which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to expand eligibility for Post-9/11 Educational Assistance to members of the National Guard who perform certain full-time duty, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id7d9b5508-9b09-4709-b4fd-4846e08572e6" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guard and Reserve GI Bill Parity Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5b586003-99fd-498e-a980-8db1321312e1" changed="not-changed"><enum>2.</enum><header>Expansion of eligibility for Post-9/11 Educational Assistance to members of the National Guard who perform certain full-time duty</header><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="idf8cbe0be1be74874ab5fb920b9c3d9f3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3301(1) of title 38, United States Code, is amended—</text><paragraph id="id83db46fa-cb43-48b1-a021-1f3a884a8078" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc1192ded-4b9d-4b12-aee7-697d24098b64" changed="not-changed"><subparagraph id="id0a231ccf-3bfc-494a-bac3-b829fb04e4a0" changed="not-changed"><enum>(B)</enum><text>In the case of members of the reserve components of the Armed Forces—</text><clause id="idf4b6e598-f063-41cc-bcae-31c679f0277c" changed="not-changed"><enum>(i)</enum><text>service on active duty (as defined in section 101(d) of title 10), inactive-duty training (as defined in section 101(d) of title 10), or annual training duty; or</text></clause><clause id="id5ea37b86-d70d-4fe6-a52f-39a0e13ebbfa" changed="not-changed"><enum>(ii)</enum><text>service on active duty under a call or order to active duty under section 688, 12301(a), 12301(d), 12301(g), 12301(h), 12302, 12304, 12304a, or 12304b of title 10 or section 3713 of title 14, but not including inactive duty training (as defined in section 101(d) of title 10) or annual training duty.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idf52e6cb5-fc70-4ece-a1d5-ca7de50ec5b5" changed="not-changed"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="ide60a9987-ab3c-4453-8f4c-71d179fe9b66" changed="not-changed"><enum>(A)</enum><text>in clause (i), by striking <quote>; or</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="idd5fc61ac-e861-488d-9a74-10eaeb0e512d" changed="not-changed"><enum>(B)</enum><text>by striking clause (ii) and inserting the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbba23c80-2ed3-4caa-93a5-b1afc34b0767" changed="not-changed"><clause id="id7c587982-ffff-4778-8359-3739eade075f" changed="not-changed"><enum>(ii)</enum><text>in the National Guard when performing full-time National Guard duty (as defined in section 101 of title 32); or</text></clause><clause id="ide1f8365b-a87e-4d95-93b4-ccb3ec5a6279" changed="not-changed"><enum>(iii)</enum><text>in the National Guard when performing active duty (as defined in section 101 of title 32).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ida268b7ce69d3402786630cec192b1d28"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ided36dc9862604eedb5144e5bc04d1324"><enum>(c)</enum><header>Retroactive applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to service performed on or after September 11, 2001.</text></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="idc35d324a340e4732b43b1e8cb66dde5d"><enum>(d)</enum><header>Application of time limitation for use of entitlement</header><text>Section 3321(a) of title 38, United States Code, shall apply to entitlement to educational assistance acquired as a result of the amendments made by subsection (a) as if such amendments had been enacted immediately after the enactment of the Post-9/11 Veterans Educational Assistance Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>).</text></subsection></section></legis-body></bill>
