which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Environmental Protection Agency to assess the lifecycle greenhouse gas emissions associated with forest biomass combustion for electricity when developing relevant rules and regulations and to carry out a study on the impacts of the forest biomass industry, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Biomass Emissions Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ideee691e19f5648d7b0a74d51ab8fa89a"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id55ddd3ccca49410fa7efac7d21beab92"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fc7576353fa4b0b8ca7631005c280a6"><enum>(2)</enum><header>Forest biomass</header><subparagraph commented="no" display-inline="no-display-inline" id="id814e65ad76a64f5ba0e062c9c70fa064"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>forest biomass</term> means—</text><clause commented="no" display-inline="no-display-inline" id="idb488c227efac4a519b18a40194d82804"><enum>(i)</enum><text>trees grown for energy production;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1cd89d9d99044cc6bbe72bdc53fd9b7a"><enum>(ii)</enum><text>wood waste and wood residues generated from sawmill operations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4b67caadf0234de99270043d96431501"><enum>(iii)</enum><text>low-grade wood generated from timber harvest;</text></clause><clause commented="no" display-inline="no-display-inline" id="id761379418396419a9a875fa6887c4b28"><enum>(iv)</enum><text>forest thinnings;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa2a5202ab384a06b4fd055c6175be62"><enum>(v)</enum><text>timber harvest slash and residues; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddffcb026f8394eafac876f45655fac20"><enum>(vi)</enum><text>forest-derived waste generated from pulp and paper industrial operations.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06fe55cad6dd4ba9b195a49133996aef"><enum>(B)</enum><header>Exclusions</header><text>The term <term>forest biomass</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="ideae0c86504a64844ac6ab99c5b1bc334"><enum>(i)</enum><text display-inline="yes-display-inline">paper that is commonly recycled; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5800dc0d90604c47b58982b56368348f"><enum>(ii)</enum><text>unsegregated solid waste.</text></clause></subparagraph></paragraph><paragraph id="idf1b307e4b31b4b19acb11248b00b0be5"><enum>(3)</enum><header>Impacted community</header><text>The term <term>impacted community</term> means a population living in close proximity to a source of pollution. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d683f0c4d0447cdb2da0df91cb05322"><enum>(4)</enum><header>Lifecycle greenhouse gas emissions</header><text>The term <term>lifecycle greenhouse gas emissions</term> has the meaning given the term in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbe6e98240794568a62d5a1ecc4122c5"><enum>(5)</enum><header>Science Advisory Board</header><text>The term <term>Science Advisory Board</term> means the Science Advisory Board established under section 8(a) of the Environmental Research, Development, and Demonstration Authorization Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/42/4365">42 U.S.C. 4365(a)</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id10d17752f82f4910b2298c6407e80d3f"><enum>3.</enum><header>Lifecycle greenhouse gas emissions assessment</header><subsection commented="no" display-inline="no-display-inline" id="idee96c439a90241b59966704486145596"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>When promulgating any relevant rules and regulations, the Administrator shall assess and take into account the lifecycle greenhouse gas emissions associated with the production of electricity from forest biomass.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3dcb57349f894956a09523dcbd973107"><enum>(b)</enum><header>Requirement</header><text>In conducting the assessment under subsection (a), the Administrator shall account for the full impact on lifecycle greenhouse gas emissions from the combustion of forest biomass used to generate electricity.</text></subsection></section><section id="id49ef9e77d1354638a11c9529c4de560d"><enum>4.</enum><header>Evaluating other impacts of the forest biomass industry</header><subsection commented="no" display-inline="no-display-inline" id="idab5dd6e9170c4f8fad8c32d301660934"><enum>(a)</enum><header>Study</header><paragraph commented="no" display-inline="no-display-inline" id="id477bcb698a2b4e30a3f170a8e15dcd11"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall, in consultation with the Secretary of Energy and the Secretary of Agriculture, carry out a study to identify and assess the impacts of forest biomass electricity production on impacted communities located close to facilities that produce wood pellets from forest biomass, forest biomass power facilities, and active forest biomass harvesting areas.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1d12e3227db45358d47fd01c85161f0"><enum>(2)</enum><header>Inclusion</header><text>In carrying out the study under paragraph (1), the Administrator shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3e64a350ae834ca2940ffbcd2b723c7e"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate—</text><clause commented="no" display-inline="no-display-inline" id="id5ab22411fda84c8c8d1e9f6adc60a6ee"><enum>(i)</enum><text display-inline="yes-display-inline">the sources of, exposures to, and impacts of noise, dust, and air pollutants regulated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>), including criteria air pollutants and hazardous air pollutants, that originate directly from forest biomass pellet mills and processing operations on the premises of facilities described in paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id17b1297d03c14724871ff8e885943f7e"><enum>(ii)</enum><text>other upstream impacts from outside of the premises of those facilities, such as harvesting and trucking; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e03dd7598b14e9fbd5443a8835f532a"><enum>(B)</enum><text>collect data, including data on cumulative impacts, on impacted communities within the geographic areas impacted by upstream and downstream emissions from facilities described in paragraph (1), including—</text><clause commented="no" display-inline="no-display-inline" id="idd2b7dd6394074ed1be8d3e4dec58dc22"><enum>(i)</enum><text display-inline="yes-display-inline">air quality measurements from those industrial sites and within those impacted communities; </text></clause><clause commented="no" display-inline="no-display-inline" id="idffafbf85cff945e0b897befa120387b6"><enum>(ii)</enum><text>the race and socioeconomic status of individuals within those impacted communities; and</text></clause><clause id="id5f9916c31a4e4a788404a092cf1d100f"><enum>(iii)</enum><text>with respect to forest biomass pellet mills, data on compliance with applicable statutes and any penalties applied for violations of those statutes.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc3fa1c3110d14a38a3b80e1b4e679520"><enum>(b)</enum><header>Report</header><text>Not later than 60 days after the date on which the study carried out under subsection (a)(1) is completed, the Administrator shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idcd10c88a24fa4be2bf4b6db3bdd1dd9b"><enum>(1)</enum><text display-inline="yes-display-inline">submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the results of the study; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7e23d1e7dd841e5a1bd3e64afbb3546"><enum>(2)</enum><text>submit the report under paragraph (1) to the Science Advisory Board to further inform the study of forest biomass associated with electricity generation.</text></paragraph></subsection></section></legis-body></bill>
