Determination of budgetary effects.</toc-entry></toc></subsection></section><section id="idC261117222574754B43415B98822418C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id46DA402DF81F4F9ABBBFEDE064724915"><enum>(1)</enum><header>Admitted</header><text>The term <term>admitted</term> has the meaning given that term in section 101(a)(13)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(13)(A)</external-xref>).</text></paragraph><paragraph id="id69608a81530444d78f96d111a5d55837"><enum>(2)</enum><header>Agency or instrumentality of a foreign state</header><text>The term <term>agency or instrumentality of a foreign state</term> has the meaning given that term in section 1603(b) of title 28, United States Code. </text></paragraph><paragraph id="id3BE31060F6A04785AE15FBA1F1EA4D6F"><enum>(3)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph><paragraph id="id89F8DE6792564CC7BCF444BADBE17C57"><enum>(4)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means—</text><subparagraph id="id360A20945458418A9A227468088E66BC"><enum>(A)</enum><text>an individual who is not a United States person; or</text></subparagraph><subparagraph id="id03B3189BD3814E36BEFEB679D5CE58EF"><enum>(B)</enum><text>a corporation, partnership, or other nongovernmental entity that is not a United States person.</text></subparagraph></paragraph><paragraph commented="no" id="idA8D8D93AB2704F4693AE9776D031E376"><enum>(5)</enum><header>Material support</header><text>The term <term>material support</term> has the meaning given the term <term>material support or resources</term> in section 2339A of title 18, United States Code.</text></paragraph><paragraph id="idA4BCD8AF75E340C08F6CAAF629231458"><enum>(6)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph commented="no" id="idFD404D07F45F459AAB80A18B09996BF6"><enum>(7)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph commented="no" id="id011B4EB8730148D2A37C9A444F6A4A5B"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A38C709E4224639B937F88CB585220A"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="iddfb2ecaa681840bd90fa5a6d9fc76305"><enum>(C)</enum><text>a person in the United States. </text></subparagraph></paragraph></section><section id="H93D1A7BB75AA48C5BAC54E320A8AF09F"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="H2BB42D8C5C4243C18E192EE456CBC72A"><enum>(1)</enum><text>to prevent Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof from accessing its international support networks;</text></paragraph><paragraph id="H10B9458C9E86488ABB68EACEA170966D"><enum>(2)</enum><text display-inline="yes-display-inline">to oppose Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof from attempting to use goods, including medicine and dual-use items, to smuggle weapons and other materials to further acts of terrorism; and</text></paragraph><paragraph id="idd9fd48d4e46e4ecba85430b18b623c8e"><enum>(3)</enum><text>to hold accountable Hamas, the Palestinian Islamic Jihad, and their international support networks for their attack against Israel on October 7, 2023.</text></paragraph></section><section id="HD3C84CB3FE1945169F5342131E74DE5A"><enum>4.</enum><header>Imposition of sanctions with respect to foreign persons and agencies and instrumentalities of foreign states supporting Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header><subsection id="idc1858cee9d82450e829e27ed7629032c"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall impose the sanctions required under subsection (c) with respect to any foreign person and any agency or instrumentality of a foreign state that the President determines knowingly—</text><paragraph id="idefb8335d6cf44f5abba0de3ef1629887"><enum>(1)</enum><text>assists in, sponsors, or provides significant financial or material support for, or financial or other services to or in support of any person described in subsection (b); or</text></paragraph><paragraph id="id5e820d9a57044bac95e3612d1ffd9d6c"><enum>(2)</enum><text>directly or indirectly, materially engages in a significant transaction with any person described in subsection (b).</text></paragraph></subsection><subsection id="id5d9653680b3c43adaa646cd5ecfeeb34"><enum>(b)</enum><header>Person described</header><paragraph commented="no" display-inline="no-display-inline" id="id037522a5ad9f44a6958b0a3977e15a06"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person described in this subsection is a foreign person that the President determines—</text><subparagraph id="id01315ccae30844f291d984f905a2d375"><enum>(A)</enum><text>is a senior member of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof;</text></subparagraph><subparagraph id="idfb32c3624749442c914584ee725a436c"><enum>(B)</enum><text>is a senior member of the Al-Aqsa Martyr’s Brigade, Lion’s Den, or any other entity that the President determines is part of the terrorist infrastructure in the West Bank and Gaza;</text></subparagraph><subparagraph id="id342b007063d9441c8820b2ce0b7d92a1"><enum>(C)</enum><text>is a senior member of a foreign terrorist organization designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) whose members directly or indirectly support any of the activities of, knowingly engage in a significant transaction with, or provide financial or material support for Hamas, the Palestinian Islamic Jihad, any affiliate or successor thereof, or any person described in subparagraph (A) or (B); or</text></subparagraph><subparagraph id="id4d6f6ce0b5664a74a37140c0143c9bc9"><enum>(D)</enum><text>knowingly provides or has provided material assistance, financial or material support, or goods or services that directly or indirectly supports the terrorist activities of any foreign person described in subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph id="id1cf60a0f06cb4545ae88f4cb73b9d1c1"><enum>(2)</enum><header>Requirement To issue guidance</header><text>Not later than 60 days after the date of the enactment of this Act, and not later than 180 days thereafter, the President shall issue regulations or other guidance to identify the persons described in this subsection.</text></paragraph></subsection><subsection id="id931aca12e0a84bd59ca03e328c347628"><enum>(c)</enum><header>Sanctions required</header><paragraph commented="no" display-inline="no-display-inline" id="ida975a2e2710d4cfe89dc3fdc563b594a"><enum>(1)</enum><header>Foreign persons</header><text display-inline="yes-display-inline">With respect to a foreign person subject to sanctions under subsection (a), the President shall exercise all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd51e6609417e49f0a77b4c50c737f432"><enum>(2)</enum><header>Agencies or instrumentalities of a foreign state</header><text>With respect to an agency or instrumentality of a foreign state subject to sanctions under subsection (a), the President shall impose 2 or more of the following:</text><subparagraph id="idcaa2549ba6a14a76b45ae20d9410d263"><enum>(A)</enum><text>The President may direct the Export-Import Bank of the United States not to give approval to the issuance of any guarantee, insurance, extension of credit, or participation in the extension of credit in connection with the export of any goods or services to the agency or instrumentality, and the Export-Import Bank of the United States shall comply with any such direction.</text></subparagraph><subparagraph id="id33495203698d417e931c30a346dfb775"><enum>(B)</enum><text>The President may prohibit the sale of any defense articles, defense services, or design and construction services under the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) to the agency or instrumentality.</text></subparagraph><subparagraph id="id71c8a4130df14a3fb3ed6c531cf186b9"><enum>(C)</enum><text>The President may prohibit the issuance of licenses for export of any item on the United States Munitions List under section 38(a)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>) that include the agency or instrumentality as a party to the license.</text></subparagraph><subparagraph id="idbb2644a241184b8f8b55349166198256"><enum>(D)</enum><text>The President may prohibit the export of any goods or technologies controlled for national security reasons under the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, or successor regulations, to the agency or instrumentality, except that such prohibition shall not apply to any transaction subject to the reporting requirements of title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>).</text></subparagraph><subparagraph id="id3055a97373f4469cb9a39e7f338295f7"><enum>(E)</enum><text>The President may prohibit any United States financial institution from making loans or providing any credit or financing totaling more than $10,000,000 to the agency or instrumentality, except that this subparagraph shall not apply to—</text><clause id="id207f567357594be29445b1c2264ec2a7"><enum>(i)</enum><text>any transaction subject to the reporting requirements of title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>);</text></clause><clause id="id50bd4749098b489ea27dbf8430fb68ef"><enum>(ii)</enum><text>the provision of medicines, medical equipment, and humanitarian assistance; or</text></clause><clause id="id2cdb25e46a75487daacbe7b37bf4d854"><enum>(iii)</enum><text>any credit, credit guarantee, or financial assistance provided by the Department of Agriculture to support the purchase of food or other agricultural commodities.</text></clause></subparagraph><subparagraph id="id24cb041bf64b432eb86bf32cb0525f0d" commented="no"><enum>(F)</enum><text>The President may exercise all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of the agency or instrumentality if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph></paragraph></subsection><subsection id="idde9de2213e8443909c74faf9701d7bab"><enum>(d)</enum><header>Congressional nomination determination with respect to foreign persons subject to sanctions</header><text>Not later than 60 days after receiving a request from the chairman and ranking member of one of the appropriate congressional committees with respect to whether a foreign person is subject to sanctions under subsection (a) pursuant to the criteria set forth in that subsection, the President shall—</text><paragraph id="id52aba2b44b2c46b082ead98200b7cbbf"><enum>(1)</enum><text>determine if the person meets those criteria; and</text></paragraph><paragraph id="id2451a6f6ba534f94a388f64a3f5c3118" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>submit a classified or unclassified report to such chairman and ranking member with respect to the determination under paragraph (1) that includes a statement of whether or not the President has imposed or intends to impose sanctions with respect to that person. </text></paragraph></subsection><subsection id="H64E75A7996C54513B337771BD94C4641"><enum>(e)</enum><header>Penalties</header><paragraph id="id2489736A60E8475B95C011330F4752E8"><enum>(1)</enum><header>In general</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that knowingly violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under section 7(b) to carry out paragraph (1) or (2)(F) of subsection (c) to the same extent that such penalties apply to a person that knowingly commits an unlawful act described in section 206(a) of that Act.</text></paragraph><paragraph id="HA0AB2EFBF2F34BB8A5D7479F0B8ABCE6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Authorities</header><text display-inline="yes-display-inline">The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) for purposes of carrying out paragraphs (1) and (2)(F) of subsection (c). </text></paragraph></subsection><subsection id="id53a4897e44ee4bb4afec2e7f8d247f28"><enum>(f)</enum><header>Exception</header><text>The President shall not be required to impose sanctions under this section with respect to a foreign person or an agency or instrumentality of a foreign state if the President certifies in writing to the appropriate congressional committees that—</text><paragraph id="idad036ae5ac4d4b02822b2749d631158b" commented="no"><enum>(1)</enum><text>the foreign person or agency or instrumentality (as the case may be)—</text><subparagraph id="id479417fe3a054aa28a5131ca7e36ca45" commented="no"><enum>(A)</enum><text>is no longer carrying out activities or transactions subject to sanctions under this section; or</text></subparagraph><subparagraph id="id2adcfbb0637f445ea750d00cca81f745" commented="no"><enum>(B)</enum><text>has taken and is continuing to take significant verifiable steps toward terminating activities or transactions subject to sanctions under this section; and</text></subparagraph></paragraph><paragraph id="id491015d9965e4bc49f200f6b8391b245" commented="no"><enum>(2)</enum><text>the President has received reliable assurances from the foreign person or agency or instrumentality (as the case may be) that it will not carry out any activities or transactions subject to sanctions under this section in the future.</text></paragraph></subsection><subsection id="id1f6c22e8f7d8469481976e79a5e9fc8b"><enum>(g)</enum><header>Waiver</header><paragraph id="idccf4c3883fea4f9d96e205b49d37e566"><enum>(1)</enum><header>In general</header><text>The President may waive, on a case-by-case basis and for a period of not more than 180 days, a requirement under this section to impose or maintain sanctions with respect to a foreign person or agency or instrumentality of a foreign state if the President—</text><subparagraph id="id643c6bd44ed34a76abd00c373dc36db3"><enum>(A)</enum><text>determines that the waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph id="id6c1358d257c0460180459f343f509494"><enum>(B)</enum><text>not less than 30 days before the waiver takes effect, submits to the appropriate congressional committees a report on the waiver and the justification for the waiver.</text></subparagraph></paragraph><paragraph id="id0163e68c9daf4b1a960aea2c515b2cfd"><enum>(2)</enum><header>Renewal of waiver</header><text>The President may, on a case-by-case basis, renew a waiver under paragraph (1) for additional periods of not more than 180 days if the President—</text><subparagraph id="id12016a5d521f4732b7990d8a18f00957"><enum>(A)</enum><text>determines that the renewal of the waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph id="idf86622979666462ca46fa39a693b98d3"><enum>(B)</enum><text>not less than 15 days before the waiver expires, submits to the appropriate congressional committees a report on the renewal of the waiver and the justification for the renewal of the waiver.</text></subparagraph></paragraph></subsection><subsection id="ide78cc70dd46d4c97a6e3a38af5997bbd"><enum>(h)</enum><header>Rule of construction</header><text>The authority to impose sanctions under this section with respect to a foreign person or an agency or instrumentality of a foreign state is in addition to the authority to impose sanctions under any other provision of law with respect to foreign persons or agencies or instrumentalities of foreign states that directly or indirectly support international terrorism.</text></subsection><subsection id="idd1d5542e17be4ba9a17ff83bb780f262"><enum>(i)</enum><header>Effective date</header><text>This section shall take effect on the date of the enactment of this Act and apply with respect to activities and transactions described in subsection (a) that are carried out on or after such date of enactment.</text></subsection></section><section id="H4011A0466A434209B4C8A327DCF4D2E5"><enum>5.</enum><header>Imposition of sanctions with respect to foreign governments that provide material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header><subsection id="H72CCA3F98FC048FA8BCA80C87AA2052D"><enum>(a)</enum><header>Identification</header><paragraph id="H538DCD0554914DC59258BEC3224DB95D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the President shall submit to the appropriate congressional committees a report that identifies the following:</text><subparagraph id="H14DFCFB227F441A18379E993E0CF30E4"><enum>(A)</enum><text>Each government of a foreign country that—</text><clause id="idBF60810CC6E3439FA1D4E64FF47DB6C3"><enum>(i)</enum><text>the Secretary of State determines has repeatedly provided support for acts of international terrorism pursuant to section 1754(c) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)</external-xref>), section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>), section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>), or any other provision of law; and</text></clause><clause id="HD56105F4C72D4D5693F848BFFCFB9862"><enum>(ii)</enum><text>the President determines has provided direct or indirect material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof.</text></clause></subparagraph><subparagraph id="HD32341275B3449C3A2735FD981FAB7CF"><enum>(B)</enum><text>Each government of a foreign country that—</text><clause id="H69AAAF81370B4A98AF75199A9C532FA1"><enum>(i)</enum><text>is not identified under subparagraph (A); and</text></clause><clause id="H9D470810BF5E4DD9B4186FEF71EED533"><enum>(ii)</enum><text display-inline="yes-display-inline">the President determines knowingly engaged in a significant transaction that contributes to the efforts by the government of a foreign country described in subparagraph (A)(i) to provide direct or indirect material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof.</text></clause></subparagraph></paragraph><paragraph id="H4796A0E276AB454887B51C3A9C046AF2"><enum>(2)</enum><header>Form of report</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text></paragraph></subsection><subsection id="H17A5C7DF29C04E3B8BDB3BA297ECF8D9"><enum>(b)</enum><header>Imposition of sanctions</header><text>The President shall impose the following sanctions with respect to each government of a foreign country identified under subparagraph (A) or (B) of subsection (a)(1):</text><paragraph id="HD0CB6710F3C148F48E8E6FD204F5B511"><enum>(1)</enum><text>The United States Government shall suspend, for a period of one year, United States assistance to the government of the foreign country.</text></paragraph><paragraph id="HC359BF9F764B4359944AB53683C3469D"><enum>(2)</enum><text>The Secretary of the Treasury shall instruct the United States Executive Director to each appropriate international financial institution to oppose, and vote against, for a period of one year, the extension by that institution of any loan or financial or technical assistance to the government of the foreign country.</text></paragraph><paragraph commented="no" id="HEBBFEC78EDCF40EF95701035D8A94B76"><enum>(3)</enum><text display-inline="yes-display-inline">No item on the United States Munitions List under section 38(a)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>) or the Commerce Control List set forth in Supplement No. 1 to part 774 of title 15, Code of Federal Regulations (or any successor list), may be exported to the government of the foreign country for a period of one year.</text></paragraph></subsection><subsection id="H19597F06709146A09B2E04A7B95C1D65"><enum>(c)</enum><header>Imposition of additional sanctions with respect to certain foreign governments</header><text>The President shall impose the following additional sanctions with respect to each government of a foreign country identified under subsection (a)(1)(A):</text><paragraph id="HB2D655E0A01A4390BB78B3FF721D7F8B"><enum>(1)</enum><text display-inline="yes-display-inline">The President shall, pursuant to such regulations as the President may prescribe, prohibit any transactions in foreign exchange that are subject to the jurisdiction of the United States and in which the government of the foreign country has any interest.</text></paragraph><paragraph id="H45403DBDAB5D442C8D2F283212F6D819"><enum>(2)</enum><text>The President shall, pursuant to such regulations as the President may prescribe, prohibit any transfers of credit or payments between one or more financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve any interest of the government of the foreign country.</text></paragraph></subsection><subsection id="HF9AE9FFAD709489C9CA7021C07579F7C"><enum>(d)</enum><header>Exceptions</header><paragraph commented="no" display-inline="no-display-inline" id="idbff4f74188164d898f6c7e502d928ed7"><enum>(1)</enum><header>Military use exception</header><text display-inline="yes-display-inline">The President shall not be required to impose sanctions with respect to the government of a foreign country pursuant to subsection (b)—</text><subparagraph id="H229E750249374D6496253789F5E4907B"><enum>(A)</enum><text>with respect to materials intended to be used by military or civilian personnel of the Armed Forces of the United States at military facilities in the country; or</text></subparagraph><subparagraph id="HE6A48EC87E474BCB92F87262B45D6546" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>if the application of such sanctions would prevent the United States from meeting the terms of any status of forces agreement to which the United States is a party. </text></subparagraph></paragraph><paragraph id="HFCC79E11817E4F3DA5C7BC746CA04E01"><enum>(2)</enum><header>Humanitarian exception</header><text display-inline="yes-display-inline">The following activities shall be exempt from sanctions under this section:</text><subparagraph id="id008e518d42d2459c81f8d83ce0f278de"><enum>(A)</enum><text>The conduct or facilitation of a transaction for the sale of agricultural commodities, food, medicine, or medical devices to a foreign government described in subsection (a) that is not otherwise subject to the export control laws of the United States.</text></subparagraph><subparagraph id="id97ea1bb80ba1456e9806168582336ff0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>The provision of humanitarian assistance to a foreign government described in subsection(a), including engaging in a financial transaction relating to humanitarian assistance or for humanitarian purposes or transporting goods or services that are necessary to carry out operations relating to humanitarian assistance or humanitarian purposes. </text></subparagraph></paragraph></subsection><subsection commented="no" id="H6A664E0CFC4E44F1B7BDBC954F373252"><enum>(e)</enum><header>Waiver</header><paragraph commented="no" id="H42A78E17510C4F37B565ED0EA9EDA62D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive, on a case-by-case basis and for a period of not more than 180 days, a requirement under subsection (b) or (c) to impose or maintain sanctions with respect to a foreign government identified pursuant to subparagraph (A) or (B) of subsection (a)(1) if the President—</text><subparagraph commented="no" id="H2F70E8BFFA8A405592DABC34FA8AB8AB"><enum>(A)</enum><text display-inline="yes-display-inline">determines that the waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph commented="no" id="H644C5EE520FB49AFB8DA02EB9B7B13E8"><enum>(B)</enum><text>not less than 30 days before the waiver takes effect, submits to the appropriate congressional committees a report on the waiver and the justification for the waiver.</text></subparagraph></paragraph><paragraph commented="no" id="H091D43995C8A4881B204DBD29014A898"><enum>(2)</enum><header>Renewal of waiver</header><text>The President may, on a case-by-case basis, renew a waiver under paragraph (1) for additional periods of not more than 180 days if the President—</text><subparagraph commented="no" id="HF5C4422BB5CE426D950415517552BA3C"><enum>(A)</enum><text>determines that the renewal of the waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph commented="no" id="HF6D4A14671A448AC8188577A6E085572"><enum>(B)</enum><text>not less than 15 days before the waiver expires, submits to the appropriate congressional committees a report on the renewal of the waiver and the justification for the renewal of the waiver.</text></subparagraph></paragraph><paragraph id="ida50f02f87c3e4119aac5fa5639e7357b"><enum>(3)</enum><header>Sunset</header><text>The authority of the President under this subsection shall terminate on the date that is 2 years after the date of the enactment of this Act. </text></paragraph></subsection><subsection display-inline="no-display-inline" id="HFCE605E631E945559A960B97538E379C"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The authority to impose sanctions under subsection (b) or (c) with respect to each government of a foreign country identified pursuant to subparagraph (A) or (B) of subsection (a)(1) is in addition to the authority to impose sanctions under any other provision of law with respect to governments of foreign countries that provide material support to foreign terrorist organizations designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></subsection><subsection id="H02E3B65F324A44D79FDDEA1EA09A4A4F"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">The President may terminate any sanctions imposed with respect to the government of a foreign country under subsection (b) or (c) if the President determines and notifies the appropriate congressional committees that the government of the foreign country is no longer carrying out activities or transactions for which the sanctions were imposed and has provided assurances to the United States Government that it will not carry out those activities or transactions in the future.</text></subsection><subsection id="H5123EF89149B4D15AE614B7D9441969D"><enum>(h)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date of the enactment of this Act and apply with respect to activities and transactions described in subparagraph (A) or (B) of subsection (a)(1) that are carried out on or after such date of enactment.</text></subsection></section><section id="HF2BD41812F844D959F88B2A3C2F46E29"><enum>6.</enum><header>Report on activities of foreign countries to disrupt global fundraising, financing, and money laundering activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header><subsection id="H855EEBD972634F10811F23695447C01B"><enum>(a)</enum><header>Report</header><paragraph id="H087F04E91E5B4357A8CA72BF9E39F429"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate committees of Congress a report that includes—</text><subparagraph id="HC029C88AD69D4ADC9FBF0CBEB3F3E18D"><enum>(A)</enum><text>a list of foreign countries that support Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, or in which Hamas maintains important portions of its financial networks;</text></subparagraph><subparagraph id="H95F2133401434A74B32F71AA120D8892"><enum>(B)</enum><text>with respect to each foreign country on the list required by subparagraph (A)—</text><clause id="H268805EECD364CC3B4B1904F3449B638"><enum>(i)</enum><text>an assessment of whether the government of the country is taking adequate measures to freeze the assets of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof within the territory of the country; and</text></clause><clause id="H40CF979DEF79486EA5AFD3AE6AEC83C5"><enum>(ii)</enum><text>in the case of a country the government of which is not taking adequate measures to freeze the assets of Hamas—</text><subclause id="H319C55E16E174E29ADA83089FD979F1D"><enum>(I)</enum><text>an assessment of the reasons that government is not taking adequate measures to freeze those assets; and</text></subclause><subclause id="H22AF58FB401E47F0B90347508B5D0393"><enum>(II)</enum><text>a description of measures being taken by the United States Government to encourage that government to freeze those assets;</text></subclause></clause></subparagraph><subparagraph id="HEC31549671FE4B1A9124024E2BF5F966"><enum>(C)</enum><text>a list of foreign countries in which Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, conducts significant fundraising, financing, or money laundering activities;</text></subparagraph><subparagraph id="H45AC355EADD74F43B777607495B96000"><enum>(D)</enum><text>with respect to each foreign country on the list required by subparagraph (C)—</text><clause id="H4B817C8AB4B84477B549BFAC3AC907CB"><enum>(i)</enum><text display-inline="yes-display-inline">an assessment of whether the government of the country is taking adequate measures to disrupt the fundraising, financing, or money laundering activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof within the territory of the country; and</text></clause><clause id="H88A7FAC446544EAABAAA1FA54C1EB8D0"><enum>(ii)</enum><text>in the case of a country the government of which is not taking adequate measures to disrupt those activities—</text><subclause id="HC399108E8F21444C9F00E8DDF311B7C5"><enum>(I)</enum><text>an assessment of the reasons that government is not taking adequate measures to disrupt those activities; and</text></subclause><subclause id="HE47C6176DDE940E2AAE9DAF028B84D1F"><enum>(II)</enum><text>a description of measures being taken by the United States Government to encourage that government to improve measures to disrupt those activities; and</text></subclause></clause></subparagraph><subparagraph id="H798F621DE2394C08A8B7BC002EBAD5B9"><enum>(E)</enum><text display-inline="yes-display-inline">a list of foreign countries from which Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, acquires surveillance equipment, electronic monitoring equipment, or other means to inhibit communication or political expression in Gaza.</text></subparagraph></paragraph><paragraph id="HA6151C2054AA48F7BC6651FD2250FF39"><enum>(2)</enum><header>Form</header><text>The report required by paragraph (1) shall be submitted in unclassified form to the greatest extent possible and may contain a classified annex.</text></paragraph></subsection><subsection id="HEBEEEF82F30440BB97C0219AF698790A"><enum>(b)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter for the following 3 years, the Secretary of State, the Secretary of the Treasury, and the heads of other applicable Federal departments and agencies (or their designees) shall provide to the appropriate committees of Congress a briefing on the disposition of the assets and activities of Hamas, the Palestinian Islamic Jihad, or any successor or affiliate thereof related to fundraising, financing, and money laundering worldwide.</text></subsection><subsection id="H960DF07FC86149619B53700E66DF6F6B"><enum>(c)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="H9C2E0789E89E431590C4E6C75D9AAB50"><enum>(1)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="HAD958E0F6F384EA085002E9D93A6A0AF"><enum>(2)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section><section id="HDF0D8972367246A0A982621EC61DC48C"><enum>7.</enum><header>Miscellaneous provisions</header><subsection id="HCFC98132FA004DC3A786F6E7F0A4EE57"><enum>(a)</enum><header>Rules of construction</header><paragraph commented="no" display-inline="no-display-inline" id="id1e8a541b43094af2a8827a68abf38d8d"><enum>(1)</enum><header>Intelligence activities</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to apply to the authorized intelligence activities of the United States.</text></paragraph><paragraph id="id31e415e7c6454893be9f42abc1ba577c"><enum>(2)</enum><header>Assistance to Palestinians</header><text>Nothing in this Act shall be construed to prohibit the President from providing assistance that benefits Palestinians in the West Bank and Gaza if such assistance is consistent with authorities and requirements under other provisions of law, including section 1004(a) of the Taylor Force Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2378c-1">22 U.S.C. 2378c–1(a)</external-xref>) and sections 620K and 620L of the Foreign Assistance Act of 1961 (22 U.S.C. 2378b and 2378c).</text></paragraph></subsection><subsection id="H3B8D92BA12A14B018337F9773F7D5EFE"><enum>(b)</enum><header>Regulatory authority</header><text display-inline="yes-display-inline">The President shall, not later than 180 days after the date of the enactment of this Act, prescribe regulations as are necessary for the implementation of this Act.</text></subsection><subsection id="ida6b883129cb3478fbcd487974ab9fd1d"><enum>(c)</enum><header>Exceptions</header><paragraph commented="no" display-inline="no-display-inline" id="id72957fcc8b23406891b761a9e27b4312"><enum>(1)</enum><header display-inline="yes-display-inline">Exception relating to importation of goods</header><subparagraph id="id33778aba08bc42609518aa4658583771"><enum>(A)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id4ed91681b0f54692958aa4e3dd3ac15f"><enum>(B)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subparagraph></paragraph><paragraph id="id33a6bc22427b40aca755a7bac8bcd64d"><enum>(2)</enum><header>Exception for approved humanitarian assistance</header><text>No foreign person, agency or instrumentality of a foreign state, or government of a foreign country may be subject to sanctions under section (4)(c) or 5(b) with respect to the provision of humanitarian assistance to the West Bank and Gaza that was approved by the Secretary of State with the concurrence of the Secretary of the Treasury. </text></paragraph></subsection><subsection commented="no" id="H162CBD33813C4E7DB2EF904310DB9AC0"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">This Act shall terminate on the earlier of—</text><paragraph commented="no" id="HB99FECFCE468462684F878A315EDBA53"><enum>(1)</enum><text>30 days after the date on which the President certifies to the appropriate congressional committees that Hamas and the Palestinian Islamic Jihad, or any successor or affiliate thereof—</text><subparagraph commented="no" id="HAE9FACEC1A704232BCDD09CFD098E994"><enum>(A)</enum><text>are no longer designated as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></subparagraph><subparagraph commented="no" id="H9C6345EC82D14260BB3CBD085D08C448"><enum>(B)</enum><text>are no longer subject to sanctions pursuant to—</text><clause id="H05547CBAB1F9466CBCBAA3C83341E607"><enum>(i)</enum><text>Executive Order 12947 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to prohibiting transactions with terrorists who threaten to disrupt the Middle East peace process); and</text></clause><clause id="H7A0E5C9B0E994D1EA46DF0CEA3BFA01D"><enum>(ii)</enum><text>Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism); and</text></clause></subparagraph><subparagraph commented="no" id="H05961155E90F4CA0A8B9C8F9E181E2E2"><enum>(C)</enum><text display-inline="yes-display-inline">meet the criteria described in paragraphs (1) through (4) of section 9 of the Palestinian Anti-Terrorism Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/446">Public Law 109–446</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2378b">22 U.S.C. 2378b</external-xref> note); or</text></subparagraph></paragraph><paragraph commented="no" id="H5CB9A27C737F460AA940A4A83FD1A870"><enum>(2)</enum><text>3 years after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="id779cf6d2716c49e78478c5b87d7a3b4e"><enum>8.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/931">2 U.S.C. 931 et seq.</external-xref>), shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage. </text></section></legis-body></bill>
