BILL</legis-type><official-title>To increase the supply of, and lower rents for, affordable housing and to assess calculations of area median income for purposes of Federal low-income housing assistance, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0C297B91E5D04D3EA60E5234DABE7C75"><section section-type="section-one" id="H5AE270B258474DD78E3A4BD3AEC21D85"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Housing and Area Median Income Fairness Act of 2024</short-title></quote>.</text></section><section id="H77626CC70DDC4474AE089265903508B0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H0EDA3D68786743A9800FA63C963D95DB"><enum>(1)</enum><header>Area median income</header><text>The term <term>area median income</term> means median income for an area, as such term is used in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>), median family income, and any other substantively similar metric that the Secretary uses to refer to the median income level for a given area or jurisdiction for purposes of any program administered by the Secretary.</text></paragraph><paragraph id="H7975975F0AC64261A1ACA09B297D2B6D"><enum>(2)</enum><header>High housing cost adjustment</header><text display-inline="yes-display-inline">The term <term>high housing cost adjustment</term> means an adjustment for high housing costs or high construction costs, or any substantively similar adjustment that the Secretary may use to increase income limits for areas where the cost of housing is abnormally high compared to the median income for such area, for purposes of any program administered by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HECE30B1A56D1422D9D2B66A8B732B6E1"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development. </text></paragraph></section><section id="HA96ABB86E46246E0B579ED6F9554F786"><enum>3.</enum><header>Urgent support for affordable housing infrastructure</header><subsection id="H6F7E832D88E5437F9E8B425BA14B2E1F"><enum>(a)</enum><header>Home Investment partnerships program</header><paragraph id="HA87CF70B0381436C90018101B9DB3085"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1721">42 U.S.C. 1721 et seq.</external-xref>) $5,000,000,000 for each of fiscal years 2025 through 2034.</text></paragraph><paragraph id="H39E9DB2E4C934E74AD14771F0BFC65F9"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any amounts appropriated pursuant to paragraph (1) shall be used only for assistance for any area within a jurisdiction for which the Secretary has applied a high housing cost adjustment.</text></paragraph></subsection><subsection id="HD77F5B156CD3406F971783F95014CA0A"><enum>(b)</enum><header> Community development block grants</header><paragraph id="H19097A3AC0ED45E68C4680F811B3F9F0"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for community development block grant assistance under section 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>) $5,000,000,000 for each of fiscal years 2025 through 2034.</text></paragraph><paragraph id="HE6975003A3284B8AB3C1244CCAC3F778"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any amounts appropriated pursuant to paragraph (1) shall be used only for assistance for any area within a jurisdiction for which the Secretary has applied a high housing cost adjustment.</text></paragraph></subsection><subsection id="HB58F3E8CAA384B76B5F6C20DFB7A542B"><enum>(c)</enum><header> Housing Trust Fund</header><paragraph id="HA367E053C1134854BC976277121E13DE"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Housing Trust Fund established under section 1338(a) of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4568">12 U.S.C. 4568(a)</external-xref>) $5,000,000,000 for each of fiscal years 2025 through 2034.</text></paragraph><paragraph id="H00071899FBA3456A8D9742EE54915E56"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any amounts appropriated pursuant to paragraph (1) shall be used only for assistance for any area within a jurisdiction for which the Secretary has applied a high housing cost adjustment.</text></paragraph></subsection></section><section id="H3111F1F7B1234772ACF446D60F3B0291"><enum>4.</enum><header>Assessment regarding optimizing use of area median income to support affordable housing in urban areas</header><subsection id="HB70B3AE723B44776A673F46D9D969DED"><enum>(a)</enum><header>Assessment of alternative calculation methods</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall commence an assessment of alternative methods for calculating area median income, and the use of alternative metrics, for programs administered by the Secretary that would make housing more affordable for low-income families residing in urban areas across the United States, which shall include analysis of the topics identified in subsection (b).</text></subsection><subsection id="HFF14820CB1294376BF77EF73711428F6"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives, and make publicly available, a report setting forth the results of the assessment conducted pursuant to subsection (a), which shall include—</text><paragraph id="HA427D27D97534E82B5C3ECA8BB1F1876"><enum>(1)</enum><text>a review and summarization of significant findings and recommendations from any related previous reports regarding area median income;</text></paragraph><paragraph id="H831B858F46B94641BB1E9C0F427E0FD6"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the extent and impacts of the affordable housing crisis in urban areas across the United States, particularly within jurisdictions for which the Secretary has applied a high housing cost adjustment, including a comparison of rent burdens for very low-income households in jurisdictions with and without high housing cost adjustments;</text></paragraph><paragraph id="H19DDA12B5BB14BA1BE071CF16772809D"><enum>(3)</enum><text display-inline="yes-display-inline">an analysis and assessment of the effects that high housing cost adjustments have had on income limits and rent prices in jurisdictions for which the Secretary has applied such an adjustment, including any effects on maximum rents allowed under sections 42 and 142 of the Internal Revenue Code of 1986 for tax-subsidized units;</text></paragraph><paragraph id="HA74C24B6DF9340F7A326AC9AA964E64F"><enum>(4)</enum><text>an updated assessment of the potential impacts to affordable housing, particularly on income limits and rent prices, of calculating area median income on a ZIP Code-level basis and using other localized methodologies;</text></paragraph><paragraph id="H5EFB1B6375C544F484E82F3164B2F280"><enum>(5)</enum><text>a process through which State housing authorities may designate area median income jurisdictions within that State;</text></paragraph><paragraph id="H148EB4FA32CD4E8E8E51C7E97D0F7A4B"><enum>(6)</enum><text>an assessment of alternative metrics to area median income for the purposes of setting income levels and related thresholds for affordable housing programs administered by the Secretary;</text></paragraph><paragraph id="H225C12BAA78B4167AE78FFF07A098D90"><enum>(7)</enum><text>recommendations for how the Secretary could reform or eliminate use of area median income for the purposes of making housing more affordable for low-income and middle class families in urban areas;</text></paragraph><paragraph id="HAFBFE19D5FF941A5990233B7B71F83A5"><enum>(8)</enum><text display-inline="yes-display-inline">any further recommendations for how the Secretary could use existing authorities to make housing more affordable for low-income and middle class families in urban areas, particularly for such families for which the Secretary has applied a high housing cost adjustment; and</text></paragraph><paragraph id="H5A95948A2ED2470B82A336D6EFC4ACD1"><enum>(9)</enum><text display-inline="yes-display-inline">an assessment of the impacts that Westchester and Rockland Counties in New York State have on the City of New York's area median income, related metrics, and affordable housing supply, including on income limits and maximum rent prices for affordable housing units within the jurisdiction of the City of New York.</text></paragraph></subsection><subsection id="HD791265D04124B2CB320E93C3E954E86"><enum>(c)</enum><header>Methodology</header><text>Not later than 45 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report describing the methodology that will be used to conduct the assessment under this section.</text></subsection></section></legis-body></bill>
