which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, with respect to the highway safety improvement program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBABCE36BD32B451182AE46EB1DD305BB"><section section-type="section-one" id="idb5d2901d27db41b5959f0162733cdd73"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sarah Debbink Langenkamp Active Transportation Safety Act</short-title></quote>.</text></section><section id="HCBD8B3FDD0E24A22BB0DFE1546041083"><enum>2.</enum><header>Highway safety improvement program</header><subsection id="HD76F4A165E2B4D1A881CC0BEFCC97961"><enum>(a)</enum><header>Highway safety improvement project</header><text>Section 148(a)(4)(B) of title 23, United States Code, is amended—</text><paragraph id="H597250FB667840458D4A429D226D59DE"><enum>(1)</enum><text>in clause (xxix), by striking <quote>through (xxviii)</quote> and inserting <quote>through (xxx)</quote>;</text></paragraph><paragraph id="H4FE6D1CED28E41F8815A5121C0608527"><enum>(2)</enum><text>by redesignating clause (xxix) as clause (xxxi); and</text></paragraph><paragraph id="H2B52F4911233496F857741FA46545307"><enum>(3)</enum><text>by inserting after clause (xxviii) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H9BEAF45405DC489BB4E451AFBE913F10"><clause id="HFB7F7EBBC3D64744A2D147E9E300FDF8"><enum>(xxix)</enum><text display-inline="yes-display-inline">The connection of 2 or more segments of existing bicyclist or pedestrian infrastructure.</text></clause><clause id="H2AE7B695AB384FB0BB9F48697F9F5323"><enum>(xxx)</enum><text display-inline="yes-display-inline">The reduction of safety risks to vulnerable road users through a project or strategy described in a program of projects or strategies developed pursuant to subsection (l)(2)(B).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1B43C60E86944AE2915C0FED1AB7EDEA"><enum>(b)</enum><header>Treatment of certain projects and strategies related to vulnerable road users</header><paragraph id="H24E58B66EC1748E698D2AC0E92BB2C4C"><enum>(1)</enum><header>Vulnerable road user safety assessment</header><text>Section 148(l) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HF73387F609FB45F7B21168565C2AF40A"><paragraph id="H710131CBE689476499E2BFA3E47B043C"><enum>(8)</enum><header>Consistency with State strategic highway safety plan</header><subparagraph commented="no" display-inline="no-display-inline" id="ide7eedab88adb43e585926b54cdb7d705"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A project or strategy for reducing safety risks to vulnerable road users shall be treated as consistent with a State strategic highway safety plan if—</text><clause id="HF2F4BBB7145D40B1B2FB54B8FDED22F2"><enum>(i)</enum><text display-inline="yes-display-inline">the relevant State strategic highway safety plan includes an emphasis area related to vulnerable road users; and</text></clause><clause id="H54368499828A4B3C892A6BD41B33C83E"><enum>(ii)</enum><text>the project or strategy—</text><subclause id="HB26A6BB6D9224D37A08E74F66DF81D89"><enum>(I)</enum><text>was described in a program of projects or strategies developed pursuant to paragraph (2)(B); </text></subclause><subclause id="HCA0482A1D913421A9A795138D030510C"><enum>(II)</enum><text display-inline="yes-display-inline">was identified by a local government, metropolitan planning organization, or regional transportation planning organization, including in a safety plan described in subparagraph (B), as addressing 1 or more areas of high risk to vulnerable road users during the consultation process required under paragraph (4)(B) and through a planning process and data-based analysis; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8bbe527d3f944976af62d376a5775384"><enum>(III)</enum><text display-inline="yes-display-inline">is a Proven Safety Countermeasure, as determined by the Federal Highway Administration.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84ee82163e5a49c48152bf9c8b129b19"><enum>(B)</enum><header>Safety plans described</header><text display-inline="yes-display-inline">A safety plan referred to in subparagraph (A)(ii)(II) is—</text><clause commented="no" display-inline="no-display-inline" id="id154b8fb7a97a491a93e0e40bde9bee91"><enum>(i)</enum><text>a pedestrian or bicyclist safety plan;</text></clause><clause commented="no" display-inline="no-display-inline" id="id19faa025e5c64c6eb73475d358e5b0cc"><enum>(ii)</enum><text display-inline="yes-display-inline">a Complete Streets plan;</text></clause><clause commented="no" display-inline="no-display-inline" id="id13af42870506424e8b6554380d6c5c3b"><enum>(iii)</enum><text display-inline="yes-display-inline">a local roadway safety plan;</text></clause><clause commented="no" display-inline="no-display-inline" id="id84f8c3789ed94a5e8a5a775f2bffbd00"><enum>(iv)</enum><text display-inline="yes-display-inline">a Vision Zero Action Plan;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9655646942634dc28436f77fa3c6f9fc"><enum>(v)</enum><text display-inline="yes-display-inline">a transition plan described in section 35.150(d) of title 28, Code of Federal Regulations (or successor regulations) (commonly known as an <quote>ADA Transition Plan</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idef39d19d09714097ba0ad77b31dd7f84"><enum>(vi)</enum><text display-inline="yes-display-inline">a Tribal transportation safety plan; </text></clause><clause commented="no" display-inline="no-display-inline" id="id760777615c6e4144aa789f1325c142d0"><enum>(vii)</enum><text display-inline="yes-display-inline">a comprehensive safety action plan (as defined in section 24112(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/402">23 U.S.C. 402</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>)); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idb412a3b217d74e25bb30345570c2117f"><enum>(viii)</enum><text display-inline="yes-display-inline">any other safety plan, as determined by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph display-inline="no-display-inline" id="H41C1B0C758C5465D945E880CD6CC8060"><enum>(2)</enum><header>Eligible projects</header><text>Section 148(e)(1) of title 23, United States Code, is amended—</text><subparagraph id="H0BC2CE814CE94D9A8D5075075A8327A4"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H1CF178866A394D6DA342AB612C964B36"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HC29ACB0A58F0439DA5E1F0BC1EACA66B"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDFED9E3B6F3740F28EE9B7C2912031FD"><subparagraph id="HBF699FC9DF3A4CB8ABB9732FCBEA5D41"><enum>(D)</enum><text display-inline="yes-display-inline">a project or strategy that is treated as consistent with a State strategic highway safety plan under subsection (l)(8).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H93313FD9E84148B3A5419D7360279F8B"><enum>(c)</enum><header>Federal share of certain highway safety improvement projects</header><paragraph id="H27886798D36840F695BEBD4DE109E97B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 148(j) of title 23, United States Code, is amended—</text><subparagraph id="HA2D7B3F633444FE2A944F02E72346C2E"><enum>(A)</enum><text>by striking <quote>Except as provided in sections 120 and 130</quote> and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HBE767746D96F4CF4B9ED540FD78D82FE"><paragraph id="H0CC816C5D4954082B6AE14AA5A4D0492"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in sections 120 and 130 and paragraph (2)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H90D6BB8023474E67BE1F44670A203989"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H8B40774ED3EB4430AC30D078EC28079E"><paragraph id="H4F49F95874A8458C8FAAB23D450C227E"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Federal share of the cost of a highway safety improvement project carried out with funds apportioned to a State under section 104(b)(3) may be up to 100 percent if the project is a project described in clause (xxix) or (xxx) of subsection (a)(4)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H75E5E45F26CD467D8C9A045ACE8A507F"><enum>(2)</enum><header>Flexible financing</header><text>Section 133(h)(7) of title 23, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id394af47d0ed841eb99032828aafceb40"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7b3f487cdf8446c94dfd84567efbe94"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idBBFCA61BCB8F44D48380A57A0DDAC554"><subparagraph id="id7ec3305bfd16468a958cec75029f7ac5"><enum>(B)</enum><header>Flexible financing</header><text>Notwithstanding section 120—</text><clause id="id95aeb2c56ebf44a7a76634a9920c3151"><enum>(i)</enum><text>the non-Federal share for a project under this subsection may be calculated on a project, multiple-project, or program basis; and</text></clause><clause id="id9df41383f3034e81ab0acf6bbe94f384"><enum>(ii)</enum><text>the Federal share of the cost of an individual project under this subsection may be up to 100 percent. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d2dffb6c704466fa1e4e2f29c9d196e"><enum>(C)</enum><header>Treatment as non-Federal share</header><text>Notwithstanding any other provision of law, funds made available to carry out section 148 may be credited toward the non-Federal share of the costs of a project under this subsection if the project—</text><clause id="H79054A1E50EA4C6AB7628CA0CF0E2D49"><enum>(i)</enum><text display-inline="yes-display-inline">includes a Proven Safety Countermeasure for bicyclists or pedestrians, as determined by the Federal Highway Administration; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id862be9bdeef54c0a9c3fc2081ce8d190"><enum>(ii)</enum><text display-inline="yes-display-inline">is consistent with the State strategic highway safety plan as described in section 148(l)(8).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H06F8B4E4962F4C3685F4E0E6545A8F17"><enum>(3)</enum><header>Increased Federal share for Proven Safety Countermeasures</header><text>Section 120(c)(1) of title 23, United States Code, is amended, in the first sentence, by inserting <quote>Proven Safety Countermeasures for bicyclists or pedestrians (as determined by the Federal Highway Administration),</quote> before <quote>breakaway utility poles</quote>.</text></paragraph></subsection></section></legis-body></bill>
