<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3963</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240314">March 14, 2024</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that noncommercial species found entirely within the borders of a single State are not in interstate commerce or subject to regulation under the Endangered Species Act of 1973 or any other provision of law enacted as an exercise of the power of Congress to regulate interstate commerce.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id65FDDD099D174E51939A5C3A93095BB2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Species Protection Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id3AFDB7A115384CCB990566D920F21DD4"><enum>2.</enum><header>Treatment of intrastate species</header><subsection id="id0043544A83A64D4B95F36BB86750F194"><enum>(a)</enum><header>Definition of Intrastate Species</header><text>In this section, the term <term>intrastate species</term> means any species of plant or fish or wildlife (as those terms are defined in section 3 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>)) that is—</text><paragraph id="idB672ED9649054DB0A2FD50D499BADD79"><enum>(1)</enum><text>found entirely within the borders of a single State; and</text></paragraph><paragraph id="idC2CA8865BBAD45209F95FDE72021E4CD"><enum>(2)</enum><text>not part of a national market for any commodity.</text></paragraph></subsection><subsection id="idB7B6364D267D48E9982116F37F79D6A2"><enum>(b)</enum><header>Treatment</header><text>An intrastate species shall not be—</text><paragraph id="id405A79C724664E3CA71218F5184D70F4"><enum>(1)</enum><text>considered to be in interstate commerce; and</text></paragraph><paragraph id="id67B50E2D2AD34DDAB56275A2B8C10C69"><enum>(2)</enum><text>subject to regulation under—</text><subparagraph id="id3F66BB099CF94D3AB931480038C21501"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></subparagraph><subparagraph id="idB7D6309A26B448A9BCB17041A478A52A"><enum>(B)</enum><text>any other provision of law under which regulatory authority is based on the power of Congress to regulate interstate commerce as enumerated in article I, section 8, clause 3 of the Constitution of the United States.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
