which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240708">July 8, 2024</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish a Government Spending Oversight Committee within the Council of the Inspectors General on Integrity and Efficiency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Spending Oversight Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id587accf214c94bf7834ba985ff27ec0f" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Government Spending Oversight Committee</header><subsection commented="no" display-inline="no-display-inline" id="id40eb3fb4097f4958b9555fd002fff155"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 424 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F2B3C123A804976A533434D4D9030E8" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="idb82ee6e3945545c79561d3fc19d7bfbe"><enum>(f)</enum><header>Government Spending Oversight Committee</header><paragraph id="id5525c048a3b249eda447f06982c1d874"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="ide5ed40e7464a45bf92656669285c3b8f"><enum>(A)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of this title.</text></subparagraph><subparagraph id="idc66abbd093994bfba2b6d08c379e3271"><enum>(B)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><clause id="idd86d62765b81479e996f1922c31afa60"><enum>(i)</enum><text>the Committees on Appropriations of the Senate and the House of Representatives;</text></clause><clause id="id0cf7ed7650e54b4bb9a4d6b99a9f590d"><enum>(ii)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></clause><clause id="id8f76ef30bc8c4a5bb76e1c39eb4c38d9"><enum>(iii)</enum><text>the Committee on Oversight and Accountability of the House of Representatives; and</text></clause><clause id="id02ed3a1322ac46e191aef656feadfb25"><enum>(iv)</enum><text>any other relevant congressional committee of jurisdiction.</text></clause></subparagraph><subparagraph id="iddb2da68c602646249a5592dec1374aa4"><enum>(C)</enum><header>Chairperson</header><text>The term <term>Chairperson</term> means the Chairperson of the Committee.</text></subparagraph><subparagraph id="id788a0c9ad5a045ea89086ab6f4c336c0"><enum>(D)</enum><header>Committee</header><text>The term <term>Committee</term> means the Government Spending Oversight Committee established under paragraph (2).</text></subparagraph><subparagraph id="id1054a5d542024990b112fe9b8b5217c4"><enum>(E)</enum><header>Covered funds</header><text>The term <term>covered funds</term> means any funds, including loans, that are made available in any form to any non-Federal entity or individual, under—</text><clause id="idad788db7b93b41a29258e05388a31d5c"><enum>(i)</enum><text>division A or B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></clause><clause id="id5ef62386323d474585abcd40c42e04f2"><enum>(ii)</enum><text>the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>);</text></clause><clause id="idbeb3c24c77e24240917a9b3b7027c25c"><enum>(iii)</enum><text>the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>);</text></clause><clause id="ide4af94187cdd46ddb5197375fdb4208c"><enum>(iv)</enum><text>the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>);</text></clause><clause id="idbbfe66bdd5a0493b9b1bdd54b729a499"><enum>(v)</enum><text>division M or N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>);</text></clause><clause id="id5fbf7e6ac92a40548a26ca320ce29460"><enum>(vi)</enum><text>the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>);</text></clause><clause id="id09fd5ce2fdee45a2ab4c6ad9100cbe76"><enum>(vii)</enum><text>any loan guaranteed or made by the Small Business Administration, including any direct loan or guarantee of a trust certificate, under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>), the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/661">15 U.S.C. 661 et seq.</external-xref>), or any other provision of law; </text></clause><clause commented="no" display-inline="no-display-inline" id="id736375698e604bfd9951a1d6957ccf20"><enum>(viii)</enum><text>unemployment compensation, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/85">section 85</external-xref> of the Internal Revenue Code of 1986;</text></clause><clause id="id3aa86f7f6fb34ed5bc2ff3807ce2c714"><enum>(ix)</enum><text>the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>);</text></clause><clause id="idc32f5f9206bd49faa919561501bb5186"><enum>(x)</enum><text>the Inflation Reduction Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref>);</text></clause><clause id="idce201e7b6b8e436e9fb763ad655497b4"><enum>(xi)</enum><text>the Honoring our PACT Act of 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/168">Public Law 117–168</external-xref>); or</text></clause><clause id="id29db5c5ebc374dcfb9aa9064f34dd2d5"><enum>(xii)</enum><text>the CHIPS Act of 2022 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>) (commonly known as the <quote>CHIPS and Science Act of 2022</quote>).</text></clause></subparagraph></paragraph><paragraph id="id93b8538f26a74c0ea02d6d6d9b7ddaf6"><enum>(2)</enum><header>Establishment</header><text>There is established within the Council the Government Spending Oversight Committee to promote transparency and conduct and support oversight of covered funds to—</text><subparagraph id="id00e5daf772a8435f8efdeef017b525d5"><enum>(A)</enum><text> prevent and detect fraud, waste, abuse, and mismanagement; and</text></subparagraph><subparagraph id="id89ac96da0807400394d95b4951835e40"><enum>(B)</enum><text>mitigate major risks that cut across program and agency boundaries.</text></subparagraph></paragraph><paragraph id="idcc7ae634bfaa40f2ab44fe8476dc9bb5"><enum>(3)</enum><header>Chairperson</header><text>The Chairperson of the Committee—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddf0bbec5760b49e48a426010ed551d50"><enum>(A)</enum><text display-inline="yes-display-inline">shall be selected by the Chairperson of the Council from among Inspectors General appointed by the President and confirmed by the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf16c986d44b44797ad74962f379c3612"><enum>(B)</enum><text display-inline="yes-display-inline">should have with experience managing oversight of large organizations and expenditures.</text></subparagraph></paragraph><paragraph id="idb44ad988f5ee45b2902145a22614cfe1"><enum>(4)</enum><header>Membership</header><text>The members of the Committee shall include—</text><subparagraph id="id7c2502ed5a794fbea55fdf013092a83c"><enum>(A)</enum><text>the Chairperson; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46a8f766ae4940a4b7a2732846c04ab6"><enum>(B)</enum><text display-inline="yes-display-inline">the Inspector General of the Department of the Labor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab282b13d6684814b331633cdcd8f56a"><enum>(C)</enum><text>the Inspector General of the Department of Health and Human Services;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id853e15de281d46df897498b8016a6c17"><enum>(D)</enum><text>the Inspector General of the Small Business Administration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8483edcdfd641fea3869e306d59f5e5"><enum>(E)</enum><text>the Inspector General of the Department of the Treasury;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15233e06054c4bfc8f80759d073f513e"><enum>(F)</enum><text>the Inspector General of the Department of Transportation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3950045c01d0421f923315afb1052225"><enum>(G)</enum><text>the Treasury Inspector General for Tax Administration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8589addfa7e4d5caa95cdc8dc6d17ff"><enum>(H)</enum><text>the Inspector General of the Department of Veterans Affairs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60a7b1598c614781871d7c6f7d0ed5b2"><enum>(I)</enum><text>the Inspector General of the Department of Commerce;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0065b4775c54194aea935e84625f00a"><enum>(J)</enum><text>the Inspector General of the Department of Justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfd2093be35c4c80bde6043b58fbeb7f"><enum>(K)</enum><text>the Inspector General of the Department of Defense;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4bdf09f41327459ea6578e71062a3a81"><enum>(L)</enum><text>the Inspector General of the Department of Education;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d7633b855ae414a816c87c206b2488b"><enum>(M)</enum><text>the Inspector General of the Department of Homeland Security; and</text></subparagraph><subparagraph id="idf2427712afcd4543a26609c9000fd05c"><enum>(N)</enum><text>any other Inspector General, as designated by the Chairperson, from any agency that expends or obligates covered funds.</text></subparagraph></paragraph><paragraph id="idfd18d355725f4a96851693d0899d0a06"><enum>(5)</enum><header>Executive Director</header><subparagraph commented="no" display-inline="no-display-inline" id="ide740d831d87840d59562521f506e1adc"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>There shall be an Executive Director of the Committee.</text></subparagraph><subparagraph id="idf495641cf0dc4400a5d0f439b6ea4169"><enum>(B)</enum><header>Appointment; qualifications</header><text>The Executive Director of the Committee shall—</text><clause commented="no" display-inline="no-display-inline" id="id1221b0b393884ea59c6acbe7b541478b"><enum>(i)</enum><text display-inline="yes-display-inline">be appointed by the Chairperson of the Committee, in consultation with the majority leader of the Senate, the Speaker of the House of Representatives, the minority leader of the Senate, and the minority leader of the House of Representatives;</text></clause><clause id="idb46c82794f1143e48b608967c4df3751"><enum>(ii)</enum><text>have demonstrated ability in accounting, auditing, financial analysis, law, management analysis, public administration, or investigations;</text></clause><clause id="id2775d925cdbb40bf81a67d76b5eaa26a"><enum>(iii)</enum><text>have experience managing oversight of large organizations and expenditures; and</text></clause><clause id="idb98c5b8a26e14ebeaba6ca312bd728ab"><enum>(iv)</enum><text>be full-time employees of the Committee.</text></clause></subparagraph><subparagraph id="id84505a06accd492cace47f1a3192eeb2"><enum>(C)</enum><header>Duties</header><text>The Executive Director of the Committee shall—</text><clause id="id7e55fa44e94240a4a42d75d7311b9b4f"><enum>(i)</enum><text>report directly to the Chairperson;</text></clause><clause id="id63b13e1e12b54553ae4ee588a9aec31b"><enum>(ii)</enum><text>appoint staff of the Committee, subject to the approval of the Chairperson, consistent with this subsection; </text></clause><clause id="id5b31bb4489844fc1930f5e80f51f8fe9"><enum>(iii)</enum><text>supervise and coordinate Committee functions and staff; and</text></clause><clause id="idbfd27f1a91fa4f12a46c593e6441fe24"><enum>(iv)</enum><text>perform any other duties assigned to the Executive Director by the Committee.</text></clause></subparagraph></paragraph><paragraph id="id6d12aeb170f64adb8618951bdb8dbc7a"><enum>(6)</enum><header>Prohibition on additional compensation</header><text>Members of the Committee may not receive additional compensation for services performed.</text></paragraph><paragraph id="id4460eaf96863497c8bdbc0108b734001"><enum>(7)</enum><header>Duties of the Committee</header><subparagraph commented="no" display-inline="no-display-inline" id="ida94c3f7b96264105b2353631aea5c02d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Committee shall conduct oversight of covered funds and support Inspectors General in the oversight of covered funds in order to—</text><clause id="ide0068595a8f044ddbb453a521a1e5c2c"><enum>(i)</enum><text>detect and prevent fraud, waste, abuse, and mismanagement; and</text></clause><clause id="id5fd2027c8ce140439d9b7521b1a4c673"><enum>(ii)</enum><text>identify major risks that cut across programs and agency boundaries.</text></clause></subparagraph><subparagraph id="idaaee91cda0984c8ca1ee0b32217b910c"><enum>(B)</enum><header>General functions</header><text>The Committee, in coordination with relevant Inspectors General, may—</text><clause id="idde43e98531144216ba48e0b8745a5e73"><enum>(i)</enum><text>provide support to, and collaborate with, relevant Inspectors General in conducting investigations, audits, and reviews relating to covered funds, including through—</text><subclause id="idb35b4c26b3f34b1cb884861009005194"><enum>(I)</enum><text>data analytics;</text></subclause><subclause id="id215aa51e45bf4bf7857afe3bdbe9a1b9"><enum>(II)</enum><text>the sharing of data, tools, and services;</text></subclause><subclause id="id454de447ccbf417d92cc564d2fe07787"><enum>(III)</enum><text>the development and enhancement of data practices, analysis, and visualization; and</text></subclause><subclause id="id0fdabf70e5a047cea5cc1691deca4c31"><enum>(IV)</enum><text>any other appropriate means as determined by the Committee;</text></subclause></clause><clause id="id57722e6962374229b5a566f00cb72ed1"><enum>(ii)</enum><text>provide analytical products to agencies, in coordination with Inspectors General, to promote program integrity, prevent improper payments, and facilitate verification efforts to ensure proper expenditure and utilization of covered funds;</text></clause><clause id="idf0a11ba5aea942258a9600f40421d000"><enum>(iii)</enum><text>review the economy, efficiency, and effectiveness in the administration of, and the detection of fraud, waste, abuse, and mismanagement in, programs and operations using covered funds;</text></clause><clause id="id2d35a52e42a741a59b39f778a13e9a30"><enum>(iv)</enum><text>review whether there are appropriate mechanisms for interagency collaboration relating to the oversight of covered funds, including coordinating and collaborating to the extent practicable with State and local government entities; and</text></clause><clause id="idecbeff5326b84e6eb2106a0b3e4aec76"><enum>(v)</enum><text>expeditiously report to the Attorney General any instance in which the Committee has reasonable grounds to believe there has been a violation of Federal criminal law.</text></clause></subparagraph><subparagraph id="id2444be68aab74f86a1e161646e0ea15d"><enum>(C)</enum><header>Additional functions</header><text>The Committee may provide investigative support to prosecutive and enforcement authorities to protect program integrity and prevent, detect, and prosecute fraud of covered funds.</text></subparagraph><subparagraph id="idfd920c97bd1243b7a991230465dadd8f"><enum>(D)</enum><header>Reporting</header><clause commented="no" display-inline="no-display-inline" id="id6e85ba4d726846b7a587bf39fa1a3902"><enum>(i)</enum><header>Alerts</header><text display-inline="yes-display-inline">The Committee shall submit to the President and Congress, including the appropriate congressional committees, management alerts on potential management, risk, and funding problems that require immediate attention.</text></clause><clause id="idb2e2ebe422d34517b905a82dd76ac030"><enum>(ii)</enum><header>Reports and updates</header><text>The Committee shall submit to Congress such other reports or provide such periodic updates on the work of the Committee as the Committee considers appropriate on the use of covered funds.</text></clause><clause id="id8a4125e4a41e4368b386b9853bc2da1d"><enum>(iii)</enum><header>Biannual reports</header><text>The Committee shall submit biannual reports to the President and Congress, including the appropriate congressional committees, and may submit additional reports as appropriate summarizing the findings of the Committee and any recommended changes to the scope of covered funds.</text></clause><clause id="id56a6d2703c3d41c09f74ac7ff1818e76"><enum>(iv)</enum><header>Public availability</header><text>All reports submitted under this subparagraph shall be made publicly available and posted on the website established under paragraph (16).</text></clause><clause id="id7af97760194544b08646664210bf6f2d"><enum>(v)</enum><header>Redactions</header><text>Any portion of a report submitted under this paragraph may be redacted when made publicly available, if that portion would disclose information that is not subject to disclosure under sections 552 and 552a of this title, or is otherwise prohibited from disclosure by law.</text></clause></subparagraph><subparagraph id="id23100dbb98674671a5dda0260566cf8f"><enum>(E)</enum><header>Recommendations</header><clause commented="no" display-inline="no-display-inline" id="ide12c360d5dbd40158de9a0425905ce32"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Committee shall make recommendations to agencies on measures to prevent or address fraud, waste, abuse and mismanagement, and to mitigate risks that cut across programs and agency boundaries, relating to covered funds.</text></clause><clause id="id09a25df3a766474f947b66f516e98165"><enum>(ii)</enum><header>Report</header><text>Not later than 30 days after receipt of a recommendation under clause (i), an agency shall submit a report to the President and the appropriate congressional committees on—</text><subclause id="ide3f9a09eec9c405db1fe21ea614a173c"><enum>(I)</enum><text>whether the agency agrees or disagrees with the recommendations; and</text></subclause><subclause id="id3ef7a0f7c95f47aa8edc6200cdf39def"><enum>(II)</enum><text>any actions the agency will take to implement the recommendations, which shall also be included in the report required under section 2(b) of the GAO–IG Act (<external-xref legal-doc="usc" parsable-cite="usc/31/1105">31 U.S.C. 1105</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/414">Public Law 115–414</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="id052a9054b06e4919869789cb01c20479"><enum>(8)</enum><header>Authorities</header><subparagraph id="idb7ab3d4b839741ada21e1f46ab2f1ed8"><enum>(A)</enum><header>In general</header><text>In carrying out the duties and functions under this subsection with respect to the oversight of covered funds, the Committee shall—</text><clause id="ida9cdd7d3d9004c80a26fc1e3c986b5e5"><enum>(i)</enum><text>carry out those duties and functions in accordance with section 404(b)(1) of this title;</text></clause><clause commented="no" display-inline="no-display-inline" id="id45cd2c68d34047498a2f31718863bfdf"><enum>(ii)</enum><text display-inline="yes-display-inline">in coordination with relevant Inspectors General, have the authorities provided under and be subject to paragraphs (1) through (4) of subsection (a) and subsections (h), (j), and (k) of section 406;</text></clause><clause id="idc99bc771b72b424fb9c71ff22ce880a6"><enum>(iii)</enum><text>be considered to be conducting civil or criminal law enforcement activity for the purposes of section 552a(b)(7) of this title; and</text></clause><clause id="idad17d0f7644141f889e7920b7e20ce8a"><enum>(iv)</enum><text>for the purposes of sections 552 and 552a of this title, be considered to be a component which performs as its principal function an activity pertaining to the enforcement of criminal laws, and its records may constitute investigatory material compiled for law enforcement purposes.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2a2358b31dd4a038a0914ccbb3821cc"><enum>(B)</enum><header>Limitation on subpoena authority</header><text>When carrying out subpoena authority under section 406(a)(4) of this title, the following limitations shall apply to the Committee:</text><clause id="id91d0476980fc40b6a6cfc252f3fc55a8"><enum>(i)</enum><text>Any subpoena issued under this subsection shall be signed by the Chairperson of the Committee, and this power is non-delegable.</text></clause><clause commented="no" display-inline="no-display-inline" id="id52c19d3cf0ff4bf096255fbf88824337"><enum>(ii)</enum><text>On a quarterly basis, the Committee shall notify the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives of any subpoenas issued during the preceding quarter.</text></clause><clause commented="no" display-inline="no-display-inline" id="idfbb2e63227e94788b546feecaa4b9851"><enum>(iii)</enum><text>The authority to issue a subpoena under this subsection shall terminate on the date that is 5 years after the date of enactment of this subsection.</text></clause></subparagraph></paragraph><paragraph id="id8564c0edb38b44469127f6ca771d5dbe"><enum>(9)</enum><header>Refusal of information or assistance</header><text>Whenever information or assistance requested by the Committee or an Inspector General is unreasonably refused or not provided, the Committee shall immediately report the circumstances to the appropriate congressional committees.</text></paragraph><paragraph id="idb5bbdc446430420a8a42ef9a50ac2a31"><enum>(10)</enum><header>Use of existing resources</header><text>The Committee shall leverage existing information technology resources within the Council, such as oversight.gov and those developed by the Pandemic Response Accountability Committee established under section 15010 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 135 Stat. 533), to carry out the duties of the Committee.</text></paragraph><paragraph id="idc3e66f3058d14318aea0f48576620456"><enum>(11)</enum><header>Contracts</header><text>The Committee may enter into contracts to enable the Committee to discharge its duties, including contracts and other arrangements for audits, studies, analyses, and other services with public agencies and with private persons, and make such payments as may be necessary to carry out the duties of the Committee.</text></paragraph><paragraph id="ide93b712713ee46108aff2a4cf1d62a4e"><enum>(12)</enum><header>Subcommittees</header><text>The Committee may establish subcommittees to facilitate the ability of the Committee to discharge its duties.</text></paragraph><paragraph id="idde7527bd40664f58a08feadbfff2f08d"><enum>(13)</enum><header>Transfer of funds, assets, and obligations</header><subparagraph commented="no" display-inline="no-display-inline" id="id7e64b0dfeede4c1c90b6c6b6b0db8db7"><enum>(A)</enum><header display-inline="yes-display-inline">Funds</header><text>The Committee may transfer funds appropriated to the Committee—</text><clause commented="no" display-inline="no-display-inline" id="idab8accfbdf124180b6569b91e887a38b"><enum>(i)</enum><text display-inline="yes-display-inline">for expenses to support administrative support services and audits, reviews, or other activities related to oversight by the Committee of covered funds to any Office of the Inspector General or the General Services Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc827f840b234432a9ce513ef767540cf"><enum>(ii)</enum><text>to reimburse for services provided by the Council.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c99be86bef74edaa9c0b65d4a47d23d"><enum>(B)</enum><header>Assets and obligations</header><clause commented="no" display-inline="no-display-inline" id="idca8e46a99e9d42fbb23a7bef0225e22d"><enum>(i)</enum><header display-inline="yes-display-inline">Assets defined</header><text>In this subparagraph, the term <term>assets</term> includes contracts, agreements, facilities, property, data, records, unobligated or unexpended balances of appropriations, and other funds or resources (other than personnel).</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a5f30901fcb4d1a96c2f1189a6fcb31"><enum>(ii)</enum><header>Transfer</header><text>Upon the effective date of this subsection, the assets and obligations held by or available in connection with the Pandemic Response Accountability Committee established under 15010 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 135 Stat. 540) shall be transferred to the Committee.</text></clause></subparagraph></paragraph><paragraph id="id946e6b1691f24a00ac69279daa5bd15b"><enum>(14)</enum><header>Additional staff</header><subparagraph commented="no" display-inline="no-display-inline" id="id91fccfd113c047c5bce5233e2702b928"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Committee may exercise the authorities of subsections (b) through (i) of section 3161 of this title (without regard to subsection (a) of that section) to meet temporary or urgent needs of the Committee under this subsection, as certified by the Chairperson to the appropriate congressional committees that such temporary or urgent needs exist, as if the Committee were a temporary organization. </text></subparagraph><subparagraph id="id8f3ad74b1d164c74b3cee0b967f716cf"><enum>(B)</enum><header>Head of organization</header><text>For purposes of exercising the authorities described in subparagraph (A), the term <term>Chairperson</term> shall be substituted for the term <term>head of a temporary organization</term>.</text></subparagraph><subparagraph id="id0b89e9db6dfb44048f5953ed76687cc6"><enum>(C)</enum><header>Consultation</header><text>In exercising the authorities described in subparagraph (A), the Chairperson shall consult with members of the Committee.</text></subparagraph><subparagraph id="id134213519c2f4d57b28e5fbf5adbc393"><enum>(D)</enum><header>Additional detailees</header><text>In addition to the authority provided by section 3161(c) of this title, upon the request of an Inspector General, the Committee may detail, on a nonreimbursable basis, any personnel of the Committee to that Inspector General to assist in carrying out any audit, review, or investigation pertaining to the oversight of covered funds.</text></subparagraph><subparagraph id="id39b2fca28aad45aab60414c5093ab603"><enum>(E)</enum><header>Limitations</header><text>In exercising the employment authorities under section 3161(b) of this title, as provided under subparagraph (A) of this paragraph—</text><clause id="idec1e098ace824f68bae687b45b247354"><enum>(i)</enum><text>section 3161(b)(2) of this title (relating to periods of appointments) shall not apply; and</text></clause><clause id="idf53901f9426a440080b43b5b7bfbedab"><enum>(ii)</enum><text>no period of appointment may exceed the date on which the Committee terminates.</text></clause></subparagraph><subparagraph id="idd30361c2e4564df6868876f24aabcd86"><enum>(F)</enum><header>Competitive service</header><text>A person employed by the Committee shall acquire competitive status and conditional tenure for appointment to any position in the competitive service for which the employee possesses the required qualifications upon the completion of 2 years of continuous service as an employee under this subsection.</text></subparagraph><subparagraph id="id05f6d17185a94f3d8e8001e62f120bdd"><enum>(G)</enum><header>Annuitants</header><clause commented="no" display-inline="no-display-inline" id="id9627b958146e401281d2bb39df1bb701"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Committee may employ annuitants covered by section 9902(g) of this title for purposes of the oversight of covered funds.</text></clause><clause id="id11987b197d744d9c9cdd85ede9b5584a"><enum>(ii)</enum><header>Treatment of annuitants</header><text>The employment of annuitants under this paragraph shall be subject to the provisions of section 9902(g) of this title, as if the Committee was the Department of Defense.</text></clause></subparagraph></paragraph><paragraph id="id3999ec347b4a449282049d9e1301189e"><enum>(15)</enum><header>Provision of information</header><subparagraph commented="no" display-inline="no-display-inline" id="idd90e1e342f7d4013b90cb5a386dec8e0"><enum>(A)</enum><header display-inline="yes-display-inline">Requests</header><text>Upon request of the Committee for information or assistance from any agency or other entity of the Federal Government, the head of such entity shall, insofar as is practicable and not in contravention of any existing law, and consistent with section 406 of this title, furnish such information or assistance to the Committee, or an authorized designee, including an Inspector General designated by the Chairperson.</text></subparagraph><subparagraph id="id3782430cf1894605910680d20ae8b867"><enum>(B)</enum><header>Inspectors General</header><text>Any Inspector General responsible for conducting oversight related to covered funds may, consistent with the duties, responsibilities, policies, and procedures of the Inspector General, provide information requested by the Committee or an Inspector General on the Committee relating to the responsibilities of the Committee.</text></subparagraph></paragraph><paragraph id="id66883e05f5474236bdc48556349a3e6f"><enum>(16)</enum><header>Website</header><subparagraph commented="no" display-inline="no-display-inline" id="idfbee9f14c4c74993a8fd34c5e22cae7d"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 30 days after the date of enactment of this subsection, the Committee shall establish and maintain a user-friendly, public-facing website—</text><clause commented="no" display-inline="no-display-inline" id="id38f85d8a83654810985641a0f00047c8"><enum>(i)</enum><text display-inline="yes-display-inline">to foster greater accountability and transparency in the use of covered funds, which shall have a uniform resource locator that is descriptive and memorable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id02990def0ba841c1926dc7160beebdb0"><enum>(ii)</enum><text>that shall be a portal or gateway to key information relating to the oversight of covered funds and provide connections to other Government websites with related information.</text></clause></subparagraph></paragraph><paragraph id="id90e87815ca8b42e09cb0bf1c3243bc47"><enum>(17)</enum><header>Coordination</header><text>The Committee shall coordinate its oversight activities with the Comptroller General of the United States and State auditors.</text></paragraph><paragraph id="id6c54b99442cc4a34a9238d43081e4a2b"><enum>(18)</enum><header>Rules of construction</header><text>Nothing in this subsection shall be construed to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1f6d14d4986f4055a0a947f389d534f9"><enum>(A)</enum><text display-inline="yes-display-inline">affect the independent authority of an Inspector General to determine whether to conduct an audit or investigation of covered funds; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida26d9767baee47459d4f5a9d52f0644e"><enum>(B)</enum><text display-inline="yes-display-inline">require the Council or any Inspector General to provide funding to support the activities of the Committee.</text></subparagraph></paragraph><paragraph id="ida5d5aeb1786845ce8a213cc6572c7378"><enum>(19)</enum><header>Authorization of appropriations</header><text>For the purposes of carrying out the mission of the Committee under this subsection, there are authorized to be appropriated such sums as may be necessary to carry out the duties and functions of the Committee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8d177a94383e4a448fd3a9ec763a29c2"><enum>(b)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall take effect on September 30, 2025.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idb71d6a08-7e89-40ba-920c-1112e1e37c6f" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Spending Oversight Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id5976ff43-c0ad-4cf4-871c-0678c8cd166f" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Government Spending Oversight Committee</header><subsection commented="no" display-inline="no-display-inline" id="id7612b617-6884-4ac6-8996-dc06fa63259b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 424 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6342a3c6-0d52-498f-8252-a3f32d432e5c" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="id29f9a0a3-744b-4240-ac80-0ea65be1f0c1"><enum>(f)</enum><header>Government Spending Oversight Committee</header><paragraph id="id7c37cd95-e648-4a84-ab3b-1689b6e51a52"><enum>(1)</enum><header>Definitions</header><text> In this subsection:</text><subparagraph id="id51e6a390-de03-4960-8f59-4db8a9f1e339"><enum>(A)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of this title.</text></subparagraph><subparagraph id="id09bbf50d-f208-40a9-92e4-5fdd0fb141aa"><enum>(B)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><clause id="id7dcde781-4962-4f60-828d-be2525cfd6fd"><enum>(i)</enum><text>the Committees on Appropriations of the Senate and the House of Representatives;</text></clause><clause id="id929ac827-294c-437c-ac5b-ce3957985612"><enum>(ii)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></clause><clause id="id18add0ae-1f20-4151-9298-45b450cee788"><enum>(iii)</enum><text>the Committee on Oversight and Accountability of the House of Representatives; and</text></clause><clause id="idf68cfe8c-0b76-4ee3-8b76-dee77e04baf7"><enum>(iv)</enum><text>any other relevant congressional committee of jurisdiction.</text></clause></subparagraph><subparagraph id="idc7caaf24-eea3-479d-9bc9-35006147905b"><enum>(C)</enum><header>Chairperson</header><text>The term <term>Chairperson</term> means the Chairperson of the Committee.</text></subparagraph><subparagraph id="idc1c6d30f-403a-4ff6-a96d-d787db8900a8"><enum>(D)</enum><header>Committee</header><text>The term <term>Committee</term> means the Government Spending Oversight Committee established under paragraph (2).</text></subparagraph><subparagraph id="id4c4391e3-3a54-4bae-963d-e2f759bd4a1f"><enum>(E)</enum><header>Covered funds</header><text>The term <term>covered funds</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id693c353289d149039cbf250af5c38ee1"><enum>(i)</enum><text display-inline="yes-display-inline">any funds, including loans, that are made available in any form to any non-Federal entity or individual, under—</text><subclause id="id49a2d16a-757f-4bfc-99d4-7495d9adf0ec"><enum>(I)</enum><text>division A or B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></subclause><subclause id="id8ba6e8b4-ff5b-4857-9fac-f64d32d3d213"><enum>(II)</enum><text>the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>);</text></subclause><subclause id="id0330115e-0045-49cc-8fab-bd3fd6244242"><enum>(III)</enum><text>the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>);</text></subclause><subclause id="id353f5be9-7326-42af-9502-ee6120e499f6"><enum>(IV)</enum><text>the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>);</text></subclause><subclause id="id83be8b8f-4c31-4c15-9190-7db79bdbc3ef"><enum>(V)</enum><text>division M or N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>);</text></subclause><subclause id="id57bddd9b-a7e3-477c-8d42-b31157adf6e2"><enum>(VI)</enum><text>the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>);</text></subclause><subclause id="id646566f3-a100-4538-97cf-42d21ea982e9"><enum>(VII)</enum><text>any loan guaranteed or made by the Small Business Administration, including any direct loan or guarantee of a trust certificate, under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>), the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/661">15 U.S.C. 661 et seq.</external-xref>), or any other provision of law; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8e17550d-74bc-465d-ae97-ad70ff2c73ed"><enum>(VIII)</enum><text>unemployment compensation, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/85">section 85</external-xref> of the Internal Revenue Code of 1986;</text></subclause><subclause id="ide0765f09-709e-4871-96b6-e3f1689a2322"><enum>(IX)</enum><text>the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>);</text></subclause><subclause id="id2f596d63-a511-4a1b-9be9-f908d9c1831e"><enum>(X)</enum><text>Public Law 117–169 (commonly known as the <quote>Inflation Reduction Act</quote>);</text></subclause><subclause id="id8f0875c4-3fd7-49eb-aeeb-ab54e2dc8592"><enum>(XI)</enum><text>the Honoring our PACT Act of 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/168">Public Law 117–168</external-xref>); or</text></subclause><subclause id="idc6dcd062-689b-4a9a-8f1b-f5d3ce8c0d76"><enum>(XII)</enum><text>the CHIPS Act of 2022 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (commonly known as the <quote>CHIPS and Science Act of 2022</quote>)); </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4f32588ec37b4a8584beed217f1c03a5"><enum>(ii)</enum><text>any Federal grant of not less than $50,000; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide7d080edd5ec435ba9d0cf3e9167a974"><enum>(iii)</enum><text>any intramural payment made Government wide for research activity. </text></clause></subparagraph></paragraph><paragraph id="id148f1594-fd28-4417-a7cb-887c39a6f258"><enum>(2)</enum><header>Establishment</header><text>There is established within the Council the Government Spending Oversight Committee to promote transparency and conduct and support oversight of covered funds to—</text><subparagraph id="ida0983a65-12a5-4a1e-b634-f71f99b5cd59"><enum>(A)</enum><text> prevent and detect fraud, waste, abuse, and mismanagement; and</text></subparagraph><subparagraph id="id6b332ac0-7bb1-4089-b52e-b5c373a4aaaa"><enum>(B)</enum><text>mitigate major risks that cut across programs and agency boundaries.</text></subparagraph></paragraph><paragraph id="idca678f5b-a9ea-4410-90e4-106e633dd9f8"><enum>(3)</enum><header>Chairperson</header><text>The Chairperson of the Committee—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9747dc01-12b2-4e1b-9257-14609cdbaed8"><enum>(A)</enum><text display-inline="yes-display-inline">shall be selected by the Chairperson of the Council from among Inspectors General appointed by the President and confirmed by the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ffcfb34-945f-42d4-8b13-fea1367854e1"><enum>(B)</enum><text display-inline="yes-display-inline">should have experience managing oversight of large organizations and expenditures.</text></subparagraph></paragraph><paragraph id="ida42c6614-9666-4094-a260-cfc09d23c74a"><enum>(4)</enum><header>Membership</header><text>The members of the Committee shall include—</text><subparagraph id="id9cb66fe3-53f0-407e-ad34-d80490023324"><enum>(A)</enum><text>the Chairperson; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00a22d72-3d5b-4116-9ec7-5a4e514d694d"><enum>(B)</enum><text display-inline="yes-display-inline">the Inspector General of the Department of Labor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdbf9fd2-8b31-4680-94cc-7950b6ce5193"><enum>(C)</enum><text>the Inspector General of the Department of Health and Human Services;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96a91107-fb21-4ba8-9cdb-e17d39f865bd"><enum>(D)</enum><text>the Inspector General of the Small Business Administration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0872c824-680f-43b8-b34c-745a52a4f5f5"><enum>(E)</enum><text>the Inspector General of the Department of the Treasury;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2da0194-3b09-4985-833c-bcae39d45bc3"><enum>(F)</enum><text>the Inspector General of the Department of Transportation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideff22c50-a813-4e75-8c7e-0d76dab80747"><enum>(G)</enum><text>the Treasury Inspector General for Tax Administration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d016763-de39-4366-9b79-abc629f389e7"><enum>(H)</enum><text>the Inspector General of the Department of Veterans Affairs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd5f982f8-20c6-4207-9f08-658e0a548eb1"><enum>(I)</enum><text>the Inspector General of the Department of Commerce;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48d31269-a6df-4824-83e8-936e6ac2993e"><enum>(J)</enum><text>the Inspector General of the Department of Justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id124b4b99-d538-44a2-ab3c-5185d32d3b2d"><enum>(K)</enum><text>the Inspector General of the Department of Defense;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66cd2d32-faa8-4f3e-8b3a-8a3d648f4081"><enum>(L)</enum><text>the Inspector General of the Department of Education;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71cf71de-b7f0-4f93-96dd-3a63ef3092cb"><enum>(M)</enum><text>the Inspector General of the Department of Homeland Security; and</text></subparagraph><subparagraph id="idce3d5c6c-4cc7-4586-8f4b-40b8390288f9"><enum>(N)</enum><text>any other Inspector General, as designated by the Chairperson, from any agency that expends or obligates covered funds.</text></subparagraph></paragraph><paragraph id="id03d58289-7e0b-4c9f-8371-c75e7cc90b34"><enum>(5)</enum><header>Executive Director</header><subparagraph commented="no" display-inline="no-display-inline" id="id54883b4d-6c7f-4816-b1a6-7993cb611990"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>There shall be an Executive Director of the Committee.</text></subparagraph><subparagraph id="idf174e7b8-1b9b-4924-9040-721114ab9811"><enum>(B)</enum><header>Appointment; qualifications</header><text>The Executive Director of the Committee shall—</text><clause commented="no" display-inline="no-display-inline" id="idf3d17cec-6bea-42f0-b4de-c8cac15e59ea"><enum>(i)</enum><text display-inline="yes-display-inline">be appointed by the Chairperson, in consultation with the majority leader of the Senate, the Speaker of the House of Representatives, the minority leader of the Senate, and the minority leader of the House of Representatives;</text></clause><clause id="id46e4fbf9-5666-4bc5-855e-28f7887517bb"><enum>(ii)</enum><text>have demonstrated ability in accounting, auditing, financial analysis, law, management analysis, public administration, or investigations;</text></clause><clause id="id6ea6ffd9-c611-4afa-9a41-c4e50204b821"><enum>(iii)</enum><text>have experience managing oversight of large organizations and expenditures; and</text></clause><clause id="id6506ef10-cba8-4281-9222-66b8537e21c7"><enum>(iv)</enum><text>be a full-time employee of the Committee.</text></clause></subparagraph><subparagraph id="id3ecae758-d3d3-4104-8d9e-227adbbb1cfd"><enum>(C)</enum><header>Duties</header><text>The Executive Director of the Committee shall—</text><clause id="id53ea113a-8dfa-45db-bd48-0efa174eecf0"><enum>(i)</enum><text>report directly to the Chairperson;</text></clause><clause id="id01ebffa3-0bae-44ad-8d21-a6f1883a2c11"><enum>(ii)</enum><text>appoint staff of the Committee, subject to the approval of the Chairperson, consistent with this subsection; </text></clause><clause id="id593269a6-0b27-4286-8427-3234038e8661"><enum>(iii)</enum><text>supervise and coordinate Committee functions and staff; and</text></clause><clause id="id04a57eb8-5c3d-4f01-9b47-6da9622cca25"><enum>(iv)</enum><text>perform any other duties assigned to the Executive Director by the Committee.</text></clause></subparagraph><subparagraph id="id32FE1EED0DDE4EB783CBC85FB0F70C8C"><enum>(D)</enum><header>Notice</header><text>The Chairperson shall provide notice to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives when appointing or removing the Executive Director of the Committee. </text></subparagraph></paragraph><paragraph id="id1dd12945-e471-4815-8d48-ad4b1d3e61e5"><enum>(6)</enum><header>Prohibition on additional compensation</header><text>Members of the Committee may not receive additional compensation for services performed.</text></paragraph><paragraph id="id6de9efa5-6e2a-4168-a1be-9317ebb6d4ec"><enum>(7)</enum><header>Duties of the Committee</header><subparagraph commented="no" display-inline="no-display-inline" id="id9a7fb2fc-db1d-465c-a795-026eb10c11d7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Committee shall conduct oversight of covered funds and support Inspectors General in the oversight of covered funds in order to—</text><clause id="ida1c2a215-344f-474e-bfa1-318762b9a925"><enum>(i)</enum><text>detect and prevent fraud, waste, abuse, and mismanagement; and</text></clause><clause id="id95bd1491-e02c-4cf6-9f64-1b6ce665a19d"><enum>(ii)</enum><text>identify major risks that cut across programs and agency boundaries.</text></clause></subparagraph><subparagraph id="id2cf939b1-5152-4ad6-9ab9-bb7bdc4d9a0d"><enum>(B)</enum><header>General functions</header><text>The Committee, in coordination with relevant Inspectors General, may—</text><clause id="id40b6142b-207c-4438-861d-c46660f6bb3c"><enum>(i)</enum><text>provide support to, and collaborate with, relevant Inspectors General in conducting investigations, audits, and reviews relating to covered funds, including through—</text><subclause id="id97a51c45-605c-4b17-b801-0985f64a2a5c"><enum>(I)</enum><text>data analytics;</text></subclause><subclause id="ide08eed5b-f972-40aa-96f4-6d1b27daa105"><enum>(II)</enum><text>the sharing of data, tools, and services;</text></subclause><subclause id="idc2ba4797-4d1e-47bb-87b6-a23b0f784c3a"><enum>(III)</enum><text>the development and enhancement of data practices, analysis, and visualization; and</text></subclause><subclause id="id5f432dd9-6f90-41fe-a883-7b12f4b16a36"><enum>(IV)</enum><text>any other appropriate means as determined by the Committee;</text></subclause></clause><clause id="id22d509f3-097e-4ab4-842d-eb716f6e275b"><enum>(ii)</enum><text>provide analytical products to agencies, in coordination with Inspectors General, to promote program integrity, prevent improper payments, and facilitate verification efforts to ensure proper expenditure and utilization of covered funds;</text></clause><clause id="id8df8c58d-30cb-40b4-aa43-e6c9adce8eb0"><enum>(iii)</enum><text>review the economy, efficiency, and effectiveness in the administration of, and the detection of fraud, waste, abuse, and mismanagement in, programs and operations using covered funds;</text></clause><clause id="id1ff4ebfb-2e03-4e9e-b67a-aee7c9a7159c"><enum>(iv)</enum><text>review whether there are appropriate mechanisms for interagency collaboration relating to the oversight of covered funds, including coordinating and collaborating to the extent practicable with State and local government entities; and</text></clause><clause id="id7f734fdc-23de-4e35-b3cd-2cd72b0b6f82"><enum>(v)</enum><text>expeditiously report to the Attorney General any instance in which the Committee has reasonable grounds to believe there has been a violation of Federal criminal law.</text></clause></subparagraph><subparagraph id="idcabaaf27-2d11-44ac-8d5f-76655ce724d7"><enum>(C)</enum><header>Additional functions</header><text>The Committee may provide investigative support to prosecutive and enforcement authorities to protect program integrity and prevent, detect, and prosecute fraud of covered funds.</text></subparagraph><subparagraph id="id5a85cc24-58e3-46ba-8be5-b77b2da5ae00"><enum>(D)</enum><header>Reporting</header><clause commented="no" display-inline="no-display-inline" id="id8c4db5df-4bbe-480b-b042-dacbc352a21a"><enum>(i)</enum><header>Alerts</header><text display-inline="yes-display-inline">The Committee shall submit to the President and Congress, including the appropriate congressional committees, management alerts on potential management, risk, and funding problems that require immediate attention.</text></clause><clause id="idf2fa93fa-6bd5-4149-af85-9aff68513be9"><enum>(ii)</enum><header>Reports and updates</header><text>The Committee shall submit to Congress such other reports or provide such periodic updates on the work of the Committee as the Committee considers appropriate on the use of covered funds.</text></clause><clause id="id24898d1c-584a-47e6-b35d-f23fe5f492d9"><enum>(iii)</enum><header>Biannual reports</header><text>The Committee shall submit biannual reports to the President and Congress, including the appropriate congressional committees, and may submit additional reports as appropriate summarizing the findings of the Committee and any recommended changes to the scope of covered funds.</text></clause><clause id="id3a858e49-ce5d-47bc-90c0-be1cd991f0e4"><enum>(iv)</enum><header>Public availability</header><text>All reports submitted under this subparagraph shall be made publicly available and posted on the website established under paragraph (16).</text></clause><clause id="ide45933b7-a2fe-4cfb-9fcd-2cf0e1e9a225"><enum>(v)</enum><header>Redactions</header><text>Any portion of a report submitted under this paragraph may be redacted when made publicly available, if that portion would disclose information that is not subject to disclosure under sections 552 and 552a of this title, or is otherwise prohibited from disclosure by law.</text></clause></subparagraph><subparagraph id="id5ce988dd-b1aa-4258-b22b-13aa1a3441f7"><enum>(E)</enum><header>Recommendations</header><clause commented="no" display-inline="no-display-inline" id="idb234dd5b-2fae-4010-9641-67976508c0b8"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Committee shall make recommendations to agencies on measures to prevent or address fraud, waste, abuse, and mismanagement, and to mitigate major risks that cut across programs and agency boundaries, relating to covered funds.</text></clause><clause id="id44d9af8b-cfb2-4e7a-89e1-04d8f1e9a45b"><enum>(ii)</enum><header>Report</header><text>Not later than 30 days after receipt of a recommendation under clause (i), an agency shall submit a report to the President and the appropriate congressional committees on—</text><subclause id="ide597743c-c33b-49c4-874d-c59096032b98"><enum>(I)</enum><text>whether the agency agrees or disagrees with the recommendations; and</text></subclause><subclause id="id1c4d441b-7321-4411-85d5-a029119d5ea9"><enum>(II)</enum><text>any actions the agency will take to implement the recommendations, which shall also be included in the report required under section 2(b)(3) of the GAO–IG Act (<external-xref legal-doc="usc" parsable-cite="usc/31/1105">31 U.S.C. 1105</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/414">Public Law 115–414</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="id509153a7-f8fa-4065-ae5c-57f4904c6c7c"><enum>(8)</enum><header>Authorities</header><subparagraph id="id26653b0c-3d73-4cda-9dfe-79d5223c050e"><enum>(A)</enum><header>In general</header><text>In carrying out the duties and functions under this subsection with respect to the oversight of covered funds, the Committee shall—</text><clause id="id4b52c10e-0407-45f4-a4c6-4725e9f1dcb1"><enum>(i)</enum><text>carry out those duties and functions in accordance with section 404(b)(1) of this title;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd45bb02a-c1ce-4f6a-9c1a-0fe4dbf54d4f"><enum>(ii)</enum><text display-inline="yes-display-inline">in coordination with relevant Inspectors General, have the authorities provided under and be subject to paragraphs (1) through (4) of subsection (a) and subsections (h), (j), and (k) of section 406;</text></clause><clause id="idc23e3822-1426-4f5f-af8c-c9f891bc82eb"><enum>(iii)</enum><text>be considered to be conducting civil or criminal law enforcement activity for the purposes of section 552a(b)(7) of this title; and</text></clause><clause id="id5d445135-bf8c-40f1-bda8-b03f4b783ed7"><enum>(iv)</enum><text>for the purposes of sections 552 and 552a of this title, be considered to be a component which performs as its principal function an activity pertaining to the enforcement of criminal laws, and its records may constitute investigatory material compiled for law enforcement purposes.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6bec37dd-9c53-40c1-835a-8d399ce9f35e"><enum>(B)</enum><header>Limitation on subpoena authority</header><text>When carrying out subpoena authority under section 406(a)(4) of this title, the following limitations shall apply to the Committee:</text><clause id="id6fcab59b-a4e7-4df7-aef8-28a6d04a5908"><enum>(i)</enum><text>Any subpoena issued under this subsection shall be signed by the Chairperson, and this power is non-delegable.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7b3ffac7-9b61-47b9-a4ac-f9ebe38ae0f6"><enum>(ii)</enum><text>On a quarterly basis, the Committee shall notify the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives of any subpoenas issued during the preceding quarter.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6b17063c-5628-4c1a-b84e-848b2ea8099c"><enum>(iii)</enum><text>The authority to issue a subpoena under this subsection shall terminate on the date that is 5 years after the effective date of this subsection.</text></clause></subparagraph></paragraph><paragraph id="ide68cec29-5a69-4a56-88cb-be839639bffb"><enum>(9)</enum><header>Refusal of information or assistance</header><text> Whenever information or assistance requested by the Committee or an Inspector General on the Committee is unreasonably refused or not provided, the Committee shall immediately report the circumstances to the appropriate congressional committees.</text></paragraph><paragraph id="id42b7491d-e586-42ae-891b-4850e5089b00"><enum>(10)</enum><header>Use of existing resources</header><text>The Committee shall leverage existing information technology resources within the Council, such as oversight.gov and those developed by the Pandemic Response Accountability Committee established under section 15010 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 533), to carry out the duties of the Committee.</text></paragraph><paragraph id="id119707dc-e1d0-4425-a0c3-2191537a9ddd"><enum>(11)</enum><header>Contracts</header><text>The Committee may enter into contracts to enable the Committee to discharge its duties, including contracts and other arrangements for audits, studies, analyses, and other services with public agencies and with private persons, and make such payments as may be necessary to carry out the duties of the Committee.</text></paragraph><paragraph id="id617b8242-0f09-4065-a1ec-8ef05df54a51"><enum>(12)</enum><header>Subcommittees</header><text>The Committee may establish subcommittees to facilitate the ability of the Committee to discharge its duties.</text></paragraph><paragraph id="ide04f1817-fd90-4b09-983f-48b766673536"><enum>(13)</enum><header>Transfer of funds, assets, and obligations</header><subparagraph commented="no" display-inline="no-display-inline" id="id56b4d5ac-ff91-4736-96c0-057b59904fdd"><enum>(A)</enum><header display-inline="yes-display-inline">Funds</header><text>The Committee may transfer funds appropriated to the Committee—</text><clause commented="no" display-inline="no-display-inline" id="id81b38a59-a039-4359-a0da-6c35bec5cc6d"><enum>(i)</enum><text display-inline="yes-display-inline">for expenses to support administrative support services and audits, reviews, or other activities related to oversight by the Committee of covered funds to any Office of the Inspector General or the General Services Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6d4a3120-843f-4abe-8c32-66fb2259d14d"><enum>(ii)</enum><text>to reimburse for services provided by the Council.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11ffab5b-20f5-4301-aff2-8f17230148bb"><enum>(B)</enum><header>Assets and obligations</header><clause commented="no" display-inline="no-display-inline" id="id8ffcbc5c-9a5f-44d3-a7cd-f268af8c1f8e"><enum>(i)</enum><header display-inline="yes-display-inline">Assets defined</header><text>In this subparagraph, the term <term>assets</term> includes contracts, agreements, facilities, property, data, records, unobligated or unexpended balances of appropriations, and other funds or resources (other than personnel).</text></clause><clause commented="no" display-inline="no-display-inline" id="idab843b8e-8405-4863-9a16-817cb98a86eb"><enum>(ii)</enum><header>Transfer</header><text>Upon the effective date of this subsection, the assets and obligations held by or available in connection with the Pandemic Response Accountability Committee established under 15010 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 533) shall be transferred to the Committee.</text></clause></subparagraph></paragraph><paragraph id="id7b2963e7-2fb0-48b7-a89e-c2c7c2456884"><enum>(14)</enum><header>Additional staff</header><subparagraph commented="no" display-inline="no-display-inline" id="id56302414-adf7-431f-8529-a2c0ba1beb5e"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Committee may exercise the authorities of subsections (b) through (i) of section 3161 of this title (without regard to subsection (a) of that section) to meet temporary or urgent needs of the Committee under this subsection, as certified by the Chairperson to the appropriate congressional committees that such temporary or urgent needs exist, as if the Committee were a temporary organization. </text></subparagraph><subparagraph id="idc1aead6f-b16c-42ab-8729-889ec950824d"><enum>(B)</enum><header>Head of organization</header><text>For purposes of exercising the authorities described in subparagraph (A), the term <term>Chairperson</term> shall be substituted for the term <term>head of a temporary organization</term>.</text></subparagraph><subparagraph id="id00ca241e-2a03-4988-af7e-cee1026b8794"><enum>(C)</enum><header>Consultation</header><text>In exercising the authorities described in subparagraph (A), the Chairperson shall consult with members of the Committee.</text></subparagraph><subparagraph id="id0fdbb483-6716-4a05-a459-6f61549499f3"><enum>(D)</enum><header>Additional detailees</header><text>In addition to the authority provided by section 3161(c) of this title, upon the request of an Inspector General, the Committee may detail, on a nonreimbursable basis, any personnel of the Committee to that Inspector General to assist in carrying out any audit, review, or investigation pertaining to the oversight of covered funds.</text></subparagraph><subparagraph id="id8efb5df7-f9c2-493c-aaf9-0c5a277c6d65"><enum>(E)</enum><header>Limitations</header><text>In exercising the employment authorities under section 3161(b) of this title, as provided under subparagraph (A) of this paragraph—</text><clause id="id29ed07b6-1ae3-450c-a4ce-10c28787edf8"><enum>(i)</enum><text>section 3161(b)(2) of this title (relating to periods of appointments) shall not apply; and</text></clause><clause id="id3c5e6bd2-f152-45f7-bfbd-14c07e6e9bdc"><enum>(ii)</enum><text>no period of appointment may exceed the date on which the Committee terminates.</text></clause></subparagraph><subparagraph id="id042656ed-767d-4bbd-ae1f-7e7221df6006"><enum>(F)</enum><header>Competitive service</header><text>A person employed by the Committee shall acquire competitive status and conditional tenure for appointment to any position in the competitive service for which the employee possesses the required qualifications upon the completion of 2 years of continuous service as an employee under this subsection.</text></subparagraph><subparagraph id="id0ffc1592-3365-4ec0-8bc9-3c1e30ba0f25"><enum>(G)</enum><header>Annuitants</header><clause commented="no" display-inline="no-display-inline" id="idcfe9afac-58b9-4ade-8a41-6c6830e7d1ce"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Committee may employ annuitants covered by section 9902(g) of this title for purposes of the oversight of covered funds.</text></clause><clause id="id4af1bf52-359d-4aaf-84a0-bcde4a47e42b"><enum>(ii)</enum><header>Treatment of annuitants</header><text>The employment of annuitants under this paragraph shall be subject to the provisions of section 9902(g) of this title, as if the Committee were the Department of Defense.</text></clause></subparagraph></paragraph><paragraph id="idd52a9a5b-3fd7-45a3-8199-81ea3039abf1"><enum>(15)</enum><header>Provision of information</header><subparagraph commented="no" display-inline="no-display-inline" id="idfcde61c6-eb8d-47a3-aabf-d70429e00b9b"><enum>(A)</enum><header display-inline="yes-display-inline">Requests</header><text>Upon request of the Committee for information or assistance from any agency or other entity of the Federal Government, the head of such entity shall, insofar as is practicable and not in contravention of any existing law, and consistent with section 406 of this title, furnish such information or assistance to the Committee, or an authorized designee, including an Inspector General designated by the Chairperson.</text></subparagraph><subparagraph id="id5ca8aca2-aeeb-467e-83e0-18f28a64221c"><enum>(B)</enum><header>Inspectors General</header><text>Any Inspector General responsible for conducting oversight related to covered funds may, consistent with the duties, responsibilities, policies, and procedures of the Inspector General, provide information requested by the Committee or an Inspector General on the Committee relating to the responsibilities of the Committee.</text></subparagraph></paragraph><paragraph id="idc7b97be5-fb4c-4e4a-8692-b8129e916d7e"><enum>(16)</enum><header>Website</header><subparagraph commented="no" display-inline="no-display-inline" id="id1f5af12e-584b-4f45-8969-d3ccc8cf0a02"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 30 days after the effective date of this subsection, the Committee shall establish and maintain a user-friendly, public-facing website—</text><clause commented="no" display-inline="no-display-inline" id="iddeb4d34d-cb53-4ff9-a173-ff9c0690aff4"><enum>(i)</enum><text display-inline="yes-display-inline">to foster greater accountability and transparency in the use of covered funds, which shall have a uniform resource locator that is descriptive and memorable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0ef1ed27-89a5-44b9-8430-c8cc0eb9b80e"><enum>(ii)</enum><text>that shall be a portal or gateway to key information relating to the oversight of covered funds and provide connections to other Government websites with related information.</text></clause></subparagraph></paragraph><paragraph id="id09bc6bd0-5292-4be7-8a9c-7e918de49072"><enum>(17)</enum><header>Coordination</header><text>The Committee shall coordinate its oversight activities with the Comptroller General of the United States and State auditors.</text></paragraph><paragraph id="id616d5cc733be464d8a73ec9084876cda"><enum>(18)</enum><header>Notice</header><text>The Chairperson shall provide notice to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives when designating or removing an Inspector General from the membership of the Committee under paragraph (4). </text></paragraph><paragraph id="idcf8cb046-9d86-4433-aa87-0638c53e5137"><enum>(19)</enum><header>Rules of construction</header><text>Nothing in this subsection shall be construed to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83b7ea37-913f-456a-8576-b4a953435cf7"><enum>(A)</enum><text display-inline="yes-display-inline">affect the independent authority of an Inspector General to determine whether to conduct an audit or investigation of covered funds; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd772088b-b182-411e-bcea-e45e80001e9a"><enum>(B)</enum><text display-inline="yes-display-inline">require the Council or any Inspector General to provide funding to support the activities of the Committee.</text></subparagraph></paragraph><paragraph id="id1f8a5e04-cf2a-46e1-b254-c754182a552f"><enum>(20)</enum><header>Authorization of appropriations</header><subparagraph commented="no" display-inline="no-display-inline" id="id08d75c78dd7b4db2a086e79c17570aab"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>For the purposes of carrying out the mission of the Committee under this subsection, there are authorized to be appropriated $17,000,000 for each of fiscal years 2026 and 2027 to carry out the duties and functions of the Committee.</text></subparagraph><subparagraph id="id259ea8a9185a4fb8b026e42e0058026f"><enum>(B)</enum><header>Report to Congress</header><text>Not later than 1 year after the effective date of this subsection, the Chairperson shall submit to the appropriate congressional committees a report that details the anticipated future budgetary needs of the Committee.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id39a6947b-e093-4aba-8607-d66c273c9ac6"><enum>(b)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall take effect on September 30, 2025.</text></subsection></section></legis-body><endorsement><action-date date="20240708">July 8, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
