<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4133</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240416">April 16, 2024</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, and <cosponsor name-id="S407">Mr. Hagerty</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Labor Relations Act to require secret ballot elections, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Workers from Coercion Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id82d0413936d24b49aa25e3bdf3bc5ca7"><enum>2.</enum><header>Amendments to the National Labor Relations Act</header><text display-inline="no-display-inline">Section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>) is amended— </text><paragraph id="id0d1652b944ce45fc919970f2f85dcccf"><enum>(1)</enum><text>in subsection (a), by striking <quote>designated or selected for the purposes of collective bargaining</quote> and inserting <quote>for the purposes of collective bargaining selected by secret ballot in an election conducted by the Board,</quote>; and </text></paragraph><paragraph id="id4a99c80e2abe43839391da9e4386ccb1"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1eea3ad025134d689463696eea898b0f"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), in the flush matter following subparagraph (B), by inserting <quote>, not later than 1 month after such petition was filed,</quote> after <quote>it shall</quote>; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17514cd071114f54beada4937add9e4c"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4cb981665b874365b41167b0589045e5"><paragraph id="idc0fd589873ba462dbfeb0df9416f6506"><enum>(6)</enum><text>An election may not take place after the filing of any petition until the Board conducts a hearing, and makes a ruling, on—</text><subparagraph id="idcb1310801ffd46bd84e135e04b3b845d"><enum>(A)</enum><text>any issues regarding unit inclusion or exclusion or eligibility of an individual; and</text></subparagraph><subparagraph id="idd8ca5cdd84874537b757870922f5de91"><enum>(B)</enum><text>any other legal dispute concerning the election alleged by the employer or a labor organization seeking recognition as the collective bargaining representative of employees of the employer.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
