which was read twice and referred to the <committee-name committee-id="SSRA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Rules and Administration</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240515">May 15, 2024</action-date><action-desc>Reported by <sponsor name-id="S311">Ms. Klobuchar</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title> To amend the Federal Election Campaign Act of 1971 to provide further transparency for the use of content that is substantially generated by artificial intelligence in political advertisements by requiring such advertisements to include a statement within the contents of the advertisements if generative AI was used to generate any image, audio, or video footage in the advertisements, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AI Transparency in Elections Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id2e908dbfe12d468f84c66f57ca45fda1" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><enum>2.</enum><header>Requiring disclaimers on advertisements containing content substantially generated by artificial intelligence</header><subsection id="ida8a28cf7f82a44b1bf4417957a3e2256"><enum>(a)</enum><header>Requirement</header><text>Section 318 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id010e90113e8c4bfcab885326b6f9b7df" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><subsection id="id6d5aaba7469b48aca9a1a7fe87a63f03"><enum>(e)</enum><header>Special disclaimer for covered communications containing content substantially generated by artificial intelligence</header><paragraph id="idb90b72b6431a4b11a470da7df1c1677e"><enum>(1)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="idb8bf6a79e52e47d2949eee8e0eeb334e"><enum>(A)</enum><header>Covered communication</header><clause commented="no" display-inline="no-display-inline" id="id95669a08492a4290b80c4777f4a462cb"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered communication</term> means a communication through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, telephone bank, internet or other digital medium, or any other type of general public political advertising that— </text><subclause commented="no" display-inline="no-display-inline" id="idc2c1905f3a224e2fabb989c5d134beeb"><enum>(I)</enum><text display-inline="yes-display-inline">expressly advocates for or against the nomination or election of a candidate; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide554f1c7232c496ea2a59ad759b69593"><enum>(II)</enum><text display-inline="yes-display-inline">refers to a candidate at any time during the period beginning 120 days before the date of a primary election or nominating caucus or convention and ending on the date on which a general election occurs; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc2696cd5352249c1b9aef510579a4dc9"><enum>(III)</enum><text display-inline="yes-display-inline">solicits a contribution for a candidate or political committee or any other person who makes disbursements for communications described in subclause (I) or (II).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida5eb572d529f496382654c797e415a46"><enum>(ii)</enum><header>Voice and likeness</header><text display-inline="yes-display-inline">A communication that invokes the likeness or voice of a candidate shall be treated as a communication that refers to such candidate.</text></clause></subparagraph><subparagraph id="id66569eff654d4e1b8b4197986990043e"><enum>(B)</enum><header>Generative artificial intelligence</header><text>The term <term>generative artificial intelligence</term> means artificial intelligence technology that uses machine learning (including deep-learning models, natural language processing, or other computational processing techniques of similar or greater complexity) to generate text, images, audio, video, or other media. </text></subparagraph><subparagraph id="idb57b50753dc04270822d678977dce0ca"><enum>(C)</enum><header>Substantially generated by artificial intelligence</header><clause commented="no" display-inline="no-display-inline" id="id0a4388562f834e82b5a85b87b0c526ff"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>substantially generated by artificial intelligence</term> means an image, audio, or video that was created or materially altered using generative artificial intelligence.</text></clause><clause commented="no" display-inline="no-display-inline" id="id698ffa7b4c5c40299bcd83c32f5e1983"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">Such term does not include an image, audio, or video that—</text><subclause commented="no" display-inline="no-display-inline" id="id9ebd2bbb59644f71ab7533c218d449a5"><enum>(I)</enum><text display-inline="yes-display-inline">has only minor alterations by generative artificial intelligence (including cosmetic adjustments, color editing, cropping, resizing, and other immaterial uses); and</text></subclause><subclause id="idc423662b659e45bfb7861c7175e02523"><enum>(II)</enum><text>does not create a fundamentally different understanding than a reasonable person would have from an unaltered version of the media. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id238f1ac8669f4daeb856fab8a4899340"><enum>(2)</enum><header>Requirement</header><text>If a covered communication contains an image, audio, or video that was substantially generated by artificial intelligence, the covered communication shall include, in a clear and conspicuous manner, a statement that the covered communication contains such an image, audio, or video.</text></paragraph><paragraph id="id26c39f2155fe4e5fb05253aa272fd93e"><enum>(3)</enum><header>Safe harbor for determining clear and conspicuous manner</header><text>A statement required under this subsection shall be considered to be made in a clear and conspicuous manner if the statement meets the following requirements:</text><subparagraph id="id59ec969570794cecbc2a1d7469a392b9"><enum>(A)</enum><header>Image covered communications</header><text>In the case of an image that is a covered communication, the statement—</text><clause id="id27338dc56e924e8f8cae0d49096217a6"><enum>(i)</enum><text>appears in letters at least as large as the majority of the text in the covered communication or otherwise meets the requirements under subsection (c)(1); </text></clause><clause id="id1d5a0b53b65d49018782b3877c2ac1ae"><enum>(ii)</enum><text>meets the requirements of paragraphs (2) and (3) of subsection (c);</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd1945ff06114266af182546cf776e10"><enum>(iii)</enum><text display-inline="yes-display-inline">states that the covered communication was created or materially altered by artificial intelligence; and</text></clause><clause id="ida963556294b1478d9a246401c3a5983d"><enum>(iv)</enum><text>is permanently affixed to the covered communication.</text></clause></subparagraph><subparagraph id="iddd6c336402694831a0af1c21d11e588b"><enum>(B)</enum><header>Audio covered communications</header><text>In the case of an audio covered communication, the statement—</text><clause commented="no" display-inline="no-display-inline" id="idd4e86662a45646c0916636d182e3c39e"><enum>(i)</enum><text display-inline="yes-display-inline">is spoken in a clearly audible and intelligible manner at the beginning or end of the covered communication and lasts not fewer than 4 seconds; and </text></clause><clause commented="no" display-inline="no-display-inline" id="ide90f256c44814aadace25ab42a68f45b"><enum>(ii)</enum><text display-inline="yes-display-inline">includes the following audio statement in a clearly spoken manner: <quote>___________ used artificial intelligence to generate the contents of this communication.</quote> (with the blank filled in with the name of person who made the disbursement to pay for such covered communication). </text></clause></subparagraph><subparagraph id="id3d9681370be843588c30805da743a48f"><enum>(C)</enum><header>Video covered communications</header><text>In the case of a video covered communication that also includes audio, the statement is made both in—</text><clause id="ida619e525ef4241ce9426a05b7fa3e30d"><enum>(i)</enum><text>a written format that meets the requirements of subparagraph (A) and appears throughout the length of the video covered communication; and</text></clause><clause id="id1acb1fdd928442e9a3c0f7b893a08fd3"><enum>(ii)</enum><text>an audible format that meets the requirements of subparagraph (B).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1a3bffb2df0748a6ba6c6ed34800cf35"><enum>(b)</enum><header>Enforcement</header><paragraph id="id28840bc490f3481ba6fcbade6544d102"><enum>(1)</enum><header>In general</header><text>Section 309(a)(4)(C)(i) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>)(i)) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb713884b941548299f33d7624091105c"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter before subclause (I), by inserting <quote>or a qualified disclaimer requirement</quote> after <quote>a qualified disclosure requirement</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbabfe0eebc6243a3bacad4301f909b45"><enum>(B)</enum><text>in subclause (II)—</text><clause commented="no" display-inline="no-display-inline" id="id41af186024c149e895559718ef9c6e60"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>a civil money penalty in an amount determined, for violations of each qualified disclosure requirement</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id34724D6C0ACC434A845CBFE0530698C6" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><text>a civil money penalty—</text><item commented="no" display-inline="no-display-inline" id="idede25b4094cf4f119cdd447c17cea26f" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">for violations of each qualified disclosure requirement, in an amount determined</text></item><after-quoted-block>; </after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id706a8cbe829b4f6d94bef36358cb9b84"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide6501b357d4641e3a2e08ed92f1bd9ec"><enum>(iii)</enum><text>by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C9ED0DE2FE84071B923FE3FE3C63C50" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><item commented="no" display-inline="no-display-inline" id="id70295f31000a49ddbceff7890dfb7be0" indent="up1"><enum>(bb)</enum><text>for violations of each qualified disclaimer requirement, in an amount which is determined under a schedule of penalties which is established and published by the Commission and which takes into account the existence of previous violations by the person and how broadly the communication is distributed and such other factors as the Commission considers appropriate, provided that any such civil penalty shall not exceed $50,000 per covered communication.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideec46749c5754e2a8d10404b4bc3acde"><enum>(2)</enum><header>Failure to respond</header><text>Section 309(a)(4)(C)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)(ii)</external-xref>) is amended by striking the period at the end and inserting <quote>, except that in the case of a violation of a qualified disclaimer requirement, failure to timely respond after the Commission has notified the person of an alleged violation under subsection (a)(1) shall constitute the person’s admission of the factual allegations of the complaint.</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9989b628d0364404b34c111f7eb5eb15"><enum>(3)</enum><header>Qualified disclaimer requirement defined</header><text>Section 309(a)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>) is amended by redesignating clause (v) as clause (vi) and by inserting after clause (iv) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6218911D617943EDB25FF9BFA2A2DA28" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><clause commented="no" display-inline="no-display-inline" id="id18c5678610c441839267e58fd6b499b8" indent="up1"><enum>(v)</enum><text>In this subparagraph, the term <term>qualified disclaimer requirement</term> means the requirement of section 318(e)(2).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id435EAFF1B5B34B968EC4845E3B624D99"><enum>(4)</enum><header>Application</header><text>Clause (vi) of section 309(a)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>), as redesignated by paragraph (3), is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide583bcf2ca4f4c36828ca0b13cfe3113"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>shall apply with respect to violations</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id9159430048CE4B6998C1ADA085D466B9" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><text>shall apply—</text><subclause commented="no" display-inline="no-display-inline" id="id905852bea10c479e8f3fe190f222aa18"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to violations of qualified disclosure requirements</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6473f98e331c48c88372c1fc786e6c5d"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb81cfdb9d7a94905b38d93625bfe73ff"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id44ED73EB74B74886BA8F1C1B2289EDF9" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><subclause commented="no" display-inline="no-display-inline" id="id4dedbba234c7482785f149e743e250cb"><enum>(II)</enum><text>with respect to violations of qualified disclaimer requirements occurring on or after the date of the enactment of the <short-title>AI Transparency in Elections Act of 2024</short-title>.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98b13760a2454fda98a1dc4e7a67fdda"><enum>(5)</enum><header display-inline="yes-display-inline">Time of judicial review</header><text>Section 309(a)(8)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(8)(A)</external-xref>) is amended by inserting <quote>(45-day period in the case of any complaint alleging a violation of section 318(e)(2))</quote> after <quote>120-day period</quote>.</text></paragraph></subsection><subsection id="id9bf8970b4c964ba383c3238311158c56"><enum>(c)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of the <short-title>AI Transparency in Elections Act of 2024</short-title>, the Federal Election Commission shall, in consultation with the Director of the National Institute of Standards and Technology, promulgate a regulation to carry out the amendments made by subsections (a) and (b), including—</text><paragraph id="id636c391adb7f47a69baf8c536a11f2bc"><enum>(1)</enum><text>criteria for determining whether a covered communication (as defined in section 318(e) of the Federal Election Campaign Act of 1971, as added by subsection (a)) contains an image, audio, or video substantially generated by artificial intelligence (as defined in such section); and</text></paragraph><paragraph id="id7cd252d8bdf7458ba3ae6a4ddc3dc156"><enum>(2)</enum><text>requirements for the contents of the statement required under section 318(e)(2) of the Federal Election Campaign Act of 1971, as added by subsection (a).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbfa2d4f198fe4b5080330a96a184cf13"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall—</text><paragraph commented="no" display-inline="no-display-inline" id="ida54f38a1a7514983a6bdcecf8f433bd7"><enum>(1)</enum><text display-inline="yes-display-inline">apply with respect to any communication made after the date of enactment of this Act; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id350ce376b8034460a7f9f1037664b9d3"><enum>(2)</enum><text display-inline="yes-display-inline">take effect without regard to whether the Federal Election Commission has promulgated regulations to carry out such amendments.</text></paragraph></subsection></section><section id="id449769e18617460eb378527126ed4020" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><enum>3.</enum><header>Reports</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and biannually thereafter, the Federal Election Commission shall submit a report to the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives that includes—</text><paragraph id="idd5b8d1d881a34a3789ded50ae40b0580"><enum>(1)</enum><text>an assessment of the compliance with and the enforcement of the requirements of subsection (e) of section 318 of the Federal Election Campaign Act of 1971, as added by this Act; and</text></paragraph><paragraph id="id05673345738c410bb6b3e2e45274650d"><enum>(2)</enum><text>recommendations for any modifications to that subsection to assist in carrying out the purposes of that subsection.</text></paragraph></section><section id="ida046ba612c0740fcbd332a2185c74fab" changed="deleted" reported-display-style="strikethrough" committee-id="SSRA00"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of any such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act, and the application of such provision or amendment to any other person or circumstance, shall not be affected by the holding. </text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id8873304a-ffbb-424e-8d18-ec7d22e1e880" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSRA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AI Transparency in Elections Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb865e415-d94d-4ae5-aead-4ccc9649e386" changed="added" reported-display-style="italic" committee-id="SSRA00"><enum>2.</enum><header>Requiring disclaimers on advertisements containing content substantially generated by artificial intelligence</header><subsection id="id9c211fa9-998b-4275-9565-90a5397aca53"><enum>(a)</enum><header>Requirement</header><text>Section 318 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfbde770f-2738-4be7-8d37-988895f9f723" changed="added" reported-display-style="italic" committee-id="SSRA00"><subsection id="ideeb4f0cc-22ba-4489-99e7-4ca65c06ee14"><enum>(e)</enum><header>Special disclaimer for covered communications containing content substantially generated by artificial intelligence</header><paragraph id="idfe38b439-e384-4656-9e0a-d452b676ac65"><enum>(1)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="ida0db18ba-39e9-417b-89a6-5e4b299ab485"><enum>(A)</enum><header>Covered communication</header><clause commented="no" display-inline="no-display-inline" id="idf1f0f9cd-7a4d-4bba-9ea1-2f30897b19c8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered communication</term> means a communication through any broadcasting station, newspaper, magazine, outdoor advertising facility, mailing, telephone bank, internet or other digital medium, or any other type of general public political advertising that— </text><subclause commented="no" display-inline="no-display-inline" id="id41eeb015-72bd-4ff4-8e80-b29946ffea3e"><enum>(I)</enum><text display-inline="yes-display-inline">expressly advocates for or against the nomination or election of a candidate; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddd4316e9-e740-45e6-8ca0-8a4f8bfa0e0d"><enum>(III)</enum><text display-inline="yes-display-inline">solicits a contribution for a candidate or political committee or any other person who makes disbursements for communications described in subclause (I) or (II).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id51581bfd-a563-425d-8c87-b4ad969c1cef"><enum>(ii)</enum><header>Voice and likeness</header><text display-inline="yes-display-inline">A communication that invokes the likeness or voice of a candidate shall be treated as a communication that refers to such candidate.</text></clause></subparagraph><subparagraph id="id8558ba11-840e-4ad9-8e9c-49a58c7c3f4e"><enum>(B)</enum><header>Generative artificial intelligence</header><text>The term <term>generative artificial intelligence</term> means artificial intelligence technology that uses machine learning (including deep-learning models, natural language processing, or other computational processing techniques of similar or greater complexity) to generate text, images, audio, video, or other media. </text></subparagraph><subparagraph id="idc7ca244b-39d8-4420-bdf7-00928fc05595"><enum>(C)</enum><header>Substantially generated by artificial intelligence</header><clause commented="no" display-inline="no-display-inline" id="id5efa6581-83b3-49fa-a4e7-800f14d73598"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>substantially generated by artificial intelligence</term> means an image, audio, or video that was created or materially altered using generative artificial intelligence.</text></clause><clause commented="no" display-inline="no-display-inline" id="id779ac82f-1a8b-43f5-9995-c030176de24c"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">Such term does not include an image, audio, or video that—</text><subclause commented="no" display-inline="no-display-inline" id="idb2ab95d9-aba9-47eb-b944-eede94a8a9e1"><enum>(I)</enum><text display-inline="yes-display-inline">has only minor alterations by generative artificial intelligence (including cosmetic adjustments, color editing, cropping, resizing, and other immaterial uses); and</text></subclause><subclause id="id7d49fd4c-eab3-46eb-ba4b-2bee88905ba7"><enum>(II)</enum><text>does not create a fundamentally different understanding than a reasonable person would have from an unaltered version of the media. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80a0e362-d165-40f9-887b-e922b98fd510"><enum>(2)</enum><header>Requirement</header><text>When a person makes a disbursement for the purpose of financing a covered communication containing an image, audio, or video that was substantially generated by artificial intelligence, the covered communication shall include, in a clear and conspicuous manner, a statement that the covered communication contains such an image, audio, or video.</text></paragraph><paragraph id="id3d98f11e-874e-4e0d-9706-08a51fdd9073"><enum>(3)</enum><header>Safe harbor for determining clear and conspicuous manner</header><text>A statement required under this subsection shall be considered to be made in a clear and conspicuous manner if the statement meets the following requirements:</text><subparagraph id="idabbcccf8-fd25-4e76-a6c7-05279527a62d"><enum>(A)</enum><header>Image covered communications</header><text>In the case of an image that is a covered communication, the statement—</text><clause id="id93a6e8e5-d998-412e-bbc6-3903569aae1d"><enum>(i)</enum><text>appears in letters at least as large as the majority of the text in the covered communication or otherwise meets the requirements under subsection (c)(1); </text></clause><clause id="id2488d882-6397-4289-8ff8-d31a9dc59624"><enum>(ii)</enum><text>meets the requirements of paragraphs (2) and (3) of subsection (c);</text></clause><clause commented="no" display-inline="no-display-inline" id="ide2e59a85-e7f2-4c92-b406-cf7be46b5ce8"><enum>(iii)</enum><text display-inline="yes-display-inline">states that the covered communication was created or materially altered by artificial intelligence; and</text></clause><clause id="ida840ad31-b576-4162-8dea-df419330bbeb"><enum>(iv)</enum><text>is permanently affixed to the covered communication.</text></clause></subparagraph><subparagraph id="idf82daf58-15c1-4392-b79c-39129275dca2"><enum>(B)</enum><header>Audio covered communications</header><text>In the case of an audio covered communication, the statement—</text><clause commented="no" display-inline="no-display-inline" id="id248b9ae7-3b15-4360-9fb9-ac0fad693d68"><enum>(i)</enum><text display-inline="yes-display-inline">is spoken in a clearly audible and intelligible manner at the beginning or end of the covered communication and lasts not fewer than 4 seconds; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id2bdb0aa4-3a5b-4c25-baa6-95eae7b0f6c9"><enum>(ii)</enum><text display-inline="yes-display-inline">includes the following audio statement in a clearly spoken manner: <quote>___________ used artificial intelligence to generate the contents of this communication.</quote> (with the blank filled in with the name of person who made the disbursement to pay for such covered communication). </text></clause></subparagraph><subparagraph id="id67e7b3d1-28af-4243-989f-7e6b4ab1dc68"><enum>(C)</enum><header>Video covered communications</header><text>In the case of a video covered communication that also includes audio, the statement is made both in—</text><clause id="id9070803e-9687-47bb-91c2-e62fe5f34ef3"><enum>(i)</enum><text>a written format that meets the requirements of subparagraph (A) and appears throughout the length of the video covered communication; and</text></clause><clause id="idf257efc6-dd70-4586-a4ec-0cc602279db9"><enum>(ii)</enum><text>an audible format that meets the requirements of subparagraph (B).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idc7f43011-cabf-4a99-a729-30c308e15468"><enum>(b)</enum><header>Enforcement</header><paragraph id="id13744240-6250-4b72-8124-b1e3f1e455a8"><enum>(1)</enum><header>In general</header><text>Section 309(a)(4)(C)(i) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>)(i)) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc6489545-f2d2-4950-b7d1-0d731e08a84f"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter before subclause (I), by inserting <quote>or a qualified disclaimer requirement</quote> after <quote>a qualified disclosure requirement</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31826275-6acb-4442-a944-f026df4310ed"><enum>(B)</enum><text>in subclause (II)—</text><clause commented="no" display-inline="no-display-inline" id="idbc23b329-3e10-49c0-9350-d79f559408e6"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>a civil money penalty in an amount determined, for violations of each qualified disclosure requirement</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id59783f3c-afc6-4f32-8cb2-30b789a482b7" changed="added" reported-display-style="italic" committee-id="SSRA00"><text>a civil money penalty—</text><item commented="no" display-inline="no-display-inline" id="idbd554dd5-b200-4246-adae-43f6e6b512c7" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">for violations of each qualified disclosure requirement, in an amount determined</text></item><after-quoted-block>; </after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idc20c9919-f486-45c7-b702-f50f71d21923"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddd3d5116-c4d1-43ed-b18e-f895bde8c618"><enum>(iii)</enum><text>by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0c9de49e-6533-494d-b538-1136a7af9b79" changed="added" reported-display-style="italic" committee-id="SSRA00"><item commented="no" display-inline="no-display-inline" id="idd9246e28-f3ae-4aaa-9eba-daf7ab3b48b3" indent="up1"><enum>(bb)</enum><text>for violations of each qualified disclaimer requirement, in an amount which is determined under a schedule of penalties which is established and published by the Commission and which takes into account the existence of previous violations by the person and how broadly the communication is distributed and such other factors as the Commission considers appropriate, provided that any such civil penalty shall not exceed $50,000 per covered communication.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id892b75fb-da48-4fad-9d5a-9c51383b9d5e"><enum>(2)</enum><header>Failure to respond</header><text>Section 309(a)(4)(C)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)(ii)</external-xref>) is amended by striking the period at the end and inserting <quote>, except that in the case of a violation of a qualified disclaimer requirement, failure to timely respond after the Commission has notified the person of an alleged violation under subsection (a)(1) shall constitute the person’s admission of the factual allegations of the complaint.</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44f51085-97a9-4681-b773-efc6da37cb1e"><enum>(3)</enum><header>Qualified disclaimer requirement defined</header><text>Section 309(a)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>) is amended by redesignating clause (v) as clause (vi) and by inserting after clause (iv) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18f5117c-4802-49aa-a4fb-0d4f01c8f027" changed="added" reported-display-style="italic" committee-id="SSRA00"><clause commented="no" display-inline="no-display-inline" id="id349f0661-a836-4c4a-95fc-260d48ed795a" indent="up1"><enum>(v)</enum><text>In this subparagraph, the term <term>qualified disclaimer requirement</term> means the requirement of section 318(e)(2).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idd12d8efa-945d-45fb-bc94-fcc8978c8137"><enum>(4)</enum><header>Application</header><text>Clause (vi) of section 309(a)(4)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(4)(C)</external-xref>), as redesignated by paragraph (3), is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id18d060e3-6658-49d9-802d-3cc635a86c41"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>shall apply with respect to violations</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id5fd3b749-ffe4-4535-aa6c-08251f878768" changed="added" reported-display-style="italic" committee-id="SSRA00"><text>shall apply—</text><subclause commented="no" display-inline="no-display-inline" id="id278a61ba-61db-4b9a-86dc-01061052a7b3"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to violations of qualified disclosure requirements</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide4d04d56-3863-47f0-bec2-e64b88475cba"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id910fc153-3346-4e12-be17-46bc1102008d"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f746817-c22d-4eae-b05e-52f482040c87" changed="added" reported-display-style="italic" committee-id="SSRA00"><subclause commented="no" display-inline="no-display-inline" id="id7a067ab2-d628-4e49-a620-931940764700"><enum>(II)</enum><text>with respect to violations of qualified disclaimer requirements occurring on or after the date of the enactment of the <short-title>AI Transparency in Elections Act of 2024</short-title>.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id660b041c-7629-4956-981b-a6a8f1b2c503"><enum>(5)</enum><header display-inline="yes-display-inline">Time of judicial review</header><text>Section 309(a)(8)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(a)(8)(A)</external-xref>) is amended by inserting <quote>(45-day period in the case of any complaint alleging a violation of section 318(e)(2))</quote> after <quote>120-day period</quote>.</text></paragraph></subsection><subsection id="idb55ffebd-1887-4168-b416-1f312b85c0f0"><enum>(c)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of the <short-title>AI Transparency in Elections Act of 2024</short-title>, the Federal Election Commission shall, in consultation with the Director of the National Institute of Standards and Technology, promulgate a regulation to carry out the amendments made by subsections (a) and (b), including—</text><paragraph id="id7a3561c2-ec8f-4136-9a6c-0cba7a8b9bdb"><enum>(1)</enum><text>criteria for determining whether a covered communication (as defined in section 318(e) of the Federal Election Campaign Act of 1971, as added by subsection (a)) contains an image, audio, or video substantially generated by artificial intelligence (as defined in such section); and</text></paragraph><paragraph id="ide4485b52-596e-45fa-a215-b7798a09efb7"><enum>(2)</enum><text>requirements for the contents of the statement required under section 318(e)(2) of the Federal Election Campaign Act of 1971, as added by subsection (a).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id43ae82d9-accf-4f91-adde-e669e8c30df7"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idaab621fb-a039-43eb-a208-e8105c354bec"><enum>(1)</enum><text display-inline="yes-display-inline">apply with respect to any communication made after the date of enactment of this Act; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba2a03b2-3305-4525-818a-d352795bb0ab"><enum>(2)</enum><text display-inline="yes-display-inline">take effect without regard to whether the Federal Election Commission has promulgated regulations to carry out such amendments.</text></paragraph></subsection></section><section id="ide2ccdd33-e584-47c1-b2d0-01b740f46d3e" changed="added" reported-display-style="italic" committee-id="SSRA00"><enum>3.</enum><header>Reports</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and biannually thereafter, the Federal Election Commission shall submit a report to the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives that includes—</text><paragraph id="idd3d6ea54-62be-4a05-9755-2f49b4fbdc02"><enum>(1)</enum><text>an assessment of the compliance with and the enforcement of the requirements of subsection (e) of section 318 of the Federal Election Campaign Act of 1971, as added by this Act; and</text></paragraph><paragraph id="idf5e1ef50-692c-4c6f-82a4-bd27fde247a9"><enum>(2)</enum><text>recommendations for any modifications to that subsection to assist in carrying out the purposes of that subsection.</text></paragraph></section><section id="id8fe94cbd-22b6-4aac-9195-c75ae77e8706" changed="added" reported-display-style="italic" committee-id="SSRA00"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of any such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act, and the application of such provision or amendment to any other person or circumstance, shall not be affected by the holding. </text></section></legis-body><endorsement><action-date date="20240515">May 15, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
