which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require employers to provide paid annual leave to employees, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFC7D3A856B754417B8CAACD477E373BC"><section section-type="section-one" id="H586A08E6D2E4482E8FBF251004332D33"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteed Paid Vacation Act</short-title></quote>. </text></section><section id="HF96ADA7A5D3644A5BEC5DB4C07BF9703"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H10CB9121A7B04DC2B2878B69C42EFDF4"><enum>(1)</enum><header>Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and <term>industry or activity affecting commerce</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9ea542f81a164d499460320d16f39245"><enum>(A)</enum><text display-inline="yes-display-inline">mean any activity, business, or industry in commerce or in which a labor dispute would hinder or obstruct commerce or the free flow of commerce; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76154a2d7f264524b226827c4b8e77a1"><enum>(B)</enum><text display-inline="yes-display-inline">include <quote>commerce</quote> and <quote>industry affecting commerce</quote>, as defined in paragraphs (1) and (3) of section 501 of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/142">29 U.S.C. 142(1)</external-xref> and (3)).</text></subparagraph></paragraph><paragraph id="HA185FE0019B54218B3CDD4B70ACD5CBD"><enum>(2)</enum><header>Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means an individual who is—</text><subparagraph display-inline="no-display-inline" id="HEEB230C5C41649629796189EAAF31AF1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H58A6E10A7F6E4C6F8B1F1B2D5B16B586"><enum>(i)</enum><text display-inline="yes-display-inline">an employee (as defined in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>) who is not covered under any other provision of this paragraph, including an employee of the Library of Congress, except that a reference in such section to an employer shall be considered a reference to an employer described in paragraph (3)(A)(i)(I);</text></clause><clause display-inline="no-display-inline" id="H811C11D782DB47E28A27AAFF3D6E32DD" indent="up1"><enum>(ii)</enum><text>an employee of the Government Accountability Office; or</text></clause><clause commented="no" id="H0C6FC343E83D4831804922483D22BBB4" indent="up1"><enum>(iii)</enum><text>an employee of a covered employer described in paragraph (3)(B)(i)(V);</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H5C1B7D6DBE8A4FAEAE7FC506B3187C55"><enum>(B)</enum><text>a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a)), other than an applicant for employment;</text></subparagraph><subparagraph id="H0794FF728B3A42F297D0865F8F8470D2"><enum>(C)</enum><text>a tipped employee, as defined in section 3(t) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(t)</external-xref>), who is not covered under subparagraphs (B), (D), (E), or (F);</text></subparagraph><subparagraph id="HE73C37E13AB145BAAC377770FCCAF307"><enum>(D)</enum><text>a covered employee, as defined in section 411(c) of title 3, United States Code; </text></subparagraph><subparagraph id="HE5864B971E3A4056BC52E845DD45483F"><enum>(E)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>), other than an applicant for employment; or</text></subparagraph><subparagraph id="H32150820A5A842589BCFAA5047BE0CF9"><enum>(F)</enum><text>a Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code (without regard to the limitation in section 6381(1)(B) of that title), who is not covered under subparagraph (D).</text></subparagraph></paragraph><paragraph id="H9B1CAB70CF2E46AF93251986F4428D27"><enum>(3)</enum><header>Employer</header><subparagraph id="H311A19462D2945CC930145215D715020"><enum>(A)</enum><header>In general</header><text>The term <term>employer</term> means a person who is—</text><clause id="HFEC53CA738A94E9785F19F690016FD34"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H5230AF019BD64DEABD137C7461675F31"><enum>(I)</enum><text>a covered employer who is not described in any other subclause of this clause;</text></subclause><subclause id="HBA41F9434F584407A371C83E3D65F96D" indent="up1"><enum>(II)</enum><text>an entity employing a State employee described in section 304(a) of the Government Employee Rights Act of 1991;</text></subclause><subclause id="HD44A2557EB774F2BACF6ACCA0EE73C9B" indent="up1"><enum>(III)</enum><text>an employing office, as defined in section 101 of the Congressional Accountability Act of 1995;</text></subclause><subclause id="HECF6A14342844041BE07C93FC46622E9" indent="up1"><enum>(IV)</enum><text>an employing office, as defined in section 411(c) of title 3, United States Code; or</text></subclause><subclause id="HB9CAB0487BDA4824B0230D82D5D435AA" indent="up1"><enum>(V)</enum><text>an employing agency covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text></subclause></clause><clause id="H0CC7E5DC393D41E18052C13909A26CD5" indent="up1"><enum>(ii)</enum><text>engaged in commerce (including government), or an industry or activity affecting commerce (including government).</text></clause></subparagraph><subparagraph id="H0A40179284B241808CF0EA3AC5750349"><enum>(B)</enum><header>Covered employer</header><clause id="H0D45F9C3769D4EA08529513A434466D0"><enum>(i)</enum><header>In general</header><text>In subparagraph (A)(i)(I), the term <term>covered employer</term>—</text><subclause id="HC940DE7C6920400D88D382AD5F1A7A42"><enum>(I)</enum><text>means any person engaged in commerce or in any industry or activity affecting commerce who employs an employee for each working day during each of 20 or more calendar workweeks in the current or preceding year;</text></subclause><subclause id="H3FFEFA5016CF4525A672F116C5C5C091"><enum>(II)</enum><text>includes the Government Accountability Office and the Library of Congress;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide0c7367e0ce0410a8569ec02497e1ce7"><enum>(III)</enum><text>includes any public agency;</text></subclause><subclause id="HAEC6DF959F9F4D8F8A880836B82E967B"><enum>(IV)</enum><text>includes—</text><item id="H9E814120AE8343BBB3B6F5886FA90D64"><enum>(aa)</enum><text>any person who acts, directly or indirectly, in the interest of an employer covered by this clause to any of the employees of such employer; and</text></item><item id="H88F35779911542BCAD9193806C58614B"><enum>(bb)</enum><text>any successor in interest of such an employer; and</text></item></subclause><subclause commented="no" id="H339AC1B740E04A87940B6D15C7277330"><enum>(V)</enum><text display-inline="yes-display-inline">includes any carrier (as such term is defined in section 1 of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151</external-xref>)) and any carrier by air (as described in section 201 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/181">45 U.S.C. 181</external-xref>).</text></subclause></clause><clause id="idc9a097203ac4490e9da37eb976547535"><enum>(ii)</enum><header>Public agency</header><text>For purposes of clause (i)(III), a public agency shall be considered to be a person engaged in commerce or in an industry or activity affecting commerce.</text></clause><clause id="ide1d9eaf85d9b4b4b9634167efec4c090"><enum>(iii)</enum><header>Definitions</header><text>For purposes of this subparagraph:</text><subclause id="idbe7af65e40c94ae181c4476b1bc4111e"><enum>(I)</enum><header>Employee</header><text>The term <term>employee</term> has the meaning given such term in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>).</text></subclause><subclause id="id6b3efbc9ea234882bf9bb59a3bcb36e6"><enum>(II)</enum><header>Person</header><text>The term <term>person</term> has the meaning given such term in section 3(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(a)</external-xref>).</text></subclause><subclause id="id8770b7ee2d7e4ca4806e7a020ee297e1"><enum>(III)</enum><header>Public agency</header><text>The term <term>public agency</term> has the meaning given such term in section 3(x) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(x)</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="idd878f36140614a8fb160274e11a120de"><enum>(C)</enum><header>Predecessors</header><text>Any reference in this paragraph to an employer shall include a reference to any predecessor of such employer.</text></subparagraph></paragraph><paragraph id="HE29DBC3EB0A443CDA49D060FFA6402AE"><enum>(4)</enum><header>Paid annual leave</header><text>The term <term>paid annual leave</term>—</text><subparagraph id="HDF18E0722B134CB0B334D3438C18E629"><enum>(A)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), means paid vacation leave, paid personal leave, paid leave provided on an annual basis (provided under this Act or otherwise), or any other form of paid leave provided to an employee by the employer of such employee to be used on days (other than nonworkdays established by State or Federal law) in which the employee would otherwise work and receive pay; and</text></subparagraph><subparagraph id="HEBFD75046775466B8A92B238957E6AFF"><enum>(B)</enum><text>does not include—</text><clause id="H5482887C63BA4C729F801A843D41ACEE"><enum>(i)</enum><text>leave provided under the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601</external-xref>, et seq.); or</text></clause><clause id="HEE9A5D87CF8D4761A22D544C7F31C64A"><enum>(ii)</enum><text>any form of sick leave.</text></clause></subparagraph></paragraph><paragraph id="H47A5FAAFB6374B45B80F57C0939FAFA9"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="HD058BD4583F54B49852A52A7706CBC28"><enum>(6)</enum><header>Sick leave</header><text>The term <term>sick leave</term> means leave provided to an employee by the employer of such employee for reasons such as personal medical needs, family care or bereavement, care of a family member with a serious health condition, or adoption-related purposes, including leave required to be provided for such reasons under State or Federal law.</text></paragraph><paragraph id="H2DF005AEC19D4BBEA6D59E1687CCA4CB"><enum>(7)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph></section><section id="HE0704B278FDA4A449F0E6154F693E8DA"><enum>3.</enum><header>Earned paid annual leave</header><subsection id="H5DFB16DCCB294FB1BD4634F60F2A8FA7"><enum>(a)</enum><header>Earning of paid annual leave</header><paragraph id="H85A915B8C7174132ABB7441A97F6A67E"><enum>(1)</enum><header>Earning of annual leave</header><text display-inline="yes-display-inline">An employer shall provide each employee employed by the employer not less than 1 hour of paid annual leave for every 25 hours worked by the employee.</text></paragraph><paragraph id="H870992C2BA9D4E22B4AA39788F588ABD"><enum>(2)</enum><header>Limit</header><text display-inline="yes-display-inline">For purposes of complying with paragraph (1), an employer shall not be required to provide more than 80 hours of paid annual leave to an employee during any 12-month period.</text></paragraph><paragraph id="HF8395FA53D74496DAEB28A70E00C9284"><enum>(3)</enum><header>Commencement of earning paid annual leave</header><text>An employee shall begin to earn paid annual leave at the commencement of employment of such employee.</text></paragraph><paragraph id="H023219AD04F446E08DA6202A210CC55D"><enum>(4)</enum><header>Overtime exempt employee</header><text>For purposes of this section, an employee who is exempt from overtime requirements under section 13(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(1)</external-xref>) shall be deemed to work 40 hours in each workweek.</text></paragraph></subsection><subsection id="H6155B0B674FA4B4D875B392BE336CF98"><enum>(b)</enum><header>Use of paid annual leave</header><paragraph id="H976E04E75DA04C36B611101F3F5E26C9"><enum>(1)</enum><header>In general</header><text>Paid annual leave earned under subsection (a)(1) may be used by an employee for any reason.</text></paragraph><paragraph id="HE1F13968B57846A981705455467B1D6C"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3) of subsection (c) and except as provided in subsection (d)(2), an employee may use paid annual leave earned by the employee under subsection (a)(1)—</text><subparagraph id="H85B5AEDBE6744F64ABE0185016642101"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the 60th calendar day after the commencement of employment of such employee; or</text></subparagraph><subparagraph id="HB951A113BB67441DBEA5D5FE75B362B6"><enum>(B)</enum><text>at any time before such calendar day at the discretion of the employer of such employee. </text></subparagraph></paragraph><paragraph id="H1D400038BDF441A5B3AB400B418B9C38"><enum>(3)</enum><header>Rate of compensation</header><subparagraph id="H438E170C8837403BBDE7955E1D743AA1"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an employee using paid annual leave earned under subsection (a)(1) shall be compensated, for the period that the employee is using such leave, at the same rate at which the employee would have been paid for such period if the employee were not using the paid annual leave.</text></subparagraph><subparagraph id="HB805713CB90B4267949D0739AE02F278"><enum>(B)</enum><header>Tipped employee</header><text>For the purposes of subparagraph (A), an employee described in section 2(2)(C) shall be compensated, for the period that such employee is using paid annual leave earned under subsection (a)(1), at a rate equivalent to the greater of—</text><clause commented="no" display-inline="no-display-inline" id="id55010246e8e14221b1dbcf5bcaa8cf78"><enum>(i)</enum><text display-inline="yes-display-inline">the minimum wage required under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>); </text></clause><clause commented="no" display-inline="no-display-inline" id="idf67b8f70c87e4aaab31c411d80380673"><enum>(ii)</enum><text display-inline="yes-display-inline">the applicable State minimum wage; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id066f8ada6dac42eca08396d67db45ff1"><enum>(iii)</enum><text display-inline="yes-display-inline">the applicable local minimum wage.</text></clause></subparagraph></paragraph><paragraph id="H2D513B625968470CB7C13B7AF908B7C4"><enum>(4)</enum><header>Loaning of annual leave</header><subparagraph id="H04DFF975C96448F5BF63E344A22D0576"><enum>(A)</enum><header>Loaned leave</header><text>An employer may loan paid annual leave to an employee for use by such employee in advance of the employee earning such paid annual leave under subsection (a)(1), including before the 60th calendar day after the commencement of employment of such employee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81090f6070eb4c94b9f02a5de6e4183d"><enum>(B)</enum><header>Use of loaned leave</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), paid annual leave loaned under subparagraph (A) shall be treated as if earned under subsection (a)(1).</text></subparagraph><subparagraph id="H3373A242F0714AB9A21E563461B82DC0"><enum>(C)</enum><header>Reimbursement for loaned leave</header><clause commented="no" display-inline="no-display-inline" id="id534c304f8aa546b5a01c9bd54f3220c6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An employer may require an employee of such employer to reimburse the employer for any paid annual leave loaned under subparagraph (A) that such employee has not earned at the time of the termination of the employment of the employee. </text></clause><clause commented="no" display-inline="no-display-inline" id="ide9286575711c4ed09abc53dfcc5b3b8b"><enum>(ii)</enum><header>Rate</header><text display-inline="yes-display-inline">Reimbursement under clause (i) shall be at the applicable rate described in paragraph (3).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca60cdeeb30145cf9751d9eecd4f3b68"><enum>(5)</enum><header>Carryover</header><text>An employee may use not more than 40 hours of paid annual leave earned under subsection (a)(1) in a 12-month period during the following 12-month period.</text></paragraph></subsection><subsection id="H4BBB701B890141008CDCEC7552BC441E"><enum>(c)</enum><header>Procedures for use of paid annual leave</header><paragraph id="H6B0E0A0E9C864E0A805C82536897C8F3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), an employee may use paid annual leave earned under subsection (a)(1) upon the verbal or written request of the employee.</text></paragraph><paragraph id="H881B1D5DA635437B873452A42B8EB100"><enum>(2)</enum><header>Employee notification</header><subparagraph id="HA9D2CDB181514430840B39EB13B6ABEF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an employer may require an employee provide the request under paragraph (1) to the employer on a day that is—</text><clause commented="no" display-inline="no-display-inline" id="id646d697cc55a4c479bd0f5c9a90b23b2"><enum>(i)</enum><text display-inline="yes-display-inline">before the day on which the employee intends to use the paid annual leave; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2fbba0042f1644278f538771d9037c85"><enum>(ii)</enum><text>not more than 14 days before the day on which the employee intends to use the paid annual leave.</text></clause></subparagraph><subparagraph id="H00EEDA98CC29456896DCEE98DC2E4C1D"><enum>(B)</enum><header>Emergency</header><text>Notwithstanding subparagraph (A), an employer shall waive any notice requirement and allow the use of paid annual leave earned under subsection (a)(1) in the case of an emergency or a situation in which an employee can not provide timely notice to an employer for the use the paid annual leave.</text></subparagraph></paragraph><paragraph id="H9A138FA484374001AF6CAEEE9B38274E"><enum>(3)</enum><header>Reasonable restrictions</header><text>Notwithstanding paragraph (1), an employer may—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb8e7b685abda436d83b6d46480f00970"><enum>(A)</enum><text display-inline="yes-display-inline">place limited, reasonable restrictions regarding the scheduling of paid annual leave earned under subsection (a)(1); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbcbe3c3a74c45a2b85fc21e0fe376fc"><enum>(B)</enum><text display-inline="yes-display-inline">reject a scheduling request under paragraph (1) for such leave for a bona fide business reason, if the employer provides other reasonable alternative times for the employee to schedule such leave.</text></subparagraph></paragraph><paragraph id="H0AFB4178EDFC43918C2F4BACE17DB954"><enum>(4)</enum><header>Purpose of use of paid annual leave</header><text>An employer may not require an employee to disclose the purpose or reason for which the employee is using paid annual leave under subsection (a)(1).</text></paragraph><paragraph id="H63E2255004C94CB184ED7C5EF08E7ECF"><enum>(5)</enum><header>Prohibition on finding cover</header><text>An employer may not require, as a condition of using paid annual leave earned under subsection (a)(1), that an employee search for or find a replacement worker to cover the hours during which the employee is using such paid annual leave.</text></paragraph></subsection><subsection id="H81AD5D57F63F42C9B1CE5FE1ECD0924A"><enum>(d)</enum><header>Procedures regarding leave for employee separation</header><paragraph id="H43827BFF7BB445F8926EB94860CC08A3"><enum>(1)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Upon the termination of the employment of an employee, the employer of the employee shall provide financial reimbursement, at the applicable rate described in subsection (b)(3), to such employee for all paid annual leave earned by the employee under subsection (a)(1) that is unused as of the date of the termination.</text></paragraph><paragraph id="HEADA29B48E5F4CABA311AC205EF148F5"><enum>(2)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">If the employment of an employee with an employer is terminated and the employee is subsequently rehired by the employer within 12 months after that termination—</text><subparagraph id="H775F0C8AD191480DAFA06FFBC1D64BE5" commented="no"><enum>(A)</enum><text>the employer shall reinstate the employee’s previously earned paid annual leave; and</text></subparagraph><subparagraph id="HB6DDEB749C2C4B8D8462425138FAA2B1"><enum>(B)</enum><text>the employee shall be entitled to use such leave and earn additional paid annual leave under subsection (a)(1) at the recommencement of employment with the employer.</text></subparagraph></paragraph></subsection></section><section id="H1D22FD057BE743AEB20312FDB6E7293C"><enum>4.</enum><header>Notice requirements</header><subsection id="HE6B1CEBD28BE4306B45BAA9ADF6A5F0B"><enum>(a)</enum><header>Notice requirement</header><text>An employer shall notify each employee of the employer about the paid annual leave policy of such employer, which shall include the information described in subsection (b), by—</text><paragraph id="H9C4C8229EF144126939E1605967F253D"><enum>(1)</enum><text>providing such information, in writing, to each employee on or before the first day of employment of such employee;</text></paragraph><paragraph id="H552E2BB4226F4BCEAEC9771934A9346C"><enum>(2)</enum><text>including such information in any employee handbook; and</text></paragraph><paragraph id="HF18E9A9BD270443081D050D569438B80"><enum>(3)</enum><text>posting a notice containing such information in a physical conspicuous place on the premises of the employer or a virtual conspicuous place, where notices to employees are customarily posted.</text></paragraph></subsection><subsection id="H7DF3475FB6F6465CBD6A09937907A521"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The information provided pursuant to subsection (a) shall include—</text><paragraph id="HD4F8BCFAD1C04F7EB366B4A8D1415F80"><enum>(1)</enum><text>the paid annual leave policy of such employer, including any paid annual leave policy that provides paid annual leave in excess of the requirements of this Act; </text></paragraph><paragraph id="H48C845A86E8B4A22AF8B6F3779F001DC"><enum>(2)</enum><text>information pertaining to the filing of an action under section 6;</text></paragraph><paragraph id="H02B10D0A4C9C4E34A171C85BB6D37DC9"><enum>(3)</enum><text>details of any notice requirement the employer may require, as described in section 3(c)(2); and </text></paragraph><paragraph id="H122DDA427ADE4F708B2BC5F548BB203E"><enum>(4)</enum><text>information regarding—</text><subparagraph id="H093F7FAA303547768D84A02C40E85705"><enum>(A)</enum><text>the protections that an employee has in exercising rights under this Act; and</text></subparagraph><subparagraph id="H39B0F69602C84473B9EBD833889F14FB"><enum>(B)</enum><text>how the employee can contact the Secretary (or other appropriate authority as described in section 6) if any such rights are violated.</text></subparagraph></paragraph></subsection></section><section commented="no" id="H0AEDA33CFEFC4047BDCB790A0600188E"><enum>5.</enum><header>Prohibited acts</header><subsection commented="no" id="H640A4BB886CC4A50B45B48219E2E0242"><enum>(a)</enum><header>Interference with rights</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to interfere with, restrain, or deny the exercise of, or the attempt to exercise, any right provided under this Act, including—</text><paragraph commented="no" id="H74815AF0A0504A50BB26E7D8F0E434A9"><enum>(1)</enum><text>discharging or discriminating against (including retaliating against) any individual, including a job applicant, for exercising or attempting to exercise, any right provided under this Act;</text></paragraph><paragraph commented="no" id="HDC665EA3706D4A0AA11A741A48D6637F"><enum>(2)</enum><text>using the taking of paid annual leave as a negative factor in an employment action, such as hiring, promotion, reducing hours or numbers of shifts, or a disciplinary action; or</text></paragraph><paragraph commented="no" id="H49F93BBFECCF4E1980D8FDCC3DACFC4A"><enum>(3)</enum><text>counting paid annual leave under a no-fault attendance policy or any other absence-control policy.</text></paragraph></subsection><subsection commented="no" id="H0F4CD26CFAA34FD9A880548E31A2C9C0"><enum>(b)</enum><header>Interference with proceedings or inquiries</header><text>It shall be unlawful for any person to discharge or in any other manner discriminate against (including retaliating against) any individual, including a job applicant, because such individual—</text><paragraph commented="no" id="HB792C7CE9509469684604DF06EC34BAE"><enum>(1)</enum><text>has filed an action under section 6, or has instituted or caused to be instituted any proceeding, under this Act;</text></paragraph><paragraph commented="no" id="HD3082E023E1D4A0DA2D83632C3052B93"><enum>(2)</enum><text>has given, or intends to give, any information in connection with any inquiry or proceeding relating to any right provided under this Act; or</text></paragraph><paragraph commented="no" id="H36D50E3A0EA8444B95251ED0BBF14A6D"><enum>(3)</enum><text>has testified, or intends to testify, in any inquiry or proceeding relating to any right provided under this Act.</text></paragraph></subsection></section><section id="H4246B65D3E434668A1D0D48DF57E26D8"><enum>6.</enum><header>Enforcement and investigative authority</header><subsection id="HAA461EC3FD3E4C7FA952A5C3555AA240"><enum>(a)</enum><header>In general</header><paragraph commented="no" id="H3FEF6B7F5F644EAAAEB7648106628ACA"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" id="HB089912C1E1148BC9FFCA607245694E3"><enum>(A)</enum><text>the term <term>employee</term> means an employee described in subparagraph (A), (B), or (C) of section 2(2); and </text></subparagraph><subparagraph commented="no" id="HA1A75387EFED4BD797D8739D351043C1"><enum>(B)</enum><text>the term <term>employer</term> means an employer described in subclause (I) or (II) of section 2(3)(A)(i).</text></subparagraph></paragraph><paragraph id="H75593C2B1951454292613E4B5257171A"><enum>(2)</enum><header>Investigative authority</header><subparagraph id="H69B025F852934AD6957D4222E4354EA2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure compliance with this Act, or any regulation or order issued under this Act, the Secretary shall have, subject to subparagraph (C), the investigative authority provided under section 11(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), with respect to employers, employees, and other individuals affected by an employer.</text></subparagraph><subparagraph id="H6A2C83D7E9A84A12A388EE12BAB1667A"><enum>(B)</enum><header>Obligation to keep and preserve records</header><text>An employer shall make, keep, and preserve records pertaining to compliance with this Act in accordance with section 11(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>) and in accordance with regulations prescribed by the Secretary.</text></subparagraph><subparagraph id="H421ECB705A3F4B91B2E6BF2BDD32CF04"><enum>(C)</enum><header>Required submissions generally limited to an annual basis</header><text>The Secretary may not require, under the authority of this paragraph, an employer to submit to the Secretary any books or records more than once during any 12-month period, unless the Secretary has reasonable cause to believe there may exist a violation of this Act or any regulation or order issued pursuant to this Act, or is investigating a charge pursuant to paragraph (4).</text></subparagraph><subparagraph id="HFD6759C0012942FD8FA2224C4A05051B"><enum>(D)</enum><header>Subpoena authority</header><text>For the purposes of any investigation provided for in this paragraph, the Secretary shall have the subpoena authority provided for under section 9 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/209">29 U.S.C. 209</external-xref>).</text></subparagraph></paragraph><paragraph id="HF30D32AEE20B43F6BC55964AD889C076"><enum>(3)</enum><header>Private right of action</header><subparagraph id="H13DEE37C05FE4E82BF415FAF1CA4CAEC"><enum>(A)</enum><header>In general</header><text>An action to recover damages or equitable relief prescribed in subparagraph (B) may be maintained against any employer in any Federal or State court of competent jurisdiction by an employee or individual or a representative for and on behalf of—</text><clause id="H5BE445E76EE14B489192AE3EE9C04696"><enum>(i)</enum><text>the employee or individual; or</text></clause><clause id="H639F277AA2B74370BBD8F08CABCCE72A"><enum>(ii)</enum><text>the employee or individual and others similarly situated.</text></clause></subparagraph><subparagraph id="H92541EC748584A719CC7C323BFB84C2C"><enum>(B)</enum><header>Liability</header><text>Any employer who violates section 5 (including a violation relating to rights provided under section 3) shall be liable to any employee or individual affected—</text><clause id="HFFFADB9B532A495A994917871378710E"><enum>(i)</enum><text>for damages equal to—</text><subclause id="H2185DE270F3A4C3B85C09C31E6529EE3"><enum>(I)</enum><text>the amount of—</text><item id="H86A19743ECB545C9A296A6BD824D11C4"><enum>(aa)</enum><text>any wages, salary, employment benefits, or other compensation denied or lost by reason of the violation; or</text></item><item id="HB5EC35481A14405FB39575E0B5AF7608"><enum>(bb)</enum><text>in a case in which wages, salary, employment benefits, or other compensation have not been denied or lost, any actual monetary losses sustained as a direct result of the violation up to a sum equal to 80 hours of wages or salary for the employee or individual;</text></item></subclause><subclause id="H8FEADD8AC76A4BA8970CDFC5540A12B5"><enum>(II)</enum><text>the interest on the amount described in subclause (I) calculated at the prevailing rate; and</text></subclause><subclause id="H4E1CD318DA0F4C85B2CED82F6255C5C5"><enum>(III)</enum><text>an additional amount as liquidated damages; and</text></subclause></clause><clause id="H5AF5E6C30AE14F1EA90FB8A9EA13BB1F"><enum>(ii)</enum><text>for such equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></clause></subparagraph><subparagraph id="H897E78EEB22945A394258BA8E2FD0ECC"><enum>(C)</enum><header>Fees and costs</header><text>The court in an action under this paragraph shall, in addition to any judgment awarded to the plaintiff, allow a reasonable attorney’s fee, reasonable expert witness fees, and other costs to be paid by the defendant.</text></subparagraph><subparagraph id="HF9FACCB7C8A447CF97E6B8E44B0ECC1B"><enum>(D)</enum><header>Limitations</header><clause id="H3A346159F91949B08438F0C2DC6C3BCE"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), an action may be brought under this paragraph or paragraph (4) not later than 2 years after the date of the last event constituting the alleged violation for which the action is brought.</text></clause><clause id="H257D8C08607044FAB25E8F156220F5B0"><enum>(ii)</enum><header>Willful violation</header><text>In the case of such an action brought for a willful violation of section 5 (including a willful violation relating to rights provided under section 3), such action may be brought not later than 3 years after the last event constituting the alleged violation for which such action is brought.</text></clause><clause id="H634720990FC343B99883707786A54BB4"><enum>(iii)</enum><header>Commencement</header><text>In determining when an action is commenced under this paragraph or paragraph (4) for the purposes of this subparagraph, the action shall be considered to be commenced on the date when the complaint is filed.</text></clause></subparagraph></paragraph><paragraph id="H28E4B31799B947589D484F6099A49892"><enum>(4)</enum><header>Actions by the Secretary</header><subparagraph id="HD3579BAF41644BF887EAFE2DAFF38229"><enum>(A)</enum><header>Administrative actions</header><text display-inline="yes-display-inline">The Secretary shall receive, investigate, and attempt to resolve complaints of violations of section 5 in the same manner that the Secretary receives, investigates, and attempts to resolve complaints of violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29 U.S.C. 206 and 207).</text></subparagraph><subparagraph id="HDD62574C82404957A062E7FC326CCE43"><enum>(B)</enum><header>Civil action</header><text>The Secretary may bring an action in any court of competent jurisdiction to recover the damages described in subsection (a)(3)(B)(i).</text></subparagraph><subparagraph id="HFAA78B39C27F4C798A716B1349298251"><enum>(C)</enum><header>Sums recovered</header><text>Any sums recovered by the Secretary pursuant to subparagraph (B) shall be held in a special deposit account and shall be paid, on order of the Secretary, directly to each employee or individual affected. Any such sums not paid to an employee or individual affected because of the inability to do so within a period of 3 years shall be deposited into the Treasury of the United States as miscellaneous receipts.</text></subparagraph><subparagraph commented="no" id="HF334155C6B1240CE81C71E78FA32D1D0"><enum>(D)</enum><header>Action for injunction by Secretary</header><text>The district courts of the United States shall have jurisdiction, for cause shown, in an action brought by the Secretary—</text><clause commented="no" id="HCE70C38819014B959609EE100A307C9E"><enum>(i)</enum><text>to restrain violations of section 5 (including a violation relating to rights provided under section 3), including the restraint of any withholding of wages, salary, employment benefits, or other compensation, plus interest, found by the court to be due to employees or individuals eligible under this Act; or</text></clause><clause commented="no" id="H50929CF15B494B1AB3BFAEB12C67A2FB"><enum>(ii)</enum><text>to award such other equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></clause></subparagraph><subparagraph id="H90CFDB20C6DC4B5A8929180002BEA137"><enum>(E)</enum><header>Solicitor of Labor</header><text>The Solicitor of Labor may appear for and represent the Secretary on any litigation brought under this paragraph.</text></subparagraph></paragraph><paragraph commented="no" id="H6D010AA9011947E095F53786345247F2"><enum>(5)</enum><header>Government Accountability Office and Library of Congress</header><text>Notwithstanding any other provision of this section, in the case of the Government Accountability Office and the Library of Congress, the authority of the Secretary under this subsection shall be exercised respectively by the Comptroller General of the United States and the Librarian of Congress.</text></paragraph></subsection><subsection id="idc585fc1b4dde430aa5a54fb7d2817e02" commented="no"><enum>(b)</enum><header>Employees covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, united States code</header><text>The powers, remedies, and procedures provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United States Code, to the President, the Merit Systems Protection Board, or any person, alleging a violation of section 412(a)(1) of that title, shall be the powers, remedies, and procedures this Act provides to the President, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(D). </text></subsection><subsection commented="no" id="H32D3CB7DF2874BDD957BB799A790D0BA"><enum>(c)</enum><header>Employees covered by Congressional Accountability Act of 1995</header><text>The powers, remedies, and procedures provided in the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person, alleging a violation of section 202(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) shall be the powers, remedies, and procedures this Act provides to that Board, or any person, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(E).</text></subsection><subsection commented="no" id="H454C53D3D4704F5D9987ED9306E5FCCD"><enum>(d)</enum><header>Employees covered by <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code</header><text>The powers, remedies, and procedures provided in title 5, United States Code, to an employing agency, provided in chapter 12 of that title to the Merit Systems Protection Board, or provided in that title to any person, alleging a violation of chapter 63 of that title, shall be the powers, remedies, and procedures this Act provides to that agency, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this Act against an employee described in section 2(2)(F).</text></subsection><subsection commented="no" id="H41F66640136C47AC9A0AFD00DBAED6A3"><enum>(e)</enum><header>Remedies for State employees</header><paragraph commented="no" id="H357BF37ACF1A4FDDB8B5B788F545DA37"><enum>(1)</enum><header>Waiver of sovereign immunity</header><text>A State’s receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment to the Constitution or otherwise, to a suit brought by an employee of that program or activity under this Act for equitable, legal, or other relief authorized under this Act.</text></paragraph><paragraph commented="no" id="H732D32BDD8B24335B40F9920FCC5E48C"><enum>(2)</enum><header>Official capacity</header><text>An official of a State may be sued in the official capacity of the official by any employee who has complied with the procedures under subsection (a)(3), for injunctive relief that is authorized under this Act. In such a suit, the court may award to the prevailing party those costs authorized by section 722 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>).</text></paragraph><paragraph commented="no" id="HC57323B86FA64FAAB6C0C99E3C1D8FEA"><enum>(3)</enum><header>Applicability</header><text>With respect to a particular program or activity, paragraph (1) applies to conduct occurring on or after the day, after the date of enactment of this Act, on which a State first receives or uses Federal financial assistance for that program or activity.</text></paragraph><paragraph commented="no" id="HB3D9F7D3369D42FA8E2656E51C50BF48"><enum>(4)</enum><header>Program or activity defined</header><text>In this subsection, the term <term>program or activity</term> has the meaning given the term in section 606 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-4a">42 U.S.C. 2000d–4a</external-xref>).</text></paragraph></subsection></section><section id="H51073C8FA5534FA5AA5A350027968EED"><enum>7.</enum><header>Effect on existing employment benefits</header><subsection id="HA3CE2D758A5C44B7A82B73015FC2C224"><enum>(a)</enum><header>More protective</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to diminish the obligation of an employer to comply with any contract, collective bargaining agreement, or any employment benefit program or plan that provides greater paid annual leave or other leave rights to employees or individuals than the rights established under this Act.</text></subsection><subsection id="H298935C297314140AD6EBCC774CE539A"><enum>(b)</enum><header>Less protective</header><text>The rights established for employees under this Act shall not be diminished by any contract, collective bargaining agreement, or any employment program or plan.</text></subsection></section><section id="H9AB9F209E7F84866A7931F547294AF38"><enum>8.</enum><header>Awareness campaign</header><subsection id="H327326E78DEA40D6BAA84267974A0CB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall carry out a public awareness campaign to inform the public about the earned paid annual leave entitlement established under this Act, which shall include information about—</text><paragraph id="H9310C99973BD4FDE9356D172E06109D7"><enum>(1)</enum><text>the rights provided to an employee under this Act; and</text></paragraph><paragraph id="H548F62CAAA214D7BBC6A5068E3B0D289"><enum>(2)</enum><text>resources available to an employee if the employee believes the rights provided under this Act have been violated.</text></paragraph></subsection><subsection id="H92994A08E8A04BB2808911FD969A7B03"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><section id="HE6358A4DAAF74ED482C6598C7E30573B"><enum>9.</enum><header>Effective dates</header><subsection id="H15E81E0A583D4D6A956F1C53745CC20E"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act shall take effect 180 days after the date of enactment of this Act.</text></subsection><subsection id="HC4907ADC388648FC843D1725F9C23BBA"><enum>(b)</enum><header>Collective bargaining agreements</header><text>In the case of an applicable collective bargaining agreement in effect on the effective date prescribed under subsection (a), the Act shall take effect on the earlier of—</text><paragraph id="HA337D0A9F51C4AEC9D85912103A86C07"><enum>(1)</enum><text>the date of the termination of such agreement;</text></paragraph><paragraph id="HE17BDA09C945443CB05DCA87C7D5C643"><enum>(2)</enum><text>the date of any amendment, made on or after such effective date, to such agreement; or</text></paragraph><paragraph id="HA7C18503D6184DAC897A10C78E4E257D"><enum>(3)</enum><text>the date that occurs 18 months after such effective date. </text></paragraph></subsection></section></legis-body></bill>
