which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To bolster United States engagement with the Pacific Islands region, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBFE77E0713554D2480269D786B96BD33"><section section-type="section-one" id="H3154C547EE8541C79E14B455C71F182D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pacific Partnership Act</short-title></quote>.</text></section><section id="HD051BFA46CD7479692BF2A0D2D0F7700"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H53574351973942B8875977B532AFD242"><enum>(1)</enum><text>the United States has longstanding and enduring cultural, historic, economic, strategic, and people-to-people connections with the Pacific Islands region, based on shared values, cultural histories, common interests, and a commitment to fostering mutual understanding and cooperation; </text></paragraph><paragraph id="H5582E82C61DD43F8AE5467F6D0B28231"><enum>(2)</enum><text>successive Presidential administrations have recognized the critical importance of the Pacific Islands region to the world in high-level strategic documents, including—</text><subparagraph id="H1567D4725A054932BD892CE76F48C8CA"><enum>(A)</enum><text>the 2015 National Security Strategy, which first declared the rebalance to Asia and the Pacific, affirmed the United States as a Pacific nation, and paved the way for subsequent United States engagement with the Pacific Islands region;</text></subparagraph><subparagraph id="HDD7E0E6D73154A4A812C6D8797B1CA74"><enum>(B)</enum><text>the 2017 National Security Strategy, which included a commitment to <quote>shore up fragile partner states in the Pacific Islands region to reduce their vulnerability to economic fluctuations and natural disasters</quote>;</text></subparagraph><subparagraph id="H72B1D0841F854AB684993EE45D25DE69"><enum>(C)</enum><text>the 2019 Indo-Pacific Strategy Report, which identified the Pacific Islands region as <quote>critical to the U.S. strategy because of our shared values, interests, and commitments</quote>; </text></subparagraph><subparagraph id="HF5FDAC26D1414A83900B40CF448737DA"><enum>(D)</enum><text>the 2022 Indo-Pacific Strategy, which recognized the need to engage further with the Pacific Islands region on shared security goals; and</text></subparagraph><subparagraph id="H15BFFC8B10804F3CAD792293CAB86767"><enum>(E)</enum><text>the 2022 Pacific Partnership Strategy, which outlined goals and methods for deepening United States partnerships with Pacific Island nations; </text></subparagraph></paragraph><paragraph id="HD29247BCFF1F4F7D959C99E7BA9CC90C"><enum>(3)</enum><text>the United States Government should further develop, expand, and support a comprehensive and multifaceted United States policy for the Pacific Islands region that—</text><subparagraph id="H72225F9D724F4CB893A042B661B2B70F"><enum>(A)</enum><text>promotes peace, security, and prosperity for all nations in a manner that respects the sovereignty and political independence of all nations;</text></subparagraph><subparagraph id="H113D275652C44C63AEED44657417021A"><enum>(B)</enum><text display-inline="yes-display-inline">preserves the Pacific Ocean as a corridor for international maritime economic opportunities and growth and promotes sustainable development;</text></subparagraph><subparagraph id="H6ECE2EA318624140951A194C878E89AE"><enum>(C)</enum><text>supports regional efforts to address shared challenges, including by strengthening resilience to natural disasters and stewardship of natural resources; and</text></subparagraph><subparagraph id="H0DE4A56F51BB46FD89FAF764B00F0FF9"><enum>(D)</enum><text>strengthens democratic governance and the rule of law and promotes human rights and the preservation of the region’s cultural heritages; </text></subparagraph></paragraph><paragraph id="H5000B0BF994E46F18C218672D012AD69"><enum>(4)</enum><text>the United States should support the vision, values, and objectives of existing regional multilateral institutions, such as the Pacific Islands Forum and the Pacific Community, and frameworks including—</text><subparagraph id="H1A6B584FF8FA4A26B2B6F5FA6BB25380"><enum>(A)</enum><text>the 2000 Biketawa Declaration;</text></subparagraph><subparagraph id="H24A25658DE4A453CAAF6B51118E5FD83"><enum>(B)</enum><text>the 2014 Framework for Pacific Regionalism;</text></subparagraph><subparagraph id="H684F044DA7E745698E71708E7D55983F"><enum>(C)</enum><text>the 2018 Boe Declaration on Regional Security;</text></subparagraph><subparagraph id="H0A5817888FBF4B7BB372A3DC3681E637"><enum>(D)</enum><text>the Boe Declaration Action Plan; and</text></subparagraph><subparagraph id="H50F606DA7575441BB895018BB17DB1C6"><enum>(E)</enum><text>the 2050 Strategy for the Blue Pacific Continent; and</text></subparagraph></paragraph><paragraph id="HFDCBA901B630468C816699B7852178E3"><enum>(5)</enum><text display-inline="yes-display-inline">the United States should work closely with allies and partners of the United States that have existing relationships and interests in the Pacific Islands region, such as Australia, Japan, South Korea, New Zealand, and Taiwan, and regional institutions such as the Pacific Islands Forum.</text></paragraph></section><section section-type="subsequent-section" id="HD23CD8F09A604B2AB4920E643934AB8D"><enum>3.</enum><header>Strategy for Pacific Partnership</header><subsection id="HEFBE0EE1EBFA435881B03374D9FE9289"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2026, and every 4 years thereafter, the President, in coordination with the Secretary of State, shall develop and submit to the appropriate congressional committees a strategy entitled the <quote>Strategy for Pacific Partnership</quote> (in this section referred to as the <quote>Strategy</quote>).</text></subsection><subsection id="H3EDDBA45550E4F0CB50B6C313C31BCA1"><enum>(b)</enum><header>Matters To be included</header><text>The Strategy shall include each of the following:</text><paragraph id="H9791F46164A7495FA585DF96519EDA66"><enum>(1)</enum><text display-inline="yes-display-inline">A description of overarching goals for United States engagement in the Pacific Islands region, including with respect to the diplomatic posts, defense posture, and economic engagement of the United States.</text></paragraph><paragraph id="H2F6536F58D964E9EA7CF1359E34C2543"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment of threats to and pressures on the Pacific Islands region, including such threats and pressures caused by factors such as—</text><subparagraph id="HABE999A94C3A4086ABEAFC528CF1A22B"><enum>(A)</enum><text>natural disasters;</text></subparagraph><subparagraph id="H55A808DDDB5243888FD7E15A39468CF0"><enum>(B)</enum><text>illegal, unreported, and unregulated fishing;</text></subparagraph><subparagraph id="H5A68749F30934A3B851647AC6CF8D4F8"><enum>(C)</enum><text display-inline="yes-display-inline">the presence and activity of non-United States militaries;</text></subparagraph><subparagraph id="HD3B0CC0A46904B99A421866E5ABC0CE8"><enum>(D)</enum><text>developmental challenges;</text></subparagraph><subparagraph id="H669B8B1798464127B73362E8BD04EA58"><enum>(E)</enum><text>economic coercion and corruption; and</text></subparagraph><subparagraph id="H817D252CFC3849C5AB2B2FD4F0444CFF"><enum>(F)</enum><text display-inline="yes-display-inline">other factors causing a direct risk to the national interests of the United States in the Pacific Islands region, as determined by the President.</text></subparagraph></paragraph><paragraph id="HAE99149B32B8416CB77E22D689EDD177"><enum>(3)</enum><text>A plan to address the threats assessed pursuant to paragraph (2).</text></paragraph><paragraph id="HAB2AAA1BFAC24B92A6032BDCF79C620A"><enum>(4)</enum><text display-inline="yes-display-inline">An analysis of the needs and goals expressed by governments of nations in the Pacific Islands region, including at or through multilateral institutions, evaluated in light of the national interests of the United States.</text></paragraph><paragraph id="HA75A6CB10AB84B4DB122FF13EF171DAA"><enum>(5)</enum><text display-inline="yes-display-inline">A plan for the resources necessary for the United States to meet its goals in the Pacific Islands region.</text></paragraph><paragraph id="HCB403BE1CBC9484CADEC89ED0C7A8F2A"><enum>(6)</enum><text display-inline="yes-display-inline">An identification of mechanisms, including existing forums, for coordinating and cooperating on shared goals among the following, as appropriate:</text><subparagraph id="H9E950A39CAB4406C94720F514202D900"><enum>(A)</enum><text>The governments of nations in the Pacific Islands region.</text></subparagraph><subparagraph id="HDAD143B8B2644BB99DF98D463169F3DA"><enum>(B)</enum><text display-inline="yes-display-inline">Regional partners in the Pacific Islands region, including multilateral forums and organizations such as the Pacific Islands Forum.</text></subparagraph><subparagraph id="HA7D6FC91B6C24CD7B9AE5EF2DCC5C86B"><enum>(C)</enum><text>Civil society in the Pacific Islands region. </text></subparagraph><subparagraph id="HA370FD75FDF748CBA11DB93A708D36E8"><enum>(D)</enum><text display-inline="yes-display-inline">Subnational governments of the United States in the Pacific.</text></subparagraph></paragraph></subsection><subsection id="H97CC93B8862B44708551AE29726D5D8F"><enum>(c)</enum><header>Consultation</header><text>In developing the Strategy, the President shall consult, as the President considers appropriate, with—</text><paragraph id="HAFB07049B3D745CFA6AF0FBBDED23B5B"><enum>(1)</enum><text>such governmental agencies of the United States as the President considers relevant; </text></paragraph><paragraph id="H435920E072544F6C9520B1413D968DF0"><enum>(2)</enum><text display-inline="yes-display-inline">regional organizations such as the Pacific Islands Forum, the Pacific Islands Development Program, the Pacific Community, the Forum Fisheries Agency, and the Secretariat of the Pacific Regional Environment Programme;</text></paragraph><paragraph id="HC3C9E9BC936B4D50A0AB7D3F5EB212AF"><enum>(3)</enum><text display-inline="yes-display-inline">the governments of nations in the Pacific Islands region;</text></paragraph><paragraph id="HB834C88F8B2A477CA30BEBF5A674B363"><enum>(4)</enum><text>stakeholders from civil society;</text></paragraph><paragraph id="HB7BA45D0D3494F7FA2E60D219AEB184C"><enum>(5)</enum><text>allies and partners of the United States; and</text></paragraph><paragraph id="H3C4F2BD15FD44D8FBD57F31A3E7988AC"><enum>(6)</enum><text>States and territories of the United States in the Pacific.</text></paragraph></subsection><subsection id="idAC2541A7C94C4759AEDD20048EA62963"><enum>(d)</enum><header>Report on implementation</header><paragraph id="idBC56BD2354DB478198AE3721931DB38F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Strategy is submitted, the President shall submit to the appropriate congressional committees a report on the implementation of the Strategy. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd68fdf9956a42afb5012f84b515f10b"><enum>(2)</enum><header>Matters To be included</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall include the following:</text><subparagraph id="idDF4BD7DAD14B4E3985997F2DA4A4ACD6"><enum>(A)</enum><text>A proposed timeline for the implementation of the Strategy. </text></subparagraph><subparagraph id="id0EFE4B56D3C54B0F9EBE2775D9573947"><enum>(B)</enum><text>The number of full-time equivalent positions and contractors needed to achieve the goals included in the Strategy. </text></subparagraph><subparagraph id="idC75FE3E82A63495A9045733CAEC2D8BD"><enum>(C)</enum><text>A description of any institutional or structural reorganizations the President recommends to help carry out the Strategy. </text></subparagraph><subparagraph id="idDC6B6CA0471045E1ABA7A0B5100ADC2B"><enum>(D)</enum><text>An identification of any additional funding needed to carry out the Strategy. </text></subparagraph></paragraph><paragraph id="id3D6E979B1C4D4DB6A43D023769B5397E" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Consolidation</header><text>The report required by paragraph (1) may be consolidated with any other report required to be submitted by the President on the date described in such paragraph or a similar date. </text></paragraph></subsection></section><section commented="no" id="H7C205993FA064E3F92EBFDA75BFBB250"><enum>4.</enum><header>Extension of diplomatic privileges, exemptions, and immunities to the Pacific Islands Forum</header><text display-inline="no-display-inline">The provisions of the International Organizations Immunities Act (<external-xref legal-doc="usc" parsable-cite="usc/22/288">22 U.S.C. 288 et seq.</external-xref>) may be extended to the Pacific Islands Forum in the same manner, to the same extent, and subject to the same conditions as such provisions may be extended to a public international organization in which the United States participates pursuant to any treaty or under the authority of any Act of Congress authorizing such participation or making an appropriation for such participation.</text></section><section id="H46CA9BCE43CD4F16A960A779C8E1A087"><enum>5.</enum><header>Consultation and coordination with allies and partners in the Pacific Islands region</header><subsection id="H2E544C9918FB4648B8A7F820346D5A5D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President, in consultation with the Secretary of State and such other heads of Federal departments and agencies as the President considers relevant, shall consult and coordinate with allies and partners of the United States in the Pacific Islands region, including Australia, Japan, New Zealand, Taiwan, and regional institutions such as the Pacific Islands Forum, the Pacific Islands Development Program, the Pacific Community, and the Secretariat of the Pacific Regional Environment Programme, with respect to programs to provide assistance to the Pacific Islands region, including for purposes of—</text><paragraph id="H5A0A4DE914534B1E86F0AE2EED47B18A"><enum>(1)</enum><text>deconflicting programming;</text></paragraph><paragraph id="H5AD9DA08CA2C4F439A1ECA0FE32C3F43"><enum>(2)</enum><text>ensuring that any programming does not adversely affect the absorptive capacity of the Pacific Islands region;</text></paragraph><paragraph id="H746617F0144C40C5B8FE637EF9CA66F8"><enum>(3)</enum><text>ensuring complementary programs benefit the Pacific Islands region to the maximum extent practicable; and</text></paragraph><paragraph id="H137DDB3E8EF043909C34E90685F7B470"><enum>(4)</enum><text>ensuring that programming aligns with regional development goals, as outlined by documents such as the 2050 Strategy for the Blue Pacific Continent, in order to support sustainable development and promote a shared vision for the future of the Pacific Islands region.</text></paragraph></subsection><subsection id="H4FEFB583E4DD4DA18C4AE31C4C67059E"><enum>(b)</enum><header>Formal consultative process</header><text>The President shall establish a formal consultative process with the allies and partners described in subsection (a) for coordination with respect to the programs described in such subsection.</text></subsection></section><section id="H5685C793CD434E8489BAE2D2989ADEDA"><enum>6.</enum><header>Reports on transnational crime affecting the Pacific Islands region</header><subsection id="H180AF9ED229F474D9693BCE114398ADD"><enum>(a)</enum><header>Updates of certain reports</header><text display-inline="yes-display-inline">The Secretary of State, in coordination with such other heads of Federal departments and agencies as the Secretary considers appropriate, shall annually update the reports listed in subsection (b) to include a discussion of transnational crime affecting the Pacific Islands region.</text></subsection><subsection id="H60A29B39E91C4A8A9A90334B5AF4E6D1"><enum>(b)</enum><header>Reports listed</header><text>The reports listed in this subsection are the following:</text><paragraph id="HD6B5CA132E38479EADF0165ABCE207E1"><enum>(1)</enum><text>The international narcotics control strategy report required by section 489(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291h">22 U.S.C. 2291h(a)</external-xref>).</text></paragraph><paragraph id="HEC28A600E44B4CBC8AE96DD25116A640"><enum>(2)</enum><text display-inline="yes-display-inline">The report on international compliance with fisheries requirements required by section 607 of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826h">16 U.S.C. 1826h</external-xref>). </text></paragraph><paragraph id="HF439A6C39F66411BB353F6DC36CC4BA1"><enum>(3)</enum><text>The report on trafficking in persons required by section 110(b)(1) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)(1)</external-xref>).</text></paragraph></subsection></section><section id="HEB6BA2874B384E0E8B3FB8922B2813E2"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB7DD86CBC7144C44BD24F61D746BFDE9"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ideeed7ad17b9a4bdca192c37b5c9532f1"><enum>(A)</enum><text>the Committee on Foreign Relations of the Senate; and </text></subparagraph><subparagraph id="H030F5BAE462A4DAAB554B7D024DC5EEA"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs of the House of Representatives. </text></subparagraph></paragraph><paragraph id="HC4CEA7C2CB504E34AE09A65E1C791C9C"><enum>(2)</enum><header>Pacific Islands region</header><text display-inline="yes-display-inline">The term <term>Pacific Islands region</term> means the nations, territories, and other jurisdictions in the Pacific Ocean within Melanesia, Micronesia, and Polynesia.</text></paragraph></section></legis-body></bill>
