which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize workforce development innovation grants for the implementation, expansion, and evaluation of evidence-based workforce programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H78DCE979F5D7418CBD80FBBD38652A21"><section section-type="section-one" id="H6B51729FF32E4A71B93C57D471D0F2F9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Jobs through Evidence and Innovation Act</short-title></quote>. </text></section><section commented="no" id="HA0CE42939E0C4ECB862121EF7889B29A"><enum>2.</enum><header>Evaluations and research</header><subsection commented="no" display-inline="no-display-inline" id="iddc6e4875f1204ab394eabda147e3c6e5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 169 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3224">29 U.S.C. 3224</external-xref>) is amended—</text><paragraph commented="no" id="HEDD6A94DFE6543B8A4E30B3C7458233A"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph commented="no" id="HF2E9BDA985614CF2A9D0C4943DD5B89B"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA2C1E50703894E12B321E973FA7207AD"><subsection commented="no" id="H7FF00BCFB68149648E06FD6D6187F98E"><enum>(c)</enum><header>Workforce development innovation fund</header><paragraph commented="no" id="H62DD65151B6E41C9884CB88E410270AA"><enum>(1)</enum><header>Program authorized</header><subparagraph commented="no" id="HF170022319E34460BED09BB6E527B913"><enum>(A)</enum><header>In general</header><text>The Secretary may, on a competitive basis and in accordance with subparagraph (B), award workforce development innovation grants described in subparagraph (C) to eligible entities to enable such entities to—</text><clause commented="no" id="H3FE246B060724A1B975B4E2336452EC6"><enum>(i)</enum><text display-inline="yes-display-inline">establish, implement, replicate, or take to scale evidence-based, field-initiated innovation programs or services for improving the design and delivery of employment and training services that generate demonstrated long-term improvements in—</text><subclause commented="no" display-inline="no-display-inline" id="idb2f3d5b2f98f446ea632cb051c2b4bd7"><enum>(I)</enum><text display-inline="yes-display-inline">the performance or impact of the workforce development system;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id30666be5f06b45e4a0f336b573fb45cc"><enum>(II)</enum><text display-inline="yes-display-inline">earnings and employment outcomes for jobseekers (including individuals with barriers to employment) and earnings for employers; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id839d4e7e1a6a4e42945a50a082bbb5c7"><enum>(III)</enum><text display-inline="yes-display-inline">the cost-effectiveness of such innovation programs or services, particularly for participants and communities not sufficiently served by existing models such as participants and communities in rural areas; and</text></subclause></clause><clause commented="no" id="H081D18EAE94B4F858879F1ABB683A7F5"><enum>(ii)</enum><text>rigorously evaluate, through a partnership with a third-party research organization or a third-party researcher, such innovation programs or services for effectiveness in achieving any demonstrated long-term improvements in an outcome described in subclause (I), (II), or (III) of clause (i).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ed055b829bd4975aad16f0d4e727ce4"><enum>(B)</enum><header>Grant awards</header><clause commented="no" display-inline="no-display-inline" id="id5b33020d853b40479a01becf802eb907"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary—</text><subclause commented="no" display-inline="no-display-inline" id="id39d4bb98c3c54b40ae5380a153c09d09"><enum>(I)</enum><text display-inline="yes-display-inline">shall award grants under subparagraph (A) on the basis of potential achievements of the innovation program or service proposed by the eligible entity with respect to demonstrated, long-term improvements in an outcome described in subclause (I), (II), or (III) of subparagraph (A)(i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbc16f70ea173447495e12032ff2af06c"><enum>(II)</enum><text>may award under subparagraph (A) different types of grants described under subparagraph (C) to an eligible entity for separate innovation programs or services that meet the relevant criteria for such different types of grants.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id71d5b54ee7e045f9a94f58e88e161f3b"><enum>(ii)</enum><header>Duration of award</header><text>A grant awarded under subparagraph (A) shall be awarded for a period determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph commented="no" id="H7548ECEA46154733BCA8BF7D65A30BD0"><enum>(C)</enum><header>Description of grants</header><text>The grants described in subparagraph (A) shall, to the extent feasible, include—</text><clause commented="no" id="H9141CE1E7AFB4175B1BB8AE55AA66DAF"><enum>(i)</enum><text display-inline="yes-display-inline">early-phase grants for an innovation program or service supported by any level of evidence described in clause (i), (ii), or (iii) of subparagraph (D), for the purposes of funding the development, implementation, and evaluation of such program or service;</text></clause><clause id="H987C8051BFD3462BAD867464930BDE8C"><enum>(ii)</enum><text display-inline="yes-display-inline">mid-phase grants for an innovation program or service supported by a moderate level of evidence or a high level of evidence (as described in clause (ii) or (iii) of subparagraph (D), respectively) for the purposes of funding the operation, expansion, and continued evaluation of such innovation program or service at a single site; and</text></clause><clause id="H32A89A4A0110440E8B3AA30E70AF5066"><enum>(iii)</enum><text display-inline="yes-display-inline">expansion grants for an innovation program or service supported by a high level of evidence, as described in subparagraph (D)(iii), for the purposes of—</text><subclause commented="no" display-inline="no-display-inline" id="id3c827161fa2e4e9f9c510f42be77bb83"><enum>(I)</enum><text display-inline="yes-display-inline">funding the operation of such innovation program or service at a single site; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id50c1b95bc3464fa8885b6e5ac8122715"><enum>(II)</enum><text display-inline="yes-display-inline">expansion or such innovation program or service to another site; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaaf47e09116b46239c28b3ab0935f7ce"><enum>(III)</enum><text display-inline="yes-display-inline">implementation of a multi-site evaluation of such innovation program or service.</text></subclause></clause></subparagraph><subparagraph id="HEA481E9B03A04649BC8B0381B11F1F9E"><enum>(D)</enum><header>Level of evidence standards</header><text display-inline="yes-display-inline">The levels of evidence described in this subparagraph are the following:</text><clause id="HFB99E718544A4A08AF7F05BCEA8DDA14"><enum>(i)</enum><header>Low level of evidence</header><text display-inline="yes-display-inline">An innovation program or service is supported by a low level of evidence if such program or service has demonstrated, through a reasonable hypothesis and credible research findings (such as a correlational study with statistical controls for selection bias), descriptive research (such as a case study), or evidence review and needs assessment, the—</text><subclause commented="no" display-inline="no-display-inline" id="id30ac55eceaa24c2f8f22bd638fd10a42"><enum>(I)</enum><text display-inline="yes-display-inline">ability to achieve positive effects on earnings and employment outcomes for jobseekers (including individuals with barriers to employment) and earnings for employers; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5672fe31bf024d5e8a5c550a306238d4"><enum>(II)</enum><text display-inline="yes-display-inline">potential to achieve such effect on such outcomes.</text></subclause></clause><clause id="HAD9ADAFFFA114C76AA6D187F7DF4FEFD"><enum>(ii)</enum><header>Moderate level of evidence</header><text display-inline="yes-display-inline">An innovation program or service is supported by a moderate level of evidence if such program or service has demonstrated the ability to achieve sizable, but not yet conclusive, positive effects on earnings and employment outcomes for jobseekers (including individuals with barriers to employment) and earnings for employers, through—</text><subclause commented="no" display-inline="no-display-inline" id="id8538134d67b64a969bd1936557134542"><enum>(I)</enum><text display-inline="yes-display-inline">a well-designed and well-implemented experimental study of such program or service, such as a randomized controlled trial; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8f629b95654d4e9c86ab1b9761a341c1"><enum>(II)</enum><text display-inline="yes-display-inline">a rigorous quasi-experimental study of such program or service capable of drawing causal conclusions about the effectiveness of such program or service.</text></subclause></clause><clause id="HB5DA795A72164483A11A9CC0FC13A5E3"><enum>(iii)</enum><header>High level of evidence</header><text display-inline="yes-display-inline">An innovation program or service is supported by a high level of evidence if such program or service has demonstrated, through replication of studies, the ability to achieve a substantial and statistically-significant, positive impact on earnings and employment outcomes for jobseekers (including individuals with barriers to employment) and earnings for employers, through 2 or more well-designed and well-implemented experimental studies of such program or service conducted—</text><subclause commented="no" display-inline="no-display-inline" id="id11b3a148346b49e285cfdab7caf8923b"><enum>(I)</enum><text display-inline="yes-display-inline">at different implementation sites; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb440d56b1383415089e1005931d83da1"><enum>(II)</enum><text display-inline="yes-display-inline">through large, multi-site, randomized controlled trials.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H782A0013161D4323B812E324E4050A0D"><enum>(2)</enum><header>Technical assistance and evaluation research</header><text>Of the funds made available to carry out this subsection for a fiscal year, the Secretary shall reserve not more than 10 percent of the funds to—</text><subparagraph commented="no" id="HCF997855BB03400DA7100456037E9F59"><enum>(A)</enum><text display-inline="yes-display-inline">provide technical assistance to eligible entities, which may include preapplication workshops, web-based seminars, support for conducting feasibility studies and other planning activities, assistance with methods and requirements for purposes of evaluation research under subparagraph (D), and support for improving grant implementation and the quality and effectiveness of activities and services funded by grants awarded under subparagraph (A), including the use of administrative data and information to improve outcomes for participants;</text></subparagraph><subparagraph commented="no" id="H791CF7DB2B674D45B6E284DBBA67A48E"><enum>(B)</enum><text>disseminate information on low-, moderate-, and high-evidence-based practices;</text></subparagraph><subparagraph id="H3FA480F4773B48BFA320CF6ECF6EC87E"><enum>(C)</enum><text>fund staffing and other costs related to such activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8da9a74b6124fc79d4ec7bd1e298e2b"><enum>(D)</enum><text display-inline="yes-display-inline">conduct evaluation research regarding activities or services funded by grants awarded under subparagraph (A). </text></subparagraph></paragraph><paragraph commented="no" id="H6FBB034C414440E99ADE386C385031CC"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idcced11bc70d04961b2d71e2e2f630178"><enum>(A)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means an entity that is any of the following:</text><clause commented="no" display-inline="no-display-inline" id="H6C9D55C76E6A4B7BA47BF4E1ECA24DBA"><enum>(i)</enum><text display-inline="yes-display-inline">A State workforce development board established under section 101 (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>).</text></clause><clause commented="no" id="H74EC64EED40D4602AB3B1C88842570AF"><enum>(ii)</enum><text display-inline="yes-display-inline">A local workforce development board established under section 107 (<external-xref legal-doc="usc" parsable-cite="usc/29/3122">29 U.S.C. 3122</external-xref>).</text></clause><clause commented="no" id="H71BACF0AE65E43EF8765BDB2C6E7A18A"><enum>(iii)</enum><text display-inline="yes-display-inline">An Indian tribe, tribal organization, Alaska Native entity, Indian-controlled organization serving Indians, or Native Hawaiian organization that is eligible to receive an award under section 166 (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref>).</text></clause><clause commented="no" id="HB5F2542F51074805A5A46CA938E05DA9"><enum>(iv)</enum><text display-inline="yes-display-inline">An institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></clause><clause id="id6bb7156c528142bfb529e4737e4775ec"><enum>(v)</enum><text>A State workforce agency.</text></clause><clause id="idaf973eec35434126a92dec4ef07e184c"><enum>(vi)</enum><text>An organization—</text><subclause commented="no" display-inline="no-display-inline" id="id58864f881f0347749bb23c13f96a93bb"><enum>(I)</enum><text display-inline="yes-display-inline">that—</text><item commented="no" display-inline="no-display-inline" id="id2db5c02e9a2745afaf94291c0aff051e"><enum>(aa)</enum><text display-inline="yes-display-inline">is a community-based organization, a nonprofit organization, or a nongovernment organization; and</text></item><item commented="no" display-inline="no-display-inline" id="idde0138f7f81f4078b7a7e71b17ee6882"><enum>(bb)</enum><text display-inline="yes-display-inline">serves an underserved population; or </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id11a5faf8ec8f4b479e938d4f6723e9f9"><enum>(II)</enum><text display-inline="yes-display-inline">that is a national or regional organization that intends to use funds awarded under this Act to make direct grants to an organization described in subclause (I). </text></subclause></clause><clause commented="no" id="H814ABB7A73BC4548BB4A41B867832A1F"><enum>(vii)</enum><text>A consortium of any entities described in clause (i) through (vi).</text></clause></subparagraph><subparagraph id="id26CD6704C84E4750B4376DF12FDB55BE"><enum>(B)</enum><header>Field-initiated</header><text>The term <term>field-initiated</term>, with respect to a program or service, means a program or service in which the elements of the program or service have been developed by practitioners or researchers in the policy area.</text></subparagraph><subparagraph id="idBC5806F33C134CCBB922F8C7FECADF5A"><enum>(C)</enum><header>Innovation program or service</header><text>The term <term>innovation program or service</term> means a program or service designed to demonstrate innovative and cost-effective ways to augment and improve employment and training services. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id422a373d9e1e4b96a13f6a07f350e36f"><enum>(D)</enum><header>Well-designed and well-implemented experimental study</header><text display-inline="yes-display-inline">The term <term>well-designed and well-implemented experimental study</term> means a study that—</text><clause commented="no" display-inline="no-display-inline" id="id8374235f17ca4356b35e444a776c07ee"><enum>(i)</enum><text display-inline="yes-display-inline">is replicable; </text></clause><clause commented="no" display-inline="no-display-inline" id="id8098538338fc4e97b3f40d42e2c7ebea"><enum>(ii)</enum><text display-inline="yes-display-inline">uses programmatic and control groups that are representative of the type of population served by the program or service that is subject to the study, including by avoiding over-selection of participants who are highly skilled prior to participation for such programmatic group;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7d558556811b457d8d972ac6e12d7826"><enum>(iii)</enum><text display-inline="yes-display-inline">uses controls for aggregate shifts that might affect baseline numbers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5d69456e07cb4842aae02bbb39c9921d"><enum>(iv)</enum><text display-inline="yes-display-inline">does not have problems with attrition of participants from the study; and</text></clause><clause id="id5fe5cf0c851b43adba57e41b355830c1"><enum>(v)</enum><text>is conducted in a manner that is consistent with applicable evaluation, data, and privacy standards and practices described in—</text><subclause commented="no" display-inline="no-display-inline" id="idc2f13a951c49495c815c2f4397d1c30e"><enum>(I)</enum><text display-inline="yes-display-inline">the guidelines of the Office of Management and Budget entitled <quote>Guidelines for Ensuring and Maximizing the Quality, Objectivity, Utility, and Integrity of Information Disseminated by Federal Agencies</quote> (67 Fed. Reg. 8452 (February 22, 2002)) (or successor guidelines); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id244c6aede05a4e8c8bf6c99ae32ed02b"><enum>(II)</enum><text display-inline="yes-display-inline">the Foundations for Evidence-Based Policymaking Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/435">Public Law 115–435</external-xref>; 132 Stat. 5529) and the amendments made by that Act.</text></subclause></clause></subparagraph></paragraph><paragraph id="H9CFA28111B774271B326E8C6B3233DCC"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this subsection, such sums as may be necessary for each of the fiscal years 2025 through 2029.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id182dea19858941939fa890672160034e"><enum>(b)</enum><header>Conforming amendment</header><text>Section 132(a)(2)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3172">29 U.S.C. 3172(a)(2)(A)</external-xref>) is amended by striking <quote>169(c)</quote> and inserting <quote>169(d)</quote>.</text></subsection></section></legis-body></bill>
