which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Workforce Innovation and Opportunity Act to permit greater flexibility in carrying out incumbent worker training programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lifelong Learning Act</short-title></quote>.</text></section><section id="id5415d5ce889948b6a59ddc14dc90b434"><enum>2.</enum><header>Incumbent worker training and transitional jobs standard reservation of funds</header><text display-inline="no-display-inline">Section 134(d) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id42d8530605964a82a858024f7af85db2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4)(A)(i), by striking <quote>20</quote> and inserting <quote>30</quote>; and</text></paragraph><paragraph id="id36d33ea9b7894255944d78c2145b238a" commented="no"><enum>(2)</enum><text>in paragraph (5), in the matter preceding subparagraph (A), by striking <quote>10</quote> and inserting <quote>15</quote>.</text></paragraph></section><section id="id1fb1895650e54fa186834317c2507878"><enum>3.</enum><header>Reporting incumbent worker training outcomes</header><text display-inline="no-display-inline">Section 116(d)(2)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(d)(2)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id02182f76f96a4e498d83dacc9f457556"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(A) information</quote> and inserting <quote>(A)(i) information</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f5f1bbaf2f04d8bb65a741ed46b7d6f"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (i), as so designated, by adding <quote>and</quote> at the end; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e757b686f934a3b8992b13577e0bdaf"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEF7FCF5F5270446FBAA90A5D12BE57D2"><clause commented="no" display-inline="no-display-inline" id="id6137e206934e4cf388048d2ce17b9b9f" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a State in which local areas are implementing incumbent worker training programs under section 134(d)(4), information on the levels of performance achieved for those programs with respect to the primary indicators of performance described in subsection (b)(2)(A), which information shall be used by the State and the Secretary of Labor in conjunction with the Secretary of Education to adapt the State adjusted levels of performance with respect to such indicators for the adult program and for the dislocated worker program authorized under chapter 3 of subtitle B.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id596c91dbb925494c91ae45bc43a62849"><enum>4.</enum><header>Expanding the flexibility of one-stop operators</header><text display-inline="no-display-inline">Section 121(d)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151(d)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idab2fb58fccc4423fa774b62f677cde17"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92f7f43b399041d994d9aa64d7b681c8"><enum>(2)</enum><text>in subparagraph (B)(vi), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10836a7e8cff4d669f775855a1f35402"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id606A2752DFC04B7BAF14F1A9BA0F3E8D"><subparagraph id="id5cf18f941d8340a5940f0869c5e96f5e"><enum>(C)</enum><text>subject to approval from the chief elected official and Governor and in accordance with any other eligibility criteria established by the State, and notwithstanding subparagraph (B), may be a local board, if the local board—</text><clause id="ide39aa6d087834213ae63e203e6415ec4"><enum>(i)</enum><text>enters into a written agreement with the chief elected official and clarifies how the local board will carry out the functions and responsibilities of a one-stop operator in a manner that complies with appropriate internal controls to prevent any conflicts of interest, which shall include how the local board, while serving as a one-stop operator, will comply with—</text><subclause id="id8100d0cabbbf425ab24c714c3d18907a"><enum>(I)</enum><text>the relevant Office of Management and Budget circulars relating to conflicts of interest; and</text></subclause><subclause id="id992b910f706c4b729dc47254ede6f67c"><enum>(II)</enum><text>any applicable State conflict of interest policy; and</text></subclause></clause><clause id="id0cc0e09c9bc840dfb794b57f935ef66b"><enum>(ii)</enum><text>complies with the other applicable requirements of this subsection.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
