which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To set aside USDA rural housing funding for Indian Tribes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Rural Housing Access Act</short-title></quote>.</text></section><section id="id62828d2647724592a890908a77b5d05a"><enum>2.</enum><header>Set-aside of USDA rural housing funding for Indian Tribes</header><text display-inline="no-display-inline">Section 509 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1479">42 U.S.C. 1479</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idc057aa244f324f5c809401b0d9d37349" display-inline="no-display-inline" style="OLC"><subsection id="idb8049330d89f4485ae55e9a85e2f4a55"><enum>(g)</enum><header>Set-Aside for Indian Tribes</header><paragraph id="id35a6e352f107458f81a2a59aec8e37c8"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="id54f56defeb0d4021b2b0a4717718ba0f"><enum>(A)</enum><text>the term <term>community development financial institution</term> has the meaning given the term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3d884477ca149039e863ca3fd209cbd"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>Indian Tribe</term>, notwithstanding section 501 of this Act, has the meaning given the term <term>Indian tribe</term> in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>);</text></subparagraph><subparagraph id="idc426a73c5163429cb42e4b5c14d4c1e0"><enum>(C)</enum><text>the term <term>Native community development financial institution</term> means an entity—</text><clause commented="no" display-inline="no-display-inline" id="id4131fab5944c4dbabdf0f5e0339789d7"><enum>(i)</enum><text>that has been certified as a community development financial institution by the Secretary of the Treasury;</text></clause><clause commented="no" display-inline="no-display-inline" id="id593ecf2f78bd469c9b4cf55c8b65abe0"><enum>(ii)</enum><text display-inline="yes-display-inline">that is not less than 50 percent owned or controlled by Indian Tribes, members of Indian Tribes, or Native Hawaiians; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2782b1ede0c54a6197af3eecdccbf903"><enum>(iii)</enum><text display-inline="yes-display-inline">for which not less than 50 percent of the activities of the entity serve Indian Tribes, members of Indian Tribes, or Native Hawaiians;</text></clause></subparagraph><subparagraph id="idcbaecd592d254bd0984084715a5c3301"><enum>(D)</enum><text>the term <term>Native Hawaiian</term> has the meaning given the term in section 801 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221</external-xref>);</text></subparagraph><subparagraph id="id69c67c7d8a0240eabc9bc20a819cb3fb"><enum>(E)</enum><text>the term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>); and</text></subparagraph><subparagraph id="id2d5303c5a5d34c47baf05260154698d7"><enum>(F)</enum><text>the term <term>tribal-owned entity</term> means an entity, whether for-profit or non-profit—</text><clause commented="no" display-inline="no-display-inline" id="id2a024c2d44b94dbcb708220ea24401bb"><enum>(i)</enum><text display-inline="yes-display-inline">that is not less than 50 percent owned or controlled by Indian Tribes, members of Indian Tribes, or Native Hawaiians; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddf34c586bba04d5f8a6f553953dfb363"><enum>(ii)</enum><text>for which not less than 50 percent of the activities of the entity serve Indian Tribes, members of Indian Tribes, or Native Hawaiians.</text></clause></subparagraph></paragraph><paragraph id="id4169da1d10a64d70809324cfcec38278"><enum>(2)</enum><header>Set-aside</header><text>For each fiscal year, with respect to assistance under sections 502, 504, 514, 515, 516, 521(a), 525, 533, and 538, the Secretary shall set aside and reserve for assistance for the Indian Tribes, tribally designated housing entities, members of Indian Tribes and Native Hawaiians, and tribal-owned entities (including Native community development financial institutions) that are otherwise eligible for assistance under the applicable sections an amount equal to 5.0 percent of the aggregate amount of lending authority, budget authority, or guarantee authority, as appropriate, made available for the fiscal year for assistance under each of those sections to make, modify, or guarantee loans or to carry out programs or activities.</text></paragraph><paragraph id="id0d48f40421734d07a7def93d112c94ab" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Reallocation</header><text>The procedure under paragraph (2) for reserving amounts shall provide that any assistance set aside in any fiscal year that has not been expended by a reasonable date established by the Secretary shall be made available and allocated under the laws and regulations relating to such assistance, notwithstanding this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
