<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4034</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240321">March 21, 2024</action-date><action-desc><sponsor name-id="S318">Mr. Wicker</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To withhold certain United Nations funding until the United Nations Human Rights Council mandates a body to investigate human rights abuses in the People's Republic of China, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Bystanders at the United Nations Human Rights Council Act of 2024</short-title></quote>.</text></section><section id="id925fa51ed78c45cc9ab3f8879109c84b"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="idb622e097675b48b48729190ac5040429"><enum>(1)</enum><text>According to the United Nations System Chief Executives Board for Coordination, the United States Government contributed $18,095,456,587 to the United Nations system in 2022, the most recent year for which the United Nations has made data available.</text></paragraph><paragraph id="id6b14d646b84b4a359058c1692f636765"><enum>(2)</enum><text>The United States is the single largest financial contributor to the United Nations system.</text></paragraph><paragraph id="id49c4ae1322d94689adb5337a7d5b8f0c"><enum>(3)</enum><text>All United Nations member states must certify that they will adhere to the United Nations Charter, Chapter 1, Article 1, which states that the United Nations will promote and encourage respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion.</text></paragraph><paragraph id="id78688b4d308f41dd84d769b1b3811174"><enum>(4)</enum><text>The United Nations Human Rights Council (in this Act referred to as the <quote>Council</quote>) is responsible for strengthening the promotion and protection of human rights around the globe and for addressing situations of human rights violations and making recommendations on them.</text></paragraph><paragraph id="ida553a79057b34389a9b2fdd8883a4449"><enum>(5)</enum><text>The Council possesses the power to establish independent investigative bodies to respond to situations of serious violations of international humanitarian law and international human rights law.</text></paragraph><paragraph id="id5170cbf0e29f490e84183195168461c9"><enum>(6)</enum><text>The Council has never established an independent body to investigate the human rights abuses of the Chinese Communist Party (CCP) in the People’s Republic of China (PRC). The Council’s failure to establish a body to investigate the human rights abuses of the CCP constitutes bystander behavior.</text></paragraph><paragraph id="id5e3df4caf72a46a38aa0b7a73f34ff84"><enum>(7)</enum><text>Following the Council’s 2018 Universal Periodic Review (UPR) of China, Former United Nations High Commissioner for Human Rights Michelle Bachelet wrote a letter to Former Chinese Minister of Foreign Affairs Wang Yi welcoming his government’s efforts to promote and protect human rights.</text></paragraph><paragraph id="id350651c62e174d0387a120ebcd050793"><enum>(8)</enum><text>The Council has established 38 investigative bodies since the Council was created in 2006. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20a03458e6854888982b721de6b69701"><enum>(9)</enum><text display-inline="yes-display-inline">The Council has established an independent investigative body to investigate Israel nine times. </text></paragraph><paragraph id="id5b39515966f54499b104e1264ec3d6f4"><enum>(10)</enum><text>The CCP has committed a number of grave human rights violations, including—</text><subparagraph id="idece940e24afe4f2ca73c505e9d9ed4e6"><enum>(A)</enum><text>the forced labor of ethnic Uyghur and other Muslims in the Xinjiang Uyghur Autonomous Region, as detailed in the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>);</text></subparagraph><subparagraph id="idfcae333c8b124f19b33e70bf6d85b065"><enum>(B)</enum><text>mass arrests of pro-democracy advocates peacefully exercising their freedoms of assembly and expression in Hong Kong; and</text></subparagraph><subparagraph id="id4e0fe72aa1b74cfdbb351b6c80455634"><enum>(C)</enum><text>widespread censorship and detainment of citizens protesting draconian <quote>zero-COVID</quote> restrictions.</text></subparagraph></paragraph></section><section id="id5ff38ae656294233bc1d1adc729a1d8f"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idcef83f7f297141b2a647e34da148f1cb"><enum>(1)</enum><text>the human rights abuses of the CCP warrant investigation by the Council;</text></paragraph><paragraph id="id9c889e85aa464a33ae65eafe9b31fb3d"><enum>(2)</enum><text>the Council’s failure to investigate the human rights abuses of the CCP contradicts the purpose of the United Nations stated in the United Nations Charter, Chapter 1, Article 1; and</text></paragraph><paragraph id="ida619d240d3074608a6e15d841d89de06"><enum>(3)</enum><text>the United States should not provide funding for the Council until it fulfills its stated responsibilities by establishing an independent investigative body to adequately examine the human rights abuses of the CCP. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida210ab7bb9ec46f88bfa81bb5ccf3d96"><enum>4.</enum><header>Withholding of United Nations funding</header><subsection commented="no" display-inline="no-display-inline" id="id954e61778da94ad99b55e09dd257bb14"><enum>(a)</enum><header display-inline="yes-display-inline">Annual United States contributions to regular budget of United Nations</header><text display-inline="yes-display-inline">The Secretary of State shall withhold from annual United States contributions to the regular budget of the United Nations an amount equal to the amount the Secretary determines would be allocated by the United Nations to support the United Nations Human Rights Council until the Secretary certifies to Congress that the United Nations Human Rights Council has mandated a body to investigate human rights abuses in the People’s Republic of China.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id51517be0f37f4e268bb1d32814058e80"><enum>(b)</enum><header>Prohibition on voluntary contributions to budget of UNHRC</header><text>The Secretary of State may not make voluntary contributions to the budget of the United Nations Human Rights Council until the Secretary certifies to Congress that the United Nations Human Rights Council has mandated a body to investigate human rights abuses in the People’s Republic of China. </text></subsection></section></legis-body></bill>
