<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4051</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240322">March 22, 2024</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S303">Mr. Thune</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit transportation of any alien using certain methods of identification, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Verifying that all Aliens have Legitimate Identification Documents Act</short-title></quote> or the <quote><short-title>VALID Act</short-title></quote>.</text></section><section id="ida70ac5e5f89844dfbdb19b0d2fb2033a"><enum>2.</enum><header>Permanent prohibition on operations for air carriers that provide, or facilitate the provision of, transportation of any alien using certain methods of identification</header><subsection commented="no" display-inline="no-display-inline" id="id1DE21A6571A24C48905388516EC8FBB5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">Chapter 401</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/40130">section 40130</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id57FBB96ED2504B82AE679B8F5B324B4D"><section id="idaccffec959e5427b8e1151a9ae5ba031"><enum>40131.</enum><header>Permanent prohibition on operations for air carriers that transport any alien using certain methods of identification</header><text display-inline="no-display-inline">An air carrier or foreign air carrier may not operate an aircraft in foreign air transportation or land such aircraft at any airport in the United States if the air carrier or foreign air carrier actively provides, or actively facilitates the provision of, transportation of any alien using any of the following for purposes of identification:</text><paragraph commented="no" display-inline="no-display-inline" id="id5da8f87809d246e8bdb8e8b95a23c215"><enum>(1)</enum><text display-inline="yes-display-inline">The CBP One Mobile Application.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1bd2607f598643c984524675e0170a36"><enum>(2)</enum><text>Department of Homeland Security Form I–385, Notice to Report.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id365169b5b83e49a29914879799b5a30e"><enum>(3)</enum><text>Department of Homeland Security Form I–862, Notice to Appear.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id88F8E22DB32E46B6B34391EABE5FF7AC"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">chapter 401</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/40130">section 40130</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC44238B95AE4C6BAE47EAE536A4BC38"><toc><toc-entry bold="off" level="section">40131. Permanent prohibition on operations for air carriers that transport any alien using certain methods of identification.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id878bcc4365954f978976b1a7b24cad61"><enum>3.</enum><header>Prohibition of certain forms of identification for airline passengers</header><text display-inline="no-display-inline">Section 7220 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/44901">49 U.S.C. 44901</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8408d8c2b03a41138024dcc9b6f4e36a"><enum>(1)</enum><text>in subsection (c)(1)(C), by inserting <quote>except as provided in subsection (d),</quote> before <quote>any document</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id684cd8e74c5449f2a92d52e281efe444"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0846ee6e92644cd989f91322ecd840bc"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3522A50B84254E44ACA048B7441A035A"><subsection commented="no" display-inline="no-display-inline" id="id78c59802ecb44becb5cb3c15c03234e4"><enum>(d)</enum><header display-inline="yes-display-inline">Prohibition of certain forms of identification</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary of Homeland Security may not designate or permit any of the following as a valid identification document for a domestic commercial airline passenger seeking to board an aircraft: </text><paragraph id="id257545d98b4b4893ae65bd35e02f3228"><enum>(1)</enum><text>The CBP One Mobile Application.</text></paragraph><paragraph id="id9c67ef4948e243129980ac2acd5f997e"><enum>(2)</enum><text>Department of Homeland Security Form I–385, Notice to Report.</text></paragraph><paragraph id="idead97e3779a24988b7ea85ca59dc2d23"><enum>(3)</enum><text>Department of Homeland Security Form I–862, Notice to Appear.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
