which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize magistrate judges to issue arrest warrants for certain criminal aliens.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Public Safety Through Immigration Warrant Issuance Act</short-title></quote>.</text></section><section id="id5310d73c779c43dfb5fc612648ca02ad"><enum>2.</enum><header>Warrant authority</header><subsection commented="no" display-inline="no-display-inline" id="idd1f93626b5744ffd98592b5e85dc5a52"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 9 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351 et seq.</external-xref>) is amended by inserting after section 287 the following:</text><quoted-block id="idbaa1d5425e4e4e1996b95860865ba9e3" display-inline="no-display-inline" style="OLC"><section id="id13abc259b909474fbc6b029377181dd8"><enum>287A.</enum><header>Authorization of Federal courts to issue arrest warrants</header><subsection id="id7fee46b3edad43d5bf23808a5a0fab77"><enum>(a)</enum><header>Authorization of Federal courts To issue arrest warrants</header><text>Upon receiving an application from a Federal law enforcement officer or an attorney for the Federal Government, a magistrate judge is authorized to issue a warrant to seize an alien located within the district over which the magistrate judge has jurisdiction if there is probable cause to believe that the alien—</text><paragraph id="id249ea100cd97481683bcb817c17febc8"><enum>(1)</enum><text>is removable (as defined in section 240(e)(2)); and</text></paragraph><paragraph id="ida91e797b6c224af2ae5b8cbbf0b1ed44"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id68c362b068bb4ccb874d2e06025ce36f"><enum>(A)</enum><text>has been charged with, or convicted of, a felony;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id194dea783dd4466bb07e51b252a4e691" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">has been charged with, or convicted of, a crime of violence, including any crime that endangers the safety or welfare of children; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="ida6a2c55615864eed814e32c8d3f99542"><enum>(C)</enum><text display-inline="yes-display-inline">is a threat to national security.</text></subparagraph></paragraph></subsection><subsection id="idec788ec219f743dca2b126d9af974983"><enum>(b)</enum><header>Ensuring the effectiveness of warrants for persons in State or local custody</header><paragraph id="id37a80fcacf104d29902b77876ee7f3d5"><enum>(1)</enum><header>Additional authorities</header><text>If such actions are reasonably necessary to ensure the effectiveness of an arrest warrant issued pursuant to subsection (a), a magistrate judge may order the State or local jurisdiction with custody over the alien subject to such warrant—</text><subparagraph id="idab24e38d573445a79fe332f39b11cf5d"><enum>(A)</enum><text>to transfer the alien to Federal custody; </text></subparagraph><subparagraph id="idd377fc1d7dca43a585ca22619b43f274"><enum>(B)</enum><text>to notify the Federal Government of the impending release of the alien to facilitate such transfer; and</text></subparagraph><subparagraph id="id523cb963deac4bca91fd3b9f2b756f1b"><enum>(C)</enum><text>to hold the alien for such time as may be necessary to facilitate such transfer, which may not exceed 48 hours.</text></subparagraph></paragraph><paragraph id="id9a08e7a53ffc4f649cea521e696b3f64"><enum>(2)</enum><header>Timing of order</header><text>An order described in paragraph (1) may be issued contemporaneously with an arrest warrant issued pursuant to subsection (a) if, based on reliable evidence, a State or local jurisdiction with custody over the alien subject to such warrant is unlikely to assist in effectuating the warrant.</text></paragraph><paragraph id="ida8c30c23217d4b3badefac2b4a4510bf" commented="no"><enum>(3)</enum><header>Rules of construction</header><text>Nothing in this subsection may be construed—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4d00d24757284764a61a93e5d62ce062"><enum>(A)</enum><text display-inline="yes-display-inline">to limit any inherent or statutory power of the Federal courts to issue orders in aid of their jurisdiction, including writs of habeas corpus and writs authorized under section 1651 of title 28, United States Code (commonly known as the <quote>All Writs Act</quote>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd77aa16a90594fa6bff58cffb217ee96"><enum>(B)</enum><text>to interfere with the Department of Homeland Security’s ability to issue detainer requests, as authorized by law.</text></subparagraph></paragraph></subsection><subsection id="idf753b9012536421cbce45e04813eb89b"><enum>(c)</enum><header>Issuing the warrant</header><text>Each warrant issued pursuant to this section shall—</text><paragraph id="idac12175b2b3f4617a92d03c0c9c2ec86"><enum>(1)</enum><text>be issued to an officer authorized to execute it;</text></paragraph><paragraph id="id003afbdd8b4949f0bef6dbe283d6b82e"><enum>(2)</enum><text>identify the alien to be seized and designate the magistrate judge to whom the warrant shall be returned;</text></paragraph><paragraph id="id29cd034d885545e397c5e8047f8e2322"><enum>(3)</enum><text>require the officer to submit the issued warrant to any State or locality with custody over the alien subject to the warrant as quickly as practicable; and</text></paragraph><paragraph id="id85462133924141d38747f8de4ea224d0"><enum>(4)</enum><text>be returned to the magistrate judge designated in the warrant.</text></paragraph></subsection><subsection id="id5676df5d25504754b52093b7e68c58ef"><enum>(d)</enum><header>Procedure for obtaining a warrant</header><paragraph id="id709773c7bd9648c49f9b3f66dbceb9ee"><enum>(1)</enum><header>Ex parte proceedings</header><text>Warrant proceedings under this section may be conducted ex parte.</text></paragraph><paragraph id="id043539c92a0b43fe98290e54f8f334eb"><enum>(2)</enum><header>Warrant on an affidavit</header><text>When a Federal law enforcement officer or an attorney for the Federal Government presents an affidavit in support of a warrant, the magistrate judge may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbe226dd4b77645c588608888b220ce41"><enum>(A)</enum><text display-inline="yes-display-inline">require the affiant to appear personally before the judge; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2830e84a33544f9eb790c34e889e51aa"><enum>(B)</enum><text display-inline="yes-display-inline">examine under oath the affiant and any witness produced by the affiant.</text></subparagraph></paragraph><paragraph id="id308d078e81044cfbb497959bac7131f4"><enum>(3)</enum><header>Recording testimony</header><text>Testimony taken in support of a warrant shall be recorded by a court reporter or by a suitable recording device. The magistrate judge shall file the transcript or recording with the clerk, along with any related affidavit.</text></paragraph><paragraph id="id02f2476ed8f04759a090977b38b75bc0"><enum>(4)</enum><header>Requesting a warrant by telephonic or other reliable electronic means</header><text>In accordance with rule 4.1 of the Federal Rules of Criminal Procedure, a magistrate judge may issue a warrant based on information communicated by telephone or other reliable electronic means.</text></paragraph></subsection><subsection id="idDBB1B32758CA42CE8EAC1FC7248AAEAA"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id6F1F652B7BDE4EC3AA2962A64D5439A7"><enum>(1)</enum><header>Attorney for the federal government</header><text>The term <term>attorney for the Federal Government</term> means an attorney representing the Federal Government, as authorized by the Attorney General.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id126C4A50665040DEB1AA81205773C2AB"><enum>(2)</enum><header>Crime of violence</header><text>The term <term>crime of violence</term> has the meaning given such term in section 16 of title 18, United States Code.</text></paragraph><paragraph id="idFB37BE01E80F47D4A10194E875CAB4A2"><enum>(3)</enum><header>Felony</header><text>The term <term>felony</term> means a crime classified as a felony in the convicting jurisdiction, excluding Federal, State, or local offenses for which an essential element was the alien’s immigration status.</text></paragraph><paragraph id="id42E8A3DF2A0B4FD6B1CD5EA625416DC5" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Magistrate judge</header><text>The term <term>magistrate judge</term> means a United States magistrate judge appointed pursuant to section 631 of title 28, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id5efabbfa8131435e8740a5f13467bf66"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 287 the following:</text><quoted-block style="OLC" id="ida32833a2-346c-4734-b89e-a2718097d070"><toc><toc-entry level="section" idref="id13abc259b909474fbc6b029377181dd8">Sec. 287A.
