which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Funding Accountability and Transparency Act of 2006 to ensure that other transaction agreements are reported to USAspending.gov, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Secret Spending Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="iddcea03a598104c5289eb502b1f79b549"><enum>2.</enum><header>Other transaction agreement reporting</header><subsection commented="no" display-inline="no-display-inline" id="id090aa9b8eae742e2b3018342ceffd89f"><enum>(a)</enum><header display-inline="yes-display-inline">Other transaction agreements</header><text display-inline="yes-display-inline">Section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida61f39ddbca04a4988cdd60c685c8533"><enum>(1)</enum><text>in paragraph (4)(A)(ii), by striking <quote>and delivery orders</quote> and inserting <quote>delivery orders, and other transaction agreements</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida50b1d3335e64e63abf5ada92ba00c83"><enum>(2)</enum><text>in paragraph (7)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id613362b38d3d4eaaa5f3ce3d91cf7028"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>(2)(A)(i)</quote> and inserting <quote>(4)(A)(i)</quote>; and</text></subparagraph><subparagraph id="ide368b7cc81954c22b8ba218b620f5847"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>(2)(A)(ii)</quote> and inserting <quote>(4)(A)(ii)</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id755fb6084c7c4626ac6b1895766ae51f"><enum>(b)</enum><header>Data standards</header><text>Section 4 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id413DDBB73BD34EE690493AE2144CEC05"><subsection id="id1ca5ed2a5d4e4946beda659015afa6b6"><enum>(e)</enum><header>Other transaction agreement identifiers</header><text>Not later than 90 days after the date of enactment of the <short-title>Stop Secret Spending Act of 2024</short-title>, the Secretary shall create a unique identifier for data relating to other transaction agreements made available on the website established under section 2.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2396f86b9caf43d3b36fd95518e7f02a"><enum>(c)</enum><header>Annual report on unreported funding</header><text>Section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33D488123D254FF9A95C643304848C26"><subsection id="id75d383f37fc444a18ee5b36a7530b6fb"><enum>(h)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of the <short-title>Stop Secret Spending Act of 2024</short-title>, and annually thereafter, the Secretary shall post to the website established under this section a report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="idd1305c43bd574f4fbd88826a97dd9bd4"><enum>(1)</enum><text>the total amount of Federal spending on Federal awards, data for which has not been posted to the website; and</text></paragraph><paragraph id="id1dd9c334bab04dca967389d937ad4dc1"><enum>(2)</enum><text>with respect to the Federal spending described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4c71072569244fbcb50e246a9034bd00"><enum>(A)</enum><text>the categories of the Federal spending; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfe98a4f057d54b60bedf9ddf41cfceba"><enum>(B)</enum><text>the reason data on the Federal spending has not been posted to the website, including whether the Federal spending was—</text><clause commented="no" display-inline="no-display-inline" id="id289e0d5f733f46c1901a72e3922fc70a"><enum>(i)</enum><text>national security-related or classified;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1696c77f432b43a7a4387e00c1b6e6ee"><enum>(ii)</enum><text display-inline="yes-display-inline">a grant or contract awarded or entered into by a legislative or judicial branch agency; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id850028873ffd40f2bd843ede7cde88b3"><enum>(iii)</enum><text display-inline="yes-display-inline">a subaward below a primary subaward.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="ide439f4bf734a4e4bbb8ca91c7a90ffde"><enum>3.</enum><header>Other amendments</header><subsection commented="no" display-inline="no-display-inline" id="id0fab097e52ba490ea6f4f0bea575e675"><enum>(a)</enum><header display-inline="yes-display-inline">Inspector General reports</header><text display-inline="yes-display-inline">Section 6(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended by striking paragraph (2) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3BF69709C0244E5C86FE2A8128A10AFC"><paragraph id="id3c9b2dc5b4f3412cb005d9358fe4d648"><enum>(2)</enum><header>Deadlines</header><text>The Inspector General of each Federal agency shall submit to Congress and make publicly available a report described in paragraph (1)(B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id657b71a4f70043eda2e9fe093e470d2a"><enum>(A)</enum><text>not later than 1 year after the date of enactment of the <short-title>Stop Secret Spending Act of 2024</short-title>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7dd37fb39e764a14b2f5a195db153b8b"><enum>(B)</enum><text display-inline="yes-display-inline">on the same date as the Inspector General of each Federal agency submits the second and fourth reports required under sections 3521(f) and 9105(a)(3) of title 31, United States Code following the date of the report submitted under subparagraph (A); and.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id330cd5a742b748b6bb9da02e072d729e"><enum>(b)</enum><header>Full disclosure of Federal funds</header><paragraph commented="no" display-inline="no-display-inline" id="idc61e73be106645b89f507263f8c9e123"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idece542492406411f9e1fc225e6c828f7"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id2a5c05ba5bf34c61ad086a444c60e2d1"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (1), in the matter preceding subparagraph (A), by striking <quote>a Federal agency or component of a Federal agency</quote>and inserting <quote>a Federal agency or a component of a Federal agency included on the list posted under subsection (e)(2)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5c8e95d6ae3d4c37a6de68dfb2dbbafb"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking <quote>to be posted</quote> and inserting <quote>to be posted by a Federal agency or a component of a Federal agency included on the list posted under subsection (e)(2)</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id497a66fc0e1e4d0b8573716f9b69dfd4"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4FE408E01C7A4A41BE4B5160D4C3388C"><subsection id="ide549839f1518427db1840726dab21814"><enum>(c)</enum><header>Quality of information</header><text>The Secretary and the Director, in consultation with the heads of Federal agencies, shall ensure that the information to be posted under subsection (b) that is posted by a Federal agency or component of a Federal agency is complete and accurate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide3c352190e764b649a1e7f461187e9ec"><enum>(d)</enum><header display-inline="yes-display-inline">Display standards</header><text>The Secretary, in consultation with the Director, shall ensure that the heads of Federal agencies that post information under subsection (b) comply with display standards established by the Secretary.</text></subsection><subsection id="id9f412ce708064578bffd854e18fb6f28"><enum>(e)</enum><header>Agency reporting determination</header><text>Not later than 1 year after the date of enactment of the <short-title>Stop Secret Spending Act of 2024</short-title>, and not less frequently than once every 2 years thereafter, the Secretary, in coordination with the Director, shall—</text><paragraph id="id43fc6d986c2f4110ac72cfbbc5ddb354"><enum>(1)</enum><text>assess and make a determination with respect to which Federal agencies and components of Federal agencies are required to post information under subsection (b);</text></paragraph><paragraph id="id05113eaf9fb84418a48e2ff434fd19d6"><enum>(2)</enum><text>publish a list of the Federal agencies and components of Federal agencies determined under paragraph (1) on the website established under section 2(b)(1); and</text></paragraph><paragraph id="iddae8abf965b84733b6637a5adc9c1d76"><enum>(3)</enum><text>provide to the head and inspector general of each Federal agency or component of a Federal agency included on the list published under paragraph (2) written notice of the inclusion of the Federal agency or component of a Federal agency on the list.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94e828ed7454490cba6f180d157499f7"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1)(A) shall take effect on the date on which the Secretary publishes the first list under section 3(e)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as added by paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
