0cc35a3c8"><enum>(I)</enum><text>the loan rate for the loan commodity described in subsection (b); and</text></subclause><subclause id="id55fa006a413d4b89be563ccba7d2e6ff" commented="no"><enum>(II)</enum><text>using data calculated and published by the Economic Research Service, the quotient obtained by dividing—</text><item commented="no" display-inline="no-display-inline" id="id54f492b9f4cd48e9b8aa1d6b0d740456"><enum>(aa)</enum><text display-inline="yes-display-inline">the difference between—</text><subitem commented="no" display-inline="no-display-inline" id="idcfc764119cbb49178a37f01ad509ea84"><enum>(AA)</enum><text display-inline="yes-display-inline">the forecasted crop input expenses (including interest, labor, property taxes, seed, fertilizer and lime, fuel, oil, electricity, pesticides, and net rent to landowners) for the applicable crop year; and </text></subitem><subitem commented="no" display-inline="no-display-inline" id="id8228aa76044042cf93cf2c70629362b5"><enum>(BB)</enum><text display-inline="yes-display-inline">the average of the crop input expenses for the 5-year period immediately preceding the applicable crop year; by </text></subitem></item><item commented="no" display-inline="no-display-inline" id="id196c01e350b84c1fa7028fa0c7a6ed39"><enum>(bb)</enum><text display-inline="yes-display-inline">the average of the crop input expenses described in item (aa)(AA) for the 5-year period immediately preceding the applicable crop year.</text></item></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1e091976545c4d248641a1aa03eb3dda"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1204(h)(1) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9034">7 U.S.C. 9034(h)(1)</external-xref>) is amended by striking <quote>(a)(20) or (b)(20),</quote> and inserting <quote>(a)(20), (b)(20), or (c),</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id382c58ee50344f5fad2a58c2c308c5c8"><enum>4.</enum><header>Textile mills</header><text display-inline="no-display-inline">Section 1207(c)(2) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9037">7 U.S.C. 9037(c)(2)</external-xref>) is amended—</text><paragraph id="id831874d4258d44ef9c7ed4ae248bd249"><enum>(1)</enum><text>by striking <quote>Effective beginning on August 1, 2013,</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C5F1CA33890411781ADBE3D15B6B3BD"><subparagraph commented="no" display-inline="no-display-inline" id="idf32a80d8de7b445f9a836b28770a4b86"><enum>(A)</enum><header>August 2013 through July 2025</header><text>Effective during the period beginning on August 1, 2013, and ending on July 31, 2025,</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89f7fc9c01a84b8397cd8777fd6fe771"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD84ADD2A1AD349539B9DA8C946C33364"><subparagraph commented="no" display-inline="no-display-inline" id="id9d2bc27b7fdb48429c3afd67021892e4"><enum>(B)</enum><header>Beginning August 2025</header><text>Effective beginning on August 1, 2025, the value of the assistance provided under paragraph (1) shall be 4 cents per pound.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
