additional duties with respect to imports of green energy goods that originate in the People's Republic of China, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Declaring Our Energy Independence from China Act of 2024</short-title></quote>.</text></section><section id="id27e08cb46787438698c7d94ccb2f575a"><enum>2.</enum><header>Findings; statement of policy</header><subsection commented="no" display-inline="no-display-inline" id="id5bcdee2e55a64cc0883da07cf2e8609f"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text>Congress makes the following findings:</text><paragraph id="id6b46b78cf125448a8a0b1719b1f253cb"><enum>(1)</enum><text>The People’s Republic of China is the leading manufacturer of green energy goods and dominates the downstream supply chain, exerting more control over the global production of green energy than the Organization of the Petroleum Exporting Countries exerts over global oil production.</text></paragraph><paragraph id="iddeeceeb547ae4752aca37103542bfb1a"><enum>(2)</enum><text>The Federal Government and State governments in the United States have imposed mandates and implemented policies to reduce carbon emissions and pursue objectives intended to mitigate climate change.</text></paragraph><paragraph id="idfd7480c9556b4e37aaeff27f32f747f0"><enum>(3)</enum><text>Mandates and policies intended to mitigate climate change undermine the energy independence of the United States and make the United States dependent on the People’s Republic of China for its energy needs. </text></paragraph></subsection><subsection id="ida41bac2a24714d3297c8ccafe5fd0113"><enum>(b)</enum><header>Statement of policy</header><text>It is the policy of the United States to establish energy independence from the People's Republic of China.</text></subsection></section><section id="idd57f217caa984d9c89c882029ea185b4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0e4f87507fd64ae08af184334a5aefa1"><enum>(1)</enum><header>Green energy component</header><text>The term <term>green energy component</term> means a qualifying battery component, solar energy component, or wind energy component.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida6adf9b97839480f9a580d1c31ee192b"><enum>(2)</enum><header display-inline="yes-display-inline">Green energy good</header><text>The term <term>green energy good</term> means a battery cell, battery module, photovoltaic cell, solar module, or wind energy component. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd60e3a6030874c86be8aac168ad30b52"><enum>(3)</enum><header>Other terms</header><text display-inline="yes-display-inline">The terms <term>battery cell</term>, <term>battery module</term>, <term>qualifying battery component</term>, <term>photovoltaic cell</term>, <term>solar energy component</term>, <term>solar module</term>, and <term>wind energy component</term> have the meanings given those terms in <external-xref legal-doc="usc" parsable-cite="usc/26/45X">section 45X(c)</external-xref> of the Internal Revenue Code of 1986. </text></paragraph></section><section id="id7deab25067534c85b9513ffe730352b3"><enum>4.</enum><header>List of green energy components produced in the United States and imported from the People's Republic of China and other countries</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the United States International Trade Commission shall publish on a publicly accessible internet website of the Office of Industry and Competitive Analysis of the Commission a list of green energy components that includes the following:</text><paragraph id="id8e0c1b0f0b314afd92bc621d42b4777d"><enum>(1)</enum><text> The heading or subheading of the Harmonized Tariff Schedule of the United States under which each such component is classifiable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b56cb833d5a4775a7a69e86b3d18a69"><enum>(2)</enum><text display-inline="yes-display-inline">The total volume and value of each such component produced in the United States. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28bc39682cf64edc8e93ace258bdc71b"><enum>(3)</enum><text display-inline="yes-display-inline">The total volume and value of each such component imported into the United States from the People's Republic of China. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01b688559f3d4e909952e8f664d521f8"><enum>(4)</enum><text display-inline="yes-display-inline">The total volume and value of each such component imported into the United States from any other country. </text></paragraph></section><section id="id7e2792b054bf46f2b7bfb4deefecae76"><enum>5.</enum><header>Imposition of duties with respect to green energy goods that originate in the People's Republic of China</header><subsection commented="no" display-inline="no-display-inline" id="id4014f2e4e1ad4e0fa0a11b38bbc7a574"><enum>(a)</enum><header>In general</header><text>The President shall impose a duty, at a rate calculated under subsection (b), with respect to each green energy good that is imported into the United States and originates in the People's Republic of China.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbce17826b0bc4b778a8958e7f923f1cf"><enum>(b)</enum><header>Calculation of rate</header><paragraph commented="no" display-inline="no-display-inline" id="id16e103950cd844d884dea21463570abc"><enum>(1)</enum><header>Rate</header><text display-inline="yes-display-inline">The rate of the duty imposed under subsection (a) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9bf375287af44d3cb69f8198b51415b9"><enum>(A)</enum><text display-inline="yes-display-inline">during the 12-month period beginning on the date that is 180 days after the date of the enactment of this Act, 25 percent ad valorem; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4858e0eebfd94662abd7517c4e3ca6b0"><enum>(B)</enum><text>during the 12-month period that begins on the day after the end of the 12-month period described in subparagraph (A), and each 12-month period thereafter until the date that is 5 years after such date of enactment—</text><clause commented="no" display-inline="no-display-inline" id="idef961749fd8d42b490f19c0e6b2930db"><enum>(i)</enum><text display-inline="yes-display-inline">the rate in effect for the preceding 12-month period; plus</text></clause><clause commented="no" display-inline="no-display-inline" id="id3d88d5363df74813afb38d5f7bab5dde"><enum>(ii)</enum><text>5 percent ad valorem.</text></clause></subparagraph></paragraph><paragraph id="ide994cd940add4f35a6ccfbaf51a004a6"><enum>(2)</enum><header>Valuation</header><text>For purposes of determining the amount of duty applicable under paragraph (1) with respect to a green energy good, the value of the goods shall be the price at which the same or a similar imported good is freely offered for sale, packed ready for delivery, in the principal market of the United States to all purchasers, at the time of exportation of the good, in the usual wholesale quantities and in the ordinary course of trade, with allowance made for duty, cost of transportation and insurance, and other necessary expenses from the place of shipment to the place of delivery.</text></paragraph></subsection><subsection id="id21abb1e5a8624b2abb1ce3d208fc6e70"><enum>(c)</enum><header>Rule of origin</header><paragraph commented="no" display-inline="no-display-inline" id="idc0ad8e80265042e1bce816fd527f5028"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, a green energy good originates in the People's Republic of China if the good is produced—</text><subparagraph id="ideb85fc59ef674e13b67199f4a819830c"><enum>(A)</enum><text>in the People’s Republic of China;</text></subparagraph><subparagraph id="id7fd2b91af15748a0afe4b6accbbd609c"><enum>(B)</enum><text>by an entity organized under the laws of, headquartered in, or with its principal place of business in the People’s Republic of China, without regard to the country in which that entity is located; or</text></subparagraph><subparagraph id="ide3dfc5f3a45443188beeb91b7f67fbf5"><enum>(C)</enum><text>by an entity with respect to which control is exercised by an entity described in subparagraph (B). </text></subparagraph></paragraph><paragraph id="id031c47e3f3b0453da14b2fd25576174a"><enum>(2)</enum><header>Control defined</header><text>For purposes of paragraph (1)(C), the term <term>control</term> has the meaning given that term in section 800.208 of title 31, Code of Federal Regulations (as in effect on the day before the date of the enactment of this Act). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3351e7edf68a4e85b5327f7ac3e7bf13"><enum>(d)</enum><header>Additional duties</header><text>A duty imposed under subsection (a) with respect to a green energy good shall be in addition to any other duties applicable to that component.</text></subsection><subsection id="idcd6dfbe446d940929b104b25282cdbed"><enum>(e)</enum><header>Prohibition on use of emergency authority</header><text>The President may not exercise the authority provided under section 318(a) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1318">19 U.S.C. 1318(a)</external-xref>) to provide for the importation free of duty of any green energy good that originates in the People's Republic of China.</text></subsection></section><section id="id02199172a2e8482c925cd5e8dfd4f49f"><enum>6.</enum><header>Report on industrial subsidies provided by the People's Republic of China</header><subsection commented="no" display-inline="no-display-inline" id="id68da855800dc4bafb68b8333704bc54f"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the United States Trade Representative shall submit to Congress a report assessing the extent to which the Government of the People's Republic of China has, during the 15-year period preceding such date of enactment, provided industrial subsidies to the battery, solar energy, and wind energy sectors of the People's Republic of China.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7beff0b6d3ef4967875e14534fbf92e2"><enum>(b)</enum><header>Industrial subsidy defined</header><text>In this section, the term <term>industrial subsidy</term> includes, at a minimum, the following actions by a government for the benefit of an industry:</text><paragraph commented="no" display-inline="no-display-inline" id="id07d1f2736e5e46009f8d898922a8c158"><enum>(1)</enum><text display-inline="yes-display-inline">The direct transfer of funds, as with a grant, loan, or equity infusion. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf86131b77e4041dc84d655e6c972f5fa"><enum>(2)</enum><text display-inline="yes-display-inline">The potential direct transfer of funds, as with a loan guarantee. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21ccb2cb324f46b9a1ca0ab7c644f6e9"><enum>(3)</enum><text display-inline="yes-display-inline">Foregoing or not collecting revenue that is otherwise due, as with tax credits or deductions from taxable income. </text></paragraph><paragraph id="id263dcfe0bb6d43bd9247f34821ee8e12"><enum>(4)</enum><text>Providing preferential access to capital, land, or electricity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5fac9dda8c524f27bdf4c605207229a4"><enum>(5)</enum><text display-inline="yes-display-inline">Providing goods or services other than general infrastructure. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06c0c5f3648d4ab6b8cf6fdbe8c2ce82"><enum>(6)</enum><text display-inline="yes-display-inline">Purchasing goods.</text></paragraph></subsection></section></legis-body></bill>
