which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to identify, analyze, and share available data for the purpose of improving the reliability and resilience of the electric grid, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Grid Reliability and Integrated Data Act of 2024</short-title></quote> or the <quote><short-title>GRIData Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id9601dde913db43d181ea53c3cda97f6a"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id384f70a0290a40b8bbf47ada6620d398"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idb4c67a63dad84c19a7e55fadbd251114"><enum>(1)</enum><header>Customer Average Interruption Duration Index; CAIDI</header><text>In accordance with IEEE 1366, the term <term>Customer Average Interruption Duration Index</term> or <term>CAIDI</term> means the average number of minutes per sustained interruption experienced by customers per year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf2abb51e1e2543f9b778c6f5c74f8c7a"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id582aeb46e3c941cabc6ea5a439862e22"><enum>(3)</enum><header>Energy community</header><text>The term <term>energy community</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/45">section 45(b)(11)(B)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60d1b2ccf2d94e26913a143aa5fe810d"><enum>(4)</enum><header>IEEE 1366</header><text>The term <term>IEEE 1366</term> means the standard published by the Institute of Electrical and Electronics Engineers Standards Association entitled <quote>IEEE Guide for Electric Power Distribution Reliability Indices</quote> and numbered 1366 (as in effect on the date of enactment of this Act).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id701c840bf68a428a95a30897c4b1451e"><enum>(5)</enum><header>Integrated resource planning</header><text>The term <term>integrated resource planning</term> means modeling and evaluating how projected long-term electricity demands (such as electricity demands over periods of 5, 10, 20, or more years) within a service area can be met with a combination of electric generation resources that best achieve desired metrics, such as metrics relating to reliability, resilience, and cost.</text></paragraph><paragraph id="idfa8d15d874a04e5e9e0a13506e72dbcd"><enum>(6)</enum><header>Momentary Average Interruption Frequency Index; MAIFI</header><text>In accordance with IEEE 1366, the term <term>Momentary Average Interruption Frequency Index</term> or <term>MAIFI</term> means the average number of momentary interruptions experienced by customers per year.</text></paragraph><paragraph id="id9c4e1d219b424a87bf5d415f1fc178f4"><enum>(7)</enum><header>Momentary interruption</header><subparagraph commented="no" display-inline="no-display-inline" id="id977a6dfd21a440ee9918523b84930e74"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with IEEE 1366, the term <term>momentary interruption</term> means a brief loss of power, as determined by the applicable electric utility, subject to subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2414eb1ab574bc7af21169e1ea6f898"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>momentary interruption</term> does not include a loss of power lasting more than 5 minutes.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a2c1196b2b64ce980c6ca8e6fd93c50"><enum>(8)</enum><header>Reliability</header><text>The term <term>reliability</term>, with respect to the electric grid, means the ability of the electric grid or the components of the electric grid to withstand instability, uncontrolled events, cascading failures, or unanticipated loss of system components.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc34a1e3db22b45b2a856e765c6239328"><enum>(9)</enum><header>Resilience</header><text>The term <term>resilience</term>, with respect to the electric grid, means the ability of the electric grid or the components of the electric grid to adapt to changing conditions and withstand and rapidly recover from disruptions, including disruptions caused by extreme weather conditions or emerging threats.</text></paragraph><paragraph id="id7ad8f7687f024730b925648e97ca5fec"><enum>(10)</enum><header>Resource adequacy</header><text display-inline="yes-display-inline">The term <term>resource adequacy</term> means the adequate supply and provision of electricity from various electric generation resources to meet projected electricity demands in a service area.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id110f3949e03745baac1e14c7e1592303"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56bbf5371b434a2296a488bb434da872"><enum>(12)</enum><header>Sustained interruption</header><text>In accordance with IEEE 1366, the term <term>sustained interruption</term> means an interruption in power service lasting more than 5 minutes.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24a164605ee34cc3bcc6c85756cbe55e"><enum>(13)</enum><header>System Average Interruption Duration Index; SAIDI</header><text>In accordance with IEEE 1366, the term <term>System Average Interruption Duration Index</term> or <term>SAIDI</term> means the average number of minutes of sustained interruption per customer per year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3207061ac614eea93e7b28c71e5b64b"><enum>(14)</enum><header>System Average Interruption Frequency Index; SAIFI</header><text>In accordance with IEEE 1366, the term <term>System Average Interruption Frequency Index</term> or <term>SAIFI</term> means the average number of sustained interruptions per customer per year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id406475e4855f4315a40633f775fdf373"><enum>(b)</enum><header>Disadvantaged community; low-Income community; rural area</header><paragraph commented="no" display-inline="no-display-inline" id="id514dcfa386be46c6a0f1a7e8a7d2f50e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall define the terms <term>disadvantaged community</term>, <term>low-income community</term>, and <term>rural area</term> for purposes of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81b272a0dc644eed94b50008f72eb99f"><enum>(2)</enum><header>Requirement</header><text>In carrying out paragraph (1), the Secretary shall take into consideration, as applicable, the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idc57466336ed24badaf84ffad605cf2c0"><enum>(A)</enum><text>The definition of the term <term>disadvantaged community</term> in each of—</text><clause commented="no" display-inline="no-display-inline" id="id9dcd9ab01ac4405e84bcdc97d1479a5d"><enum>(i)</enum><text>section 6001 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/1015">16 U.S.C. 1015</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id31dcc1455f0b4b9f8f4dd2eb8d0b67c4"><enum>(ii)</enum><text display-inline="yes-display-inline">section 50121(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18795">42 U.S.C. 18795(d)</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id597abb45933d4b029a979859125706cd"><enum>(B)</enum><text>The definition of the term <term>low-income community</term> in each of—</text><clause commented="no" display-inline="no-display-inline" id="id2a2c543c9cd446318f0f2b89233abf09"><enum>(i)</enum><text display-inline="yes-display-inline">section 11406(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/149">23 U.S.C. 149</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf6ca065da26b491686cca66ad5f17cbe"><enum>(ii)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83799374912c45b2899ce09cfb3947ea"><enum>(C)</enum><text>The definition of the term <term>rural area</term> in each of—</text><clause commented="no" display-inline="no-display-inline" id="id4233745ba3cb4d72a3cdfbaa75fcdb74"><enum>(i)</enum><text>section 609(a) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/918c">7 U.S.C. 918c(a)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idaeeb522b002a4ab8b06d1e3efc4c3f04"><enum>(ii)</enum><text display-inline="yes-display-inline">section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id67502673c3e34719ae5a65f1d9efd604"><enum>(iii)</enum><text>section 6702(a) of title 49, United States Code.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idbd8954a3d0f04d22831801ed7c6c1422"><enum>3.</enum><header>Identification, analysis, and sharing of data</header><subsection commented="no" display-inline="no-display-inline" id="id01459d6d031e438ba381a071f217b8f0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall work with appropriate entities, as necessary, to identify, analyze, and share available data in a manner necessary—</text><paragraph commented="no" display-inline="no-display-inline" id="idcb8b1d3ab9c04004896d4a1b0257c942"><enum>(1)</enum><text display-inline="yes-display-inline">to inform and improve the reliability and resilience of the electric grid, especially in rural areas, low-income communities, disadvantaged communities, and energy communities; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83f642edd780425b935bd748ccf07deb"><enum>(2)</enum><text>to improve long-term reliability assessments, resource adequacy models, and integrated resource planning.</text></paragraph></subsection><subsection id="idcaf94a802e914b068644c008a31f7248"><enum>(b)</enum><header>Data identification and analysis</header><paragraph commented="no" display-inline="no-display-inline" id="id66a8c3835b1d4737a7d9a5a53f2a8d76"><enum>(1)</enum><header display-inline="yes-display-inline">Reliability and resilience data</header><subparagraph id="id32bc0981ca214350871bb5ab843ea87c"><enum>(A)</enum><header>Types of reliability and resilience data</header><text>In identifying and analyzing relevant data under subsection (a), the Secretary shall consider the types of data to be shared, including—</text><clause id="id7bc7abc9e4ab4a049c2a3051b7b3d294"><enum>(i)</enum><text>existing IEEE 1366 reliability data and metrics, including—</text><subclause commented="no" display-inline="no-display-inline" id="id8f0fd3b968b5447da620e4b91e7872e9"><enum>(I)</enum><text display-inline="yes-display-inline">the System Average Interruption Duration Index (SAIDI);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id90982157363e4081a8bb7ba057f8915e"><enum>(II)</enum><text>the System Average Interruption Frequency Index (SAIFI);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id378ee612d2b94e45a72d5e01a9609625"><enum>(III)</enum><text>the Customer Average Interruption Duration Index (CAIDI);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5c37f2447e3d4eb4b6159990d93a4ce7"><enum>(IV)</enum><text display-inline="yes-display-inline">the Momentary Average Interruption Frequency Index (MAIFI); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida9ddad37353c4019860a32c5c28ebc9b"><enum>(V)</enum><text>any other reliability data or metric defined in IEEE 1366, as the Secretary determines to be appropriate; and</text></subclause></clause><clause id="id39d2e1f56b2347f0b309ab283455d5cb"><enum>(ii)</enum><text>any new or modified data or metric, as the Secretary determines to be appropriate.</text></clause></subparagraph><subparagraph id="id10826b01b10147098445742b94f6e0d6"><enum>(B)</enum><header>Temporal frequency of reliability and resilience data</header><text>In identifying and analyzing relevant data under subsection (a), the Secretary shall consider—</text><clause commented="no" display-inline="no-display-inline" id="id616ac449ea234b8983bbf889f809f143"><enum>(i)</enum><text display-inline="yes-display-inline">the temporal frequency of the production or collection of that data—</text><subclause id="idab01697ab9e14d86a74894f56fd21f55"><enum>(I)</enum><text>to inform the reporting and dissemination of information relating to the reliability and resilience of the electric grid on an annual basis, especially in rural areas, low-income communities, disadvantaged communities, and energy communities; and</text></subclause><subclause id="id877bda8fa61e42eeac42c248ef9c7897"><enum>(II)</enum><text>to the maximum extent practicable, to inform customers experiencing power outages of anticipated recovery times on a real-time basis, such as through the Outage Data Initiative Nationwide (ODIN) program of the Department; and</text></subclause></clause><clause id="idb28bf51f30f846429cdd9dd6c27359e1"><enum>(ii)</enum><text>any other considerations relating to the temporal frequency of the production or collection of that data, as the Secretary determines to be appropriate.</text></clause></subparagraph><subparagraph id="id1d223be463ab4a8d8f4d09d1146f322d"><enum>(C)</enum><header>Spatial resolution of reliability and resilience data</header><text>In identifying and analyzing relevant data under subsection (a), the Secretary shall consider—</text><clause commented="no" display-inline="no-display-inline" id="id9a7a1a4d7c274f8ea9686a44e263d0e4"><enum>(i)</enum><text display-inline="yes-display-inline">the spatial resolution of that data, with a goal—</text><subclause id="idc9a4ced95a2a46fa8bfa048cd77609e1"><enum>(I)</enum><text>to inform the reporting and dissemination of information relating to the reliability and resilience of the electric grid on an annual basis, especially in rural areas, low-income communities, disadvantaged communities, and energy communities; and</text></subclause><subclause id="id25F80D8F69D548A79917DCC450346B38"><enum>(II)</enum><text>to the maximum extent practicable, to inform customers experiencing power outages of anticipated recovery times on a real-time basis, such as through the Outage Data Initiative Nationwide (ODIN) program of the Department; and</text></subclause></clause><clause id="id813091059f7943ed9cb3dfda24f256ee"><enum>(ii)</enum><text>any other considerations relating to the spatial resolution of that data, as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id7b0fdfac39264720ab9b8640759a4348"><enum>(2)</enum><header>Weather data</header><text>In identifying and analyzing relevant historical or simulated future weather data required for long-term reliability assessments, resource adequacy models, and integrated resource planning under subsection (a), the Secretary shall, as necessary, work with National Laboratories, the National Center for Atmospheric Research, the National Oceanic and Atmospheric Administration, and other agencies or entities to consider—</text><subparagraph id="ida45b197e8aa348dab6d2ba52126ee321"><enum>(A)</enum><text>the type of data, which shall include meteorological variables that have significant impact on—</text><clause commented="no" display-inline="no-display-inline" id="id0459c8463f5347918a5e268224d5f76f"><enum>(i)</enum><text display-inline="yes-display-inline">generation, transmission, storage, or distribution availability; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id88bb25be48674031b605a47359babf05"><enum>(ii)</enum><text display-inline="yes-display-inline">electricity demand;</text></clause></subparagraph><subparagraph id="id52a6016c6191493192fef43844b7dbf4"><enum>(B)</enum><text>the representativeness of the data, with a goal to approximate actual conditions as closely as reasonably possible with representativeness validated and uncertainty quantified;</text></subparagraph><subparagraph id="id32363b56b888465aa2d2c51ac1c253e0"><enum>(C)</enum><text>the spatial resolution of observational data, with a goal to provide weather data over a grid with 2 kilometer spacing or smaller;</text></subparagraph><subparagraph id="id58691286c50e4699947f8900fe177bb3"><enum>(D)</enum><text>the frequency of the data, with a goal to report weather data not less frequently than hourly, and preferably every 15 minutes; and</text></subparagraph><subparagraph id="id9781103faab24b93b3aedc692a49a4bf"><enum>(E)</enum><text>the duration of the data, with a goal for the data to be—</text><clause commented="no" display-inline="no-display-inline" id="id59b6a3c93b644b96a57deaffe89baee0"><enum>(i)</enum><text display-inline="yes-display-inline">chronologically consistent, complete, and span at least a 30-year period; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5e2fb932176d4dc28e520b46e3bb8517"><enum>(ii)</enum><text display-inline="yes-display-inline">updated periodically, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id417c0ffec92b46109d9596d30daef3ad"><enum>(3)</enum><header>Potential data needs</header><text>In identifying and analyzing relevant data under subsection (a), the Secretary shall consider potential future needs, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8a45e3c47bcd4748915a1e7f10ec78c8"><enum>(A)</enum><text display-inline="yes-display-inline">emerging technologies that employ machine learning or artificial intelligence for the purposes of improving—</text><clause commented="no" display-inline="no-display-inline" id="id7a4712fd6279416981400fc17c7006e9"><enum>(i)</enum><text display-inline="yes-display-inline">the reliability and resilience of the electric grid, especially in rural areas, low-income communities, disadvantaged communities, and energy communities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcc8f553cabf443028a1ffc27e4b93146"><enum>(ii)</enum><text display-inline="yes-display-inline">long-term reliability assessments, resource adequacy models, and integrated resource planning;</text></clause></subparagraph><subparagraph id="id657d1d6ff632442bbabddd7f6b5261f1"><enum>(B)</enum><text>the changing mix of energy generation resources and demands on the electric grid, including energy efficiency as a resource;</text></subparagraph><subparagraph id="id72d3ac5b07ff4bf9b19714557130ec40"><enum>(C)</enum><text>the security and costs associated with collecting and sharing those data; and</text></subparagraph><subparagraph id="id323584f359f34dd8b39e322a1623bdb5"><enum>(D)</enum><text>ways to mitigate risks and cost impacts to utilities associated with data collection and sharing. </text></subparagraph></paragraph><paragraph id="ideeda03f66a404ed3be0a16b4748f64ca"><enum>(4)</enum><header>Methods and platforms</header><text>In identifying and analyzing relevant data under subsection (a) with consideration of the factors described in paragraphs (1) through (3), the Secretary shall consider the available methods and platforms for acquiring and sharing the data, including—</text><subparagraph id="idf585667836d142e5a824f35532fc25c1"><enum>(A)</enum><text>existing surveys, such as the surveys carried out using Form EIA–861 of the Energy Information Administration;</text></subparagraph><subparagraph id="id4ba35d339b484910922f376db943bfb1"><enum>(B)</enum><text>existing data sharing platforms, such as—</text><clause commented="no" display-inline="no-display-inline" id="id235d6ee9eabc468683e9f4679393420c"><enum>(i)</enum><text display-inline="yes-display-inline">the Open Energy Data Initiative of the Department;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1424215ef44d4eff8c0d86e11e8989df"><enum>(ii)</enum><text>the Outage Data Initiative Nationwide (ODIN) program of the Department;</text></clause><clause commented="no" display-inline="no-display-inline" id="id417f9b574a094e29a6cfefb4ca57eb9f"><enum>(iii)</enum><text display-inline="yes-display-inline">the U.S. Energy Atlas of the Energy Information Administration;</text></clause><clause commented="no" display-inline="no-display-inline" id="id84b94171fc144077a4b7bb765822a542"><enum>(iv)</enum><text display-inline="yes-display-inline">the Wind Data Hub of the Pacific Northwest National Laboratory; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id95efd2525d5f438fb78daa2503410865"><enum>(v)</enum><text display-inline="yes-display-inline">the National Solar Radiation Database of the National Renewable Energy Laboratory; and </text></clause></subparagraph><subparagraph id="idaff43c049e354804ade70c545ea95f16"><enum>(C)</enum><text>other methods and platforms, as the Secretary determines to be appropriate, including automated data collection methods.</text></subparagraph></paragraph></subsection><subsection id="iddf09b1688ead4ad29622e9489795a477"><enum>(c)</enum><header>Data and information sharing</header><paragraph id="id0f83afec02124122880dfa0fd6cc4893"><enum>(1)</enum><header>Report</header><subparagraph commented="no" display-inline="no-display-inline" id="id7a29a4b679b14f6b9dfc7839e81ea0fb"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress and make publicly available a report that summarizes the findings from the activities conducted under subsection (b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c47d047d1bb4d4fa3f42b6647b928d9"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">The report under subparagraph (A) shall provide recommendations on the data types, spatial and temporal resolution, collection methods, and sharing platforms that will better assist utilities, regulators, National Laboratories, academic institutions, and associated agencies and entities in improving long-term electric reliability, resilience, resource adequacy modeling, and integrated resource planning.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f847016adb04a749049857c20ae6e3e"><enum>(C)</enum><header>Consideration of costs and security risks</header><text display-inline="yes-display-inline">To the extent practicable, the report under subparagraph (A) shall consider costs and potential security risks associated with data collection and sharing, with the goal of minimizing costs and maximizing privacy and security, as needed.</text></subparagraph></paragraph><paragraph id="idcab71d80b43b4f8cb84e0224e6751592"><enum>(2)</enum><header>Websites</header><subparagraph id="id3958a35ccf1c46d98e9837498ba3a28f"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall identify existing websites administered by the Department or entities funded by the Department, including websites of the Energy Information Administration or the National Laboratories, or establish new websites, to share available data in a manner identified under subsection (b) and reported under paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2b36fefcce44df2aa2c8c7fb9c23e10"><enum>(B)</enum><header>Preference</header><text display-inline="yes-display-inline">To improve accessibility and standardization, the Secretary, in carrying out subparagraph (A), shall give preference to fewer centralized and integrated websites with appropriate links and references, as necessary, rather than to multiple independent websites.</text></subparagraph><subparagraph id="id496acdb236724e6da416ef95b8d85fa7"><enum>(C)</enum><header>Updates</header><text>The websites described in subparagraph (A) shall be updated as needed, as determined by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="idf4675912e6764672b756b62198cd7a73"><enum>(d)</enum><header>Steering committee</header><paragraph id="id911f31396d2140d0be0c310d9f549ad1"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a steering committee comprising a group of stakeholders, including, as the Secretary determines to be appropriate—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbae1f0c933d940f4a7bebbeac9dd5d56"><enum>(A)</enum><text display-inline="yes-display-inline">representatives from relevant Federal agencies, such as—</text><clause id="ide3d73d1a60e74d3f84f13ed3527bbcc8"><enum>(i)</enum><text>the Office of Science and Technology Policy;</text></clause><clause id="idbac3bd381bd74a90bb9562801eb95164"><enum>(ii)</enum><text>the Office of Electricity of the Department;</text></clause><clause id="idbd6543c67a444fe6a5e6c115e528894c"><enum>(iii)</enum><text>the Office of Energy Efficiency and Renewable Energy of the Department;</text></clause><clause id="id3b98abe72b8040008548354cd394eaf8"><enum>(iv)</enum><text>the Office of Cybersecurity, Energy Security, and Emergency Response of the Department;</text></clause><clause id="id30752939715e409c8d508cb6cad2262f"><enum>(v)</enum><text>the Energy Information Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6126278fa01b4a8ebac0b525e40ad315"><enum>(vi)</enum><text>the Federal Energy Regulatory Commission;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba0e4dfd8c0f4fdfba0b4ca3aa65290f"><enum>(B)</enum><text display-inline="yes-display-inline">representatives of regulators and electric power sectors, such as—</text><clause id="id9e26ced9e93944d8991434e65fd53cd9"><enum>(i)</enum><text>the North American Electric Reliability Corporation;</text></clause><clause id="id5e5365481e854216b92c4d675c174c64"><enum>(ii)</enum><text>the National Association of Regulatory Utility Commissioners;</text></clause><clause id="ide43343e1db434cf196d809254ffca1cd"><enum>(iii)</enum><text>State utility commissioners;</text></clause><clause id="id7ad147326f0146e584cdaba60b046f30"><enum>(iv)</enum><text>grid asset owners and operators from the investor-owned utility segment;</text></clause><clause id="id4b4f18f1b0534722bf8978441ec66d26"><enum>(v)</enum><text>grid asset owners and operators from the public power segment;</text></clause><clause id="id9ff708dbfce248158cc62920b6181a9a"><enum>(vi)</enum><text>grid asset owners and operators from the cooperative segment; and</text></clause><clause id="idc2dfa647fd9f4b95ab242c7df38019b3"><enum>(vii)</enum><text>the Institute of Electrical and Electronics Engineers; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27d9b33d02844a98b4373e71661ee2e8"><enum>(C)</enum><text>subject matter experts.</text></subparagraph></paragraph><paragraph id="id25013e51a7204cfbb3f805acbee2a590"><enum>(2)</enum><header>Purpose</header><text>The steering committee established under paragraph (1) shall help inform and guide the development and goals of the activities carried out under subsection (a) by identifying priorities for the identification, analysis, sharing, and use of data under that subsection, such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb661ef7e4d064745ae9a82f0633375f3"><enum>(A)</enum><text display-inline="yes-display-inline">customer affordability;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9eff925f5b3740daaed8cb0eb8283eb7"><enum>(B)</enum><text display-inline="yes-display-inline">feasibility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b4593d4bafe47ed8c4ccb804d9f3496"><enum>(C)</enum><text display-inline="yes-display-inline">the leveraging of existing capabilities to minimize duplication of effort; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id074d684de1ea4351bd29a47f2bdd7807"><enum>(D)</enum><text display-inline="yes-display-inline">the protection of sensitive data or information.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52524598b59448cd96b39391e362e28b"><enum>(3)</enum><header>Applicability of FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the steering committee established under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5608819638264e12bbaca49c19d75779"><enum>(e)</enum><header>Responsibilities and costs</header><paragraph commented="no" display-inline="no-display-inline" id="id7d8461237f684ab2a777e40cb1a6444f"><enum>(1)</enum><header>Collaboration</header><text display-inline="yes-display-inline">In administering the activities described in subsections (a) through (d), the Secretary may work with utilities, electric cooperatives, National Laboratories, and other agencies and entities, as the Secretary determines to be appropriate. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2971801023ba422085d161bd393ee14b"><enum>(2)</enum><header>Avoidance of additional costs</header><text display-inline="yes-display-inline">In administering the activities described in subsections (a) through (d), the Secretary shall use amounts appropriated under subsection (f) to avoid imposing additional costs on electric cooperatives, utilities, and assisting entities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide06b90402ec34fb88de53b6ffa26ed49"><enum>(3)</enum><header>Additional programs</header><text display-inline="yes-display-inline">The Secretary may establish new programs to carry out the activities described in subsections (a) through (d), as necessary, using amounts appropriated under subsection (f).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c434a9bc65e4c7ab291d19cf7ae697e"><enum>(4)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in this Act precludes a State from continuing to collect, or adding to, specific data required to be submitted to a State agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id598f581e3a5540368a38edcfe64710b0"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $10,000,000 for the first fiscal year beginning after the date of enactment of this Act, to remain available until expended.</text></subsection></section></legis-body></bill>
